I wish I had seen this post when you originally started it. It seemed like NOBODY understood what you meant lool, even though you explained it as clear as crystal. As soon as I started reading the responses I was like ' :blink:  confused face', that's not what they are asking lol. I'm not sure if they'll 'stop you', stop you because it's clear what your intentions are and it's evident that you have all the legal documents you need to stay for the allotted 90 day period in which you have to wed. Although I'm not a K-1 holder, I've travelled to the US quite a few times since my fiancé moved back September 2013. This year I've travelled 4 times and on one of my trips I only had a week back home before I flew back to America. Each time they just asked why I was there and stamped me and sent me on my way. Like I said that's not with a K-1 so that information was pointless lol. However I don't see why they'd need to stop you as they know that you're not trying to stay illegally, you're actually there with a Visa.

Nobody? Really? He explained it a clear as crystal? He asked about U S customs.

hi guys, i am flying in to America on oct 30th! i just want to know from you guys' own experience if people with k1 visa get stopped at the US customs? and by stopped i mean not just speak to the officer but get actually stopped by being taken some place else to be asked more stuff. i am asking if that is how it is for everyone with k1 visa because a friend of mine that is also from Poland was stopped and i just want to know if that is the case when it comes to all of us.

Your question is about customs which is different than immigration. Customs reviews what you are attempting to import into the USA. The " stuff " you bring in. If you don't report all the " stuff " or have " stuff " that isn't allowed you could be sent to secondary inspection.

If you are actually asked about immigration its possible they would ask some simple questions and you would be granted entry as many are. These things are done on a case by case basis so its incorrect to think its " all of us " as though there is something different about people from your country.

Hello,

 

Quick question - my fiance and I have received our NOA2 and the visa interview is next Monday (Oct. 20). I believe we've gathered all of the docs required based on the checklists I've found, but one thing I can't find is whether or not my fiance will need a police certificate from USA.

 

The reason I ask is because she spent exactly a year here on an internship, and the instructions say that if the applicant had ever spent more than a year abroad in any country, they would need a police record. Does this apply for her time in the US too? Anyone have any experience with this? I'd appreciate any insight anyone could offer.

Sorry If this is post on the wrong section, I really dont know where this will go.

 

I met boyfriend online on skype, and we were on long distance relationship for 6 months skyping then came to the US on new years of 2012 under a student visa (F1). He studed in here in the US until Apirl and back to his country. He then came back to visit me on the following new years eve. On may of 2014 I went to his country, down in brazil for the summer and now he's planning to back here in America and we are thinking of the possiblity of getting married and living in the US. What would be better?

 

 Trying to take the K1 visa or him comming here with a tourist visa that he already has and getting married, and apply for a change of status in the US.

 

What would be best if my boyfriend has already a toursit visa and came here a few times, I also went to his country down in Brazil once recently 2 months would it be worthy to get married in a tourist visa or should it be better for him to apply k1 visa in his country?

 

 

P.S I am currently of course from the US He's from Brazil

Your second paragraph indicates the intention of committing fraud when you refer to the use of the tourist visa as a means to immigrate. If you were to do this in this manner and were found guilty of visa fraud he could suffer a lifetime ban. The most important aspect of this is what his intention was when he crossed the U S border.

What would be best is a clear understanding of the laws so you can determine the best course of action. You can certainly marry while he is in the USA on a B 2. After understanding intent he can decide what his was therefore what should be done.

He doesn't apply for a K 1 anywhere; you do by petitioning for him to be approved for a K 1. You can not do that if you are married. If you are married you will petition for a C R 1 which results in a green card upon entry.

What I am talking about is how two cases yet similar result in different responses from the VJ community. Basically you are saying that one way to get a green card is to come to the US with the intent of leaving, and then suddenly, because the intent initially was to return, decide to "change" one's mind, marry and file for AOS? No wonder there is so much scrutiny regarding B1/B2 visas. What you are referring to is a loophole which has been abused. The mentality to use visitor's visas to AOS because they "met" someone on vacation or because they had an epiphany and would rather stay is bogus. It is cutting in line so to speak. You can do it, yet it doesn't mean it is right. Why even bother with a K1 or K3 if you can just "change" your mind upon entry? I say the OP should encourage her SO to go on vacation with a return ticket, and then "reverse" course and file for AOS based on your logic.

