My hubby and me had the a similar situation last year too, we applied, got the visa, I came to USA and I had to leave before the 90th day for personal reasons.
After few month we re-applied for a K1 visa and like you our petition was under AR for a really long time we didn't know what to do but after waiting and waiting we contacted our congress man and after two weeks we had our NOA2 ...we aren't really sure if he had to do something with that but somehow it worked!
So contact you Congress person, it won't hurt. Good Luck :thumbs:

When my fiance visits me again in September of 2006 for 3 weeks, I am going to start the process of filing for the K1 visa. He plans to visit again at Christmas, but will he be able to enter the U.S. once the process has begun? He is in a position whereby his employer can write a letter of reference proving he is gainfully employed and will be returning to the U.K. and can also bring documentational evidence such as bank statements, mortgage, utility bills, etc. He normally travels here on a Visa waiver... will he still be allowed to do this once the process of the K1 visa has started?


He is still eligible to use the visa waiver program until the K-1 is issued, but he must be able to prove his plans to return to the UK and be able to convince the entry clearance officer of that. My husband (who was at the time my fiance) visited me three times during the process this way and had no problems until the third time, and then only because he had spent the full 90 days in the US each time. It sounds like your fiance will be okay, but remember that it is up to the officer and he does stand the chance of getting turned back. How likely it is, depends largely on the officer and how satisfactory the answers are.

The problem with the "spur of the moment" plan (other than it is illegal-while it is not technically illegal to marry and adjust from a tourist visa per se) is two-fold.

First, as stated, the way you are going about it is illegal. You are planning it now-therefore it is not spur of the moment.

Second, you are going to be asked tp prove you didn't plan it ahead-that it truly WAS "spur of the moment". The onus of proof is on YOU. USCIS takes a dim view of people trying to skate around the legal visa process, and the consequences of trying to do this can be severe, not to mention inconvenient (what deportation isn't, really?)

I suggest you research some less shadily-legal options.

My fiance just received his Packet 3 from London. The steps say (not word for word):

1. Complete and return all required forms to us as soon as possible.
2. Begin collecting documents (eg, police certificate, etc.).
3. Complete checklist and send it in.

According to these instructions, my fiance sends in TWO different things. The first will be the required forms, and the second will be the checklist once he collects all necessary documents, which will take some time. Maybe it's because a lot of people get all assembled documents before their packet 3 arrives, and can do step 1 and 2 at the same time, but we haven't done that. I'm just confused because I haven't seen any reference in anyone's timelines regarding sending it things from Packet 3 in 2 parts. Obviously, we want to wait to send in the checklist until we have everything so they can give us an appropriate interview date in Packet 4, but we also feel from the instructions that we should complete step 1 ASAP.
This would only apply to those who went through London embassy.
We plan on following the instructions, but it worries me that I haven't seen anyone on this forum send it in two parts, with the forms first and then the checklist (at least nothing that my search has brought up), so I thought I'd ask to put my mind at ease.

We sent everything in at once. They assume it's going to take a while to collect everything else on the checklist (the medical, the police certificate-which DOES take the WHOLE 40 days!, etc.) so that's why they suggest sending the forms in first, then the checklist when you're ready for your interview. Like I said, we sent everything at once-checklist and forms.

You need that slip to pay the fee, as the teller at Barclay's will stamp it and you show this to the official at the Consulate. It is an official form. The short answer is yes, you've waited too long to file the I-129F. It takes a few months at least to be approved. Four weeks-it's not going to happen. Look at the timelines for an average. To put it into perspective, Russ and I got through the process lightning-fast...and it took us from the beginning of October 2005 to the end of January 2006 to secure his K-1.

You can get married in four weeks, but then you will have to return to England and have your spouse file for the K-3 spousal visa for you before you return again. That will take a few months at best, but really is the only legal option you have that will let you keep your wedding date.

If you try to adjust status from your current situation, you will have to PROVE that you did not have intent to stay when you entered on VWP. This is not easy, the officials deciding have total control over this kind of situation and if you do not succeed in convincing the person reviewing your case you could be looking at a ban from the US for several years. Believe me, the burden of proof is on YOU in that case, and it is not an easy task to prove it. If you did enter the US on the VWP with the intent to remain, you have, in fact, broken the law-they don't like that in the least, for obvious reasons. Not to mention that you can try to adjust status, but it's going to take longer than you have left on the VWP, so not only are you going to be looking at trying to prove you didn't come here with immigrant intent, you are going to have an overstay to explain-overstays will get you banned from the country.

Marry, go home, and have your spouse file for the K-3. That's pretty much your options, in a nutshell.

Well, it does seem to me that you don't have a very good understanding of the visas at all!

If you are getting married in the US ONLY, you can file for the K-1, bring your fiancee HERE, and get married HERE. This allows you to get married immediately upon her arrival. After that, you could in theory be granted advanced parole to go back and have your ceremony in Cambodia. I wouldn't, if I were you, plan on any kind of timeline before you had the visa or your advanced parole IN HAND. That's what the rest of uf have had to do, that is how it works.

