K-1 Fiance(e) Visa Process & ProceduresFlooded with applications in July
Do you think service centers are going to be flooded with new applications in July, because of the fee increase at the end of July? Do you think it will take a lot longer to approve applications? 3 months?6 months? a year?

K-1 Fiance(e) Visa Process & Proceduresphone call and touched
I called USCIS and then checked the status on-line and it shows the case has been touched. Does it mean someone worked on my case or because of the phone call to USCIS? Any ideas? Thanks!

K-1 Fiance(e) Visa Process & ProceduresK-1 visa

Hi everyone, Can someone tell me if I have to send any original documents with the Affidavit of support to my Fiancee? She is tell me I need originals for her to take to Kiev for her interview. Bank statements,IRS transcripts,W-2, divorce papers etc. I am worried to send these documents with my soc.number on them and bank account numbers. I have heard horror stories about identity theft and it takes years and lots of $$$ to get it all strightened out. My Fiancee told me she has talked to some girls on a Russian forum that have gone through the interview there in Kiev and they told her they need originals there. ( true or Fulse) If these papers would get into the wrong hands, they would have a field day with them! Thanks for your help!!! Jeff & Yulia

i would use DHL and have them picked up at one of there locations.

K-1 Fiance(e) Visa Process & ProceduresI'm so confused...
To give you guys an idea of the extent to which we talk on MSN: He just copy/pasted our chat log into MSN and it was 3787 pages long and about 1.4 million words. That's only one screenname...

Okay, guys, this has really reassured me a lot about the process. Now all we have to do is wait a few more months before we can start it! ;D Thanks again!

K-1 Fiance(e) Visa Process & ProceduresI'm so confused...
I've been told that I should keep a record of all our email correspondences and phone calls so we can show we've had a relationship all this time. The problem with that is that we rarely email because we talk on MSN all the time. Also, his phone number doesn't show when he calls me, and because international calling isn't included in my cell phone plan (the only phone I have), he doesn't have any phone calls from me. Apparently a phone record is difficult for him to get. Also, even though we spend a lot of time talking to each other, it's not reflected in the phone call list because we use a voice chat program (Ventrilo) all of the time. Every email I've ever sent to him is only 4 emails. The only good thing is that because I work in a post office and I love sending real letters and postcards, he has quite a few of those spanning at least a year's worth of time. Would photocopies of those be good enough to send in our application, or would I have to include the real thing?

What I'm worried about with doing a marriage-based visa is having proof of a bona fide marriage when we can't even live together in the same country. If I were studying abroad in Germany and we lived together there, that would be nice, but unfortunately I can't do that.

QUOTE (Dan + Gemvita @ Aug 30 2007, 02:40 AM) <{POST_SNAPBACK}>
With the K-1 visa, the only way your fiance could work right away is to go through JFK as the PoE. You will be able to get the work stamp. Although, its only good for 90 days. Otherwise, your fiance would have to apply for an EAD which takes about 90 days to receive, and its best to apply for that with AOS, otherwise it will only be good until the expiration of the visa (And you probably wont receive the EAD until after).

With K-3, he can work as soon as he applies for and receives his EAD. This takes about 90 days.

CR-1/IR-1, he will be able to work as soon as he arrives. Since this is considered an immigrant visa, the K visas are non-immigrant visas with immigrant intent.

Yeah, I read about the 90 day work permit somewhere before, but I'm not sure where he would get it. Does he just ask for it at customs, or is there some special place he needs to go? Should I put the forms for the AOS and the EAD in the same actual envelope, or just send them out at the same time?

Yeah, I've read the comparison, but somehow it didn't really clarify which was the best for me. I guess I'm just a bit think or something. ;D

At least I'll be an expert at mailing all of this stuff in, because I work at a post office...

This has really been very helpful, guys. Thanks a lot!

K-1 Fiance(e) Visa Process & ProceduresI'm so confused...
What's probably most important to me is that he can work soon after getting here and that he could be here within a year or so. I've kind of got two plans in mind:

1) After my visit this winter, submitting for a fiance visa and marrying this summer(?) sometime. OR:

2) When he comes here next year, marrying and then applying for one of the visas for spouses (I'm still unsure about the real difference between the two - and yes, I've read the comparison)

I apologize if I'm coming across as idiotic - this is the first time in my life I've had to deal with all of this bureaucracy and it's all a bit much. Over the months I've read many, many websites about the different visa options and I've never really quite understood the differences between everything, and I'm so intimidated by everything and the fear of screwing it up is so great I just feel lost. This is by far the most helpful and informative of any site I've ever come across on the subject, though. biggrin.gif

K-1 Fiance(e) Visa Process & ProceduresI'm so confused...
Hey! I'm new here and I've just spent several hours reading and rereading the guides, flowcharts, and threads on this site as well as the state department website. Now I'm just confused and overwhelmed and I'm not really sure what I should do. I'm an American citizen and a full-time college student. My German boyfriend and I are engaged and we are interested in having him move here to live with me in the United States. We met online, but have already met in person; in fact, I'm staying with him for a month this winter and I'm unsure of what sort of "evidence" I should collect while I'm there for a later visa application. Also, I'm unsure of which visa we should actually apply for - is it better to try the fiance visa and then get married and live here, or would it be better to marry first and apply for a spousal visa? What's the major difference between the two visas for spouses? I would also have problems with finances, as I work part-time for my university earning $7/hour; hopefully I could get my parents to agree to co-sponsor, since I earn far less than the 125% poverty level I need. Any clarification on the visa process would be really very much appreciated. I'm sorry if this is all explained in the guides, but all the abbreviations and forms and different official things I've been reading about has really confused clueless old me. Thanks so much for your help!