I know what you are talking about. What you have described in your " basically " rant is exactly correct. You are disturbed that you or someone like you isn't appointed the thought police for America.

Is there a " loophole " . Yes. You simply just stumbled across something that has existed for a long time. Unfortunately you are not in charge of right and wrong other than your own choices.

I can do it? No but many others can and will. You see I am proud to be an American citizen.

Why bother? Because some people will want to do what is right even though they wont ask you for permission. Another reason is the initial difficulty of being granted a tourist visa.

Please contact the O P by P M to explain exactly what you expect of them. You may find that one person in a million that will do what you think of as right and disregard the actual use of the existing laws.

My logic? No. Its the U S government that determines the laws by using the system we enjoy to create those very laws; not me. It is certainly true that the O P could use those very laws and a total understanding of the application and definition of " intent " to gain a green card.

Where is boiler and some other people saying: "well, life happens, just AOS"? How can one case be considered fraud, and the other okay just because the beneficiary was pregnant? (The Chile Example). I call double standard by some posters here. If the OP had said, "I hadn't thougt about getting married until one day it occurred to her she would have gained sympathy from the faction on VJ that encourages adjusting status with a tourist visa.

I don't know who you are talking about and it probably doesn't matter. What does matter is the law. The law that is approved by the govt. That law says if a person enters the USA on a tourist visa with the intent of marrying and then filing an AOS has committed fraud. That same law allows for those that enter, marry with the intent of leaving and change their mind and decide to remain can file the AOS to do so.

Again I don't know who the mystery faction is but I do know that V J has a forum that helps people learn how to legally follow the law to file the AOS.

The U S govt is responsible for the adjustment procedure. It seems to me that Boiler and others are just more aware of those laws and are encouraging people to use the in place legal procedure.

You are incorrect twice.

It is not illegal to enter the USA with the intention of being married. Its is illegal to do so using a tourist visa if the original intent is to remain and file an AOS.

most probably not...not including a boarding pass will definitely not get you an RFE...but did you include passport pages stamped? The USCIS just wants proof that you met within 2 years of filing...whether that is in the form of boarding passes or copies of passport pages stamped<this is a more authentic source than the boarding passes...
And about how you did not specify how you met online...did you write your statement of meeting on a sheet of paper? notarized? It depends on how much info you included, the more details, the better...but there is no saying Yes/No you will/won't get an RFE for this part...depends on the officer reviewing your file...
But no need to worry, you will be fine!

Hello everyone!
After 8 touches when I thought today was the day I was getting my NOA2, I got an RFE instead. Today I got the email notice for it, so should be receiving it in a few days. I think I may know what it is for after reviewing this wonderful thread. It might be for Part C #2, where you have to answer "yes" or ''no".

The thing is that I hired an attorney for the paperwork, and when I sent in my I-129F in August 2008, the form I used was this one: Form I-129F revised 11/24/06, and now, when I look at the USCIS website, the form is UPDATED as: revised 07/30/07 and the one prior to that (11/24/06) does not contain a section for the "yes" or "no" in part C #2, the newer updated 07/30/07 one contains this part to answer "yes" or "no".

Other than this reason for the RFE I cannot think of anything else, especially after extensive research here on VJ, nothing else comes to mind...so I will post back once I get the postal mail notice and hopefully I will be able to send back to CSC whatever they requested the day after, if not the same day, I was really hoping for my NOA2, and this RFE was a rude surprise!

Anyone else get an RFE for the reason I mention above?

That may be excellent advice for some situations, but not "always". In our case, we went through the whole process without ever sending in the USC's birth certificate at all (we used the passport to provide proof of citizenship).


