Hi Guys,

I finally sent the packet to USCIS on monday and just realized that I have made a major mistake. I think I may not have attached my fiance's photo with the G-325A. Every thing else is in order.

So, I called USCIS to see if that could be a problem and the gnomes that are sitting there have NO answer for this. I called twice more and each time I got another gnome or gnomette and just told me to contact a immigration attorny. WHAT? I about reached thru the phone and .....

Sorry if I sound so pissed off, specially when I am the one who made the mistake.

Anyway, may be you guys can help me with this.

1.) First of all, how much trouble I am in? --Scratch that, I am already in trouble with the ONE
2.) Will the USCIS still start my application and put me in line and just ask for a photo?
3.) IF not then do I have to start the whole process again but loose the fee I already sent?

All you can do is expect the RFE & respond to it with the photo. I did almost the same thing; got the RFE. It cost me almost 3 months.
Your case will be processed to the point the photo is required & then put on hold until the photo joins the case by use of the RFE.
You will not be asked to begin the case again or lose the fee.

Immigration based visas are approved by USCIS & NVC. Tourist visas are submitted, approved & issued at an embassy. The problem with having a pending immigration type visa can be at the POE. The officer there may turn the tourist away when they find the pending petition.

When you enter US on a K1 visa you will have to get married within 90 days since your arrival.You can apply for a social security number before or after marriage and also apply for a permit to work.

Any S Security card issued prior to green card can not be used for work. You can not get an EAD prior to AOS application. You can apply for EAD with your AOS. My wifes EAD arrived 30 days after the green card so was worthless. You will take your green card or EAD & other I D info to S S office to apply for the card. It will arrive within a month. If you apply in your maiden name the card will have that name. If you change your name you will need to get S S card changed as well.

No problem.... just a word of advice on hiring lawyers, as a matter of law you are required to receive an "engagement letter;" that letter lays out the terms of your relationship with the lawyer, including fees. Make sure you read it and understand it. For example, if the lawyer is only willing to do X amount of work for Y amount of money, that should be spelled out. If you can't live with the money the lawyer wants you to pay or the fee structure, find another lawyer OR if it is not a big firm, negotiate the terms of the engagement (few people take the latter option). A lot of people get burned by skimming the fine print or not feeling like they can/should ask questions and negotiate. AND it sounds like your lawyer may be a jerk--the answer to this question requires no time or thought from a trained immigration lawyer.... even their secretary should have been able to answer it.

YES, it is super important that you list your daughter. It is ok that he is not listed on the BC, but I would have it and the signed paternity statement available.

You do not need to state that she will accompany him, as I assume she is a USC and that question is really asking who are the derivative beneficiaries of the application (i.e. who else needs a visa). If you are paranoid you could submit a supplement to question 5 on the DS-156K explaining your situation, but I would just check "no" to both options in number 5 (the child will neither accompany nor follow the K-1 because your daughter is already in the US).

Letter of intent is simple, Just put your address at the top and the date and put To: US Immigration and say I John Doe intend to marry Jane Doe within 90 days of entering the USA with her K-1 Visa.

and sign it


It's that simple, that's all you need

and she needs to do one too.

It's less than 1 year old, says April 2009, it couldn't be outdated already, but I will check with them and find out for sure.

I'd say she wound up with a jerk for an interviewer, it could go either way. I really don't think they should have a right to deny a US Citizen a wife, they don't do anything about these illegals coming over here and they take welfare too and they don't stop that, but they complain about a good US Citizen.

It would have been better if she said in the future you plan on having kids when you both have plenty of money, because you don't believe in having kids unless there is plenty of money to take care of them.

All you can do is pray, We got to pray just to make it today.

Normally they will tell you right away if you passed, so it doesn't look good if they have to think about it, but it's not no until they say no.

