Hi,

I'm a bit confused by the info on this page here at VJs,

I'm looking it over and I see it says to send the i-134 amongst other thing once the NOA2 arrives. The NOA2 is something the non citizen gets from their consulate right?

The reason I ask was I've been checking the USCIS status site (http://www.visajourn...t/k1guide#proof) and finally got approved March 7, 2012. It says though that they "mailed me a notice that we approved this 129F PETITION FOR FIANCE(E)"; but that's not NOA2 right? Or is it?

Should I wait till she gets her letter or can I send it now? Thanks all!

You can & should look at the P 3 requirements. Find them on the embassy web site. Send her the 134 form right now along with at least one year tax transcript.
You are going to get NOA 2 which is what they told you. That means the case is now at NVC where it will reamin for only a short time. It then is sent to BKK where it arrives at the consulate section. They forward it to the visa section. When you are sure its there you can submit the P 3 docs. Those will include a police report & her medical. The submission of those docs triggers the interview date. That date will be about 60 to 90 days later.

Hi All,

I am visting my fiance in Thailand, and working on getting everything together so I can file as soon as I get back to the States. I have her birth certificate and a letter of employment from her current job, both are in Thai. As I understand it, any one can translate documents to english if they fill out the small form that says they are fluent in both langauges? I just thought the person translating might have to have some certification? Your thoughts please.

We will have her letter of intent to marry and the info that she has to fill in on the forms. You know how it is, always afraid you will forget something.

Review the requirements for filing a K 1 case again to make sure you are clear on what & when you need to do. See the guides here on VJ.
You dont need the things you list at this time. You dont need a letter from her employer at all. However to answer your question I have copied the accepted form for your review.
The "certification" is simply the statement you see here. Since you are there it may help to get the translation done anyway. Beware of agencys charging high fees to do such things.
You are many months from needing package 3 items but you could review them with her now. Find them on the embassy web site. You should prepare to understand the use of the 134 form. In addition its a good idea to attach a tax transcript to the 134 but its not required.

Actually, people are often declined because of past events. Six days or even one day is enough to qualify to file the petition but to obtain the actual visa is a judgement call by a Consular officer. If it is possible to arrange another visit before or at the time of the visa interview, that would be a very good idea. If not, be certain to document how and how frequently you communicate and be very well prepared for the interview.

I was talking about this specific case. In my own case I was denied for a tourist visa 3 times. Those denials had no affect on my visa. Even though we disclosed those denials there wasnt one problem nor one question about those denials.
Many people are denied tourist visas only to be granted an immigration visa later. I have seen this here on V J many times. What probably matter most in this case is excatly why the visa was denied. The O P left that info out. I have to assume it was due to ties to her country.

I met my fiancé online a year ago. After six months we decided to meet. It was easier to meet in the USA, but my tourist visa was declined. It was harder for him to visit me, because of his work. However he came and we spent 6 days in my country.

After we met in person we decided to marry and now we have ready the documents for K1 visa. We are afraid that the visa application may be decline because of the little time we spent together and the declined tourist visa. Are 6 days too less time?

We have a long distance between us for the next 6 months, so we think it is better to put the visa in progress, but we want to make the right decision …

You will not be declined because of the past events. The 6 days are enough to qualify for the K 1. You are on the right path now. Use the guides here to study the procedures. Then post any questions you have so the members can be of help.

Yep a lil bit. My co sponsor who he is my fiancee's stepdad, he is a president of a bank in latinamerica. He lives in Miami most of the times but works in Costa rica (where the Corporate Headquarters is) he has to travel at least once a month to San Jose. He's an american citizen, with his residence in Florida. He pays his taxes every year. He also have other bussiness in the US.

My fiance makes 56 but taxes from 2010 where wayyyy less cause he was unemployed back then. That's why we rather to take his stepdad as co sponsor, just in case. But his stepdad (my co sponsor)submmitted taxes from 2008, 2009, and 2010. He has no W2 (I thought he had) but he doesn't work in the US. But instead he gave us a job letter and his bank letter. He asked for an extension for his 2011 taxes. I hope that it shouldnt be a problem

Your fiances current income is what is most important. He cant support you from what he didnt earn or from 2010 income anyway. 56 K is way more than is required. All he needs to do is verify that income & the fact that he doesnt owe the IRS.
You still dont acknowledge the fact that the embassy may or may not even accept a co sponsor. Ignoring the possiblity could result in diaster. That could be a bigger problem than his tax status.

