K-1 Fiance(e) Visa Process & ProceduresNeed urgent Help

hrt4u2c,

Please review AFQuaid's post history, there are 17 pages and contain a wealth of information for people traveling/meeting with disabilities. You may also find their website to be of some use. They met, applied for the K1, married and are currently in the AOS process.

OP, that's exactly the case I was referring to. They were forced to travel and meet in person despite both being wheelchair bound - their waiver of meeting requirement was denied.

K-1 Fiance(e) Visa Process & ProceduresNeed urgent Help
It is unlikely that this will be granted - we have VJers here who are both wheelchair-bound permanently, who cannot travel without aides and medical attention, and they were denied the waiver of meeting.

K-1 Fiance(e) Visa Process & Proceduresquestion on letter of intent

Ok, I am the one going for the interview. Do I have to have another letter of intent as well? If so, how come I wasn't told that? This process is extremely frustrating and I'm tired of learning I need "this and that" when I wasn't told in the first place.

Joe...this is from the Guides section. The part you question is bolded and underlined. It has been there this whole time. As far as you "being told what you need" it's your responsibility to read these Guides and find out this information instead of relying on everyone to tell you what you need.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). 2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy. 3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F). 4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all. 5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form. 6. A copy of the NOA2 that you received in the mail. 7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

a) you can be a tad more respectful in your tone, thank you very much

B) When I say "what I was told" I am referring to my PACKET 3 INSTRUCTIONS, thank you very much

c) the "guide" is a hell of a lot different than my PACKET 3 INSTRUCTIONS, thank you very much

d) I don't "need everyone to tell me what I need" thank you very much. What I do ask for is clarification as to why the "guide" is so different than my PACKET 3 INSTRUCTIONS, thank you very much

Yep, a new/updated letter of intent is required from the USC fiance when you go to the interview, and if I remember correctly, this requirement is stated in the package 4 letter -- at least it was in mine.

I know that. I already have it. What I was asking is if "I" need to make a new letter of intent. Why does everyone assume I'm the USC fiance? It was stated in my instructions as well, however, contra to the rude post above which referred to a "guide", my instructions did not mention that "I" had to have a new letter of intent as well.

This is a confusing process to say the least. And alot of things are learned along the way. Thats why Visa Journey has the guides. To assist us in things that may come up. Things may be different than your packet 3 because additional information was maybe added that came up. These guides may save you tons of time and heartache because they are developed to cover things we may not have been TOLD by immigration we needed. People have run into all sorts of things in the interview and these forums and guides are there to help us avoid pitfalls. Things change so fast in this area. The guides may be different but invaluable. I'd go by your packet 3 information AND anything not listed in that packet but is in the guide...i'd add. Better safe then sorry. Good luck and God Bless

Hi
Me again..wow I have a list of questions..and now Im getting nervous.

1. I read on VJ in the photograph requirements that we are to send full frontal views of our pics but I just noticed the I129F says 3/4 view.. WHICH IS IT????? Do I need to redo these and send them in??? Can i do this before a RFE???

2. I sent a regular birth certificate front copy only. I need to know if if i have to have a long form birth certificate...or is this one i sent with my parents names and the state seal acceptable? Will I be RFE'd and can i resend this with my A number BEFORE i get the RFE???

K-1 Fiance(e) Visa Process & ProceduresWas I "Touched"?

Yes, that means you have been "touched"....looking at your signature, your NOA1 date is a day before the "last updated date" on the USCIS website. Many people experience this....it may be the date they deposit your check, or just initial shuffling of your petition putting in the right place for eventual adjudication.

Good luck!
-P

Thank you, I sort of assumed maybe one desk processes the noa1 then once that is done and documented as recieved that it will shift to another desk to wait in line. Thanks.

Hi,
I don't mean to be stupid...but when I log into my "account" with USCIS it says "LAST UPDATED" and June 26, 2007. Is THAT where we find if we've been "touched"? And is that a good thing? Where exactly will it show if our papers have been "touched". Thanks

K-1 Fiance(e) Visa Process & ProceduresVermont

Once things are straightened out, CSC's and VSC's times will be similar to each other. That doesn't mean VSC and CSC will be processing as quick as VSC does now though.

