Yes your in AP and it will take few weeks or longer to finsih the process. Once they have your evidence they will have a CO review the case and then contact you once they are finished. Good luck.

In addition, the embassy or consulate may need to get security clearances for the applicant. Security clearances take time.


This could be the delay since they are not able to ajudicate a visa until all clearances come back clear. Good luck and hopefully it will not be too much longer.

Alexander I am sorry to hear that you got caught in the AP processing. I have to say that you must have an upbeat attitude and keep Clara upbeat as well. I married a man from Pakistan and we had to endure the AP processing. It was not fun and we made a pact to not to discuss it and dwell on it daily. I made jokes, we talked on the phone, cam chats or yahoo chats daily, and did not set any definite plans on certain dates that could come and go (we did this once and it was disappointing). You have to take this time and make it as easy for you both as you can and remember to send emails, cards, chats and all the things you were doing in the beginning to keep this part of the processing fresh just like you have to work hard to keep a marriage fresh and exciting.

Remember that once you are completed with this processing you will be together and that believe it or not this dreaded time will fade into a memory. Take care of yourselves and realize that this separation can be handled easier if you do not dwell on it daily.

You don't have to worry about the Affidavit of Support (AOS) just yet.. No you don't need to send it in the package you're mailing in now. THat comes up later in the game once you get your first two letters (NOA1 & NOA2 - Notice Of Action) and then stuff gets sent to the consulate near the fiancee and then there's packets sent to you with specific requests for information and at that point and at the interview time is when the AOS comes up.

So don't panic right now.. We're talking at least 3 months right now..

Don't forget to list in your profile info here where the two of you are located.. It helps people answer your questions depending on which part of the world you're coming from..

And once you get going, make sure to update your immigration timeline and copy and paste it into your "Signature" in your profile info.

hi all!

today we filed the I-129F!! SO exciting! But i was wondering how they feel about people being together not that long. I mean me and thomas met september last year and till december when he left london, we spend every day together, lived together, travelled together. Since then we talk everyday, email, write. Ive been in march to see him and am going in june, he is coming in july. we are deeply in love and surely they cant deny me a visa because the duration of the relationship isnt long enough? will it take longer? also by the time we get married we have been together for over a year..
just wondering if anyone has experience in this!

Oh, don't think he isn't letting me live it down
saying that he got it done all by himself..
he's so proud it's ridiculous!

and in regards to his passport, it only had one stamp that he entered canada.
Mine was just the first page where it just showed my pic and info.. the stamp pages weren't sent

I only found out like a week ago that he didn't even send my passport pics that I mailed to him to include with the petition...

Just to complete this thread.. I just wanted to formally post that our application got approved in 44 days with no evidence sent and no RFE issued

Only things that got sent (my fiancee is now forbidden from filling out any forms for the rest of our lives) were:
- I-129F
- G-325A
- Full photocopy of HIS USC passport
- First page of my passport
- HIS passport pics (NOT MINE!!) :ranting:
- $170 cheque

As explained to you above, they don't want a whole pile of evidence. They only need evidence you have met in the last two years.

Re: the question on the I129F wherein it asks if you have met in the last 2 years, what did your fiance put as his answer?

Depending on his answer, and the evidence garnered from the passports, you may not get an RFE at all. Depends on the mood of your adjudicator.

If your fiance sent EXACTLY what you listed, I'm guessing any RFE you get will be for a lack of his birth certificate.


He explained in his answer that we've been together for the past two years and we met through his roommate (my cousin) at the time. He send a complete copy of his passport which has a stamp showing that he has travelled to canada before (however it might only be the one stamp as it is not that difficult to travel between Canada and the US)
I was under the impression that you only need a copy of a passport OR a birth certificate for the petitioner (think I read that on the I-129F form) - in any case, he's born and raised in the US.

Things that he didn't send: Letters of intent, photographs, bills etc.

Update: got my case number! :thumbs:

For right now, I'm just getting all our evidence of our relationship for the past two years together (So far I have: phone bills, bank records, flights itinerary, bus and train tickets, photographs, individually signed letters stating our intent to marry each other, and another letter stating how we met.)

So, it seems the general consensus from everyone is that I should wait.. :blink: this is going to kill me. And he feels so bad now cuz he feels like he royally messed up and that I should do all the paper work from now on!

wouldn't this avoid that, as opposed to getting rejected and doing it all again, I really don't mind if it delays our process as long as it gets us in...

When a case is transferred to CSC, like we were, it takes a bit longer. You need to r-e-l-a-x and only call when you really really need to...otherwise you are not gonna get through this process in one sane mind.

Her financial aid situation will change when filing her FAFSA form; she will have to declare her spouse's income on here and it will count towards the total figure calculated as household income. Since colleges use a ratio of household income to tuition in order to calculate the financial aid package, any income he makes will significantly affect her eligibility for grants. Loans, however, are generally not affected by this figure, as they are not need-based; things like the PELL grant and other government or school specific grants WILL be affected as they are need based.

I used to work in financial aid while I was going through University, so if you need more clarification feel free to ask.

If you need parental permission to marry AT THE TIME OF FILING, then you need to include proof of that permission when you are filing. The date of the wedding is irrelevant, USCIS does not care when you marry so long as it is within 90 days of your entry into the US on the K-1. If you do not have proof of parental permission when you file, you need to wait until you are legal to marry without permission.

That seems to be the best option, although with a denied K-1 petition it may make it difficult for your fiance to prove ties to her home country...after all, by filing the petition, you've made the intention to bring her over here to live known to USCIS. When processing tourist visas, they will look at it.

Another option would be to meet in a third country, one that she could get a visa for and one that might not be such a long flight for you.

Technically, a denial on a visitor visa *should* have no impact on a fiancee visa - however, this depends on WHY one was denied. If the denial was for failure to prove ties to a home country, this is a moot point when applying for a fiance visa as the intent IS to immigrate. If she got denied for, say, criminal activity, that would be different. The visas are different classes and you're asked to prove completely different things when applying - what will get you denied for a tourist visa may not necessarily get you denied for a fiance visa.

Either way, to gauge by this other member's case, I really hope that you get the waiver but I think that it's very unlikely: if two completely wheelchair-bound individuals who can't travel at all on their own can't get it, I honestly don't know who can!

However, there are other users on this board - and if they're around, I'm sure they'll add their input - who both are confined to wheelchairs for life with a debhilitating muscular disease and who were refused the waiver of meeting requirements.

To be honest, since they were refused, I'm not really sure who *would* be approved! And they are BOTH wheelchair-bound. Can your fiance not come and meet you?

First of all, congrats on your upcoming marriage!

Once you are married, then you need to file for Adjustment of Status (called AOS). There's a whole forum on here about it. Do NOT leave the US until your green card is in hand or you have applied for and received Advance Parole documents, or you will have to file for another visa.

Go check out the AOS forums; that should give you a good idea of what you need to do.