This is very difficult to understand & follow. This co sponsor is a citizen of what country? And lives where? From what you say he is paying taxes in the USA. Is that correct? Your worry should be if the embassy allows a co sponsor; then if that income is generated outside the USA.
Again if your fiance makes 56K there shouldnt be a problem as long as his taxes are paid.

Hi Vj'rs my interview appointment is in about 10 days. We have everything set up, but we are concern about taxes. My fiance and I think we have everything to have an i-134 without sponsorship. He makes 56,000 per year and his accounts are`perfect. But 2010 he was without a job and that year his taxes wasn't that good. The point is that we rather to take a co sponsor (just in case) but when he gave us all the papers he submitted taxes from 2008, 2009 and 2010. He hasn't have his taxes from 2011 (he ask for an extesion until october) so instead he gaveus W2 for 2011 taxes.

Is that ok? I mean he is giving 3 years of taxes and w2 from last year. Or should he be submitting taxes from 2011? I don't know what to do.

Im scared that maybe we do need a sponsor but we don't have his taxes from 2011, and embassy may ask for it and we only have his w2.

Should I be worry?

As far as I know it isnt required to submit tax info with the 134 but it is done in many cases. At my embassy they request tax info most of the time for example but it isnt required. Check with your embassy
One question would be to find out if the embassy would even allow the use of a co sponsor. Some do, some dont in K 1 cases. Doesnt sound like you need one anway. However I dont understand the meaning of " the point is" sentence. It seems to indicate someone gave you tax info for 3 years.
What may be needed is your fiances' tax transcripts for at least one year. If the most recent year didnt fairly reflect his income then he should supply more years to create an average.
If he is going to submit only tax forms & not transcripts those forms must include all supporting documentation. Submitting a W 2 only will probably result in a request for more info therefore a denial until its submitted. If he is going to get an extension for 2011 it is then correct to supply the extension info.
Contact the IRS by phone, on line or in person to obtain the free transcripts. Get them by fax, mail or in person at any IRS office.

Hi All,

I was in a bit of a rush, excited as I was, I put the address as

120-122 Wireless Road
Bangkok Thailand,

on my fiance letter of intent and my employment letter from my employer, which I sent to her 2 weeks ago now.

Instead of

95 Wireless Road
Bangkok Thailand,

(both address are valid but I believe the 95 one in the non immigrant Visas and the other is for everything else (?)

Is that going to be a big deal since my fiancee is the one mailing it and she will mail it really to 95 Wireless Road along with the rest of packet 3. Do the reviewers care that much for the address?

As long as it arrives at the correct address it should be ok.

A co sponsor that is a USC can be used. Your fiance will have to deal with the tax fraud unit of the IRS when caught so factor that into your future plans.

MC is the only case I know of where a court order was used succesfully. I hope the questions I posted will be answered so others can understand how it was done.

A letter from the dad is not needed, if mom has a court order from the Thai court giving her full custody of the child. The document needs to be translated into English. We did not have to deal with the children's father at all.

Then you assume this person has such an order & that the embassy will accept it as they did in your case. In two cases I know of they would not accept the court order but I do not know why. One couple I know of spent 10k trying to get such an order. How much did you pay? How exactly did you obtain the court order? How long did it take?
If they dont have an acceptable court order the father must sign & probably appear at the embassy.

First of all, I would like to thank everyone who has put together this site. It has been a HUGE help for me. My question is aout the K2 visa process. While, your site has given me a clear understanding of what a K1 requires, I cannot find many details about the K2. My questions are:

1. Do I all I need to do is add the child's name to the I-129F form that I am submitting for my fiance to get a visa?

2. Are there any other forms I would need to fill out and submit for the child?

3. Do I need to send copies of the child's passport and birth certificate as well?

4. Is there an additional fee I need to pay at this point?

Any help that could be provided will be greatly appreciated.