I agree..I think the changes in centers will even it out more....so the waiting times are similar no matter which center processes your petition

K-1 Fiance(e) Visa Process & ProceduresRFE Recieved

Got my RFE in the mail today and reads: Need intial evidence that I have met my fiancee in person in the past 2 years. Include pictures, boarding passes, passport stamps or military papers.....I did send pictures as evidence so why this RFE?
I no longer have my boarding passes or ticket reciepts, but I can obtain a copy of my frequent flyer statments that indicate flights numbers, dates of travel with my name and account number...Would this be OK? My passport does not have any stamps because Cuba does not stamp US passports, so what else can I use for evidence of meeting? E-mails, phone records, disc or tapes are not considered evidence for them...PLEASE HELP!

Pictures are only secondary evidence. They will not stand alone. Passport stamps prove you've been there. You can't get that, so the next best thing would be boarding passes. You neglected to save those, so the next best thing would be evidence you paid for a hotel room or used an ATM or paid a restaurant tab with a credit card or even with cash if you have a dated receipt.

Think about what proof might exist that you were in Cuba within the past two years and get your hands on it.

Call the airlines as well, sometimes they can pull records that a boarding pass was issued, with dates, times, seat. They have to keep records, I just dont know for how long. Also, I beg to differ about emails and chat logs. Find ones right before the trip where the two of u may have discussed details of travel. Find some from AFTER the trip when u come home soo excited and share things you did or missed about each other. But try the airlines OR where you got the tickets from. I get mine from cheapseats.com and I can log in and see all my itineraries and print them out. Check with your travel agent or online where u got them. How did you make and pay for your hotel reservation? Was it just for you? or for you AND him?

K-1 Fiance(e) Visa Process & Proceduresi dont have any of my boarding passes

I dont have ANY of my past boarding passes. Can i just get printouts of my flight itineraries to include in my I-129 package and also photocopies of my passport stamps?

Will this work?

Thanks!

Yes, we did this and there wasn't an issue.

To all who did this, did you include all pages of the passport or just the pages with stamps? I am submitting my birth certificate for proof of citizenship. However, because of a minor name conflict between bc & passport I would prefer to not provide a copy of the identification page of the passport and just provide copies of the pages with the stamps.

So, you think proving "somebody" went there is going to be good enough?

I did want to clarify for the OP that the passport stamps are proof but the itineraries are not. It's ok to send them to support the stamps and other evidence but they don't mean much on their own. Pictures would mean more but most pictures don't prove much.

No offense...but i could have sent ANYONES identification page. These aren't the originals so no way to know on a photo copy WHO that id page really is anyways... Just a thought.

I"d also like to point out that alot of itineraries show that the ticket was PAID for and HOW and by WHO. While they don't provide sufficient evidence alone they certainly can be used with dated pictures or other reciepts from the same time. I mean If I have an itinerary showing Im flew into egypt Jan 20, and my hotel reciept shows I was there Jan 20-Feb 5, then I add a few more reciepts with pictures and a certified letter from family, friends there that will attest to our meeting. Alll that evidence adds up. Its up to the adjuicator to decide. While I agree the HARD proof is in the boarding passes, I disagree that itineraries can't be viewed as evidence. Its just PART of the picture.

K-1 Fiance(e) Visa Process & ProceduresIs it me or is Vermont now taking FOREVER???

yes; both anecdotal evidence and the stats in here show no July rush... as was said somewhere else: it's not really the sort of thing you CAN rush, in most cases; you're either ready to file or you're not... sure; I bet there were a few people who were planning to wait for some reason and then changed their minds because of the fee increase, but I can't imagine it would be many; how many of us were planning to wait to file? most of us just got engaged and started making plans and filed when we had our stuff together
and certainly the VJ stats indicate a pretty standard month

so the VSC slowdown remains a mystery...

For me I don't mind the wait...never did expect a 4 week approval anyways...however....it WOULD be nice for VSC to explain a bit WHY the huge change when sooo many were used to it the fast way. Just a bit of information would go a long way to sooth the worries and finger nail bitting many of us VSC'ers are experiencing. If there is a backlog I'd like to know and know what it is that is slowing me down from being with my SO. Maybe information on what they are doing to fix it and a time frame of when we can expect this to be brought back up to speed....or something. ANYTHING is better than the quiet anticipation. I mean...come on....3 approvals in TEN days.....does make you wonder what is going on.

