It does not matter, if the OP wants to list or someone wants to list they have a child on the way they can list it. Its their choice not your opinion on if they should or shouldn't. It is not required no, but if they want to put it then they very well can put it in the packet in whatever way they want to.
The person can list it in the cover letter, in a personal letter or in the question about how you met/when you met in person. Its up to the person who is filling out the forms, also up to when/how the pregnancy first happened.


Well let's see. :blink: How does a pregnancy happen?? It ain't from drinking the tap water. It happens because one set of glands was urgently calling out to another, and no protection was used. And, NO, the pregnancy need not be documented in the 129-F application. No check box for that on the form, and it serves no good purpose to attach a statement. No expedite would be granted to a high fraud rate country, as others have said here. Good luck!

Not necessarily. There is a difference between "sole custody" and having "transport rights" The sole parent MUST have expressed rights to remove the child from the country to the United States PERMANENTLY. If the divorce agreement does not grant her that, it does not count. They need EITHER a letter from the father OR a specific court order allowing her to remve the child permanantly to the United States.

The age at which this is required varies also, in Ukraine it is age 16, in some countries age 18.

Another thing, and I always have to say this having gone through this with two children...get this stuff done BEFORE you file the petition!!!!!!!! If it means delaying the petition a few months for a court order...so be it!

What exactly is the court order called? I am asking about the document you say the embassy will accept. In how many cases was this court order accepted & the childrens visa issued?
The answers to those questions will make it possible for a friend to obtain the visas she badly wants.

Even though her K1 mother has sole custody, the Bangkok consulate is telling us they need an affidavit of consent from her father before they will issue her a k2 visa. Her mothers visa was already approved. Problem is we cannot locate the father as he has not been involved with the daughters life since her birth 17 years ago. We have already shown proof of sole custody. Anyone have experience/insight on this issue? Thanks!

This subject requires exact details to be correctly understood.
The child has two parents but one may not be on the B Cert. If both are on the B C it doesnt mean they are legally married. If they ARENT the one that has physical custody can ask the Ampur for a document assigning a sort of legal custody. This is useless to submit to the embassy.
If they were legally married one can petition the court for physical or legal custody or both as far as I know. In a recent case a couple submitted a court order indicating the female had sole legal custody of the two children. Even though the message from the same embassy implys they will accept the order they will not.

When you get frustrated with how long some part of the process takes keep in mind that people send in tons of stuff that isnt required or usefull. All of it has to be reviewed. These officers have just so much time in a work day just as the rest of us.
There is no question that your relationship will qualify Ice for a visa. Your relationship goes back years rather than months. Few cases are like yours. He has lived in the USA. You have spent a lot of time in Thailand. These facts are enough to prove the case.
I have never seen a case that I was more sure of than yours. No, you dont need to send more but I know you will.

embassy told me that my petition is being sent back to USCIS

i kept on calling USCIS but they do not have it yet , my fiancee did call and provided all details to
her senator office and we were told they will check on this but no reply from them yet

keeping it short..so here is my Question does anybody had same issue? if yes could you please
tell me what i can do to get my visa .

Yes others have this problem at times. You can wait until USCIS reviews the case which can take months.
You could also help your self by giving more info here. Such as what country you are dealing with. What did the embassy tell you? There is a reason it was sent back.

I am no expert on Embassy but I can offer you some advice. First, all employees in America are supposed to receive a "W-2" form from their employer by January 31st each year. This will show his income. That is what I would provide them. I will also offer 3 months of pay check stubs. This is all he needs to prove how much he has earned. They might still want to see his Income Tax Returns for 2011 but that is no problem too. If he is not self employed, he should be able to file soon after he gets his W-2 from the employer. He can file on line or he can take it to a tax professional that can file it and print out the 1040 form that he filed.

If he is self employed then that takes a while longer and is hard for some people to do by himself. In any event, taxes can be stressful for some people here and take them a few days to organize and it is a pain. I would nudge him and provide him this knowlege but if he is stressed about taxes and can't produce till later, don't push him. You could delay the interview but not too far. Just take the last appointment available. You can always provide the tax forms later but they might just accept the W-2 and his pay stubs as proof. That should be enough. Don't provide a copy of the W-2 or the pay stubs. Provide the real thing that was given by the employer.