Oh no. I sent only the "short form" of my birth certificate. Our state does have a long form option but it takes 6 weeks to obtain. And I didn't send copies of my passport pages.

Is it possible to make an addendum to an I-129F that's waiting for review. I already received NOA1 with case number. I wonder if I can "pre-empt" the RFE by sending my passport copies?

I think as long as you send it in with your A# on each page with a cover letter of explanation (also with the A# listed) they should be able to connect the file with your additional information. Make sure your names are on EACH page you send. Along with the phrase "originals available upon request"

Probably depends on the person doing the review.

On the USCIS.gov site, when I check on my/our status,... (I filed for an I-129F visa) it says on the site:

Your Current Case Status for Form I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

so.... these are government workers (no offense!) (Well... only if you see this comment online, here)
So, don't expect perfection. Don't expect excellence. And, don't expect consistency!

That's why so many variables get thrown around here.
There's no consistency with anything to do with these visas, it seems.

That may be because EVERY CASE IS DIFFERENT.
And, also because of the factors sited above.

Government sucks.

Kenshaq,... I looked everywhere, and I'm going by some sense of memory because I could not find on the uscis site, about whom to make the check, and there is, IN FACT, if you peruse the uscis site, a discrepancy about the amount. One place there, it says 340. another place it says 350.

I did this once before, about 4 years ago. For the most part, things remain the same. But, it was scary then, and NOW?! for even a few rules to be changed, and then, you see a discrepancy on the uscis website, and that makes it even scarier.

I didn't have any problems (she had NO problems) back then. I sent in about an inch and a half or more thickness, of all my paperwork and it was all real organized, all the i's dotted and t's crossed. And, then... HER INTERVIEW WAS ABOUT 2 1/2 Minutes,... Visa Granted. No problems. But, I guess everyone else can relate,... you just hate the thoughts that you messed up (I'm an old ideal perfectionist, afraid of failures), and then it takes an extra2-4 months.

So, I'm jus trying to cover all bases.
This time, it's about the same.
Clean as a whistle.

But.... I'm noticing a few changes.
And, that stuff with the ONE G-325A and ONLY ONE PASSPORT FOTO,.. rather than 4 of each,.. well, that's jus freakin me out a bit....

jajajaa... I'm thinking ... send four of each anyway, and send $350 and tell 'em to KEEP THE CHANGE...

(for me in Louisiana, 3 years ago, it was 'sent to Mesquite, Texas)

Or, can you take your K-1 package to Regional offices?
(like I know there is one in New Orleans, a few hours away from me)

I just spoke with one of the counselors out in San Diego at easyvisa.com, and he said he'd never heard of the G-325B form, before. (but, yes,... there is one! and it's two pages long.) And, he said yes, he actually works on cases. (so, ... he should know.)

And, he said yes! the price has come down to $350.00.
Unbelievable.

And, so that must be why (he also confessed) times from sending in initial paperwork to the time of interview is running about 7 months (to Colombia/usa), even though he admitted they 'say' 5-7 months.

And, if there is no requirement for the G-325B, then... that eliminates my last concern posted at the bottom of the post just above this one.

I'm USA citizen, filing for K-1, I-129F, for colombiana again.
Different person.
Everythings clean.
She should have no problems.
Not a young girl, but a lady (at least by age).
Her sister introduced us.
No marriage brokerage or agency stuff, here.

Someone has told me that you now have to file a G-325B form.
A) Is that required?
B) If so, is it in regards to me (the one filing initially), or in regards to her (the one I'm filing for)?
C) If so, is the second page to be filled out by me? or, by 'the Authorities'?
I've read all through everything on the USCIS.gov site the past week and it does not currently say
anything about filing this form G-325B.

Secondly, I see, even on the USCIS website a few nights ago, there is conflict of information in regards to current cost of filing the I-129F. One page says $340.00 (us), another page says $350.00 (us). When I filed in June of 2007, it was about $180.00 and I thought it went up the next month to $450! A year and a half ago, someone who helps with the visas in Colombia said, ... $450.00.