K-1 Fiance(e) Visa Process & ProceduresI-129F Type O
If I may add..... If the adjudicator comes across something they need to verify, they are required to use all means available to obtain that information prior to issuing a RFE or approval. You may be behind a bit due to that process. Have you checked the USCIS website to see if they did indeed send an RFE that maybe you didn't recieve hardcopy on???

K-1 Fiance(e) Visa Process & ProceduresUse the first name?

I wonder in the I-129F package if I should refer to my finance using her first name only.

If you are writing a cover letter you can go ahead and use her first name. My fiance use my first name on the cover letter and my full name on all other documents.

A lot of people that have fiances from Morocco have "engagement parties". It looks good at the interview too if they look at your photos. But the folks here are correct about making sure your fiance DOESN'T call you his wife at the interview and POE. Your fiance can be turned away at POE if he refers to you as his wife. Good luck in your process!

K-1 Fiance(e) Visa Process & Procedurescalling card proofs

ok
what i did was i bought all my calling cards from the mexican grocery store here
then i just put about 16 on the printer
printed
then flipped them
and showed a diff. pin #
to show they were all diff. cards
that worked for me

I have Vonage and they list all calls that I make. So, when I use calling cards it lists the 800# that I dialed and how long that call was. I started writing on the cards the date and how long the call was, then it matches with my phone records. I was hoping that it will work similarly as Raspect's case did.

K-1 Fiance(e) Visa Process & ProceduresHelp! Package Rejected 2nd Time for Incorrect Reason (Check)

They refused funds from the same bank TWICE! DO NOT send them another check from that bank. Get a US Postal money order, or a certified check from any Bank of America branch.

It makes no sense to try and send funds from the same bank a third time. Even a certified check may not be good in their eyes.

The bank is Wachovia. It's a national US bank. A large one at that. I think the confusion is because of the pictures on the check. I doubt it's the bank itself as it was never even submitted to them at all. But you may have a point, not risk it one more time. I can go to a Bank of America and get a certified check from them. I want a way to track this thing and money orders make me nervous. :(

Certified Check should solve this problem. Also, from my understanding, if you get a money order from the bank it can be traked just like a certified check. Me personally, I prefer the certified check that's what I mailed in to USCIS, I also photo copied the check for my records.

K-1 Fiance(e) Visa Process & ProceduresAre all these calls really necessary?

not really a massively important issue, but over and over again these past few days I've seen people in here talking about 'calling every day' 'calling til I get an answer' and so on; obviously sometimes this is necessary (in the case of paperwork having gone astray, or similar), but I can't believe it always is; many of the comments seemed to relate just to checking the status of a case... so I thought I'd see what others thought:
is there any possibility that these calls are slowing the process even further? are the people who answer the phones - not necessarily the first person, who's probably a receptionist, but the one(s) the calls get passed to via the 'RFE trick' or whatever - also the ones who process our cases? and if there's even a remote possibility - can we minimise unnecessary calls please?!

not meaning to target anyone with this... it's a genuine question that I thought I'd open up to discussion :)
it may well be that the process would be exactly as slow if no one called at all... just been wondering

Through the whole process, I only made two calls and that was to the National Visa Center. Otherwise, I decided for my own sanity to purposely NOT call no matter what. After reading various posts on here about the many calls and their disappointing aftermaths, I am positive I made the right decisions.

I'm not sure it really slows anything down, though. I would imagine the people answering the phones are not the same one's working on the cases.

I agree, I chose not to call unless I had to. I had a problem in the very begining and I called. I found VJ and a lot of my questions have been answered here as well. No need to call. I've been patient and I know he will be here soon.

Thank You VJers for all your posts (questions, announcements.. updates, etc) Its helping me so much. Gosh!!! I wish we didnt go thru an agency. Spent extra money and I'm the one updating them with things that they didnt hear about(increase in fees, direct filing, updated version of I-129F). Whats up with dat? Time for your common sense to kick in. Only one signature, that of the USC, is needed on the I-129F form. You have one already filled out. Just download the current form, put the same information on it, print it, sign it and send it in place of the one you have. You prepared the form, so just leave the preparer information blank or write none.

tHANKS.. I was just freaking out again .. i really need to get some rest.

