K-1 Fiance(e) Visa Process & ProceduresPre-Application worries
If your fiancee will still be in college once she sends the I-129F(petition) that's no problem. However, when you have to go for your visa interview at the embassy abroad she will need to send her 3 last tax returns accompanied by a letter of employment on company letterhead from her employer. If her financial status is not enuf to support you and her, she will DEFINITELY need a co-sponsor. So maybe you guys may want to look into that right now.

K-1 Fiance(e) Visa Process & ProceduresDECLARATION OF MEETING DRAFT

Attn: Sklind
Yodrak and others.

Hi everyone,

I have been away from this website for long time. Sklind, your declaration on is fine but you have to explain more how you met and started communication, before the actual physical meeting. I have my post here on our journey through the whole process. So you will be fine when you add the online meetings.

However, I wish to comment on Yodrak suggestion of retaining an attorney in Nigeria. That is totally irrelevant and may even jeopardise your case. Nigeria embassy lay more emphasis on your personal ability to proof your case rather than through an attorney.

Because, the embassy is concerned with your safety and how truthful is the fiance intention to marry you. A lawyer cannot proof that its him(the Nigeria fiance) and not even you. Adjudicating Officer will strive to find this fact of his intention during the interview. You cannot not proof what is in his heart. My dear it is difficult for you to do that. Of course the meeting and the joy and witness will be there when you arrived Nigeria. But what is in the heart? You cannot uncover until long time later.

I say this because its very sad how my country folk behave all in the craze for a GC! After my arrival here other readers of this site have followed my way. I received emails and phone calls offering advises. About three couples succeeded. But can you believe that out of these three others. I am the only one still trully in marriage till date? Those others marriages have broken up. ......the sunny&ruthan, rotimis, afrodikes and so on. Make a research. I am not trying to expose anyone but....the truth has to be told. If he is truly the one for you good luck. Getting over here is one thing and staying in marriage truthfully is another. Good luck to you. Please you don't need any lawyer.

JJ

Well JJ i would like to add that many of us here (married to Nigerians) are very much still in love and still married to that same Nigerian. So you are not still "trully" the only 1 here in marriage. I got married shortly after u guys and my husband and I are still married and am very much still in love. And another thing, it's not very nice that u put other people's names out there like that.
Sweetee

JJ:
BTW; u should come over to the African Sub Saharan forum and u will find that many of us are still 2gether.

We changed addresses and it actually sped it up! because they sent out the packet straight away. We wrote them and letter and sent it express/overnight and also emailed them.

K-1 Fiance(e) Visa Process & ProceduresVisiting the US Visa Waiver Program

i didnt have no problems... i left germany on the 30th of april and im staying in the states until the 28th of july. they asked more questions than usual at the american airport and my luggage was double checked. but other than that there werent any problems....

questions they asked me:

are u a student?
how long u planning on staying?
who u visiting?
who u gonna b staying with?
who is gonna pay for the expenses?

yeah but how many times have you been to the US in say the last 2 years? they didn't ask me anything either when I went in but I have only been twice....I think thats more what he is worried about frequent visits.... :(

K-1 Fiance(e) Visa Process & ProceduresVisiting the US Visa Waiver Program

I'm not a student no. My Dad's self-employed and I sort of work for him off the record and Temp the rest of the time. I'm really worried now I've read all sorts of Horror stories about Officers turning people away for multiple visits. This is only my second visit though ever. I have no intention of staying after 90 days and have booked a return flight. As for supporting myself well I'm taking my ATM card but my Fiancee will be supporting me mostly.

Sh*t I'm really, really worried now. I don't want my Fiancee to be mere yards away and me deported back to England without seeing her.

oh sweety :(

I have been twice, both for 90 day periods...with no questions at all....either times...I was going to go back again for a couple of weeks while I wait on my interview but seeing I have to wait around till the 27th etc for my doc appointment now I'm wondering...I do know how you feel and this is major major stress and *bs*....I was worried the second time I went in even though my fiance was with me... :(

Now I wish I never left the US.What a mistake on my part....

If you hadn't left the US they would have most likely found you and deported you. Without sounding cold they way that you wrote that makes it sound like you just want to get back into the USA. Thats how it sounds, however I'm not saying thats the case, but some people may take it that way.

Like everyone on this forum you will have to wait no matter what...if you love him you will wait, so prepare yourself now.

Everyone here is right, get a lawyer because chances are they will find out pretty fast.

K-1 Fiance(e) Visa Process & ProceduresIs this NOA2

No, this is because of IMBRA your case is being transfered to California. Your NOA2 I guess will come out of California now... either way this is not an approval they are just notifying you that your case is comin out West.

WESTSIIIDE.

Grr that sucks... So do we have to start counting again or can we carry on from where we left off? We have already been waiting over 30 days for it. And we really dont want to have to start all over again.

I know that that im asking a lot but if its been moved over to there does that mean there is a problem with it or is this just a normal thing

K-1 Fiance(e) Visa Process & ProceduresIs this NOA2
Hi there,

I just got this e-mail and was wondering if this means we are at NOA2??