I'm completely and pleasantly surprised, of course, if it's come down to the $350 range.
Anyone just filed know the correct answer?

I've got yet just one more concern, but I'll have to check the details, to ensure that I properly state my question. Thanks for anyone who can help.

never mind; I figured it out, Request for Further Evidence.
My evidence was about an inch and a half thick, when I sent it initially, and so I guess maybe that's why there was no RFE. ... The interview consequently, was about 2- 4 minutes long; visa granted.

But, I need a little help, with a few questions about changes, this time around.

I did this (fiance visa process) once, very successfully, without problems, about 3 years ago.
But, I asked the lady to return (to Colombia), which she did.

And now, I'm filing for another colombiana, and THERE ARE a few changes in some of the paperwork requirements.

I hope I'm posting on the correct part of this site, in order to get some help with just a few concerns about some changes to filing.

Hi, I arrived here in the USA with my 11 year old daughter on a k1 visa. I just married my American citizen husband and we are trying to work out what to do next. Can someone tell me all the forms that I need to file? Do we have to do th petition or relative again even though we did that so I could get my K1 visa? Also do I need another medical or is the one I took in australia (in september 06) enough? It's so confusing and any help would be very much appreciated.

Hello Everyone!

We just received the RFE letter today at 4PM Las Vegas time (4days after Case Updated).

Whew! My fiance called me and we opened the letter together. We were so excited to see what was our RFE.
A good grief!!!

Here it is:

1. FORM G325 - Write NONE to questions and informations that don't apply to you. N/A is not an appropriate response. Don't leave any blank unanswered. (What the HECK??? This is the only reason for our 2-3 weeks delay. OMG!!!)

2. Translate in English all foreign documents to be submitted. (GOODNESS! All Submitted documents were in English language already. We called the uscis and clarify the second statement. No worries, just an additional info to be mindful with in case of any tagalog or foreign documents to be submitted.)

Guys, you better watch out for this simple mistakes. Our case might help some filers here.

I am filling out a new I-134.  This is my second K1 visa process.  The first one was successfully granted however that relationship didn't work out.  Anyway, that is a different story.  The question I have is in regard to answering this question on the I134, question 9, where it asks if I have previously submitted an I134 for someone else.  Yes, I did, but that person has returned to their home country and therefore the I134 is no longer in effect.  How do I answer the question?  Yes, but it is no longer meaningful or No, because it is not effective any more.

So this question just came up because my fiancé and I were certain that we could. But I just read on other posts that joint sponsors are not accepted by every consulate (what exactly does that mean, or rather how do I find out which ones do?) and then others that say joint sponsors are only accepted in special cases(ok so what is that supposed to mean now) and at last that joint sponsors are pretty much never accepted.
People advise to just try to file the affidavit without the joint sponsor and just try to make it on our own, which is, I'm sorry but absolutely not helpful, because if we thought it goes through, well then we wouldn't need a joint sponsor in the first place. Or the advise to just get a better paid job, well that doesn't help me either.
It's not like my fiancé has no income, but his work is seasonal and well, he doesn't make a fortune. He is 20, so am I, therefore his assets are limite and I highly doubt his support form goes through.
His mom is our joint sponsor, she absolutely matches the requirements, but i'm just really really worried now. I'm a German citizen and would go the consulate in Frankfurt.
Can anyone help me at all? Give me any advise on this? Any experience, please, everything is appreciated : )

Have the USC contact the embassy in Germany to ask for info about the subject. What is done in other countries has nothing to do with yours. If they say they wont accept co sponsors you should consider marrige and then file for the C R 1 type visa where they are accepted.

we took nearly 500 pix of our time together,   mostly just me and her,   but a cpl with her daughter and some with her coworkers and friends,   but none of any other family because they live too far away and she rarely sees them.     Will just our pix of me and her together,  and the pix with her daughter,  and the ones with her coworkers and friends be good enough proof?   of course i also have all the airline receipts and phone records,  and online chats and a number of other things to submit.    i just want to make sure we have everything we need so we get approved.