I know this info is here some where but I still find this site confusing,please forgive me but my question is once a k1 is approved and sent to the embassy how long do they have before they must act on the case?,my girl was approved,her papers were processed at the embassy in abu dhabi on 15th of april 2009,she went for her interview on july 6th 2009 but was given the blue slip,since then we have provided them with all the info the blue slip asked for and as of now we still wait for our number to come up,I thought I read some where that the case has to be dealt with by them within a certain amount of time,I thought it was 12 months,that 12 month period is almost on our doorstep as today is the 19th of january 2010,do you think they could be waiting until the last moment to see if we are going to give up or somthing?both of us were so nieve about the whole process and now it feels like were getting bent over a barrel :angry: am I way off base on the 12 month time frame thing?I know they have to deal with it at some time,they can't just let it hang forever can they??? :crying: thanks for any help everyone :unsure:


I've done this 3 times and never had a problem, they have always been quick, but then I am always well prepared and I make sure my girl is well organized. This is the last time I will do this.

You must have made a mistake along the way, but still it shouldn't take this long. I would think since your girl is in Iran, not many people marry an Iran girl, so the embassy should be empty. I didn't even know we had an embassy in that country.

All I can think of is, you can write a letter to the Immigration in America and ask them what is the problem.

You must have some kind of emails you can print, or if you have to, start emailing now or logging now and she can print something out to take with her and she can always say there was a problem and most got lost.

You must have sent her a couple of greeting cards, so she can use that.

Just do the best you can, most of the immigration officers are nice, and as long as you have everything else perfect, then if you only have a few pages of email or a couple of cards, it might be ok.

I did this 3 times and all 3 times they never looked at the stack of 500 pages of emails, but you need to have something, you can't give her a ream of blank paper with one email on top.

Do it yourself. Why pay for something you can do yourself. It's very easy, it's like filling out a credit card application.

Just make sure you read instructions and check it over and over to make sure you got it all filled out right. Don't leave blank lines, put None or N/A or they will think you forgot to fill out that line.

and read about what you don't understand on this site, and don't forget to put the check in with the I-129 form, they have to have the money, money makes them happy.

Make sure you have job, they require that you make a little bit of money, it's not a lot, but some people seem to think that they can do this on a minimum wage job and then they get surprised when they find out they don't make enough money.

Then get ready for all the fees they charge. It's going to be about $3000 in fees to get through this. When I first did this a few years ago, it was less than $1000

This means your case has been send back to USCIS for review. Generally, this just means more time in processing...dont lose hope.... if you do not hear anything within 5 months, you can create a service request. And then they will be obligated to reply.

I hope not but if your application gets denied you will receive very specific reason as to why it was denied. Instead of appealing, file a new one while making sure you address the previous denial reason sufficiently.



If it is denied must you pay the 455 dollars again to resubmit? (Assuming this is for a K-1)

One issue that was major for me and my wife that hasn't been mentioned yet is the issue of separation and timing. My wife, the USC, comes from a large Italian family, with strong traditional values. It was important to her, and therefore to me, that we have only one wedding anniversary, and no separation after the wedding. A CR-1 would have generated two wedding anniversaries - a "legal" wedding, probably in Canada, with a Justice of the Peace, to start the visa process, followed by a significant period of separation, followed by a larger, "real" wedding, with all of the family, after my arrival on the CR-1. Which anniversary do you celebrate every year? When were you "really" married?

We weren't really comfortable with that, so we went for the K-1, even knowing that it would cost more. It was worth the extra money to only have the one "real" wedding and anniversary, and no separation after the wedding.

Your mileage may, of course, vary, but it's something you should discuss seriously with your fiancee.


Oh we have... we've shared similar concerns and we're working out what will be best for all. Thank you for your views on this though!

Right now the period of separation will allow her to work, which unfortunately is turning out to be the main deciding factor. She will need to buy a car once here, etc so we're going to take the time to work up a substantial buffer of funds. xD Fortunately during this time we're learning more and more about the processes and we're starting to not be so worried about them! lol

If you make $10.25 an hour, and work full time (40 hours/week), you should be pulling in over $20K annually. It's your before-tax income that matters.

