I am a US citizen who has lived in Thailand for the last ten years.  My fiancé(who is Thai) and I plan to move to the United States and marry there.  We expect to settle in Fort Lauderdale.  How do I fill out question 28 on Form I-129F(Address in the United States where your fiancé intends to live), as I do not currently have an address in the United States.

If you are sure you are going to marry why not do it in Thailand and then file for a C R 1 visa using the DCF method? There are many advantages in this including the use of a co sponsor. DCF will save you a lot of time and some expense as well as giving her a green card very soon after arrival.

OH my world, how in the world will someone steal that. What airport was that and are there no camera's around. The document was so important it should have been placed in the curry on and not placed in the regular bags for cargo. Any ways i hope USCIS does something positive for your fiance. Good luck

These docs should never be placed in anything that is out of the possession of the person with the visa. If they are put in a suitcase that goes in the cargo area the bag would be on the other side of the POE anyway.

I hope the O P will do as V & T suggests or they may have a huge problem.

I wanna jump in here real quick, since it seems that people know what they talking about! If we submit the 1040 and w2's, will we get the original documents back??

I doubt you would see those again as this type of info becomes part of the case file. There is no reason to submit them because you can use the transcripts or copies of the other tax info.

Sorry if it was vague. My fiance is from the UK. I have worked on and off since I graduated high school but I'm still about two years away from getting a degree so I can't do more than about 20 hours of work per week while I'm in school. But hopefully that combined with my dad backing us will be enough. 

I'm one of those people who worries a lot so it's kind of been weighing on me, haha.

The U K will accept co sponsors. Worry is part of the journey but the more you learn the easier it becomes to understand where the future lies.

The rules of the K 1 require you to marry within 90 days. Once that is done you may decide to file the AOS which will result in a green card for her. That allows her to work and the AOS process allows the use of a co sponsor.

Hi, guys!

My fiance and I are getting ready to send out our K-1 packet and there's something that's really freaking me out. I know that I will need to show I can support him financially but I am a full time college student and only work sporadically. However, my father, who I live with and I believe still claims me as a dependent on his taxes, has agreed to co-sponsor for me. He is gainfully employed and more than meets the requirement and he really wants to help us out. Will his income and sponsorship be sufficient to allow my fiance to move here?

The post is vague so its hard to know what to tell you. For example the name of the country your fiancé is from. Not all of them allow co sponsors. Check with your countries embassy to find out.

If its is allowed and the fathers income is sufficient there should be no problem.

I am filling out the I-134 and I understand that London would like to see a copy of my pay stubs, W-2's, and Tax Returns. However, I filed my taxes on Turbo Tax so I was wondering if I am allowed to print out my Turbo Tax returns or if I have to write the IRS? 

Its best to use the IRS transcripts. Turbo Tax returns show you filled out forms only.

I'm an Au Pair from Thailand on a J-1 visa .My boyfriend is U.S. Citizen.I been here almost a year and half, we've been dating for the last 10 months. I have to return to Thailand in November. (My visa expires in 20 October it's will be soon. but has grace period 30 days after finish Au Pair duties .so can we start k1 visa now While I am in United States?or I have to wait until finish aupair program in October ? I believe he can send the K 1 petition in no matter where you are at that time. It just means you must be in Thailand to interview for the visa. Do not over stay you present visa.

The other option is as Penguin says. Stay and marry. But if you need time or want to return to Thailand and your family, plan on being there about 6 to 9 months.

It would be a good idea to include in your addiction that fact that Thailand isn't the P I for example. Beware of well meaning people that aren't familiar with the methods of embassy in Thailand. For example in Thailand for K 1 cases co sponsors aren't allowed in 99% of cases.

A church cant be submitted as a sponsor anyway. It must be an individual who is a USC. That person should be a family member or a close friend.

Submission of the 134 is part of the P 3 docs which are sent after the case is at the U S embassy I V section in BKK. At least one years tax transcript should be submitted as well. The embassy requires a wet signature on the 134 so it must be mailed from the USA.