If the pics are used at all they would be submitted much later in the process such as during the interview or with the P 3 docs.

So here's my story....  my name is Justin,   I'm from Illinois,  a lil over a year ago I met the girl I want to spend the rest of my life with,  we just knew from the first time we chatted online that we were perfect for each other.   Her name is Pitcha,   she lives in Bangkok.   We chat online all day, every day,  yahoo cam, send each other gifts,  occasionally call,  and so on.       About 6 months ago we tried to get a tourist visa so she could come here and we could meet and see where it goes.   We did not know much about the visa process and the high percentage of tourist visas getting denied at the time,   so of course we got denied.  After she got denied I decided to go her.  My first time leaving the US and first time ever being on a plane.   After my 25 hr journey to the other side of the world,   we finally meet,   and spend 2 weeks falling more in love than we were before.   Was the most amazing experience of my life.   The only bad part of my trip was having to leave her standing in the airport with tears pouring from her eyes as she watched me leave,   not knowing how long it will be before we meet again.                                                                                                                                                                                                 Ok so now my question.......she is separated from her husband,   but not legally divorced.   They have a daughter and he still takes care of her and her daughter.  They remain friendly and civil to each other for the sake of their daughter and their home.   They are able to live in an apartment of his workplace since they are still legally married.   Here is where it gets complicated..........he knows me and her are happy together and want to marry.    but if they legalize the divorce,   then he will no longer support her and she will be forced to move and will create problems for her and her daughter.    I know the visa process takes a lot of time,     so my question is......Can we start the K1 process while she is still married as long as she gets divorced sometime during the process?   I just worry that she gets divorced and our K1 visa process takes up to a year and she is having a tough time there for a year.   Any info helping our situation would be much appreciated.   Thanks for reading.attachicon.gifme and Pitcha.jpgattachicon.gifme and Pitcha.jpg

You need a total understanding of the situation and we need more info. Please keep in mind we all want to help you not be critical of what you have or will do.

My first question is about her " marriage ". In Thailand it is common to describe a relationship such as she says she has with this Thai man as being married when many people are not really legally married. I would tell her you need a copy of her Thai marriage certificate. You will later need a copy of her divorce cert if she is in fact married. Thais do not marry because doing so gives the man access to the families assets. Thai law doesn't protect women as the laws here do.

Do not attempt to start the K 1 process until you are certain she is divorced. Do not send money or pay for anything from this point forward. Please follow this advise until you have a better understanding of these affairs. Pun intended Karee.

I hope Karee and some other members experienced with Thailand will add some insight today as well.

Im not exactly sure of the little town he lives in but yes he will be able to get into town by bus. I will have a co- sponsor to help me out through all of this. When he was here we made it just fine but he was working. I dont owe a whole lot on my house at all. And own both of my cars no payments. I have a lady here helping us and she said to not worry about it and we would get. It done. He has family all over honduras so i am sure he will be ok i am just worrying to much.

You or your lady sponsor should contact the embassy to ask if they will even accept a co sponsor in a K 1 case.

Ok im alittle worried for my fiance once we get to the interview part of this all. He is currently in honduras and speaks only in spanish and reads spanish as well. Is there a lawyer or something that he can get there that will help him with the forms etc when we get to this point? Id like to be there with him through this so i could help but theres no way since i have 5 children and a house here. Any help or input would be appreciated thanks.

Relax. Keep in mind several things.

Most people that go thru the embassy experience do so in Spanish. He will have no problem and be able to do everything in his language.

You could fill out all the forms for him now and scan to him. He would then simply sign as required. He should get his birth cert translated there and get several copies with stamps ect. These will be needed later.

The work in these cases is mostly in the forms. The interview will prove to be easy for him.

My co-sponsor is paranoid about his SSN and has had me black it out and refuses to submit any other way. So we're ultimately worried this could get us denied due to not showing the SSN, but we are showing EVRYTHING else.

