I made a Bone Head mistake last Tuesday when sending in my Responses to the RFE!
Sure! I sent it certified mail, return receipt requested.

But in my haste, mixed with always a bit of anxiety that so many of us experience when sending/responding/communicating with
USCIS,... I meant to, but didn't ALSO tell the postal worker: NEXT DAY DELIVERY!

So,... it's been a week, and I'm still waiting.
That seems a bit long, Louisiana to Vermont.
I'm gonna call uscis and/or go talk to the post office today.

QUESTION: Does USCIS ALSO send text message/email upon receipt of a response to an RFE?

Why? Is your case a difficult or extra complicated one?
Thousands of people just do it on their own, it literally takes a few hours to read FAQs here on forum and on USCIS site.
I'm of course not trying to talk you out of throwing another thousand dollars away ;) But you DON'T need a lawyer, especially at this stage when everything is already filed. (Unless, again, your case is difficult, needs professional help, etc.)

For those who complain, just be smart ahead of time, pay online, get your tracking number, insure your packages if you think they may be valuable.

it takes way longer. Up to a year. Fiancee visa takes about 4 months. There's no way to get all the certified copies from all 3 states. And again, we didnt meet through the matchmakers! I thought in the instructions it sais only about those who met trough brokers agencies. Am i not right?


we thought the cr/ir visa would take forever too so we planned for a year long ordeal but in the end it took about 4 months for my wife's ir visa to be approved from the date it was sent to the day she got the visa in hand. We actually could have done it faster because we delayed sending in one of the packets during the process. We did everything ourselves with the help of vj and the great advice here. So if you just cannot get the docs from the clerk of courts where you had the convictions, the cr/ir is not a bad way to go.

I have been to the Philippines two times. I have seen cheaters and people that do not match. I ament Jean on a dating site in May. From the start we have ment each others expectations. I visted her in August. I even extended my stay untill the middle of September. Now back in the USA I just sent off the K-129 and now waiting. I worry about our age difference.

Also, make sure you bring tons of evidence. We brought over 500 pictures and 3 reams of paper consisting of emails, online chats and e-cards. It all weighed in around 40 lbs. There is no such thing as too much evidence at this consulate. No matter how much you present to them, their standard motto is "Lack of Evidence". Anyways, good luck and don't become a victim.

Actually the 90 days isn't a "check point" to be sure about getting married. You NEED to KNOW this before you move here. The 90 days is a deadline that the USCIS gives you to accomplish this. If you aren't sure about being married BEFORE you get to the US, you need to step back, slow down and figure it out.
Drives me crazy that people think of the 90 day deadline as a decision or trial period. You should absolutely KNOW you want to marry this person you are moving your whole life for BEFORE you get here.

It is a 90 day buffer zone, where the foreign bride begins her adaptation period to the USA and her new man. There are TOO MANY cases seen on this board, where the relationship implodes prior to the 90 day marriage deadline period. Sorry you don't see it that way, but if you were a man whose Filipina flipped out on him, stole money, went out with other guys, by day 55, and then you could send her back home by day 60, then maybe you would have a different perspective. Oh, and to quote a guy who did CR1 Visa, and had the latter happen to him, "Gee, I wish I had a 90 day K1 Trial Period. "

Be glad you did this on a K1 Visa, which allows this next stage "check point" that allows 90 days to be sure about getting married.

Many CR1 visa brides are locked in to a legally-binding relationship when they arrive in US, and find themselves wanting to divorce within 90 days of being stateside.

Hey, sometimes things dont work out the way we wanted, but sometimes, we find out it wasn't what we needed.

There are many hotels in Makati that aren't expensive. For example, LPL Suites, BSA Tower and Prince Plaza II right across Greenbelt 5 have very reasonable rates. The first time my husband came here, he stayed at LPL Suites and paid only 2000+ php a night. There are also inexpensive hotels on P. Burgos St., like Oxford Suites and Citadel Inn, if you don't mind staying in the red-light district. There are more choices in Makati than in Taguig. I live here in Taguig, and there are condotels here at The Fort, but they're pretty expensive.

