It doesn't really make sense to me that they would deny for the reason that you could become a public charge if the co-sponsor has that high of an income, unless either they don't accept co-sponsors in SA, or your wife hasn't worked in a long time. But I think I read in one of your comments that she will "go back" to work after her surgery. So I'm confused on that. I would try calling and emailing to get more information so you know what you need to do.

If it is going to get sent back to NVC then my suggestion is that you get married and file for the IR1/CR1. Good luck to you;)

Today I went to the second interview,,,,,, a new CO wanted to restart from the biggining, and she grilled me by the questions... Finally she informed me that I am denied and gave me a paper that explains why :
Ineligible to receive a visa under the following section(s) :

- Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case :
( Please note that your case is being forwarded to NVC for further processing. The petitioner will be contacted to complete the process.

-Section 212(a)(4) : which prohibits the issuance of a visa to anyone likely to become a public charge.

- Further consideration will be given to your visa application after you obtain and present the documents listed above and/or the following: *
( please note you are welcome to submit additional information for Consular Officer's review for reconsideration of 212(a)(4) above.

What does all that mean?
What should I do in this case ?
They denied it because my fiancee is not working and she has no income ,,, but why we asked to file an affidavit of support?
For what it is going to be used this affidavit ?
I am lost and frustrated and can not believe what happened.

I hate to admit it to this board, but.... I did not include any phone records at all, this, my second time for applying for fiance(e) visa. The relationship was 2 1/2 years in age. My phone company only makes available the last 2 or 3 months records. IF YOU ARE BEING OBJECTIVE... that really proves nothing. Phone records for the entire 2 1/2 years... yeah, that would be evidentuary.

I may get called out, on this, for an RFE, but... I think the rest of my preponderance of Proof of Relationship was more than substantial.
We'll see.

I think I added a note in with my application, to this affect, of why I did not include the phone records.

I don't think you have to send anything.
It's pretty much done, on your end, except for the I-134/affidavit of support.

They have a marriage that is not recognoized by the USA due to the husband still being legally married at the time of their marriage. If it had occurred here in the USA it could be construed as polygamy but being that the marriage did not occur here there is no illegal action.

Filing for K-1 IS the correct choice because they are NOT legally married. It sounds like they have been together for some time now, so proving bonafied relationship should not be difficult for them at the interview stage.

In all likleyhood they will receive their K-1 without much of a problem. The petitoner is NOW divorced and fre to marry, they have seen each other within the last 2 years. THOSE are what USCIS adjudicates.


Respectfully,... I still disagree on one point.
The entire process is NOT ONLY AN OBJECTIVE ONE.
It's ALSO LARGELY SUBJECTIVE.

And, the people at the uscis are undoubtedly trained and given extensive criteria, by which to judge.

IF NOT,... then they would simply feed the information through a computer and ... VIOLAAAA! A DECISION. (And then, none of us would have to wait more than a few moments for a decision)

I still think the chances of visa being granted are SEVERELY DIMINISHED, do to the fact that you did something INTENTIONALLY that was not such a smart thing perhaps in the eyes of the USCIS (and in mine, as well) and got married Before your significant other was legally divorced.

I would think also the USA might look upon that as being criminal. IRREGARDLESS of the technical things of which the above posters speak.

HOWEVER.... I could be dead wrong.

ok, thanks all.

I guess I paid it last time and forgot about it, along with the medical exams and other things.

Fees change pretty rapidly.
I filed the first I-129F in June 2007 and that app fee was only about 150 or 175, and then the very next month, it went up to the 455. now, back to 340 or 350.

Fairly sure, that didn't happen/wasn't the case then.

Sounds pretty good, as long as you provide as much documentation as possible, and you'll have still about 7 months to accumulate more and more evidence you can take to the interview!

Interviewers are not computers. They are people. They work off of feelings, sometimes.
One day, ... this will all evolve and it will be done by computer, and there will be a whole new set of malcontents for a whole new set of reasons. Many of us who perhaps pass the people reviewers would not pass the computer reviewers and visa versa.

I hope to let you know soon, in the next few days or weeks,... that in fact, an I-129F can be obtained without a phone record.

I believe the preponderance of other evidence that I presented will be/was sufficient to allow the reviewers to make an appropriate decision, one that I'm hoping/looking for.

Look at it. Phone records in and of themselves prove nothing, other than how many times you dialed a number and how long you spoke. NOTHING ELSE.

Helpful? Sure.
Necessary? Not so sure.

My phone company only makes available the last 3 months records. What good is that? Some. Little?

So, I wouldn't freak out, just over that, if the rest of your case is or seems solid.

Okay, I finally got on the website.
It was NOT coming up, with the OLD "http:" that was showing up in the drop box below my url line.
But, RATHER.... I had to type in the 'www.uscis.gov'... then the site comes up.

Well, well... nice to see at least, after waiting that something changed on the status of the case.

Their request is for "initial evidence", as opposed to "further evidence".

I'm guessing then,... something I forgot to include (or, perhaps they lost) in the line of the legal documentation.
Maybe in my haste, I left something out.

Any other commentary, on the differences between 'initial evidence' vs. 'further evidence'?