Providing tax forms proves he filled out forms. The W 2 is an indication of income from a source. Its best to provide tax transcripts which prove he filed the tax forms, the income & the tax payed on that income. Those come directly from the IRS.

Does somebody know what I should do if they really didn't send us any RFE's? I mean I don't see why I should pay a fee of $640 just to tell them that they messed up. But I guess I'm just gonna follow you adivce and reapply with a whole new case.

You could try to find out why you didnt get RFEs. Its very strange that they didnt send them. Its possible that they were not delivered to your address.
I wanted to find out more about your case to know if you could do what we did in a similar situation. I can tell you there is a different way to get the case reopened. Its called a motion to re consider. Its free for one thing. To do this you would need to know if they sent RFEs or not. My husband wrote a motion explaining the situation; asking for re consideration of the case. That was accepted & 60 days later the case was approved even though we had been told to file the same thing they told you.
The underinformed seem to think I was just trying to be mean. No. I was trying to get enough info to see if you might be allowed to do as we did. Bobbys post is along these lines as well.

I need your help please.
I applied for a K-1 Visa and waited 5 months. Then I got denied because I forgot to send in all the information. I hate myself for messing that up. Now they gave me the option to do a "motion to reopen" or to start a completly new case. If I start a new case then it's gonna take 5 months all over again. My and my fiancé would hate to wait that time again. I miss her soooo much! Now my question is did anybody of you did the motion to reopen? Is that gonna take less than 5 months? Or is it gonna take longer? And they told me on the phone that I have to pay $640 to do this motion to reopen. Is that correct? (it didnt say anything about that money in the letter where they told us the case got denied). And can I come visit her in the US just for like a few weeks while we are applying all over again or doing the motion to reopen? And what would you recommend for me to do anyway? A motion to reopen or a new case? The money doesn't matter by the way.

Please somebody help me here. But only answer if you know what you are talking about.

You are still " messing up". You forgot to include the info people would need to offer advise. Like what you forgot to send in.
You called & were told how much the motion would cost but want a different answer? Its is correct.
Do we know what we are talking about? The real question is do you? There has to be more to this than you have said.
Its unlikely you would be granted a tourist visa after someone files an immigration petition for you. You will be asked about this if you apply. Study the strongest ties rule prior to attempting a tourist visa. Make sure you know what you are talking about.

Thank you so much for the information and support again Ning. I was just going to ask them about the co-sponsoring for k-visas in general. But I've talked to my Fiancee for quite a while last night, I think we're going to go with your option and try marriage here first. We're not in a rush or anything so we've got all the time in the world to get married and begin that visa process. Hell, I might finish my Masters here and get a presentable job on the federal poverty line before attempting this, just for the better chances. So again, Thank you so much for your help, I might need it again here in a few more months after our marriage :)

With your education of course you would have a good chance at earning more than enough to qualify if you were working here in the USA. However with your present income & someone to supply some support you would be approved for a CR1 even now. Keep in mind the support isnt a factor until later in the process. When you file you will get NOA 1 in a month or so which indicates they have your money & your case is in line. About 5 to 6 months later you would get NOA 2 which is the actual approval by USCIS. They case is then sent to NVC ( national visa center )for further processing. They will request the support forms during that time. This means you have about 6 months or more to be ready to supply those forms.
As to marrying in Thailand there are several benefits I have found in my own situation. My husband had me get my Thai I D changed to my married name. I then got my passport in that name. This helped me a lot when I got to the USA with many things. My green card is in my married name, social security, drivers licence ect.

I think I will decide to start from scratch and do the CR-1 if they will not take co-sponsors for the k1, but I will message you if I need that letter. And also, yes, I have been here for over 2 years, but I had read I can not file as a DCF to the embassy in Bangkok because I am under a Student Visa. Again thank you, I really appreciate your help.