I am from Thailand and I have tourist visa for multi entry. I would like to go visit my fiance in the state while I m waiting for NOA2. I got NOA1 since May 31. Since I m not sure how long it will take  but i just want to go visit him and his family. Is it ok if I will get NOA2 (or even package3) send to my home in Thailand  when I am still in US ?  then when my family in Thailand inform me that  the package3 has arrived I will fly back to Thailand and have an interview.   and  does package 3 has time limited , I mean how long we can gather all the document before we submit package 3 to US Embassy in Thailand?

NOA 2 will be sent to the USC not to you in Thailand. The case will then be sent to NVC and on to BKK.

BKK will notify you to send P 3 docs including police report and medical. Your fiancée will need to send or give you the 134 and tax transcript for at least one year.

Submission of the P 3 docs will trigger the interview date to be set and you will be notified of that date. Do not submit the P 3 docs until you are certain the case is with the embassy I V unit. If you send them in ahead of time they will be thrown in the trash. There are no files maintained by the embassy for such things.

Do not assume what happened to a citizen of Canada will have anything to do with you as a Thai. Its possible you would be allowed entry into the USA but its possible you will be denied entry. You will have to arrive with any info you have the proves you MUST return to Thailand.

My fiance' and I have prepared everything that we need to send our I-129f package tomorrow. I have read from 

Step-by-Step Guide on How to File for a K-1 Visa that we need to make TWO copies of the entire package before we send it in. Why is that? Is it okay if my fiance' just scan the paper works he filled in and email them to me instead of printing out the entire package?... what about our photos that he sent.. should he print 2 copies also?   

 

You are getting a lot of incorrect info about what to send and when. I don't see any comment about how the USC will overcome the support issues. He should figure that out before he sends in anything. You could both be very surprised in the future and now would be the time to decide how to approach that subject before you spend time and money in the wrong direction.

Thank you for the big lesson. rose.gif . Sorry if I my words are unpleasant for you.

In this immigration ordeal there is a lot to be learned by all of us including me. Believe me I have made some too.

We will see in this case what will happen when this issue of support comes up. The problem is only two people have to live with that outcome.

I can tell you and others that in at least 4 cases I know of co sponsors were accepted. I helped in each of those so I know what took place first hand. I am hoping this couple will understand what I said to them and at least try to implement the ideas if they are too have any chance at success. To submit the case without doing anything other than the normal things will result in a denial in my opinion.

These cases are truly unique. Therefore those unique qualities can sometimes be used to overcome difficulties. For example the USC in this case is a student that will graduate in March. That coupled with the fact they can file the AOS one day after they marry. This means the real time of the support problem isn't really that long because they CAN use a co sponsor with the 864 during the AOS.

Presenting all of this in the right way can spell success in the issue of support. The key is to get the officer to see the level of understanding about the process and the timing of that as it relates to this unique situation.

Let me know if this makes sense to you now and if you agree something along these lines will be the best chance they have in a K 1 case where the embassy doesn't usually accept co sponsors.

 That's what I told her. Big apologize!

Maybe what can be learned here is to realize there is more to this than you might think. I know you meant well and I know she just didn't understand the total circumstance she was about to enter into. This is exactly why I tried to let her know.

Lets try to help her figure out what is best to do now. I have sent her some info to think over that should help her and the fiancé understand better what they can do.

I do believe in Karma and hope you now see it in what has taken place. Ask your friend and mine, Nicollet about this. Then put me on your friend list if you want.

Go back to Sept 4th. Read the last post. Then tell me you have read all the posts.

You began on the 5th. She said they were sending in the petition. Go back to the 4th again and ask yourself why they should do that on the 5th.

Ask your friend Nic who helped her with her situation. It wasn't you I am sure of that. You probably should have told the O P to talk to her first. Karma?

For the OP situation, again, read each post. I could've just gave any advise whatever I want. But, I do know the beneficiary comes from different country from mine. Why didn't you tell her to stop? She said her fiancé cant provide support at the level required. She said she thought they could use a co sponsor. She gave you all the correct info to arrive at the correct advise in her exact situation.

