Hi Everyone,

I filed my I-129F in mid-December, and received a NOA very shortly thereafter. According to the USCIS website, the application is undergoing initial review and we should expect to hear something by the end of April. Assuming that this is true, perhaps we are looking at a May interview date?

If that is the case, should I be planning to travel to Dakar to accompany him to the interview? If I had infinite money and vacation time, this would be a no-brainer for me. However, my father died suddenly three weeks ago and I had to take off work for arrangements. I do not have much vacation time available, and burying my dad was also quite expensive. I have been to Senegal three times in the last year, and it all adds up! Do you think my fiance will have a harder time if I am unable to travel to Dakar for the embassy? I am doing my best to put aside money for the trip in case it's necessary, so I would really appreciate the responses.

I also have another inquiry for you lovely people: Given that my fiance was recently transferred to France for work (on a diplomatic visa) for a 3 month period, he will be outside of Senegal until the beginning of May. Is this a problem? Is this something that could weigh in favor of his application--the fact that he is trusted to travel? If so, should/how should I alert the embassy of this new development? Again, all constructive feedback is appreciated!

A bit about us, to the extent that is helpful in forming a response: We are a bonafide couple. We met by chance in Senegal when neither of us was looking for any kind of romantic relationship whatsoever, and the rest is history. I'm an African-American/Jamaican young lawyer (mid 20s) who is currently working for the federal government (nope! we don't get special treatment), and he's a student/ veteran employee (approaching mid 30s) for a telecommunications boutique in Dakar. Our families have become very friendly, especially with all the support his family has shown my mom after my dad's passing. He's a divorced dad of a 6 year old, whom I met and befriended before I met his dad. As previously mentioned, I've traveled to Senegal a couple of times last year, and am hoping to hop over to France to see him for Easter. He has a lot of family in New York, and I was friendly with his relatives before knowing of his existence. I met him while staying with his extended family during my first visit to Dakar in December 2010. I speak French and have been learning Wolof. He has been taking English classes since having met me, because he wanted to ask my Anglophone dad for my hand in marriage :(. (My mom is a French teacher, and my siblings all communicate with him in French.) We're (somehow progressive) Evangelical Christians; they're Muslims (with some Christians in the family). That's about all I can think of, and I hope it's helpful. I await your responses!

From what I understand, it is extremely possible for a K-1 application to be denied if sufficent evidence of a bonafide relationship is not established. It is very important to follow the rules of application, and to be sure that your intentions are consistent with the purpose of the K-1 visa in order to avoid denial.

There is nothing to discuss here. You have been scammed. Call ICE immediately. If you need to do so, also send in a letter to USCIS explaining the situation so that you will have documentation showing that you were not in on an effort to defraud the United States government. Remain in touch with the woman and do not alert her as to your plans to report her. If you have an idea of where she is, it will make it easier for Immigration to pick her up.

What no one is mentioning is that, yes, the CBP officer that processes you at POE has the SOLE DISCRETION to turn away anyone he wants. Period. He is the last line of defense. During 9/11 era, one officer turned away a terrorist, against the will of his supervisor and extreme pressure to let the bad guy in, so these powers are in place for good reason.

That said, under normal circumstances, healthy immigrants with all their papers in order, no contraband, no criminal record and no previous immigration refusals or deportations should not worry about having a problem.

Nonetheless, POE "interview" with the CBP officer should be taken seriously with no attitude or angry responses.

Canada has superior health insurance compared to the US. Your baby will be delivered free up North Vancouver Way with her privileged health insurance. if you don't get married within the 90 days of the K1 visa, you have to add another form (I-130) and some other hundreds of $ to your AOS package.
and then, of course, expect to be questioned at the interview as to why you didn't get married within the 90 days. I think it's at least human for the interviewer to be curious and ask why you did not comply with the visa.
Obviously after the 90 days have passed you become out of status. Actually, you'd be out of status even if you married but didn't send your AOS application within the same 90 days.
The difference is that while the foreign spouse of a USC is eligible to adjust status, and USUALLY will get scolded for not having done so yet and nothing more, an out-of-status foreigner that did not marry the USC petitioner of his visa is subject to deportation. it would be the same as overstaying a tourist visa or the VWP.
of course, the longer you wait the worse it is, especially if you live down south near the mexican border. the odds of being stopped by CBP would be higher.