K-1 Fiance(e) Visa Process & ProceduresWhen we will be approved??!!
Mellarbi did your fiance sign a release from from the congressman's office for them to proceed and followup on your case? If they did not sign a release form they are powerless and will not contact any agencies on your behalf.

Secondly, once you sign over the rights to the congressman or senator's office the USCIS will contact them with all information reguarding your case on updates. The USCIS will still forward you all paperwork, forms, etc that are necessary for your case but will not respond to emails for an update.

I would contact the person or persons that the fiance had talked with previously and ask them to do a status update on your case. That person should be able to tell you if the USCIS has replied to them. In our case my congressman would not help us but our senator did inquire for us. I will also say that if for some reason your name is being hit in one of the many data bases there is nothing that can be done to expedite the checks but you will have peace of mind that you are not lost in the processing.

Good luck and make sure to recontact your offical that was asked to help you in the first place.

Copies from your passport pages and pictures of yourself together should be sufficient evidence. I would not send anything now unless they contact you and ask for more evidence. Hold onto the other things and you can use them at the time of interview for proofs. Good luck and patience is a virtue you learn from this process.

K-1 Fiance(e) Visa Process & ProceduresVery new at this
1. When you log on to the USCIS website, look at the date on your case (it changes when touched) - click on the case and read the details. In the case of touches usually the message is the same. When an approval happens on your case your date will change but the status message will be changed as well.

https://egov.immigra.../jsps/index.jsp Go to this site and register if you have not done so already and you can keep up with your touches this way.

2. It is always best to not set your date in concrete for your marriage until you have a good idea that your case can be finalized and ready to come to the USA. If you make plans and they cannot issue the visa by the time of the wedding you may have to incur a financial loss.

3. Not sure it matters but all good things no overstays or other problems.

4. Medical is basic physcial and chest xrays and blood tests.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresMy journey now from nvc to American embassy in Pakistan

Today i got PACKET 3.5 from the embassy and the must provide the following documents and send it to the embassy

Original signed, Form I-864(Affidavit of Support) from the sponsor and notarized by an American notary public or Consulate Officer at an American Embassy or Consulate. (One copy of I-864 for each derivative applicant)

Copies of the sponsor's federal tax returns(Form 1040) for the past(3) years

An original job letter?proof of self-employment from the sponsor.

Complete i-864(with supporting document from a joint sponsor, if needed

Faisil are you sure about the I-864 documents since they are usually only sent in with the CR1 packets? If you go to the Islamabad forum the other K1 petitioners were only required to submit the I-134 since Danika just posted her list for others asking what was needed for K1 interview. You normally would submit the I-134 at the embassy and once you come to USA, marry and then apply to adjust status is the I-864 required since it is legally binding.

Here is what was asked for in the K1 packet 3.5:
Two copies DS-156
One copy DS-230
One copy DS-156K
One copy DS-157
Birth certificate (and english translation)
Death certificate or Divorce certificate if previously married (and translations)
I-134 (Affidavit of Support) from petitioner & supporting documents, including:
Copies of petitioner/sponsors fed. tax returns
Proof of employment
Proof of assets
Beneficiaries passport
Two passport size photos
Police certificates

per post number 2492 in the Islamabad forum http://www.visajourn...h...=79&st=2490

You cannot know which one is yours since they do not give you the tracking information. I know when I found out our information they had only sent one on the day the operator said it was sent from NVC. Track all from that date and they should arrive at the same time and you will know it arrived. Other than that is sit back and wait on the embassy to contact you in a few weeks after all the packets have arrived and been put in the system.

Good luck!

IS IT A MISTAKE OR THEY SLUGGISH?

They do this sometimes and you cannot go by their times so do not worry about this some cases move faster than others and they cannot all be on the same date. Each case is different as you know and some endure long name checks.
MaryandMianFemalePakistan2006-11-21 07:57:00
K-1 Fiance(e) Visa Process & ProceduresMy journey now from nvc to American embassy in Pakistan
Fasil they will not give you the tracking numbers for your packet to the embassy. You can call them for an update and if some cases they will say your packet was sent on xx date. At that time you can do a general search of the DHL site and see how many packets went to the embassy and watch for its arrival.

Once it gets to the embassy they will match the hard copy with the electronic copy and you should hear from the embassy in two or three weeks. Until both packets are in the system it may not show as being in there yet. Just be aware that we have a lot of holidays coming up so down time for the embassy since they will be closed for Pakistani holidays and American holidays as well as weekends.

Good luck and your getting closer to having your case in your country.