They shouldn't have filed the case until they fully understood the support issues as they relate to Thailand.

You never said one single word about the most important aspect of the case. Tactics and strategy? Noise before defeat? What about that?

The rest of what you wrote is ridiculous. Karma? You believe in good karma? What about the concept of bad karma?

I am done with this now. Learn to live with what you have done before you attempt to lecture others. Take responsibility for what YOU do.

Please stop putting out this advise as though it were correct or even applied to her situation. You have helped her or rather the USC file a case with no thought to the most important aspect . Support for example.

What exactly do you think she should now about the problem of support? Should they have paid the fees and filed the case with no knowledge of the end result? Go back and read what you said.

Then read again her post about the reality of the present situation.

My fiance's interview is on September 30th.  Originally, I had decided to use a co-sponsor because I was working 3 part-time jobs and wanted to be on the safe side in terms of looking financially viable.  However, I was recently offered a full time position that would cover the financial requirements for the k1 visa.  The job starts on September 9th.  I would be letting go of 2 of the part time jobs, which means working 1 part time job, and 1 ft job.  I'm not sure how to reflect all of these changes on the I-134.  Do I still need a sponsor?  I don't have any paystubs from the job that starts on the 9th of September, but I have a signed letter from my employer stating the position, the salary, etc.  Please let me know!

You don't need to indicate income you no longer have. The current income is short lived so I would submit the cosponsor to help ensure success.

Even if you have pay stubs it would only show a few weeks. Submit tax transcript to prove past income and tax status. Letter from job is ok but anyone could question it. What is important is your ability to prove support.

Yes if you have an interview, the IO can ask for originals of anything in your file. They are not typically asked for though, since the divorce decree has been dealt with and taken care of with the I-129F petition/K-1 visa approvals. A copy of the divorce decree is not a requirement of the I-485.
 

We were surprised to find we had to do it again but of course couldn't argue with the officer. She had what he submitted to Thailand on her desk as we talked.

You only need a copy for the USCIS service center, so scan or fax should work as long as it is clear and legible. You should send a copy of your entire divorce decree. Some people have used only the page with the judge's signature and court seal and been fine, but others have received RFEs, so to be safe, I would send in a copy of your entire decree.

 

The consulate can ask to see an original of everything you sent with the petition though, so when the USC petitioner gets a new copy from the court, he may wish to get more than one so he can supply one for your K-1 interview later.
 

Divorce decree is not needed for AOS, just your new marriage certificate.

My husband has submitted the doc to USCIS as you say. The embassy looked it over and approved my visa.

At my AOS meeting we were given an RFE that said to submit the original doc with the judges signature and court stamp. It took contacting the court in another state, paying with certified funds and two weeks to get it. The whole thing set us back at least a month.

My boyfriend can not find the divorce decree since 17-18 years ago he can not remember the date. But he recognized that the court where the divorce court to proceed.

 

He divorced at Harris County District Clerk Houston, TX.

We are worry so much.

He does not need a copy of every document in the decree. He needs the document with the court stamp on it. We submitted ONE document to the embassy in Thailand. I don't know if they will accept a faxed or scanned copy so the USC should ask. This doc will be needed at the AOS stage anyway and I know they wont take a faxed copy.

Follow the instructions. Notaries verify signatures not content.

The 134 is used for K 1 type visas. The 864 is used later for the AOS or in other types of visa cases.

Hi all

 

First of all thanks for collectively being such a great resource. With great thanks to the people here, we've filed our I-129F and received NOA1.

 

I'm just looking for clarification on domicile requirements now. We'll be using a co-sponsor as my American fiance is living with me in New Zealand temporarily (he arrived a month ago) until we return to the US.

 

We made a decision ages ago that we couldn't wait in uncertainty any more for a ruling on DOMA, and that he would make arrangements to come to New Zealand - on a temporary basis if there was a ruling in our favour, or more permanently if there wasn't.

