Hello Everyone! I haven't posted in a while but i wanted to say first CONGRATS to all of those who have recently approved petitions. How exciting! We are early November filers but no word yet..patience truly is a virtue! I'm going to go see my beloved in March and I'm currently gathering up stuff we will need on down the line should we get approved. I'm currently gathering tax documents and getting things organized but I have come across a few questions.

1. I was a dependant in 2010 and therefore did not file taxes on my own behalf (only worked 3 months)I have them for 2011 and 2012. Is this enough?

2. I efile with Turbotax. They give you an option to print off all your forms after you file for your records. Can i use these or do i specifically need to ask for transcripts from the IRS?

3. I have 3 children. One lives with me full time and I'm his sole provider. My other two children reside with their father as of right now (their choice)and he has custody of them by the court of law (physical and legal). Do I need to claim my one as fully dependant and the other two partially dependant? Or just claim the one that lives with me and not the other two? The court forgo'd child support so we could travel back and forth to see the kids and per agreement with their father. What is the best way to approach this?

4. What all does my co-sponsor need to send in? The Affidavit, taxes transcripts, letter from employer, bank statements? Does she need to prove US citizenship with a BC or Passport? We are working on this now and I wanted to double and triple check.

5. Last, if we are approved, i'm sure the interview won't be for some time after March. Is it okay to gather up all this stuff and take with me to save time and postage? Is there anything that is time sensitive?

Sorry for all the questions! I just want to be sure that we are gathering up everything that we need and it's done the correct way! We also need Letters of Intent for a second time and ongoing relationship proof, correct? Thank you all for invaluable help! We both appreciate it very much :)

I was wondering why you think that you can't go into the interview with him. I was with my fiance (now husband) at his appointment. We used his appointment receipt for his admission and I showed my American passport. I had made an appointment, just in case, at the same time; however, they told me Americans can always enter the embassy. We went through security together, we were escorted to the waiting room together. There are two areas in the office. One is for citizens and the other for non-citizens, but we sat together. We were called up to the window together. I was asked to step away from the window while my fiance was asked questions but everyone in the room could hear the conversation. We could hear the conversations at every window. No one is taken into a private area. I was then called to answer questions also. The interviewer asked my fiance to step back. The interview was not long. They looked through all our papers and we left together. It was a very bonding experience to share. I think it is not necessary to be there but it was nice. I'm glad I did it.

The reason why i said that was because the information provided on VJ for the embassy website in Tunis says that we can't attend the interview..hmmmm..I might just give them a call. I wasn't expecting to go in anyway..I just wanted to be there for support more than anything and if nothing else, the fact that i'm there would still look good.

ya, you can delay stuff at the IV unit by NOT sending in the Packet 3 response asap. You have 3 to 4 months to send it in, after it arrives.

Once it's sent in, one gets on the interview calendar.

oh i see what you are saying now..We have the funding now so no need to delay lol We are hoping to get everything sent in as soon as possible as it comes..We don't want to be apart any more longer than we have to :)

OP - since yer NOA-1 date is 2012-11-19 -

I say do yer own stuff for graduation, and plan and budget for the trip to Tunisia, around December of 2013.

Be certain the Packet 3 docs are returned to the IV Unit around the end of October, 2013.

okay i'm curious but why so late? That would be over a year since we filed and got our NOA1 :blink: It's been almost 5 months already and according to USCIS, the average time is 5 months..the average time to get an interview appointment in Tunisia is 59 days I think..I was thinking it would be more around July or August. Am I not understanding something? sorry..I've never done this before lol

Okay so here is the dilemma. I just got back from Tunisia over a week ago from visiting my fiance. He is set to graduate college the end of next month. Due to financial reasons, I can only afford one more trip. It's $1,500 per flight. We'd also like for me to be present at his interview(God willing we get approved!) What would you do? Would you spend the money and go to graduation, something that will never happen again or not worry about going to the interview? or would you go to the interview? I can't go IN to the interview with him but I feel like it would look better for us if i WERE there anyway..if nothing else, as support for my fiance. ahhhhhhhhh! Any suggestions would greatly be appreciated! We are stuck between a rock and a hard place for sure :(

