K-1 Fiance(e) Visa Process & Proceduresonline relationship vs. having met in person
QUOTE (tprak714 @ Jan 29 2009, 06:04 PM) <{POST_SNAPBACK}>
We've been romancing for only about 8 months online and we haven't even met each other yet, in person. I want to go ahead and file the I-129F without proof of having met in person. I want to bring her from Cambodia to marry in the states. Should I start the application now? Any thought would be greatly appreciated. Thanks.

You haven't met each other in person within the last two years? don't even think about filing I-129F until you've met your fiance(e) in person and have evidence to back that. Good Luck!

K-1 Fiance(e) Visa Process & ProceduresFaster or easier processing for EU citizens?
I don't know about easier processing for EU citizens but I don't understand what do they mean by easy cases. Some couple know eachother for years, have plenty of documents, photos, etc to prove their relationship and they are still on the back of the line, waiting 6+ months. How to they define who is an easy case and who is not? But anyway I guess asking all those questions won't help us getting approved any faster so we better gather all the patience we have and wait for them to make a move. Good luck to all of you and specially to my coutry mates from Bulgaria. I really wish all of you get approved as soon as possible so they can get to us (November filling) biggrin.gif A bit selfish but hey we are all impatient

K-1 Fiance(e) Visa Process & ProceduresShould I K1 or DCF or can we do both?
Hello Jessi and Iva. As far as i know you can't do both K1 and DCF. So you have to choose either to start with the k1 process and wait with her in Bulgaria or live here (am in bg) for 6 months, get married and apply for k3 in the us embassy in Sofia. I don't know which one is better. we decided to go with K1 but that's completely up to you. And yes I think you will need a lawyer even for an advice. If you want and do your homework well you will be able to go trough without him but i see you are confused which path to take so my advice is see a lawyer and just listen to what he has to say.
Good luck on your journey and have a lot of patience. You'll need it.

sorry for misspelling your name Jesse blink.gif

Hello all, my girlfriend just called from Guangzhou, and said her visa was denied because of the typical ( NOT A BONA FIDE RELATIONSHIP) crying.gif and it was the black lady officer that i heard about from other people that she likes to deny many people, hope she can sleep good tonight, me, NOT !!! mad.gif

Hi,
My fiance got rejected on Nov 3rd with the balck lady with 3 fingers missing, My finace is still crying, I filed another K-1 and hired an attorney, otherwise they can deny us again in the next interview. You should talk to my attorney, let me If you want his email.
Ramin.

Vietnam is the same way. For you 2 who got denied, when you sent in your I-129f, did you send in any proof with that? How much? What kind of proof?

I hope it doesn't sound racist (I am not at all, just stating facts) but there is a black lady who works in Vietnam who I have also heard denies everyone. I wonder why that is or if it is just a coincidence???

Background checks happen at NVC stage and, according to their employee I talked to the other day (and maybe even the forum here itself) , they seem to be happening more often these days.

It's called Administrative Processing, a.k.a. AP and it takes anything from a few days to a few months. Or maybe even forever, because the only information they will give you is - timeframe is indefinite.

Nobody knows what exactly happens there, or why. Or whether or not it affects the outcome of your interview.

Right now, some kind of average processing time for this AP mystery is 6-7 weeks. According to people who have been through it recently and happen to be members of this forum, of course. Otherwise, it's all unknown.

OK 2 more questions

1) if the NVC does the background checks, what exactly does the USCIS do?

2) has anyone ever had a case denied or sent back by the NVC AFTER it was approved by the USCIS?

Uhh. I'm far from some expert, so here are my (#######)shots:

1) USCIS does all the work that either approves or denies a petition. What exactly those things are, I am not really sure. Probably has to do with the petitioner's status (married/notmarried, USC/notUSC, etc.) I am not really sure they have the ability to check anything concerning the beneficiary. Of course, they make sure all the submitted paperwork is sufficient, too and that it meets the requirements.