Our lawyers sent the I129F to Nebraska in the first place so im a little worried if this just means we need to start the clock again?

Message starts:
Application Type: I129F , PETITION FOR FIANCE(E)

Current Status:

On June 1, 2006, we transferred your I129F PETITION FOR FIANCE(E) to an
office in CALIFORNIA SERVICE CENTER for processing. That office has
jurisdiction over the case. They will send you a written decision as soon
as processing is complete. You should receive a notice informing you
that your case has been transferred to a local office.

If you have questions or concerns about your application or the case
status results listed above, or if you have not received a decision or
advice from USCIS within the projected processing time frame*, please
contact the National Customer Service Center.

National Customer Service Center (800) 375-5283.

*The projected processing time frame can be found on the receipt notice
that you received from the USCIS.
*** Please do not respond to this e-mail message.

Sincerely,

The U.S. Citizenship and Immigration Services (USCIS)

Im with everyone so far that is saying that Nebraska was quicker. When i changed the service centre on my timeline is added a week to the wait. I personally think that it is to do with getting centres to specalise in different areas. Well lets wait and see whats going on.

Ok ive finally got a reply from the lawyer.

We were transferred because Nebraska is getting very very busy and is now the slowest for K1 visa's in the country. According to our lawyer it should reduce the waiting time by about a month.

As for if we are going to the back of the line...im not sure. I am going to e-mail them again when i get home from work tonight... they have been very evasive with their replies saying that Cali is the fastest.. we shouldnt have to wait as long etc. No definite Yes or No on if we are at the back of the line re June 1st.

Ill keep you all posted

After getting such a quick response to my last post about my K1 being transferred and reading on the rest of the forums that a lot of people are going the same way i thought that i would help out a little.

I have e-mailed our lawyers and basically asked them the 2 questions that everyone else seems to be asking and waiting on USCIS to answer..

Why have we been transferred?
Do we go to the back of the line and start again with the wait?

I will let you know as soon as i get an answer

Hope this will help everyone

K-1 Fiance(e) Visa Process & Proceduresturist visa
I have spoken to our lawyers about the very same thing.. The best way to do things is for the Petitioner to visit the UK.. That way they cant say that you plan to stay as you have a K1 for UK to USA not the other way around, make sure you visit length is not close to the time limit on the tourist visa and you should be ok. I also reccommend flying in to UK airports early.
Mark HewittMaleUnited Kingdom2006-07-02 07:36:00
K-1 Fiance(e) Visa Process & Proceduresvisit to the UK???
My fiance is planning on visiting me in less than a month. Im gonna tell her to bring the NOA1 and things like that to show she is going to return. Also we have found that keeping the visit well under the 90 day limit on the visa is a good idea.

One final point, make sure that you have some cash with you, enough for a couple days stay and a credit/debit card.

K-1 Fiance(e) Visa Process & ProceduresLawyer's response to K-1 questions
In response to the questions I asked in this thread: http://www.visajourn...

I recieved this response:

According to the Intake Officer at Greer, you have two options:

1)When you and Dean enter the country, he may be asked why he is entering (business, pleasure, etc.). If you say, we are coming in to get married, you will probably be turned around and sent back. Coming to the US on a visa waiver means you do not have an immigrant intent (do not plan to stay here permanently). If you/he are not asked, don?t volunteer the information. And, if not asked, you can get married once here and file your permanent resident package and stay here. If he is asked why he is coming in, he should not lie ? this will set you up for failure later ? it is called visa fraud and he can sent home and barred from reentering the US.

2)If you are asked your intent, come on in and have your normal stay and Dean should return to the UK before the expiration of the waiver. While here, file the fiancé visa petition. Once it is approved, Dean can apply for the fiancé visa at the US Consulate in the UK, come back to the US and you can get married within 90 days.

Does this make sense to anyone?

K-1 Fiance(e) Visa Process & ProceduresAttending fiance's interview - suggestion

The Russian Embassy doesn't allow anyone except the Beneficiary into even the waiting room or so the site says.

Im thinking of going anyway and sitting outside on the curb. I want to be there for her, I really do but the money part too is a big deal. I can get over there and back for under 1200.00. I'll just have to work extra hard and sell some stuff on ebay to pay for the airfare. If so it will be my third trip to Russia in under a year!

K-1 Fiance(e) Visa Process & ProceduresNOA1 dates
Hello AussieW,
so I look at our NOA2 now and see no Priority Date...it's blank. Is this ok?
Also a question about the NOA2's "Notice Type:"
Our NOA2 says:
"Approval Notice Valid from 04/24/2006 to 08/24/2006"

Does this mean her interview will be before August 8th? Ive looked on the US Embassy Moscow site and found sched. interview dates for May 27 thru July 27 and did not see our MOS ? WAC #. Ive been calling Moscow off and on for a week now and sending out emails and so far our case has not arrived. She told me it could be up to 4 weeks before they get it but I understand that DHL is quick from the NVC to other embassy. I can mail somthing from home to SPB Ru using Global Express and it gets there in 8-9 days tops. Any help or info would be great. Im just setting back and working my tail off waiting for our big day! :)