Hi we only submit 100 pics but they only saw 10 of them so really it depends on the CO or USCIU that is working your case..any way email them in my case USCIS continusly communicate with me via email all the time when documment or signiture were missing...or if it CO so email the same or send a expres mail over night with required signiture, plz do not panic but make sure you move fast because everyminute and day count for your case to be susccessful approve!!!!!!!! Your fiancee's visa will remain active until it is used in America or expires so you should not have a problem with that. The only issue I can forsee is that once your fiancee is in The Philippines she will need to attend the CFO seminar before Philippines immigration will let her leave if she has the K-1 visa in her passport.
A one way ticket is no problem as the intent with a K-1 visa is to stay in America. My wife entered with a K-1 visa and a one way ticket with no issues.

Hello every one my fiancée just recently had her interview in Thailand and was approved. She works as an English teacher and before coming to the US she would like to return home to visit her family before coming to the US. I plane on meeting her in the Philippines her home country then we travel back to the US. Does anyone know if there would be an issue with immigration’s for her leaving Thailand where visa was issued to go to Philippines before going to US? I know it is an issue if here in us and leave without having applying for AP. also anyone have issue with airlines for buying one way tickets as have been told need to get round trip?

Hi,

I am just about to send in our petition to kick start our k-1 journey. For photos included for evidence, I am just printing out the photos in color from my home printer (2 photos to a page and captions). Has anyone had any issues or RFEs due to the photos being on plain paper and not traditional photo paper? Granted my future wife and I have been together for a while so I do not foresee any issues proving our relationship as the toughest part was not including all 1000 photos from our collection :P . Thank you!

I made under the 125% level of income last year, but this year I'm making more income due to obtaining my CNA license and not going to school anymore (for now) and working more than 40+ hours per week. Am I likely going to be denied because I haven't had the required income for over a certain amount of time? I also have changed jobs this year due to my previous client moving to a Nursing home, and now i'm working in a Nursing home myself.

I just don't want to risk getting denied because of this issue. If it's even a decent chance of denial, my fiance and I would rather just go with the DCF visa option and get married and live together in the Philippines. I just don't want to waste any more time, money, and suffering for something that might turn out to be a big waste....


You are talking about 2 VERY different options. Going away to live with her vs. YOU getting 2 or 3 additional jobs to meet the 125% option.

Please tell us, what is it that you most want to do? It's up to you.

The beneficiary can get cold feet when the reality hits him/her about making a major life change of moving to US and getting married. It is more common than I first thought based on the responses here. Filing all the paperwork, getting approved, setting embassy appt, sending final trip money and having it stolen...Happened to me, too, so i know how you feel. Bottom line: Better to know now, than after the marriage, so good move on doing a K1, and not tying the knot and having a big/legal problem to deal with to undo it. You can just kick the dust off your feet, and move fwd when you are ready and find a woman of solid character and who is deserving of you. Good luck.

I think that one of the great mistakes that people make is lack of time. I've seen time and time again that people rush into marriage (international and other wise) and don't take the time to know their potential mate.

I believe that some people can fall in love quickly but that isn't the case of most. The other mistake is unrealistic expectation -- "she's going to be a great house wife", "he's going to be an outstanding provider". We have to be realistic about our expectations as well.

Marriage is more than a wedding, it takes work and so many don't understand that until its too late.

I think you are right but what do you suggest we do about the problem? Are we going to become Dr Phil to the worlds population? How do we limit the expectations of others that we dont even know? I think the expectation that we can influence the thinking of another person is unrealistic.
It incredible to me that people will use a public forum to ask for advise about such a serious situation. Its also incredible to think they would follow such advise. Really they are just venting and stabbing in the dark rather than forcing themselves to accept reality and deal with the problem they created.
babygurl think everyone that enters the USA on a K1 should marry and figure out who they married later because its cheaper for example. She waited a full 7 months to file. That must be the benchmark for success.
I suppose thats why V J provides quality advise about immigration matters and wasnt designed to take care of the worlds marital woes.