The embassy will require a letter from the father of the child allowing the child to leave Thailand. They will require this in both languages. Many times they also require the parent to come into the embassy to be interviewed. Request a copy of the sample letter from the embassy.

BKK does not accept co sponsors for K 1 cases most of the time. You will supply the 134 form as to support. You asked about success based on your assets. You have enough but if they question that she will not be able to answer & you will not be there to do so. The intention of the letter is to express what you plan to do & that you understand USCIS will be reviewing the situation as part of the future AOS ( adjustment of status ). In doing that if you for example didnt have a job or had low income you could use a co sponsor. This should serve to inform them that she will not ever need govt assistance which is what the whole support aspect is about.

Thanks for reading my post and I am most grateful to all who reply with help and suggestions.

My questions is in regards to the Affidavit of Support income requirements as I am currently residing in Thailand with my Fiancé for whom I have already submitted an I129-f K1 petition.
I am not clear as how assets count as meeting the support requirements as I currently have no job/income. I have substantial savings in cash/stocks of about $175k at the moment which by my calculations would clearly meet the support requirements alone since my Fiancé has no children.

I currently have no debt/mortgage, do not own a home, and the savings I have established were from working as a contractor in Iraq for a little over 2 years. My credit report is clean except for a $57 unpaid doctor bill (I paid it).

I can show income (from tax returns) of about 99k for 2009, 140k for 2010, and about 40-60k for 2011 when I quit my job (hey, we can't be in Iraq forever).

My parents have even sent a notarized letter stating we can stay at their home rent free for as long as we wish.

Has anyone been successful qualifying solely on assets (especially in Thailand) without having active employment? Also, can I count stock dividends as income?

Everything else is pretty case closed as I have been living with her in Thailand over 6 months, have proof of trips to Bali and around Thailand over the past year and 3 months, and have only a year age difference.

Any thoughts/suggestions/comments/questions?

I agree with Penguin. But I would add it may be a good idea to write a letter expressing your immediate plans for support. Meaning X amount of cash set aside to cover the time until you have found work. In doing that you can also explain that you will file the AOS which includes the 864 & the ability to use a co sponsor. This gives the govt assurance that she wont need U S govt assistance. Remember she is inteviewed alone & may not be able to explain anything about your lack of income, future income, ect.
Your case will hinge on support & nothing else because of your unique situation.

The first thing to do is check yourself with the embassy in Manila. You will find they dont accept co sponsors in K 1 cases. That will save you the time & money for filing a case that will be denied.

This is my first time here. My friend suggested I travel to Thailand to see my fiance a 2nd time.
We just got our initial receipt for K1 on April 16. My question is can she apply for a tourist visa
to come visit me this summer and could this count for our 2nd visit. Are there any pro's and con's by doing this?

There is zero chance she would ever be granted a tourist visa. She can apply at any time & as many times as she wants. The resulting denials will not affect the K 1. It will affect her mentaly which is something you wont be able to help her with long distance.
Many K 1s are approved based on the one visit requirement. Visiting her more than once certianly helps the case but isnt required. There is no reason to believe she wont be granted the K 1 visa as long as you both follow the procedures. Begin now to document your relationship while educating yourself about the requirements of presenting your case.
I suggest you buy a copy of Thailand Fever from Amazon. Have her find on in Thailand at any book store that supplies books to farang or send it to her. Spend your time investing in your futures. Have her begin to study the USA, its people & English.

I should have made it clear that I was specifically asking about the BANGKOK embassy in THAILAND. It seems apparent that procedures vary greatly from one location to another. I especially would like to know if the Packet 3 information can be hand delivered to that embassy or if it is required to trust it to the postal system.

In the past it was all hand carried in the day of the interview. Now it is mailed in with the exception of the medical & relationship documents. The reason for this is to give the officers time to review the material prior to the interview.
Keep in mind that this is done in many cases with few problems. In my experiance with the Thai postal system things went well. I dont see cases here on V J where people complained. Andi for example recently did exactly what is required with no problems.