I know it's a fiance visa... I just didn't know about the assurance of it compared to a CR-1. I would just like to go back home with the person I've been dating for 3 years. My family wants that as well and are willing to fill the co-sponsorship.

I doubt you will get an answer by calling them. They will tell you they dont pre-screen cases. The three cases I mentioned were all approved using co sponsors but each case is unique you wont know until she interviews.
The best & safest way would be the C R 1 if you are sure you want to marry. There are many benefits to doing it this way. You will submit an 864 showing your present income & be allowed at least one co sponsor to show ability to support her. She could begin working soon after settling down in the USA.
No matter what visa you attempt you will not be at the actual interview as they no longer allow you to attend. It wont matter anyway because she will do fine at the interview. Most of the effort is put into the documents which will be complete.
Its possible to buy a pin number at any Thai post office that allows X amount of calls directly into the embassy visa section. This would help one or both of you gather some info. Just try to frame the questions in a general manner rather than specific to your actual case.

A K 1 is used to bring her to the US for marriage. If she marrys you can file for the AOS ( adjustment of status ) which results in a green card about 6 to 8 months later. There are fees involved.
The C R 1 doesnt require the AOS;she gets a green card quickly.
Fed poverty lines are exactly the same.

Well, here it goes. I've already filled out all the petition files for k1, they're waiting to be sent. But I am still at unease whether or not I should send it.

I'm an American full time student in Bangkok, but I'm pretty sure my income doesn't count for the federal poverty line. I get monthly checks from veteran's affairs of around $950usd, (have $4xxx in my account and would grow till noa2 arrives)
I'm not in the army, i receive the benefits because my father is 100% disabled from the army and I receive Survivors and Dependents educational benefits from that.

But other than that, my Mother and possibly my father(and other family members) will co-sponsor for me and also for my gf too? Would they need to fill out two I-134's for both me and her? And if we plan to live with my mother, would that count as 3 people(me, my mother, and gf) on the federal poverty line? Because my mother meets that poverty line for 2, but not 3 in the household.

If you think I'm pretty my S.O.L, could you give me any alternative ideas for bringing me and my gf to the states? Thanks, I'm just hoping for the best.

Before you send it carefully think over what Penguin said & the following.
In general BKK doesnt accept co sponsors for K 1s. However in 3 cases I know of they did because like you they were students but they were in the USA. If you decide to attempt using a co sponsor I will help you with a letter to submit at the right time. You of course would take a chance they would accept the explanation & allow the use of the co sponsor. In the other cases they did not have any income so your monthly income would make a difference. You are only about 7,000 dollars short of the poverty line now.
The problem with doing the above is you will pay the fees & not know until the interview if they will allow the co sponsors. Really it will be after the interview because you wont be allowed inside to help. This is the reason for the letter.
It would be safer to marry in Thailand to allow you to file for a CR 1. If you are a 6 month legal resident you could file in BKK as a DCF which savews time. The C R 1 is better for several reasons including the use of co sponsors. The C R 1 gives her a green card which allows her to work ect.

As she gives the facts it certianly appears he has a tourist visa. I should have seen that when she said he was visiting.

Its unlikely he would be able to get a tourist visa under any circumstances but with a pending K 1 there is zero chance. All people with tourist visas are considered intending immigrants. They must attempt to meet the strongest ties rule which means they must prove they must return to their country. Doing that coming from Hati is about as difficult as it gets. Exposing the fact that he intended to visit you as a fiance would result in a denial.

Five months is a long time to wait for anything but it is common for this type of thing with USCIS now. Its unlikely there is any real problem with your case; they are simply busy. The holidays dont help of course but they just add a few days really.
These service requests are also common. Everyone I have seen resulted in the same thing which was a message saying they were working on the case as time would allow.
Doesnt hurt to call but may just add to the overall frustration when it produces no real results. Same for trying to get help from a politician. They all have staff trained to placate people on these issues. Our Senators office was worthless even though they had people with over 20 years of experiance. It took two months to get an answer which they sent to the wrong address. My husband found out more himself & the Senators office admitted the info they found was outdated & wrong. These are the same people that havent dont anything about the immigration process for 60 years.
I am an expert in waiting after the 408 days my case took. My husband met with USCIS several times in person trying to see what was going on. They could not say why it was taking so long. The responce he got was "this just never happens". Really? It happens to many of us as we see here all the time.
The good thing is you are at the 5 month mark so it really wont be too much longer.