If it is a test drive, then why are both the petitioner and beneficiary required to write and sign letters saying they intend to marry within 90 days? I'd love to hear of someone at their interview say they're just coming to try out the relationship for 90 days and get married if it feels right. Yes the K-1 visa does give them 90 days to get married, and if things turn out bad to return home and not marry. But that is not the intent, and there is no way someone would ever get the visa if they stated they have doubts about if they would marry the person within 90 days. In fact, I believe that would be considered a material lie during the interview with the freshly signed letters of intent sitting in the file, and possibly grounds for a permanent ban.

If you dont like the term test drive I can understand. I think we all know about the letters of intent. I think everyone that interviews knows they cant say they are trying out the relationship. But if they met just once in person they are granted a visa as we all know. Things can be very different when people are actually together for a longer period of time. This can be seen here on V J many times.
You agree that the 90 days allows them to marry OR " if it turns out bad to return home". What would you call that time period? Why are there 90 days allowed?
So those that dont marry have lied? And now should suffer a permanent ban? Who would determin they lied? The system is designed to grant visas to people that intend to marry & to allow them to go home if they dont.

Then you know people who lied to get a visa. Letters of intent are mandatory for a reason.

Visits are for test drives. If you don't know for sure that you want to marry the petitioner and live your life in the US then this visa is not for you.

People abusing the system and using this visa for unintended purposes are the reason this process can be so ridiculous.

If you need more time to "get to know your fiancé" then perhaps they shouldn't be your fiancé.

They didnt lie as far as I know. They intended to marry but didnt have concrete plans to do so before they got here. They were granted the visas by the embassy just as everyone else is.
The law indicates people must have met in person once. That is hardly enough time to get to know someone well enough to decide to marry them. I would agree the system is flawed but it serves to bring many people here to decide what they really want to do.

No. The visa is not intended to grant people a trial period with their partner or in their new environment. It's to make wedding plans and settle in a bit. This isn't a "see how this works" visa. It's a visa intended for people who have already made the decision. I'm so tired of reading this here on VJ, people who think the K1 is actually intended as a 90 day test drive.

The visa isnt granted to make wedding plans. That can be done from anywhere. The immigrant knows little of planning weddings in the USA anyway & would probably prefer to marry in their own country. Settle in a bit? In many cultures its a huge break in tradition to settle in before a person marrys. The immigrant is at times thrown into a unique situation where I would think a " test drive " would help.
I personaly know a few women that came here only to decide they made a mistake. They had no plans to marry as far as I know. Keep in mind the visa is granted to people that may have met only once in their lives. A test drive is exactly what may be the best way to find out of the couple is compatable in a real life situation.
This is a difficult subject so you may need a nap as if you tire easily.

Agreed. The answer is the reason there is a 90 day period for people to find out if the situation is correct for them when they are in the country & area where they will live. The immigrant may need time to adjust or may not be able to do so when they are in the real circumstance. The immigrant must make the most serious decision to leave their country, family ect behind for the unknown. Few people have a real sense of what life is like in America.
The other option is to simply marry into the unknown hoping love will be the total answer to happiness. The divorce rate in America was about 54 % last time I checked. Rushing to marry may simply create a difficult situation beyond that of returning to a home country.
I doubt anyone here is in a position to determin the actions of another person or see inside the make up of anothers relationship. We all have to decide our own fate.

How important is it to the governing bodies (immigration, consular, etc.) that the sponsor visits his/her fiancee in their country more than once. Is one visit sufficient, or will the consular or whom ever, see this as a issue?..... I've been told by others (not here in VJ) that it could be a problem proving a genuine relationship.

Is there anyone out there that has visited their fiancee only once and still received the VISA, and what problems arose from only one visit?...if any

We do have all receipts, itinerary, etc. over 1000 pics of ourselves and with family and friends during my 2 week stay, records of all our twice daily communications from Skype, Yahoo and cell phones.

This is the only issue of concern, we are great on everything else..... is it imperative to make more than 1 visit?

Also, I do have good reasons for only 1 trip, but will they listen and consider my reasons?