2) NVC doesn't do much, I assume, if a case gets received and forwarded within the regular timeframe (a few days, as much as I've noticed). If a case gets stuck, it is for a reason basically never disclosed. I would assume that, for some people, something pops up that requires further and more detailed research (name, the same or similar to someone else's, whatever red flags.. blabla..). On top of that, I also asume that a whole lot of petitions end up being stuck in AP - at random. Those probably just sit on someone's desk until they remember to forward them to where they belong.

Badgerella, are you saying that the NVC is background checking the USC or the beneficiary at this point? Can AP happen during the USCIS stage as well as at the NVC stage? thanx

It means they have done something with your petition. Touching is always good because they are actually doing something but not necessarily doing anything towards approval

Can a touch a day after getting the NOA2 mean they sent it off to the NVC? Or the NVC received it?

I think the others that responded, misunderstood your concern. Your concern is that although you are not married, in you emails you refer to each other as husband and wife and she signs, Mrs (your last name). This is defininitely NOT GOOD but she may be able to explain it at the interview.

Yeah but she only says that in the emails but at the same time not all of the emails does she use my last name. But everything she signed like the letter of intent to marry she signed using her first and last name and it was notarized at the US consulat in Osaka. The same with her G-325a and everything else she signed only the emails is where she will use my last name. I was just worried that they may think because of the email and only the emails that we are married. I was only divorce offically for 2 days when I got to japan and the divorce did not have time to be processed through the system to be able to get a divorce.

I would suggest she stop referring to you as her husband or to herself as Mrs. ... and that you submit no more evidence that does so, then prepare both an explanation and apology for any confusion. They'll understand it is explained as some silly thing people in love do and you in fact are NOT husband and wife.

My fiance called me husband in some of the emails I sent for evidence also. I see that it is bad but why is this a bad thing? Just curious

I also had multiple trips which is a BIGGY!

Cool. Thank you. I will only have two trips. My second is in Feb and I don't expect the NOA2 until April. This shouldn't be a problem should it?

I just didn't want overkill (hundreds of pages of chats.)

Your second trip will not be a problem, it will only be an asset.

Print what you have, Make sure you send a couple of emails.

They didn't take our emails, bank accounts.

I think when they saw my 3 trips to PI over the last 18 months, they figured we had a relationship. Plus I went to the Interview.

Good Luck and I wish I was going to PI with you, I sure miss the great weather over there....

I hear you. The weather is very nice over there. It has been cold here in Texas the past couple of days. A lot of times it is nice during the day so I wear shorts and shorts sleeve but then it gets really cold at night.

I am gathering evidence of my relationship to my fiance. I had a few questions.

Is it ok to just give her copies of receipts, ticket stubs, etc for the embassy or does she need originals?

Also I am having problems printing chat transcripts. I go to history and click one but it only prints the first page. I can save it and open it. But when I do that it looks like it is in notebook and looks like something I could have just typed up.
Should I copy whole transcripts or is just the first page of one a month fine? How many do you recommend and how many pages?

Also I hardly have any emails and don't have any letters because we chat and talk on the phone everyday. There was no need. Is this bad or does it matter?

Thank you.

"There was no need." YES THERE IS AND WAS!
You still have time to get GOOD phone records. Both of you send each other once aweek snail mails. Do some screen prints.
Get her all the originals of EVERYTHING you can. You shouldn't need them and she might!

Do about 3 complete chats a month. Shoot each other some more emails.

How do I print Yahoo chats without it making it look like I could have just typed the whole thing in Notebook? I found a way to print but it only prints the 1st page no matter what. The other way I found to print will print the whole thing but it looks like it was done in Notepad and could have been made up

I am getting nervous reading this. My fiance is 19 and from the Philippines and I am 29 and am from the USA. I have a lot of phone records but they are to her cell phone. Can she bring in the phone to prove it is her number? Should I be worried? What is the best way for her to pass the interview? We are planning to be together next year and will be devastated if she isn't approved.

Can't take cellphones in USEM. No need worry as long as you have the call records. Who else would you be calling almost daily in the Philippines?
Best way to help her to pass is for you to make more than one trip and to attend the interview with her.
I've been banging around immigration forums for quite awhile and have seen VERY few denials if the fiance attend the interview. Seen LOTS of fiances kicking themselves in the butte because they didn't attend the interview and their fiancees were denied. Me included!