Anytime people go outside the procedures they may suffer a set back. There is risk involved in what you want to do.
The current procedure indicates sending in the docs contained in P 3. If you dont do that they may not set the interview date. To find out what they want in this situation your fiance can go to any Thai post office to buy a special pin number that will allow her to call directly into the visa section to ask questions. The questions should be in general form & not specific to her case.
Could you fill out the forms & scan them to her so she could mail them in? The problem may be your 134 which needs a wet signature. Its best to include at least one years tax transcript with the 134.

Notaries simply verify signatures. They have nothing to do with the content of a document. It would server no purpose for someone to submit a 134 other then their own so a notary isnt required.

I met my fiance through a social network called Hi5, four years ago. We exchange numbers, we chat online, I've travel on numerous occasion, he proposed on new years, everything is wonderful and we are growing closer together and would like to have a family. I am submitting the petition for a K-1/k-2 visa today (wish me luck) I followed all the steps and I have been traveling to the Dominican Republic quite often. He has a fun 3 year old son and we developed a great relationship. My fiance has has full custody and the kid is very smart and alert for a 3 year old, sometimes I wonder if he is really that age LOL. Anyhow the issue that I need help with is once I submit the petition and everything goes ok, do we need a sign consent from his biological mother eventhough my fiance has full custody of the child?

I was thinking since we have court papers saying he has full custody of the child, that we don't need to have her sign a document so he could travel.

Please advise! Not sure what to do.

Make sure you check with the embassy there to understand exactly what they want & will accept.

It doesnt need to be notarized. Notaries verify signatures while having nothing to do with content.

This is almost impossible to do when you are dealing with Thailand. Your pending petition shows intent to immigrate so there is no way to prove you wont simply stay inside the USA.

I tried to look around a bit first, sorry if I'm missing something obvious. But is there guide that discusses K1 interview prep? It would be for Thailand if it makes any difference

I'm trying to decide quickly if I want to use a visa service or attempt on my own with VJ support. I'm confident once I get Wila I can AOS, etc. without professional assistance. But I up to that point I'm nervous, I don't do anything that will keep us apart any longer than need be and want make I can provide Wila with adequate support to handle vaccinations medical, interview prep successfully.

What you are missing is experiance. What you have to replace it is V J. Just relax,learn as you go & you will do fine. The last thing you need is a visa service. They provide almost nothing and add to the confusion as you filter everything thru them.
The work in doing this is in the documents understanding the process. Neither is that hard especially if you have some support. The decision about her visa is really made based on the docs being correct rather than the interview as long as there isnt anything out of the norm.
The packet 3 docs are fairly easy and you have many months to get them ready. See the 134 support form to begin to understand that part.
The medical is easy for her. She will need a police report later in the process so plan on that.
Send in the basic forms when your ready. Then sit back & relax while you learn how to do the next steps. There are many members here to help you along the way.

You probably can attend the interview without the medical by telling them up front you dont have it. They will not issue the visa until it has been submitted. The medical will be complete in one day and you will have the results before you leave. The difficulty will be getting that info inside the embassy.
Go to any Thai post office to buy a special pin number that allows you to call inside driectly to the visa section. Do NOT ask them questions about your exact case. Ask in general terms only. Ask for example-- If someone didnt have the medical what would they do ect. Ask how someone would then submit the docs to them.
In my own case something like this was needed. The officer told me to call them when I had the docs. I did so & they met us outside the embassy to take them simply because it was the easiest way to get it done. In my case they were correcting a mistake they made but still it shows you what is possible.
Also try using visasbkk2@state.gov as thye email. The other is screened by Thais while this one is more direct.