My fiance applied for a tourist visa to come visit me in August but was denied. He is a citizen of Cameroon but is living as a student in Korea. The reason he was given is that he doesn't have enough social ties in Korea. He has been living in Korea for 5 years, goes to school, has a job, attends a church on a regular basis, has friends, etc. He has plenty of social ties, just not family. Is there any way for him to improve his chances when he reapplies? Will having our paperwork showing that we are working legally on his fiance visa help? Would having a letter from his church help? Just wondering how we can make his chances better. He definitely wants to reapply. We are having a baby in February and we both want him to be here for the birth.

When the facts surrounding you situation are applied to the criteria for a tourist visa he will never get one.
He has to prove beyond doubt he will return to Korea or Cameroon. Read the " strongest ties" rule & you will find that USCIS views all people with visas as intending immigrants.
This means his ties to you become stronger than they are to a country where he may live simply due to the pregnancy. Additionaly USCIS will find that you have petitioned for his fiancee visa. Those two facts alone are enough to cause denial. The previous denial will also be a factor.
Keep in mind that even if he was somehow approved for a tourist visa he would probably be turned away at the POE where they actually determin if he can enter.
The only way to know for certian is to pay the fee & submit to the interview. I am sorry to say this will be money & effort wasted in my opinion. He can apply again at any time & as often as he wants.

I do not know the actual answer to your question. I think they will decide right then. All they are looking for is the evidence they must have in the file to allow them to issue the visa.
I think we can see here this is a case of the officer using discresion which told them there wasnt enough evidence of a higher income. On that day the officer decided 4 months wasnt enough time to indicate the income would remain at that level based on the year before. All you have to do is give them what they need to be able to change their mind.
My husband was in a similar situation with his income & job length. He did what John suggested you do. At that time the USC was allowed inside so he was standing right there at my interview. They didnt ask one question about his income or really anything else.
Something from the employer will enhance the evidence enough. The letter I suggested about doing the AOS should show that you are aware of the future process including using the co sponsor if needed. It also means USCIS will have a second chance to review your situation & decide about her green card.

Of course it isnt good that they didnt issue the visa so far but this isnt as bad as it may seem. They kept those docs as part of the case file. Now all you have to do is what they asked which is give them more of the same type thing. The letter John indicated could do it but try to do the others things we suggested as well. More is better in this case. Maybe your boss can be a little creative in the employment area. Again I would send a letter explaining why last years income was lower & what I was doing about improving it. Such as requesting more hours at work & seeking a second job. Nothing wrong with pointing out some help from your parents could be given if need be. Also it would be good to tell them you plan to marry right away & the file the AOS right away. Important because they will see that you understand as part of the AOS you can use a co sponsor. This means that there will be almost no chance of her ever needing govt assistance which what they are concerned about. Remove any doubt & you will get what you want.
Nothing is for certian but if you do these things you will succeed.

My fiancee got a 221(g) after her interview today at the Bangkok embassy, and here is the reason they gave her:

" your fiance has not shown that his income is sufficient to support you in the US. If his current salary is higher than his 2010 salary, he should provide recent pay stubs showing his current income."


my question is she did bring my recent pay stubs with her to the interview ( 8 of them, and they are above the 125% poverty,and my IRS transcript 2010 is below the poverty line),and the CO didn't even look at them.
And the embassy are keeping my I-134 and all the support docs for the I-134( returned all the other docs to her), what should i do now? what am I going to bring back to them since they ask her to bring those pay stubs to them ?

Any suggestions or answers are appreciated! feel so helpless now!

This is a little confusing to me. You say they didnt look at the pay stubs & then you say they still have them.
I assume those 8 stubs represent 2 to 4 months of income which wasnt enough to satisfy them.
I agree with Johns advise. Doing what he suggests will produce a letter that indicates not only what you have earned but the projected annual income while showing they intend for you to be with them into the future.
You could write a letter to submit explaining why your income was lower last year & what you did to improve it at this time. My husband did this just to make sure there was no question about his income levels.
There is a reason they kept the other docs. Just do everything you can to allow them to issue the visa.

As far as I know there are not. A P is a very difficult thing to understand or endure. We waited for about 5 months & never found a reason nor any info from any source as to how it works.

Sure it makes sense. She was allowed to visit the USA by using a tourist visa. I am sure you know that visa is used for purposes other than immigration.