 

He has given up his apartment and full time job in the US (he is also a self employed writer), but has kept all of his furniture in a storage unit in New York. Our intention, should everything go to plan, is to travel to the States in late February to coincide with his best friend's wedding - they're going on honeymoon so their house will be empty for a month, giving us a place to stay while we get ourselves sorted again.

 

Any suggestions on what we can do to prove domicile would be really helpful.

I am tired of reading hundreds or even thousands of old yahoo...FB...MSN...Whatsapp chat logs from when I first started talking to my fiancee in 2010/2011. If I were to print alllllll those chat logs to choose which ones to send in from 2010 to present, I'd kill about 10 trees....its just too much and I am overwhelmed as to what I should do. I want to send a couple pages each year  to span through out those years to show progression of our relationship but I cant take reading all that anymore....Im even at a state of crying Im so freakin overwhelmed with all this...I want everything to be perfect...I dont want any RFE and I want it to go smoothly....Im sorry I just needed to vent but also still at a loss as how much is too much bc Im becoming OCD about this...HELP!!!!

Try a little logic. If you were the officer what would you do with a written mountain of this type of chat. Keep in mind these people are busy and at least one is working on your case. Send in a few pages from the beginning, a few from the middle and a few more recent pages.

We filed our I129F packet in August, 2 weeks after that my fiance' moved to a new company. His job description as of the moment is "temporary". Is this going to be an issue during the interview? On our I129f we mentioned his old company since he's still working there and we also used it on our affidavit of support which was included in our packet. We received the approval of our petition on September 27. We are awaiting for our case number to schedule my interview.

We're going to update/ bring a new affidavit of support for the interview which is his new company. I am just worried that we'll have a problem with this since he's not employed "full time". His annual salary is above the poverty guideline, 125%. But the job description on the employment certificate will be "temporary".

I need your help guys. Being away from someone you truly love is difficult. I want to be with him soon.

It doesn't matter if the job is part time or full time as long as the income is sufficient. If the job is described as temporary that could be a problem.

I see you believe this is all part of some gods plan. If that's what you believe I don't understand why you would spend one second worrying your way thru this at all. If your god approves of this then you will have what that god wants you to have. It seems USCIS isn't even part of the problem even though they must approve the case. I don't see why you would lose sleep either. Sleep well as you await the days and nights ahead and understand you are simply part of that " perfect timing ".

I am the petitioner but not employed. I am disabled and draw social security disability income, $18,185 in 2009. I also have savings and assets. So I cannot get my employer to verify employment, neither am i self employed. I still deserve to have a fiance. I still deserve to have my fiance's visa approved.




My husband also receives social security disability benefits and from what i know it doesn't make a difference. He got a letter from ss stating he receives benefits and how much etc. so that i could send it in with my aos application. I don't think it matters and if it does matter to them then that is so some serious discrimination.

K-1 Fiance(e) Visa Process & ProceduresQuestion about Form I-134 Affidavit of Support

Hello all! My apologies if this has been addressed but i have just a quick question. I work two jobs. How would i state that on the I-134? It has a place for the primary job but the second job needs listed as well and there really isn't a place to put that on there. I could add it as a supplementation, maybe? Any advice would greatly be appreciated! Thank you!

I'm waiting on packet 3 and confirmed with someone else that the fee is $240. Don't worry about that. I've seen the email they sent and it has several outdated forms attached. Email them the ds-230 and print the rest to bring to the interview. I may get all the updated forms online instead of using their old ones. Bring the multiple copies listed online as necessary. Our NOa 2 was may tenth sleep.png seems like they skipped right over us... Good luck to you anyway

Right there with you!! I've been so stressed and ours was approved May 23th..i'm getting really frustrated! We called multiple times and emailed..no answers..just the old "you'll hear from us soon" None-the-less, good luck at your interview, guys!!

Hello everyone! I hope your journeys are going well! We sent in our DS 230 and are currently waiting for an interview date..it's been 11 days so God willing, hopefully soon!! I just have a quick question..