If you are getting married in Cambodia, you can go and do that and THEN file for the K-3 for your spouse. Yes, it necessitates her remaining in Cambodia while you file. Yes, it means that if you cannot stay with her there you will be separated. Yes, it sucks. But that is the way it is.

Your options are limited because you are marrying a non USC. USCIS is not Burger King, you cannot have it your way. This is unfortunate and a big headache to everyone who has been through this-none of us will call the process easy. It entails separation from our partners and long waits, hassles with paperwork, and sometimes ends in heartbreak. It sucks, but this isn't an easy process for anyone, and people around here tend to get touchy when it looks like people want to find ways around the process-yes, it hits a nerve with people who have been through all of this heartache before you.

If you get married in Cambodia, the I-129F route will not apply to you. The K-1 visa is for people who are getting married IN AMERICA ONLY-you cannot marry anywhere else in the world if you are using a K-1 visa, it is only for people intending to marry in the US.

If you want to have your wedding ceremony in Cambodia, you will need to go the K-3 SPOUSAL visa route, which you will file for AFTER you marry. These are your two options. Either the K-1 visa, on which you must marry IN THE US, or the K-3, which will allow you to marry in Cambodia.

It's all up to where you want to get married. There's no way to marry in Cambodia and just bring your bride home, unfortunately. You could bring her over on the K-1 before your wedding ceremony in Cambodia, have a civil marriage in the US, file for advanced parole, and go and have the ceremony in Cambodia even though you are already legally married, OR you can wait, marry in Cambodia, and file the K-3 spousal visa. That's it. There is no easy way to do this, unfortunately-immigration is tough.

What would I do? Well first of all I'd research my LEGAL options, not suggest lying to USCIS about when I got married and risk the legal repercussions and possibly a ban on entering the US for the beneficiary. That is, in all reality, very VERY stupid, as it will eventually be found out and the problems which would arise would be bigger than just a few months' separation.

If you get married in the middle of filing the K-1, you WILL have to start all over again and wait for the K-3. If you lie, you will get caught, and you will have far bigger problems. So what I would do is NOT make any wedding plans until the visa is in hand. I would file for the K-1 when I was eligible and then WAIT....patiently...until it was approved before moving on to the next step and getting married.

Yes, it sucks you can't get married when you want. That's the problem with marrying a non USC and that's what everyone on this board has gone through. Deal with it.

That depends on why the tourist visa was denied. If it was denied because your fiance couldn't show proof of ties to his home country, then no, they won't be taking it into account. If he was denied for drug offenses or some other heavy crime, then they probably will.

There are different kinds of fingerprints you can have taken at the interview in Juarez.

Everyone has fingerprints of both index fingers taken at the interview when the consul officer calls you up for the questioning portion of the interview. Very painless, it's a touchpad that glows red which you just press your index finger against when told and the consul captures your print. As far as I could tell and have heard, everyone gets these. These are free.

If there was a hit on your name when it went through the security name check, you will get another kind of fingerprints taken. Not everyone gets these, but many do because of the commonality of last names in Mexico (and I think because of the percentage of Mexicans in the US illegally) If you are lucky and the consul officer is feeling generous, you can have these fingerprints taken electronically which means the results should be back that same day or the next work day. If you're told you're being sent for fingerprinting, ASK for the electronic prints. I did for my husband, and we think it saved us a 2nd trip to Juarez and many months of waiting. If you have to file a waiver, generally you do not get the option of the electronic prints. Instead they have a 2nd kind which is with the good old ink pad and turns your fingers black for a long time. These are sent off and people will have to return appointment months later. Either of these cost $85 USD plus some (this was the price a year ago, it may have changed now)

There is yet another kind of prints that are pretty common at Juarez but most people have never heard of. I hadn't before we had to go get them for my husband. These prints are taken after the index scan and the electronic prints. They call them the bridge prints, and they have to be taken at the actual border between Juarez and El Paso. I don't know why they are needed but we were told there is a different print database there which has to be checked. These are free but you have to pay between $25 -$40 for the cab ride. Walking is dangerous because there are people waiting on the bridge who may try to steal your papers (and it looked like it was true when we passed them in the cab)

The key is not to freak out if you have to have the prints. Tell the truth, grit your teeth (if you have to) and smile, and just trust that the prints will show that what you're saying is true. It worked for my husband and I, as his K3 visa was approved after 2 very long days of stress and worry at the consulate.

How did you know when your husband had the 5 yr. ban or just a denial? My fiance was simply told to reapply for his visa in one year. And after sorting through all of his paperwork, I don't see anything that says a 5 yr. ban has been placed.


He was told plus the paper he was given by INS said it. It said Expedited REmoval at the top and stated the clause of law he was being accused of violating- I dont know the form number though.