She can legally marry while in the USA on a tourist visa. However if that is done with the intent of then staying in the USA to avoid the laws you couldnt file the AOS documents to gain a different legal status.
If the intent of the use of the tourist visa was to visit & exit the USA but things changed, she decided to marry, she could qualify for the AOS ( adjustment of status ) procedure. If she is still in the USA.
What can be done hinges totaly on her intent when she entered the USA.

I am having trouble recieving mail from my fiance in Thailand. She sent me the G325 and letter of intent in late September. Both documents were dated October 1st. Now it is the end of October and I have not recieved them yet. Will they accept the documents if the signatures are older than 30 days??

My mail sent from Thailand takes about 10 to 14 days . There is no reason to pay FedX because they all send mail by plane these days. Thailand has an express mail system which works fine. Its the in country mail system that takes so long.
The docs will be accepted even if the date is not within 30 days.

Here is a snapshot of how things work at LAX for new immigrants.

Your wife will go through immigration at LAX.
She will go collect her checked luggage.
She will exit into the unsecured area of the international terminal. (It's a tunnel where you'll see lots of anxious families waiting for someone.)
She will go outside to the domestic terminal located next door.
She will need to go through security and check her luggage for the domestic leg.

The snapshot is blurred. It leaves out the fact that she will want to take a luggage cart to put her things on & go thru customs before leaving the secured area.
The cart is important for several reasons. She can use it to transport her luggage inside the international terminal & to the domestic terminal.
Going thru immigration & customs can take awhile. There are several filghts that land at about the same time. Hundreds or thousands of people in the lines. Two to three hours could be spent there.
Once she walks up the ramp she will see the last check point which she simply walks by. After that she has to decide what she wants to do. It would be great if you could be there. If not she could find the second level of that terminal where there are some places to eat or just sit.
I assume she will use Southwest to Texas. She can take a shuttle bus by walking out the doors of the terminal & across the first drive area to the center waiting area. There are signs above indicating where to wait for the buses.
I would advise her to simply walk to Southwest. Its really not that far. Out the door of the international terminal, turn left, use walkway to terminal # 1 ( southwest ). Easy 10 minute walk. Walking allows her to keep the luggage cart. Using the bus doesnt.

This sounds good but is very hard to do. Adopting a child is something that requires a lot of work, time & probably a lawyer. Check into it on line & you will begin to see how difficult this is.

Yes, I'm aware of the situation with the child. The law is that the father must sign if he has custody, but I do not think he legally does, at this point. If he does not, I think he would sign it.

Other than that, now after looking at various visas in African countries, it is clear that they all have special visas for dependents of temporary workers, and it says nothing about the dependents having to have a passport from the same country as the worker.

These things can be difficult & possibly different in different countries but it would be a good idea to check with the embassy in Colombia to make sure they would accept the custody agreement of the court.
If there is no problem having him sign then there wont be a problem. I hope that the case for the sake of the child.

Thank you for the additional responses. More and more I realize that I am throwing, incorrectly, citizenship status and immigration into the same pile... Can someone offer me some guidance along the following points? :

- I am doing to be doing one of those things where a U.S.-based company with offices in Rwanda will be sponsoring me, providing my housing, etc. I am fairly sure, as I briefly understood from a conversation with a co-worker, that if I have dependents, I would need to let the company know so that they can sponsor (or whatever the correct terms is, in this case) and accommodate for them, also. I think it's like you see in the movies: Foreigners living temporarily in an expat community in a foreign country with their families all there, etc.

- IF this is the case, and especially IF there is a possibility that I will be outside of the U.S. for even up to 6-7 years (and possible moving across East Africa and to Dubai), would it not be wise for me to marry her in Colombia and then just let my company "sponsor" her and her child to follow me wherever I go? I mean, I cannot imagine them sending me abroad on a U.S. salary and telling me my spouse and stepchild cannot accompany me... Right?

- The only nag in this I can think of is if they say, "Well, she is not a U.S. citizen, so she cannot come." But I don't think that is correct logic. After all, wouldn't the sponsoring process more be based on where she is going rather than where she is originating? If the office of my company based in Rwanda can sponsor me, shouldn't they be able to sponsor a citizen of any country?