I've been reading a lot on VJ and have almost everything ready to send out but I was told by a few people that I do not have enough photos. When I read the VJ guide lines they specifically say to send 2 - 5 photos. I am sending 6. I've gone to Chile to see my fiance for one month in July and three months Dec - March. I have 2 photos from July at very well known tourist places from Chile. And I have 2 from Dec - March also my fiance and I in very well known tourist places. Then I have one of my fiance, his sister, her daughter and myself outside of his families home in Chile. And finally one of my parents (went from NY to Chile to meet my fiance and visit their family (my parents were born and raised in Chile)), my cousin from Holland, my fiance and I on a boat tour through Chile. Do I need to add more? I just don't want to add a million pictures since I know when they are reviewing my packet for approval they maybe spend 10 - 15 minutes reviewing it. So my question is should I add more pictures or am I fine since I have a lot more evidence. (Passport stamp, itineraries and so on)

I think you have the right idea about this. Picture yourself as the reviewing officer. They dont have time or need to see a hundred pictures. The quality of the pics is more important than the quantity. your situation is pretty unique in that your parents went there ect. All of that will carry the day when it is time. The foundation of your relationship is whats really important. Yours is very good & well done.

we are ready to begin our journey through getting approval for our visa, but i have a question that i hope someone could help me with. First a little background. i met my fiancee in feb of 2011. she got pregnant in may of 2011. we got engaged in nov of 2011. i have been to manila to see her a total of 6 times with the last time being in February of 2012 when our son was born. i was going to submit our paper work in November before the baby was born, but we felt we didnt have enough pictures of us at that time because the pictures mistakenly got erased from her camera. we then decided to wait until our son was born before we would proceed. I was going to make another trip in july and during this time, i would have "report birth aboard" and got him his us citizenship. i have to postpone that trip until September. i am now redoing our paperwork that we did in November to submit next week.

my question is, do i need to add my son to the k1 visa application since i intending to get his US citizenship in manila? should i wait to do him first and then submit for her K1? i am hoping to have the greatest x-mas ever so i want to send the k1 app next week in hopes of them being here by then. any help, directions, or comments is greatly appreciated.

No reason to wait just because of pictures with your relationship background. Send in the petition asap. You may be too late for the Xmas anyway.
The child doesnt need a visa if you get him U S citizenship. He cant be put on the K 1 as a citizen of the USA.

My dad and I have a recurring discussion about this topic and I want to understand once and for all, so if anyone could share an answer I would appreciate it :)

I read in many places that K1 visa is the fastest and safest route out there for someone wanting to bring their foreign fiance to the US. (Which is why I chose it)

My dad continues to insist that petitioning for K1 visa is stupid and a waste of time because my fiance already has a tourist visa. He says fiance visas are mostly for people who don't have any visa (no other way of coming to US). So he thinks it would be faster for him to come to the US with his tourist visa, and marry me after 2 months, then get the residency. He says that everyone he knows has done it this way and that it has worked out for all of them.

My reply to him is "What about after marriage? with fiance visa he can stay, but with tourist visa he has to leave the US" But my dad replies saying that he can keep renewing his tourist visa for 6 months until he gets his residency. (Is this even true?)

I am not very knowledgeable about this topic so I'm not sure how to answer him...so what do you guys say?

(I already sent in my K1 petition so this is mainly a question just for curiosity's sake!)

EDIT: Sorry about the topic...I'm not sure if "K3" was the correct term, what I meant was "just coming to US and marrying as a tourist"...as I said i'm not very knowledgeable!

Your dad is simply wrong. He is advising you to commit visa fraud. When you are caught you will have a lifetime ban to deal with. Of course that will allow plenty of time to discuss with him what the laws of the USA consist of.
Just stay within the laws to get what you want. Dont lead a life where you have to worry every day about what you have done & what you will have to do.
You have done what is correct. Follow this path to the future you see for yourself. You will leave the ignorance behind as you gain knowledge & have confidence that you have done this the right way.

Prepare yourself for whats to come. You will call NVC only to be told they dont have your case. You will go back to the fear factor. USCIS will tell you they dont have the case either.
The last event at USCIS was to place a bar code on your case file. Until that code is entered by NVC your case seems lost in the black hole. No one can find it.
Your case will be entered into the NVC data bank asap. If you case is a K 1 it will pass thru NVC pretty quickly. They forward it to the consulate in BKK. The consulate section will forward it to the embassy visa section. That takes a few days. The visa section will send notification while requesting P 3. Sending P 3 triggers interview date.
You can download P 3 at anytime. Do not send the docs in until you are CERTIAN your case is in BKK.

