I also am self-employed, and I think both times, I did as was recommended and wrote a statement to the basic, general facts of 'in business continuously for ___ years in the town of _________, and got it notarized and witnessed. Notarization, while perhaps not absolutely necessary, never hurts, and with a copy of your professional or trade license, if applicable.

You're gonnna have to provide 3 years tax returns at the interview, personal and corporate (corp, if applicable).

I think this is sort of a scare list.
If your case is legitimate, just be yourself.
I think that is the message you need to 'hear'.
The first time I did this about 4 years ago, I sent in a chit-load of paperwork.
Mine was as you say, overloaded with documentation, proof of relationship.
My app was nearly 2 inches thick pile of relavant stuff.
Of course, the relationship had been about 4 years, so there was plenty of stuff.

The interview in Bogota was....... 2 or 3 Q's, 2 or 3 minutes. VISA GRANTED.

You don't always know what SURPRISES may be lurking, uncovered ahead of time, after one arrives.
You may want to ask someone to return to their homeland for a lil while longer.
Probably the exception, rather than the norm.

But, also many times the roundtrip ticket is cheaper.
Bottom line.

I've seen alot of folks who applied in June/July here, who have received NOA2 recently, but none yet in August.

It's moving fast, in Vermont, it appears.
We'll see.

Like someone says above: It's all unique. Every case is different, just like "no two waves are alike".

Even my case, although seems very clean, .... still from the first time I did this about four years ago, this one is much, much different, in and of itself, but also on top of the fact that it's my 2nd time going through.

Good point, az110695... fees vary from time to time.
Processing times VARY CONSTANTLY... little relationship to what the fees are.
There are so many other factors making every case unique, as well the average processing time seems to be either way up or way down, every 6 to 8 months, or otherwise.

I'm not angry about the situation at all, but as you said - they counsider the petitioner's income and assets. Child supoort is NOT income, and her income is not sufficient to support the household when you add a fourth member (the OP states the petitioner's income is approximately $24,000).


Luckily, IRS, or other alphabet soup bureaucracies' definitions aren't always the final answer...

The point was really that the USCIS' role in this is to determine whether or not the petitioner can financially provide for the members of the household, given the monetary and real assets available. Child support is intended to provide for the needs of the children...housing, food, clothing, educational expenses, medical care, etc. Why would it be justified to ignore the fact that a portion of these needs are provided for, in the case of the petitioner's children?

I honestly don't understand the indignation expressed over the issue of child support. It seems quite simple:
1) The job of the immigration authorities, in this regard, is simply to determine if the beneficiary and/or their children are likely to seek means tested benefits.
2) They consider the petitioner's income and assets for this purpose, and their ability to support the entire household.
3) The children, under age 21, of the petitioner are counted as part of the household,and both parents of the petitioner's children are responsible for support of these children.

Obviously, if these children are counted by USCIS as part of the petitioner's household, then their financial support should naturally be counted as well- it demonstrates that the petitioner is capable of supporting the members of the household adequately, according to the standards required by the USCIS.

understandable ... so what are we looking at for costs? for everything ... I am just getting really confused on some posts, some say she can re-enter some say she is locked out .. just confusing but I appreciate the help ..

we want to marry and have a wedding, but the wedding can wait .. we are wondering is our best bet to just go to justice of the peace and get officially married and then start the process ... or is it better for her to go home and stay there and then come back and marry me later? .. now if she opts to do OPT can she do OPT and then 5/6 months into it we end up saying lets marry .. or is there stipulations to all of this ... sorry for this whole confusion, just figured you guys might know considering most went through it ... We truly appreciate it!

Correction: she CAN leave the US if she wants, she just won't be allowed back in until she has a visa in hand. Whereas K-1, she lives in Canada, and can come to visit US if she wants.

only issue is she doesn't want to go home and NOT work, or even if she finds a job she doesn't want to work it for 6 months then come back to USA and try and find a job ... she is looking to graduate in may and stay right here ... we want to get married definitely .. we don't mind marrying asap and having a wedding down the road .. we have done the long distance as I live 6 hours from her ... well we obviously live together now since we went to the same school but for summers and christmas we never were together ... so what im really saying is if we get married and she cant leave the us ... how long does it usually take for a green card so she can re enter canada to see family

You would marry and then file an I-130 and I-485 with medical and all supporting documents to get a green card. She would not leave the USA at all during this.

I first want to explain our situation and hopefully ya'll can help! I "Corey" am an American citizen, born and raised. I have been with my girlfriend of 4 years "Erika", she is Canadian ... we met at college, and she will be graduating this May 2012. We are wondering what we need to do to make sure she can stay here in American and live with me when done with college ... She tells me she can only stay in the US without being married if she finds a job in her field, but her field is Criminal Justice, my Aunt works for the county and said that they don't usually hire Canadian's because they need to take the oath, and how can you if you are not an American citizen? Please let me know if you guys know any ways around this or what to do, we want to get married we just didn't want to rush a wedding or anything .. we figured we could just go to the courts and get married, be legally married and have a wedding next year or down the road, we both agreed on this ...

basically, if someone can give me some information on what I or She needs to do to make sure this works, she doesn't want to go back to Canada and start a job and then re-locate back to the USA 5 months later, she would like to just stay right here get a job and continue with life ... let me know what we both need to do? and what is our total fees possibly looking like ... anything I need to know please let me know, she is going to some US/Canada thing on Monday, so hopefully she gets information there as well...

Hello All,

I am new here in the forums and going thorough the visa process now for k-1.

Currently my finance lives in Colombia and she will be going to Bogota for the final interview. I have heard bad things about Bogota. I have heard many people that say once the 129f petition is approved and sent to Colombia the embassy is not contacting the individuals there. Some people tell me they have the petition approved and Bogota has not sent anything to the fiance for four months when she calls the embassy they tell her she has to wait. I also know that the 129f petition after approved is only valid for four months.