The rules were written by the very governing body you now fear. Just do what many have done and follow the rules and you will suceed just like everyone else. Of course more is better but the rules dont dictate that.
The cases are usually decided based on the documents required. The relationship needs to be sound. Keep in mind no one is going to review 1000 pics ect. If your relationship is weak enough to require the submission of a mountian of evidence you may indeed have a problem. If it isnt you will be fine.

The problem in getting a tourist visa is complying with the strongest ties rule. She must prove beyond a doubt she MUST return to Thailand. The problem with that is the history of fraud by Thais which continues even today. All people with any type of visa are considered intending immigrants which is the essence of the problem.
The only way to know if she can get one is to step up to the window but the chances are not good.

Tight Situation - Seeking Advice

Hello all, I'm seeking for some suggestion or advice from anyone who can help.

I had been divorced twice. My first ex-wife is from China and we had been marry for 4 years using the method K1-Visa. My second ex-wife is also from China and we had been marry for 2 years using CR1/K3-Visa. I know in the eyes of immigration officials my track records really appears to be dreadful. I know I had make a few mistakes in my life and marriage is very serious commitment. I learn from my mistake and I am just like everyone else, searching for the right partner to spend the rest of our life together. I had an opportunity to meet this wonderful woman (introduced by my Aunt) who happens to be living in Thailand.

My question is, does anyone know what is the best method for me to bring her to America with my current status?

* K1 (again)? Which have a good change of denial?
* K3 Way too long of a process
* Have her obtain Tourist Visa? Not sure of the criteria

A friend told me that it is not impossible for me, but I have to pick the right path and be diligent. Any professional advice would totally be appreciated.

The decision is simple. You arent married to her so you must use the K 1. You can explain your serial marriges to USCIS if they ask. You will submit the divorce docs and it may never come up. Be sure you are ready to prove you have met her at least once and provide further evidence of the relationship. You should be well versed in this.
She can apply for a tourist visa at any time. She will find its very difficult to get one.

Hi, Our case is under AP right now but they gave my fiance his passport back saying that if he needs to travel somewhere he will need his passport.....so is it bad sign that the gave him his passport back? does that mean there are less chances of approval?

The bad thing about A P is you wont know how long it will affect your case and you will get zero info about whats going on. This now requires a lot of patience to get thru this time period. Many of us went thru this but got the visa as a result.

Hello,

I am in the homestretch here and as I completed packet 3, I had the following questions and need opinions.

Form 156 asks if someone else completed the form and needs a signature. Since I am completing them for my Thai fiancee, signing it and then scanning them to her, I wondered if scanning is ok or if I need to sign and post them to her so that they are the originals.

I was married before and I have my divorce papers as required in packet 1. In packet 3, it asks for marriage papers and I wondered if a copy of my original marriage certificate is required. I do not have it and was curious how other members have handled this.

Finally, what is standard for the I-134? Do I include bank statements and employer letter only or just a copy of my tax returns? Any advice on what has been done before would be fantastic.

Scanning it should be fine. They just want to know who was responcible for filling out the form.
I havent seen the latest P 3 but almost no one would have those papers including my husband. I think this is related to spousal cases where they want to see the marrige cert for the new couple. We submitted our Thai cert.
Its best to send tax transcripts. If you use your tax returns you must send a copy of every document that was part of the filing. Get the transcripts free from IRS on line, by phone or in person. They will fax them to you quickly or mail in about 10 days.

So, they are not asking how we met? I mean, whether we were introduced by a mutual friend, or met online, etc.? This is all about the first meeting in person? This is what has me confused.

This is very simple. Just tell them the basics of how you met. If it was on line thats ok in todays world. Not the first time you met in person but how you met.

Thanks! Yes, we are submitting the original signed I-134 with Packet 3. Likewise, I got my fiancee's birth certificate, name change certificate and her marriage certificate signed and certified by her Amphur (local government) and had them translated by a certified translation service. I also had a copy of my divorce decree notarized (certified true and correct copy).

There is nothing wrong with what you did but it wasnt required. Notaries verify signatures and have nothing to do with content of a document. It would serve no purpose to turn in someone elses divorce docs for example.
The "certification" of the translations can be done by anyone competent in both languages. The actual certification is the statement they sign indicating they are.
See the sample form I copied here. Something like this is all thats required.