Why speculate and take a chance if it does get sent back? If you have not received the NOA1 for the I-130 and have yet to send in your I-129F petition, you can get the latest version of the I-129F completed and signed and get it signed by your spouse and have it ready.

K-1 Fiance(e) Visa Process & ProceduresFiancee filing location...legal residence question
Evening all,

My Fiance is a US citizen, and I am Australian and we are planning to file for a K-1 at the end of September. We do have a little strange residency situation , however.

I am living and working in Costa Rica, with my work permit renewal still in process. This is pretty standard for Costa Rica, as the immigration laws have been in turmoil since the new government came into power mid last year - every expat I know has their status "in process" for almost a year.

I don't want to have to return to Australia to file and interview (eek -added $$$$) - can I do this from Costa Rica? I have conflicting info so far...

K-1 Fiance(e) Visa Process & ProceduresL1 vs a existing K1 application
I work for a global company where I have a potential for getting a sponsored L1 visa (fairly easy to apply for AOS after marriage). No jobs have come up in our set time frame that would work, so we have decided to go down the K1 road.

If a job becomes available that entitles me to the intercompany transfer L1 while my K1 is in process, is that a problem? Does one negate the other?

Anyone with a similar experience?

If we go through the whole K1 visa, but marry in the UK where his family is, well is that ok. Or do we have to get married in the US. Our plan is possibly to get the visa, then I fly over to get him, we get married there, then fly back and get his AOS. If we can't do that, I guess it would be get married over there then file. K-1 Fiance(e) Visa Process & ProceduresNever met my fiance but sent in the K-1 application

No, I don't think that learning disabilities are the reason for making dumb questions.. most of the times we are just too lazy to read, if you are going to start this journey on your own, do yourself a favor and read and read and read again, get informed as much as you can, read books, read the guidelines, and please read the instructions! If you have a question you can always come here and ask.

You'll learn so much more doing some reading first.

I don't think so either, I was just saying maybe being so harsh isn't the best way to handle these posts. But sometimes you read and read and something may be right there and you don't see it, so you ask, then get flamed. This is an extreme case and you would have to be quite out of touch to not know. I agree that it was either a joke, or someone asking to see if anyone has gotten away with it. Maybe it is someone who is totally in love with his gf but can't afford to fly over. I know I know if you can't afford that marriage shouldn't be in the picture so on and so forth, but being in love makes people do odd things lol

K-1 Fiance(e) Visa Process & ProceduresNever met my fiance but sent in the K-1 application

If one cannot read (and follow) the instructions of a simple form, they have bigger issues than getting flamed on a messageboard.

So if someone has a disability that makes it hard to comprehend what they read they deserve to be flamed, and should certainly not fall in love with anyone in another country. I will tell my LD son that...

I'm sorry but you people can be really rude. Maybe this person isn't a troll, maybe he/she just didn't read completely. Maybe they have a learning disability, who knows but who are you to judge. We are all going through this and it isn't easy at all. No question is a dumb question and if you don't want to read/answer it then just don't. There is no reason to make someone feel bad for asking a question. God knows I've asked at least one dumb one since being here. Sometimes your fingers rush ahead of your brain. So constructive answers or keep it to yourselves. I know it might be hard.. perfect people who never ask dumb questions or make mistakes...

K-1 Fiance(e) Visa Process & ProceduresK1 Visa, Nerves and worries
So I've been on this bored for 10 months now I think. Gathering info and waiting. Waiting for my divorce to be final so I can start my K-1. Well I will have my final divorce decree on 11 Oct, and now I'm scared to death. Not scared of getting married, or being with Carl, just scared of the process. It's not been such an issue up until now because it's always been "when, someday, soon" Now I have a date and I am going to start filling things out now. He is going this week for his police report. He will be here on Sept 29, and we will do all the paperwork then. I plan on sending it out the day the divorce is final. Hopefully this doesn't raise any red flags. Well just wanted to get that out. When I joined I thought it would all be over by now. Divorce took a lot longer than I wanted but the end is near.

K-1 Fiance(e) Visa Process & ProceduresFlooded with applications in July
Do you think service centers are going to be flooded with new applications in July, because of the fee increase at the end of July? Do you think it will take a lot longer to approve applications? 3 months?6 months? a year?
