K-1 Fiance(e) Visa Process & Procedures	Heavy Heart	How did you know when your husband had the 5 yr. ban or just a denial? My fiance was simply told to reapply for his visa in one year. And after sorting through all of his paperwork, I don't see anything that says a 5 yr. ban has been placed. He was told plus the paper he was given by INS said it. K-1 Fiance(e) Visa Process & Procedures	Heavy Heart	My husband was given a removal order with a 5 year bar on reentry to the US, and we were able to successfully apply and get his K3 visa from Juarez once the ban period had ended. It's almost guaranteed they will ask about the POE denial at the interview, and you can almost be sure your fiance will need to have fingerprints taken. But if the denial at POE is the only thing that comes up matching his fingerprints, I wouldn't worry. The only comment I would have to make is this... where you say... He definately should not have done any form of work while on a visitors visa, but he was never illegal. working while on a tourist visa is illegal. He was legally present in the US, but by working he violated the terms of his tourist visa. I am not saying it to be mean, but because you might not want to stress that point so strongly in your interview as you did in your post, as it seems like you think your fiance didn't do anything wrong. My husband and I when asked said yes he did work for a short period, and we realize now that it was wrong, and obviously we know now, as we have been paying for it by having our life put on hold for the 5 years. The consulate truthfully weren't that concerned with him working without a work visa, they just wanted to make sure that is the only thing he had done, and that he never crossed again during the ban time. I'd say you'd be smart to take proof your fiance was in Mexico the entire time after the POE denial and that he hadn't crossed without inspection once his tourist visa was revoked. We took paystubs for the entire 5 years.... hehe! The consulate will then also prove it via ensuring his fingerprints only show up for the one incident. Chin up It's very scary imagining what is going to happen and what you're going to have to go through, but the consulate is actually more understanding than you're expecting or worrying about. My husband's interview was more difficult because someone else had used his name when they were caught by INS during the ban period , and we had to go through extra fingerprinting so INS could prove it wasn't my husband. Once the 2nd and 3rd set of fingerprints came back and they saw it wasn't him, his visa was granted. He definately should not have done any form of work while on a visitors visa, but he was never illegal. Very scary moments for a while, but we knew he hadn't ever reentered once being sent back, so we knew the fingerprints would show we were telling the truth. Make sure you do write up a summary of the incident and include it in your cover letter with the I129F packet. We hired a lawyer who did this for us, and stated the part of the law that showed my husband was eligible to reapply for a visa once the 5 years were up. If you are still worried about it, you might do a 90 minute consulate with a good immigration lawyer who can review your case and any facets of it you might not have considered, and hopefully ease your mind. K-1 Fiance(e) Visa Process & Procedures	I-134 or I-864	I would definitely take a I-134 with you in case and all the supporting documents (i.e. tax returns, employer letter, etc.). We saw people turned away when we were in Juarez because they didn't have all the paperwork needed. They did take my I-134 but turned down my parents' I-864 and I-864A as cosponsor telling me to save them for AOS. (Turning down the cosponsors was rather odd - I had no job at the time since I had quit and moved to Mexico 2 years prior - but they only turned it down after seeing my tax returns proving I had an excellent paying job in the US before I quit AND after I confirmed I could return to that job upon my return. All u have to do is speak to someone at your local support enforcement office and get a copy of your court order. The person to speak to would be your caseworker. That document would be your proof. K-1 Fiance(e) Visa Process & Procedures	I got the RFE today, not what I thought it would be...	After waiting since Saturday, I finally got the letter in the mail. The information they are looking for isn't bank statements, phone bills, emails, pics or letters. In fact, they need more proof on my fiance's divorce. Evidently the document we submitted with the english translation wasn't the actual certificate of divorce but the request for the divorce. So for a Greek divorce we need two documents, one from the church and one from the courts. So off my fiance goes to speak with his lawyer tomorrow to get these two documents, with english translations and copies of all documents back and front. Ugh!!!!! Hopefully we can get this in to the Vermont office soon. We have a deadline to get this in by July 16th. I also got RFE on Apr 3,it's similar request as you.Don't worry,please speedy to submit the additional request and hopefully everything will get done soon After waiting since Saturday, I finally got the letter in the mail. But once it gets to NVC there very short time and then sent overseas to the consulate. The consulate will then send out package to the fiancee of what they need to do and sometimes the interview date and time are with the packet. I would make photocopies of everything you submitted and NOAs in another packet that you can readily have in hand if they want you to resubmit. That way you will have it ready and only need it if they cannot find the original documents. Maybe once you show it they will get you back on track and expediate your interview so you and Paul an be reunited soon. You can always reapply later if that is what you wish to do. Long distance relationships are hard and marriage is very hard to begin with especially the first two years. Your checks here in the states means something came up in one of the data bases, job, or education can play a part in this. I can only tell you to try and give it some time and hopefully it will pass fastly. If you look at my timeline below I am married and it took her 6 months to get to the embassy and then 6 months to get an interview and now we are in administrative processing. They have not run any security checks on our end right now and they are secretative and will not tell us why we are on hold. Pray for patience and understanding and only look at this process one day at a time. If I look further out I get depressed. Yes the co sponsor agrees to help so that you will not have to use goverment aid if you are not qualifiied over the poverty level. 2. I-134 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require a different form. Some require an I-864. If yours does, send that instead. You can call or email the consulate to check. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 3. http://uscis.gov/gra...forms/index.htm 4.