You have to meet the income requirements, or have a co-sponsor that meets the income requirements, regardless of which type of visa you choose. If you choose to go for a K1, then the consulate will want evidence of your income with an I-134 affidavit, and USCIS will want it again with an I-864 when you apply for AOS. If you choose to go for a CR1, then you'll need to submit the I-864 before the visa will be approved. Either way, you have to meet the income requirements.

What they want is proof that you can support an immigrant, even if the immigrant isn't living with you and sharing household expenses. A divorce wouldn't relieve you of this obligation, and the US government doesn't want the sponsored immigrant living off the taxpayers. 125% of the poverty level is an arbitrary number they seemingly pulled out of a hat. In some states, you can live quite comfortably at this income level. In other states (California, for example) you'd be lucky to afford a bachelor pad in a shady part of town. In any case, this is the threshold they came up with, and the one all of us have to meet.

Frankly, most people who have a tough time meeting the income requirements will also have a tough time with the expenses of marrying a foreigner and helping them immigrate. Even with a fiancee from nearby Canada, the expenses can add up fast. In my case, the fees I paid to the US government were a small fraction of the total costs.

If you go for the K-1 then you must marry in the US. If you choose to go for the CR-1 then you can marry anywhere you like.

With the cost of traveling to Montreal vs. the cost of adjusting status, I suggest going for the Cr-1. It is a superior visa if you ask me.

Now, a denial is rare in Montreal (for typical cases) because it is a low fraud country (not to say that it is unheard of). If there is no criminal activity or visa overstay or other illegal activity, and your relationship is solid, you should be fine. However, if the Cr-1 is denied, you may apply again, with all the associated costs paid again, but you will have to overcome the reasons for denial. If you are denied adjustment of status then she will have to leave the US. Either way, a denial will make it VERY difficult for her to ever visit the US.

But again, denial should not be on your radar if your relationship is solid and there are no aggrevating factors

Its only on my radar due to the I-864! =S I make about 16-17k a year at 10.25 an hour working full time and it still isn't enough for this poverty line. I don't know what kind of job they expect me to have lol.. but I'm trying to get a second job at the moment just for this situation. I live comfortably as it is by myself and if she comes here with a CR-1 she'll be able to get a job and we can share costs making it even easier for us both. This poverty line situation on the 864 is what's really scaring me... everything else is solid for sure! ;)

EDIT: We're definitely going to consider the CR-1! Thank you guys for the info! Just worried about this sponsorship stuff now =S

If you marry and get an approved Cr-1 she will need to move to the US within 6 months. When she does, a green card will arrive in the mail

An interview and medical are required for any type of visa. Where in Canada is your girlfriend from? This will determine where the interview will take place (unless it's a CR-1 visa and then it wil be through Montreal)

Shes from around Vancouver, but if we did the CR-1 she'd need about a 600 dollar plane ticket and a hotel, unless she stayed in a hostile. But still it looks to end up being about the same cost for the K-1 vs the CR-1..

So if I understand correctly:

The nice thing about the CR-1 is we'd only have to be worried once (interview) and then she can come here and get her green card.
Vs.
The K-1 where we're worried twice, once for the Visa and once for the AOS =S But she would be stuck here not able to do anything...


How about if the CR-1 vs the K-1/AOS gets denied? Whats the process we should take after that? Just resubmit CR-1 for 355 dollars? vs. an AOS being denied, we need to resubmit for 1010??! Does she get kicked out? Thus we need to redo a K-1 to get her back in? CR-1 sounds less frightening atm lol.

Ok so I've looked into the K-1 visa relatively thoroughly. My fiance is Canadian, I'm a US Citizen... she's been to visit me twice now, I've been to visit her once (twice very soon)... We've known each other for nearly a year and a half and would like to get married and settle down in the US.