Hi,
I was told that my case has been transferred to the embassy in bkk. I have been going through the packet 3 and getting my stuff together but i just found out that i cant get police clearance without a cover letter. It is to my understanding that it takes 2-3 weeks to get police clearance
Questions are:
Is that true?
Do I have to send back a copy of the police clearance as well when i send back my packet 3?


I live in Bangkok and would love to talk to someone with a similar experience who has already managed to get an interview date. I dont want to go wrong and waste any more precious time. Posting the same questions several times will only serve to confuse you or others.
Its true that it takes that long. If you were just there and talked to them why do you ask? What did they say?
You are the only person I have seen in over 5 years that says they demand a cover letter. Where are you going to get this letter? Did you ask them to see an example?
Many people that passed thru the process and were helped here on VJ used the NOA I suggested you use. Yet you say you tried some letter from NVC. If you take them something they never saw before you can expect the result you got.
I already explained to you how to submit the police report so dont understand how you can be confused.
I hope others can help you of course but its unlikely that a Thai fiance will know what you should do. Most know little of the process.
You can help your self by going to any post office where you can buy a special pin number that allows you to call directly into the visa unit of the embassy. If you do that you MUST not ask questions about your exact case. Frame the questions in general manner or they wont respond.

OK I called BOTH the 1 800 829 1040 # and the 1 800 908 9946 # both went to same place the latter # got you there a little faster. I called them both and entered all my requested data and waited 10 business days. 15 business days later I got nothing so I did it again and again 15 business days later I got NOTHING but 6 weeks wasted time. I went to www.irs.gov and did this ONLINE then did the online survey and told them how the 800#'s failed me too. Well you guessed it... 15 business days later I got NOTHING! @$%*@&^$*#%@#&$!!!

So I called the first 800# then pressed Zero to operator and was on Hold and listening to recordings for nearly 25 minutes. The guy answers says his name and employee # then "How may I redirect your call?" I tell him all above and then says he will transfer me to someone who will fax it to me in real time. GREAT :)

So another 20 minutes of listening to recordings and then lady answers the phone with her name and employee number. I repeat the above facts, she then gets my SSN, Name, Address, Birthday. She says then says what is the purpose for the Income Tax Transcripts? I say USCIS, Dept of Homeland Security and DOJ for VISA. She says please hold. 5 min later she asked where these filed by Mailed IN or Electronically for 2009, 2010 & 2011. I say 2011 & 2010 were electronic and 2009 was mailed in. Put on hold again. 10 minutes later she says she has found them and could they be faxed in the next 48 to 72 hours? I reply NO WAY not after all of this and nearly 2 moths of trusting your systems NO WAY. Also the guy who transferred me said they would be faxed real-time today!!! A long pause then I hear her exhale abruptly and say "I will have to walk to the printer now". I stayed on my cell phone while these were faxed to my home phone line and Fax Machine. Each year was about 7 pages so 21 pages later I have them :)

DO NOT WAIT UNTIL your NOA#2 then start to get these you might be severely delayed. Yes many have had the 800# work for them... But I would try it once then do website same day then 15 business days later you got nothing then see above. GOOD LUCK :)

People can also just walk in to any IRS office & get them handed to them there. Our arrived by mail in 8 days.

My fiancée is so stubborn that he doesn't want to change from K1 to DCF. -_0 too bad...
For me DCF is the best choice so far as it save money and time.
Guess I have to pray for CSC to approve my case soon...

To qualify for the DCF the USC has to be considered a legal resident of Thailand for at least 6 months. That means he may be able to do as Karee suggested by obtaining a O type visa and waiting an additional 6 months then file the DCF.
What you see as being stubborn may be that he is simply more informed than you are. I think it would be a mistake to begin the try to qualify for the DCF at this late date. The K 1 would be faster in the end.