This is a subject where it would be a good idea to apply the advise or you will be back here reporting the problems.

mimolicious  is correct.

First transcripts are best but returns are ok as long as every supporting doc is sent as well. Your co sponsor has to submit the docs required to prove they not only filed taxes but have paid those taxes. This can not be done with returns.

Your co sponsor is simply ignorant of the process. Everything submitted goes to the U S govt. The same govt that issued the S S number for example so there is no reason to think they will abuse the info. Blacking out info may be allowed but if it isn't you will be issued an RFE which will add at least two months to the case. All of that to provide what we all know is required anyway.

Awww I'm working. But I work for multiple contracters through out the year. 4 so far this year. But I do only work 6 to 8 month per year. But I average 62000. Its still full time job. I still work 1500 to 2000 hrs per year. Thanks for your reply btw

 

Then your tax transcripts will be enough proof of the income.

I won't be able to provide a letter from my employer. I will send a letter from my union hall showing my good standing for our work list and my position ( journeyman). I meet all the requirements. I have 4 yrs of tax transcripts. plus pay stubs from current year. Will this cause any problems?? Also. I just received my nvc case number over the phone and my packet is in route to embassy. Is it safe to schedule our appointment now??? Thank you in advance:)

Not working is a huge problem. Being on an out of work list is fine but wont substitute for real income. You should check with the embassy about using a co sponsor if they will allow it.

Is there anyone who can help me how to retrieve my old ds-160? I was applying for b1 before and I got denied and now me and my boyfriend have plan to get fiancee visa but the lawyer asking me about the D's -160 where in she can check why I got denied.

This should serve to indicate the worth of using a lawyer. The lawyer should know why you were denied and in fact that the denial will have nothing to do with the outcome of a K 1.

You got denied because all people with any type of visa are considered intending immigrants. You couldn't offset that concept with evidence so you were denied.

K-1's are actually being processed a lot faster now than before form what I've seen throughout this forum. I wouldn't recommend a lawyer because assembling everything is fairly easy. Save your money and look around this forum for guidelines....it's extremely helpful!

 

The lawyer simply becomes a filter for the info which has to be assembled anyway. This means it probably takes even longer when using a lawyer.

The  O P s previous denials shouldn't affect the outcome of the K 1.

We do need help!

 

My Financee  lives in Florida, I live in India. I { 32 yr old Indian man.She is an American 33 yr old. We are single (never married before)}  attended the interview in Mumbai,India for my K1 visa on 11th Oct 2013. The interview officer asked me only 5 questions about

 

1) How we met  first time despite distance?  Answer: Online forum

 

2) Why it is with American Woman? Answer: Its nothing to do nationality to share individual views and experience.So we talked to know more about each other and we wanted to move on in our life.

 

3) Did she meet your family? Ans: No. During her visit to India, we travelled  northern part of India together. My father only lives in Southern part of India ,who doesnt speak English. I live seperately since since my mothers death in 1998.

 

4) How your family feels about this relationship? Ans: Happy.

 

5) What about the Wedding plans? Ans: We are waiting for the visa to get married.

 

Then the officer gave me a letter stating that our documents are going to sent back to USCIS for the possible reviews in few weeks.

 

 Now Me and my Fiancee are restless with this not knowing the timeline of this procedures not knowing the  outcome being very anxious in our case.

 

What Happens When a Petition/Application is Returned to the USCIS by an Embassy/Consulate  after the Interview of K1 VISA?

I hope you will ask the mods to move this and begin your own thread.

Your situation is similar to the other case of course. Like that case I would think you would see where your case is going. Back to USCIS as you said. There to take months to review and then result in a denial. These cases are decided at the embassy level really so if there was going to be an approval it would have happened there. I know sometimes these cases are sent back again by USCIS for possible approval but who wants to sit in limbo for many months just to see if they were one of the very few?

Question # 2 is where the decision was made I think. Your answer was honest but inadequate for the officer.  

Take the advice given to others here and consider getting married in India and then file for a CR 1. Otherwise just sit back and wait for as long as it takes.