For those of you who don't like to read details find the ####'s at the bottom ;)

For the K-1
  • Initially I need to file a I-129F (455 dollars)
  • yadda yadda happens and she gets her interview... (131 dollars)
  • she needs to get a medical exam (~100'ish dollars)
  • (any other fees?)

Now on to the visa being used to cross the border... once here, we have 90 days to marry. (I-94?)

  • Soooo, we marry...
  • After marriage, but before the I-94? (90 days) is up we file for an AOS... (!! 1010 dollars)
  • and wait for green card / ability to work for (XXX long?)

All said and done I've seen it quoted to be around 22-2300 dollars for the K-1... not horrible, and a decent amount of work/effort/time/fright (lol). I think I've bulleted most of the main steps... feel free to add/correct any problems.

But still if there's a better way, I would like to investigate it! Which lead me to find hints about this CR-1.

From what I understand (it's taken me about 2-3 months to figure out the K-1 on my own! LOL so I don't understand very much apparently ;)) it would be possible for her to fly down here, marry me and return to Canada***. I then file a CR-1...

...aaand what happens? Does she get a packet and an interview like the K-1?
Does she need a medical exam? (Seeing that they need an I-864[? the income support / sponsor document] I'd assume one is required just for that in this case?)
It seems she's granted a visa AND a green card right away? (Awesome! if so, no more 1010 dollars! xD)
What happens after the CR-1 is accepted?

It seems like it's too easy... lol However, do we need to be married -here-? I am planning on visiting her sometime in the future to meet with some of her extended family and her next trip here was going to be the K-1 and moving in! xD


If any of you can help me compare or explain in our case which would be better please do so! =D


***Mind you, she'll need to come here twice in the CR-1 case, which is gonna be a cost of around 400-500 dollars for a plane ticket extra -if- we need to get married in the states. However I think it'll be at least a few hundred cheaper, but definitely a lot less hassle?

Trips you guys went together? Those should have stamps if you traveled to another country there should be date stamps.

Well now you've confused me as well :lol:

So, dot, you're the American petitioning for your Canadian fiance? And you live in California but you're fiance lives in Edmonton, correct?

There are only two consulates in Canada that process immigrant visas- Montreal and Vancouver. If you live in Western Canada you interview in Vancouver, and if you live in the eastern portion of Canada you interview in Montreal. The American consulate in Calgary does not process visa's of this type, unfortunately. So yes, your fiance will need to fly to Vancouver to attend his interview. The American doesn't need to attend, but you certainly can if you want.


Yeah you are right, I'm in California and he's in Edmonton. So only he needs to interview right? Do I need to go to any interview? So I guess I will be sending him the packet of stuff I prepare to send to the USCIS too? :huh:

Okay so basically after the stuff approves he needs to go Calgary (US embassy) to get medical exam , and then he flies to Vancouver for interview ? :oo: And I just sit back and relax at home and wait for the results? - The poor dude :whistle: :lol:

If you're from Edmonton you'll be interviewing in Vancouver. Vancouver is the faster of the two consulates :thumbs:

For photographs, I would actually try to get a second set developed. I don't really know how well a photocopy would turn out. Sometimes if you're lucky and you ask nicely they will give you the pictures back at your interview.


I'm going to try color copies at a shop :) The reason is I don't have the digital copies. some pictures are given to me from a friend that took the pictures, back in the days with the regular ol camera :] Hopefully it will be a breeze since we dated for 10 years.

So about Vancouver thing, Am i supposed to fly there for an interview?! I thought it would be in California where I live. :(

This US embassy closest to Edmonton is in Calgary.

Absolutely. After spending some time reading reviews and personal experiences from Canadians who interviewed in Canada's two K-1 processing consulates (Montreal and Vancouver) you will feel a lot better about what you face later in the process. Many of us have commented that the interview is actually the easiest part of the process.