Thank you for the response. You were denied? Did they say why? What did you do to get approved and how long did it take?

you are making a mountain out of a molehill... make it match the BC then... how else would they know anything different... They care that you are a US citizen and not that you were born in city A in Kansas or City B.... If you want... just submit your passport instead....

I already sent my packet in though. Can I easily send them a new form or does that delay things?

If it is a "certified" BC from one of the fifty States (which demonstrates that you are a USC) then don't worry about it...

Yes I-129F and G-325A have to be originals sent to USCIS.

All attached evidence that is sent with the I-129F should be copies.

You can send a photo copy of I-129F and G-325A and the originals of the evidence to fiancee for interview.

Sorry for the confusion. I am new at this. Do I send her my original birth certificate too? I sent the USCIS a copy. Also with her brith certicate I heard that they only take certain kinds. How do I know that she has the right birth certificate?

Thank you so much everyone
US B.C. is primarily used to prove citizenship for filing the I-129F. a photo copy for interview should be fine. Some send a complete certified copy of US Passport to fiancee for interview, this does 2 things, proves citizenship, and shows a record of trips to see fiancee.

I'm not sure what will happen regarding the canceling of your work visa. If it wasn't reported to the authorities it might show up as a "we no longer need this person - sent home".

With regard to your interview, answer what you are asked as directly as possible and do not elaborate unless you are asked to give more detail. Keep it simple and I am sure everything will go well.

Let us know how it goes. Good luck.

Hello Everyone,

I am 3 days away to my final interview for CR-1. However, i am bothered with my not good past. Three yers ago i worked in one of Taiwan company. Honestly i am not proud for what i've done....with my friends we stole a scrap thing in the company like VGA for the computer supposedly as a souvenier. But the management learned about it and they send us back home. We were sent back home, cancel our visa but the company didn't turn us in the authorities. My passport dont have any stamp but only departed date. I even went to korea after taiwan and traveled in bangkok, malaysia, singapore and now i am presently living in japan. I already acquire a police clearance in taiwan and they found no conviction in my record. I am just worried that the US embassy will check on what happened with my work in taiwan. Do i have to mention this during my interview? please i need advices and support.....thank u guys!!!!!!!

When I initially put this information into my timeline back in Sept. it projected a NOA2 of Jan 6 so I have not given too much thought between then and now. But I just signed into the USCIS site and it has not been touched. So I clicked the pink to see processing times

Form Title Classification or Basis for Filing Processing Timeframe
I-129F Petition for Alien Fiance(e) K-1/K-2 - Not yet married - fiance and/or dependent child March 07, 2008

To me this looks like the Vermont center is just now processing people who applied in March of 2008 and this is about five months behind where I thought we were.

On the VJ site I look at many people with similar timelines to mine and it seems to me that they are getting done in the timeframe I initially expected. Which is correct? When should I expect the NOA2?

K-1 Fiance(e) Visa Process & ProceduresI129F Form and exceeding the space alloted
Hi,

This question is for the I129F but I think could be for any of the forms really. They are in PDF format and you just fill them out but if you enter more text than the space allows it shows a + sign. On the PC it is ok if you are viewing it electronically but printed out it only shows the + sign.

So the question is if it is better to abbreviate or even truncate the response to that section if it runs over as the printed version does not show the entire text just the + sign.

Thanks for the advice!

K-1 Fiance(e) Visa Process & ProceduresRedacting letters and other supporting papers
Hi,

In thinking of supporting documentation such as letters, credit card statements, chat transcripts and the like - will it be seen as prejudicial if certain parts of those documents are redacted (blacked out)?

If so, thinking to just leave them off -but for example, my credit card statement will show some supporting charges but I am not so keen to show all charges to US CIS nor to reveal my complete credit card number to God know how many folks going through the paperwork.

Likewise some of the letters/chats have some short and personal passages that are not directly relevant so thinking to just line that out and present the rest that does support the petition.

Greatly appreciate any advice/past experience with this.

Thanks!