You will create the 134 support form & forward to her after which she will submit it prior to the intervew. This gives you about 6 months to be employed. Your should also submit tax transcripts for 3 years. The gap in employment can be explained by a simple letter attached to the 134.

Than the best thing to do since I will be there a good stay, is to get it all together and mail it from there back to the States. I hate to wait till I get back home if mailing it from there could start the process a little sooner. My hope was to be able to have her come here before winter sets in. As I read this I am uncertian if you intend to marry in Thailand while you are there. In one part you speak of a K 1 but later make refrence to being married there. Whatever you do she wont have to worry about the winter this year. Either visa will take many months. Six months to get thru USCIS alone. Then 1 to 3 months with NVC. About 2 to 3 to get the interview date in BKK.

Begin to look into what you have to do to marry in Thailand. There are different ways to do it. Please read up on our culture to understand what may be asked of you. Then temper that with what you feel is reasonable & possible.

Yes I think its incorrect. They probably would inform you the fee was incorrect & ask you to pay the remainder prior to the issuance of the visa.
I am hoping someone that recently got a K visa would answer because I know these fees changed.
Again if you needed to you could just inform them with the P 3 that you will pay the prior to the issuance of the visa by bringing the reciept to them in person.

"There is no longer one single visa application fee for all non-immigrant categories. If you are not sure which of the MRV application fees applies to you, please pay the Thai baht equivalent of U.S. $140. We will determine the correct fee at your visa appointment and advise you how to pay the difference".

I actually live in Thailand so luckily it's not a big deal for me to go back up there. However I live up North in Chiang Rai and I bet the form they have (see attachment) is outdated. I've read some of your posts in the Thai portal and you have helped others quite a bit. As the next step is the interview I'm starting to get nervous. May have a few more questions and would appreciate your advice !

One way to do this is to let the embasy know you will pay the fee the day of the interview & return the reciept that same day. Thats what we did because we simply forgot to do it before the interview because they reschedualed the date at the last minute. At that time they wouldnt let people mail in the P 3 stuff anyway. It took an extra 45 minutes to do this but we couldnt get the visa ofr 3 days anyway. They told us to bring the reciept when we came in to get the passport but we did it that same day to make sure.
Another would be to try to call them. This can be done in several ways. Best way is to buy a special pin number from the Thai PO that allows you to call directly inside to the visa section. It was about 400 baht I think for X amount of calls.

Mailing my Packet 3 today to the US Embassy in Bangkok, Thailand. In the Packet 3 instructions it says;

APPLICATION FEE: Each K Visa applicant must pay in Thai baht the equivalent of US$131.00 non-immigrant visa fee, which is non-refundable, at any Thai Post Office. Please
mail in the receipt which is valid for one year.

It doesn't say who to make, what I'm guessing is a money order of sorts, out to ? When I mailed I-129F I got a money order at the US Post office and it was made out US Dept. of Homeland Security.

Does anyone know ?

The fee is paid in cash (baht) at the Thai post office. They will issue a reciept which is mailed in or turned in at the interview.

My fiance already book his flight to the Philippines this coming February, and looking forward to be in his arms again:) We were both hoping that he would receive the NOA2 once he flies back to US so it'll be such a good news for the both of us after his short vacation here. I'm not worrying much about the long NOA2 wait.. since i am positive that things will turn out well since prayers are stronger than impatiently waiting when NOA2 will arrive. What's important in every relationship is how you stood strong as a couple, and no matter how far the distance is.. the love you both have is much closer to your hearts (L) GOOD LUCK guys! Let's always remain positive B-)