 

Our co sponsor finally sent me all the documents needed for the interview (when we have it). She had to wait a long time for her employer to do up her statement of employment. I mailed out the documentation to my fiance but i'm scared to death that he may not get it in time. I also sent a set to a friend who will be travelling to Tunisia but she's not sure exactly when yet as she was having some issues. I sent it to my fiance the fastest way possible via USPS..but i've sent stuff the quickest way before and it still took a month to get there..DHL costs wayyyyyyyyyyy too much and i would have had to drive over 30 minutes away to mail it out as that was the closest facility. I made colored copies of everything before i sent it.

 

Our dilemma is: What do we do if he doesn't get it in time? Would it be okay to scan colored copies and email it to him to print out? All have the original signatures, dates, etc. It would just be a copy of the originals. Would it be acceptable for the embassy to have the copies and he could tell them that the original documents are on the way in the meantime? This, of course, is worst case scenario in the event that he WOULDNT get it in time..

 

Any advice would greatly be appreciated!! Thanks so much!

an advice that i can say is asked a CENOMAR (certificate of NO marriage) from her. If she can provide that with the recent date , then she is not married but that guy who messaged you might have able to access her account and made some false stories.  The best thing is talk to her personally. If she is married, theres no way the woman can apply for a fiancee visa without finding out in the USCIS stage first.

This is my first time posting in the forums, however I have been using visajourney for information for months now. It's a wonderful website that has helped me understand the visa process better.

Even tho I feel somewhat comfortable with the process my fiancee (from the uk) and I (US) was still considering hiring an immigration firm to help us with the process as we are extremely stressed out. We have known each other for almost 2 years and have been waiting on starting this process for 6 months now.

Ive called two places (K1,K3 visa assistance and Power Visa) when I asked questions about the financial support aspect of the process where I have to prove I can support my fiancee and I. I got some different info and now I'm a little unsure of what to think. So here is my question..

My current job Ive only had for about 6 months now. Prior to that I was laid off but I had plenty of savings to support myself untill I found a new job finally. As you know the economy was bad a year ago and still is. I was lucky enought o find a good paying job that is stable and I have already been promoted even. I do make over the 125% poverty line.

Problem is from what Ive been told is that they will want W2's as part of the proof. Mine won't show that I made over 19,000 dollars as ive only been employeed for 6 months of last year. I do have sheck stubs from the last few months, and some savings. I was told by one firm that savings, and other assets do count. The other told me that that doesn't count and I would have to get a co sponsor for that part of the process. I have little family left and no friends that I could ask for such a thing.

So any information regarding this part of the K1 process would be greatly appreciated. We are desperate to figure this out as its the last thing we are trying to understand so we can get this started.

I have a question . How long will it take after i get packet 3 in the mail to get an interview? what if i messed up on my petition because when i sended it to uscis i wrote that we met in 2009 which i was mistaken we met 2008 2 months before 2009 .i didnt want to start over because my lawyer said it would be a lobger proccessing time to fix everything should i just be honest in my interview?

Interview date will be set according to the existing work load at the embassy.
The small mistake you made shouldnt be a problem. Be honest in this and every other aspect of your case if it even comes up.

So... find one who meets the poverty guidelines. Does your USC petitioner work at all? Or have any assets or income? If the income requirements can't be met either by your petitioner (main sponsor) or co-sponsor then you're going to be refused the visa under Section 212(a)(4) which prohibits the issuance of a visa to anyone likely to become a public charge.

I find these sort of posts fishy. Seems like you know what your problem is and what is required to solve that problem. Are you insinuating in your post that you are looking for a co-sponsor on this forum? If so, all I have to say is :rofl:

How did you read that into what the OP said? They indicate they have an interview a few short weeks from now. There isnt much time for anyone to do what has to be done let alone asking a total stranger. Also I suppose the OP knows the co sponsor, if allowed at all, must be a family member or close friend to be accepted.