I dont see any info here about the situation with the child. You need to check into what it takes to take the child out of Colombia. To bring the child to the USA for example the mother will need a signed statement from the father allowing the child to leave.
I would think your company would have more info on sending it employees & families to other countries. My husband was sent to Saudi Arabia & Colombia. The company had people that did nothing but visas for entering those countries to work & live.

I was recently in Italy to visit my fiance and we decided prior to my departure to Italy that he should make an appointment with the American Embassy to apply for a tourist visa (I believe called B1)It all worked well I arrived there few days before the interview and had very little or no worries that he should not receive it. I figured that given that we are midway through our k1 application would be a plus and he should not get rejected.

First of all I was very disappointing that I was not allowed inside the consulate to support him and needed to wait outside. I was really disappointing not only that I could not go with him inside but also felt rather unpleasantly surprised that as a US citizen you are not allowed in the building unless you have an appointment of some sort. It was my first time while abroad that I "had a reason " to go to a US embassy was would have thought that as an American Citizen they would welcome you with open doors for whatever reason you needed to enter the building. This nuisance was nothing compared with the outcome of the situation.
My fiance went inside and he was really surprised to find that his "interview" was not even an enclosed door area but a window counter (similar to how banks have) and while talking with the officer everyone in the room can hear all the details of your business there. I am now wondering when going for the K1 interview is there a similar setting for the interview? A window counter where all around can hear details of your relationship and other personal details?

And now for the conclusion of the interview. He presented the officer with all the documents we had prepared for the occasion (NOA 1, the I-131 Affidavit of Support from me and other documents pertaining to the payment for the visa application -a staggering 112 Euros!!!) In the beginning he was telling the officer details about his job and all other personal information, concluding with the fact that the reason why he is applying for the visa is to come spend the holidays with me and that he is on the K1 visa. My fiance says that the moment the officer heard about the K1 application he stopped him and said " I am sorry but because you are on the K1 track I cannot give you a visa because everyone claim to go and not come back".....Is is just me or this does not make any sense?!?!?! I mean it would be very silly of him to come here on a tourist visa and remain illegally in the US, or that he would remain here and we would change the visa type to the other type for couples that marry in the US (not even sure what type of visa that is). at this point we have been waiting for the NOA 2 for 4 months and it would have been very silly of us to even consider the idea of starting all over, so obviously he would have returned back for the interview duhhh ..... I dont know but the reason for refusal just does not make much sense to me, especially that we think that this was the reason for which the officer denied him the visa.

I felt and still feel frustrated at the fact that I was not allowed inside the building, would I have been there with him maybe I could have said something more to the matter to give assurance that he would return back.

Any ideas, thoughts on this greatly appreciated...

The interview is not with you so they have no reason to have you present. It wouldnt have changed the facts therefore the outcome if you had been inside. Nothing you would have said would have made a difference.
It doesnt make any sense to you because you were ignorant of the laws & rules. This is common because USCs dont need to deal with these things. Its also why the immigration laws of the USA havent been changed for over 60 years.
Thousands or hundreds of thousands have used & abused the tourist visa to immigrate to the USA. People now have to conform to the strongest ties rule.
Your fiance has proven those ties are to you by you petitioning for a K 1. As soon as they cross the U S border those ties change from whatever they were to you, the USC. Thats why they are turned away at the POE many times.
In your case you didnt even know that if he got inside the USA you could have simply done an AOS ( adjustment of status ) which would make it possible for him to stay legally. He would have done as you say & gone back to interview.
I was turned down 3 times for tourist visas for all of these same reasons. I also had planned on going back. It didnt make any sense to me or my husband at first. His reaction was to bring me here to become a citizen so we never have to deal with permissions again.

lol that's why i said LAOS. figured you were asking for answers from anyone in general but for the future maybe you should say that you want answers from thailand petitioners and beneficiaries only...then you won't get unnecessary replies from those in other countries.

However you are replying in the Thailand forum which helps people isolate the questions & answers.
Nick is worried enough without thinking what you said had anything to do with her case. It doesnt. Your refrence to age for example. She & her fiance are almost the exact same age. Bonafides? Her relationship has been solid for years not months. And as I said A P is not usually applied for missing docs.
Nick is worried about A P. Adding to that worry with misinformation is not helpful.