You don't need to provide any originals of any evidence you are sending in with your petition, just copies. Save the originals to bring to the interview. Although they will probably not be needed, it is always nice to be prepared.



It's actually Edmonton, Alberta, Canada. I'm not sure if it would be the same as the Vancouver and Montreal? But I'll take a look . Thanks for the tips. I will send in photo copies of photographs then? Do you think it will turn out looking fake? Or should I get colored copies? :I

It seems like I will need the real copy later on for Immigration or Consular officer??? as given on some cover letter samples.

I'm still struggling to put my petition packet together, I remember there was a checklist on this site but I can't find it now. :(

So this is what I am confused about:
(1) For intent to get married later, I know that with my packet I need I-129 form, and G 325A form, but do I also need to include notarized letters from friends and family? AND/OR a letter of intent from both the applicant and the beneficiary to be sent into the USCIS???

Or Am I supposed to provide the letters of intent and the notarized stuff after my fiance arrive to the USA?? :blink:

(2)Am I supposed to have some sort of PROOF or something that we are intending to get married? We're both filling out forms isnt that enough clue that we are trying to get married?!!!!!! (3) I'm suppose to copy my birth certificate front and back, but there's nothing on the back, what am I suppose to put on the back?!!!!!! :wacko:

(4) Lastly, When am I suppose to indicate I am unemployed and need a co-supporter? Is this part for later on ?? I'm confused :crying: STRESSED OUT!!!

The Passport Photo in my passport is what got me confused, it does not match the example in the Document. However the second set of passport photos I took in Colombia is the same as the Photo in My Passport, but does not match the specs in the document referenced above.. So that's the reason it was confusing to me... No Problem now, I'll follow the Document for Dept of State and send the 2" x 2" Photos...

However, the second half of my confusion is as follows...



In the guides it says to make two copies.. No Problem, Done... I've got more than 2 copies, so real good shape there,...... But do I need to send a copy to the USCIS or is one orginal ok? And if I need to send additional copies, do I need to send additonal passport photos as well to go along with each copy.. This is why I'm concerened.. I have only 2 Passport Photos of my fiancee which matches the documentation above.. so if I need more, can I have the photo's copied at a photo center?

Sorry if I seem slow, but really want to get this submittal right...

2x2 inch photos are correct; 1 inch from the top of your hair to your chin; and for your copies, my instruction only says to send one, i guess we can send 2 of each just in case they need it? :)

If you are worried they need more later on, see, it's better to take your own photo, then at least you have a copy and u can redevelop more later on if you need to. I did my own photo with a white wall, and then just use this website to make it a passport photo perfect.

It's free and easy. I just did that and sent it to a store to develop. 19 cents for 6 photos, what a deal! :)

Since the instructions say to send a photo for both parties I am at a loss to explain why you would think only the beneficiary needed one. Any passport type photo will work, the instructions also include details of what the photo should be like. You can make your own. If you do not like your photo, make a new one. After you (petitioner) send it in, you will never see it again.


Thanks, I've already gotten a photo, I just didn't want to retake it :) I look ugly in the photo, but if I will never see it again it's okay I will send that one in :lol:

Regardless of the consulate, they'll use a photo the visa applicant carries to the interview. The petitioner will never see their photo again but it should meet the specifications for background to be accepted.

Actually, his from the I-129F won't go on the visa either :) His visa picture will be the one he brings to the interview. At least, that's how Vancouver did it.

Hi guys, do you know if they are picky with the passport photo? or what they actually will do with the petitioner's photograph?
I thought only the beneficiary needs a photo for his visa...

1) My good background photo I turned out looking like I'm on drugs. (if they aren't posting it on something I will see again, I don't mind sending this in)

2) The photograph I liked, my background may not be light enough *(if they are mounting it on something like a visa or passport I want to send this one)

Hopefully people who have their K1 completed would know :D