Added: and yeah, I'd listen to Amyyduck's advice.

So fellas who are scrimping and saving just to pay for the USCIS process, and barely can pull the dough together to do that, are going to put themselves and new bride in a POOR situation. It is quite possible you may go beyond the 5 months that was the previous "goal" of USCIS.



She is not at the consulate phase yet. That would come after petition approval.

The O P said Africa without indicating a specific country.
I think the fact that they are waiting for the NOA 2 shows they arent at the consulate phase. I am pointing out that if they are trying to understand or plan they should consider the possibility of A P later. People are always concerned about time just as we see here.

There are many cases where they report more than 5 months to get NOA 2 right now. Calls to USCIS result in being told they are backed up with cases.
Africa is a place where some countries have embassies that place many cases in A P for further review. If yours is one of them you should prepare yourselves for that possibility.

HLP is correct. It would help if you said what country you are dealing with.
Best to send last years tax transcript which proves what you made & that youy own no tax. Sending copies of returns ect just proves you filled out forms. It doesnt mean anymore than that.
Get transcripts from IRS for free by calling, on line, by fax, by mail, or in person.

Thanks for the reply. Yes, I have seen the DS-230 as well. I downloaded all the forms to help her fill them out. My understanding is the Bangkok Embassy only wants part 1 of the DS-230. Anyone with recent experience care to comment? I'm getting the documents together now for the I-134....putting it off a few days to get the current year W2. I'm sending her a package soon with copies of all my docs. I hate having all my personal info out there but feel like she might need it during the interview. If she doesn't interview until summer I don't want to send the updated intent letter too early. I'm going to visit her again in April maybe I will just take it all with me then.

I know you are trying to do everything you can which is normal. However you may be doing these things again when the time is more appropriate.
The 134 for example is part of the submittal for the interview. That wont happen at least 6 months. When you do submit it attach a tax transcript rather than tax forms & W2s ect. BKK is one embassy that prefers them.
BKK is busy all year. They see about 700 cases per month many of which are not immigration based. During the summer they have tons of students to deal with. This is why immigrant visas are done on Mon & Wed only.
Because she is an English teacher there isnt a reason to have her do ESL classes. From what you say there wont be any Thais there anyway. A different idea that might work would be to find out what it would involve to have her become a teacher in the area.
The temples will serve to help her find where to buy food & many other things. This will be very important to her.

My fiance and I are getting the package 3 documents together ahead of time. We are waiting on our NOA2 from the VSC (please no RFE's!). She will be interviewing in Bangkok eventually. Can someone confirm the forms DS-156, DS-156k and DS-157 are all for her and none of them apply to me? It all just seems redundant giving them the same info over and over. If anyone is interested I joined the long wait in late Oct 2011. From what I've read so far we have a long way to go. Thanks to the creators and contributors of this site. There is a lot of good info here.

I'll be posting more in the future looking for others who have been through this and might live near me (Raleigh, NC). The country immigrating from is not important. It would be nice for us to have some friends locally who can relate to the process and living in a new country.

I'm also interested on things you have done to make your spouse more comfortable on arrival. I'm currently trying to get my tv hooked up to the internet for watching Thai tv (my Dish provider has a lot of international packages.....except Thailand :(. I've located some Thai restaurants and thought about making a welcome banner with American and Thai flags. Any other ideas?

Find the book Thailand Fever on Amazon. Have her find it in Thailand or send her a copy.
I use You Tube to stay connected to Thai shows. There are many & even some videos of her area probably.
When she gets here it would be fine to do something special of course but she would appreciate time to get used to her new area. Everything is so different.
Food is a big deal. She would like to know where she can buy food to prepare at home. She will find people to connect with at those stores.
Locate the local temple to allow her to practice her faith. Again she will find people to relate to there. Hopefully you will have some knowledge of what we do at our temples.
Look into ESL classes at schools near you. She wont want to begin this right away but its a very good idea for many reasons.