I guess my question to everyone here is I want some feedback from people who have gone though the process in Bogota Colombia.

Anybody who has information recent withing the last year or two would love to hear about your experience in Bogota.


You are correct of what people have told you. That embassy does not contact people accordingly. Helping a friend and he received the NOA2 on August 4 and spent around a month to contact anyone in the embassy to find out why they haven't sent the package. The finally sent it by email. They changed the appointment system now is online. So it is a mess.

You cannot use a tourist visa to re-enter the USA and apply for AOS. That is visa fraud.


This is the first time hear this! (Basura lo que dice este tipo). I know that people come to the states, marry an us citizen and then apply for AOS.
One thing for sure if you apply for AOS, your husband should stay here until he gets his papers, to avoid any inconveniences, as the visa may get voided.

I'm just baffled by this I-864 Affidavit of Support. This is insane. The govt must be astounded that there are any legal immigrants into America! Who are the financial suicide volunteers who are signing these papers? Would you marry someone and sign a pre-nupt that says: "If you are ever divorced that you will pay ex-spouse $13,000 MINIMUM for the rest of their lives, and have additional liabilities with the govt? No one would get married. I mean the sponsor is putting himself / herself at a complete disadvantage. It's giving your spouse a loaded gun and saying, okay honey, when we have an argument, let's try to forget that you are holding a loaded gun. And yet people sign this form.
I am baffled. Am I missing something here?
I was going to try to bring a fiance here to the USA, but after reading this form....I'm utterly floored. This can't be right.


If you don't agree with the conditions of bringing a foreign bride into your life, then just go to match.com and get a plump, drama-free girlfriend with baggage there. It's as SIMPLE as that.....LOL!

I hope I am posting this in the right place.
So far here's my scoop. I filed I-129F 5/9/11.
RFE was in July and I submitted RFE right back to USCIS.
Now waiting for our NOA2.
Here's our problem. We hired Allan S. Lolly to do our paper work. We had read over the process of the k-1 and it
seemed over whelming at the time so we entrusted our papers to the atty. First, it took them 6 weeks from the time
they sent us the I-129F forms to complete till they finally submitted them to the USCIS. We never talked to them over the phone
but they would only communicate via email. This dragged things out by weeks. Second, they lost our check to submit the I-129 form and
they never told us, and when we called to see if the forms were submitted they didn't tell us they lost the check but that they were waiting
for us to send it. Ya, right. I emailed them and told them the day we had sent it and to be expecting it. This was another delay.

Then after they submitted the forms with our evidence of relationship, which consisted of facebook profiles of us writing back and forth, emails,
phone records,bank account statements showing rick had been here and we opened a joint account, gas receipts from Rick's travels, toll booth
receipts and lots of photos, we get a RFE. We didn't know why this would happen. This attorney was not clear about anything. Unfortunately Rick
and I did not find VJ till just this month, and had we of found it sooner I am sure a lot of our confusion about this process would not of been a problem.

After reading and understanding the difference between Primary evidence and Secondary evidence, we can see that we didn't' have enough if any primary
evidence and the attorney should have known this. Rick and I live only 8 hours from each other, so he drives here monthly.
So WHY did he not tell us before he submitted our evidence that we needed dates on our photo's. This
is what the RFE asked for when we got it back.
So, we submitted the photo's again but this time date and time stamped. They send us a email saying they were concerned about our evidence.I was so upset
at this point, I called them crying and stressed out and asked them why they are having a problem with what I just sent them. ( I by the way did not get to talk to the
attorney, but only the girl who answered the phone and forwarded my info to him) When they emailed me back finally, I told them I had submitted the info they asked for.
They checked into this and said, yes, I was correct and I sent them exactly what they needed and they apologized and said the attorney just didn't look at all the photo's.
( Just for the record, I enlarged the font size of the date and time so that it couldn't be missed, but I guess they missed it anyway.). Oh, ya, one more thing.
The attorney said that I am going to need a co-sponsor for Rick because I am unemployed here in the U.S. and told his assistant to send me the I-864 form. I HAVE READ ENOUGH
TO KNOW FROM VJ THAT THIS FORM IS FOR FILLING OUT AFTER AOS AND THAT THE I-134 form is the one we need now. Is this correct? I feel so upset right now because
this attorney seems to not give a darn about the fact that his mistakes can and could cost my fiance to be denied.
SO, HERE IS MY QUESTION:
What exactly do I have to do to fire my attorney and ask him to stop all work on our case, and then how do I go about contacting the USCIS so that they don't send anything more
to my attorney. I am planning on using the I-134 form and this I believe I bring with us to the interview, signed and notarized.
They have made this out to look like my fiance will come here and suck up off the government. Little do they know that Rick has 2 full time jobs in canada. One which he owns which is a 3rd shift cleaning company. Owning his own company may not help him to prove he has never been a slacker nor will he be. He has worked 7 days a week for years.

To fire the lawyer you would email them since you have said they dont have or use a phone. I would contact the bar association to let them know what took place. Call USCIS to find out how to notify them.
The 134 doesnt need to be notarized. You can try using the 134 for your co sponsor but they may ask for an 864 due to circumstances. Your 134 is signed by you & submitted by him. Check to see if you as a USC are allowed at the interview.
I dont know what you mean by they made it look like he will " suck up off the govt". His work background in Canada will have little to do with his actions here. With a K 1 he wont be working at all for some time. This is exactly why you as the USC must show ability to support him. If the U S govt believes he is here to be supported by the tax payers as you say he wont be immigrating here.