I have a problem with my birth certificate. It does not have a name or surname on it. I need to certify or notnotary birth certificate. Does anyone know where I can go? Do I need to go to one that the US embassy recognizes? I have found a lot of answers to my questions here and hope to hear from someone on this matter. Thanks for your help

I never heard of a B C with no names on it. You will need to begin with the Amphur in your area or the city hall.

Good point, the wait is 6+ months either way if perhaps marriage and the standard cr-1. Point being the 864 seems to be preferred to consulates who don't often accept the 134.

The 134 is accepted by BKK in every K 1 case I have seen for over 5 years. What is important here is to understand they dont often accept co sponsors. to have a chance the planned approach must be near perfect.

By the way, why not get married in Bangkok, and in 6 months file the DCF?

He would have to be a legal resident for 6 months to be able to file DCF. That would require a O visa or similar.

-(this is the petitioner speaking)- I told my Fiancé not to post on these forums because most people on here are much less informed than we are. We already know the answers to these questions but my fiancé likes to be thorough with everything ;0. Anyhow, we will not be lying about anything in our paperwork as I will be getting a letter of employment from from parent's business as they are in need of a replacement employee since their last employee was let go. Sorry to waste your time as we do not have any questions here.

It probably doesnt matter to you now but if you read what G wrote it does seem to suggest you intended to say you ARE working for your mother. Ahn Map is a well informed and respected member here that was responding to what is written. Some people may not be well informed but he isnt one of them.
I dont think you have wasted anyones time if you or your fiance gained some insight. For example the fact that BKK almost never accepts co sponsors. This is a very important point in your case. If you truly knew the answers to all of this maybe she should have just discussed these matters with you. It is odd to me that you have petitioned for a K 1 knowing they may not accept a co sponsor. Then again maybe you do know more than we do.

Hi there,

I heard that nowadays BKK consular rarely accepts the co-sponsor for K1 visa and that makes me worried.
My fiancée served for US Air force in Anchorage AK from 2004 - 2010 and for that he has gotten a GI Bill which means he can study anywhere in the world and the US government supports for his tuition fee and pocket money depends on which area of the world he lives.

As a consequence, he did not have a job since he keeps studying. However, his mother has her own business as a dog breeder in IL and that makes lot of money. His father works for US government as an Auditor.

So my question is what should I do between asking his mom to be co-sponsor or ask his mom to write a letter that he is her employee who has a salary xxxxx/year? (of course the salary he get should be above the poverty line)

I understood that the US government wants to make sure that my fiancée can support me and I won't become a US government's burden.
Actually I also plan to apply for the job with Nestle USA as I am working for Nestle (Thai) Ltd. now.

It is true that in most cases they will not accept co sponsors. However they did in 3 cases I know of. I know this because I helped write letters for them to submit explaining how they would be supported in the future. Those cases were approved and they are here in the USA. Those were all K 1s with student fiances.
Your fiance can show a history of working in the past. He can submit a letter indicating he is a student on the G I bill. He could tell them his plans for finishing his studies and going to work including a timeline. He could explain how he now recieves some support from his parents until he finishes school if thats what he does. He could explain what support you both will require from his parents including the initial burden of living expenses for you both. The important thing is to lay out a plan for how all of this will be done to offset the idea of you becoming a burden. Doing all of this is far beyond the usual. His parents would submit a 134 or a 864 along whith his 134. Nothing is certian in doing this but its the only chance you have.
He must be careful if he indicates he has a job with is mothers firm. If that isnt true it would spell disaster. If it is true he will need to submit his pay history and tax info to prove it. He would add that to the tax transcripts he should submit with the 134. His mother would add her tax transcripts to her support docs.
You could write a letter indicating the possiblity of transfering to Nestle but make sure you explain you know this wont be possible until you can legally do so. That wouldnt be until you had an EAD or green card. You wont have those until you submit the AOS. This usually takes 6 to 9 months.

My husband lost his job in March of 2012. Is it ok for me to use a co-sponser? Should i still send my hubby"s 2011 tax returns and w-2 he got b4 losing his job? please advis. thank you

Attempting to decieve them with false info will result in a very serious situation. Just submit the docs with the current info which is also the truth.
Check with the embassy to see if they will allow the use of a co sponsor.