They may be but you take a chance they are not. It is better to submit transcripts.
Notaries verify signatures not content. There is no reason nor requirement to notarize these docs.

Can't remember which one, but you should know that if it's required there's 3 shots involved and they are administered over I think 7 months. Have the bene see a doctor ASAP to see which shots are required in case it will take this long.

They will give the MMR shots. The follow up shots can be done in the USA. I had mine done at my local county health clinic for 23 dollars. My daughters were free.

At the point of receiving NVC notice dated Dec, 16. No Package 3 delivered to fiance in Thailand yet.

Have some questions, if anyone can help. Fiance going ahead with Physical today. Everything else pretty much in order. Next the Police background. However I have read both things.

1. The background check requires a copy of the cover letter from package 3
2. Also, that it can be do done with NOA2, is this right?

Police will usually respond to anything indicating the need for the report. NOA 1 or 2 have been used in the past.
NVC to BKK takes about two weeks. All cases are sent to the consulate section across the street from the embassy which houses the visa section. This transfer of cases takes a few days believe it or not.
Contact consulate duty officer with your case number requesting notice.
The P 3 docs can be sent in anytime after you are sure the case is with the visa section.
Good idea to submit your tax transcripts for one to three years with the 134. Free from IRS by request. On line, by phone or by fax.
The fee can be paid at almost any Thai post office. I believe its 350 dollars. Post office knows current fee for K visa.
Interview date is triggered by the reciept of the P 3 docs.
Schedual updated end of every month unless they changed. Your case may never show on the schedual but you can see how busy they are. They see over 700 cases per month. Mon & Wed are dedicated to immigrant type visas. This is why itseems to take forever to get a date.
Your fiance can buy a special pin number at the post office which allows her X amount of calls directly into the visa section. These questions must be about general info & NOT about her exact case.

If the denial was due to the typical reason of lack of ability to show strong ties to your country you will have no problem with the other visa.
Hopefully you will also realise you need to provide some facts & details in your questions or suffer from bad info as a result.

I'm one of the 5.6 million long-term unemployed people in America after losing my job at GM (General Motor's) when my unit closed (so much for GM's bail-out).

I'm highly qualified but I'm an Occupational Health RN and work in industry and industry has been hit hard. So while I received unemployment benefits for 2011 in excess of the minimum required amount for the affidavit of support I wonder if that is the same as having zero income for 2011. (I was unemployed for the entire year of 2011)

If that's the case, and since I start a job in three weeks earning $750/week, the question probably becomes: How soon can I file the affidavit of support or rather how soon can I file with a good chance of it being accepted? Must I work 3 months, or 6 months...or must I wait until the year is over (I'll have exceeded the minimum amount for one year in October).

Interestingly my assets are far in excess of what is needed with zero income but apparently the Bangkok Thailand embassy won't consider them (I've heard they want to see a job and nothing else) and will not accept a co-sponsor anyway (and I have no living relatives to co-sponsor for me at any rate).

Does anyone have any experience with this? With 5.6 million long term unemployed (Bureau of Labor Statistics Jan 6, 2012) I can't be the first person wondering...

Thoughts, suggestions....guesses?

BKK is truly unique in its methods so please be careful as you apply info to your situation while considering the source of the info.
Keep in mind that you are dealing with a K 1 which means the support doc ( 134 ) wont be submitted until just before the interview. This gives you plenty of time to generate an income history.
Your case will be with USCIS for about 6 months. The interview should occur within 3 months of the NOA 2 date.
Additionaly your assets will be considered unlike what you were told. It is true that in most cases & certianly in yours a co sponsor isnt allowed.
It would be best to create a work history to couple with your assets to be in the best position to be approved at the interview. This was recently done by a member going thru BKK where that case resulted in a K 1 visa.
