If your US citizenship is based on a green card petition filed by one of your parents, then you should not have a problem with bringing in your first wife.

Of course this would be the time for the CIS to re-examine your file. The important questions would be whether you revealed the fact of your existing marriage at the time you got your green card and also under what category your parent petitioned for you -- unmarried child of a permanent resident; the unmarried child of a US citizen or the married child of a US citizen.

People just don't seem to understand this question at all, i would like to dare anyone to read and try to understand before post any comment...i am divorced now,, well divorce from both previous wifes, the only problem is that while marry to my US wife, i was separated from the one in Brazil (now my current fiancee) but not divorced...Until i finally did, (too late, i know) but like LIFE"S JOURNEY said before, this overlap in marriages might bring some issues.. Someone even mentioned something about "perjury"... The Model Penal Code in the US(section 230.1) defines bigamy as a misdemeanor and polygamy as a felony...
How complicated we (humans) have made things in this world, right? when everything should be so simple, it's all about papers... and money, and Bull**** and that's how we are loosing our own existence, but. that's my opinion...

On The K-1 Visa Application Packet there is a sworn statement that the applicant needs to fill out, stating that she/he is legally able to marry, either single or divorced, anyone who's married does not qualify for this type of visa! If you are petioning a Fiancee, this is your Fiancee, it could have been your ex-wife, but at the time of the application she or he and the petitioner needs to be either single or divorce...

Oh! well, yes i never say "isn't complicated at all" i said it is, but i hope that won't be a bar, because in that case, then, the invalid marriage would be the second one, right? the one in the US, but we got divorced a long time ago...I guess the illegal term here would apply if i would still be married, but i am not, i am divorced now (and twice) so could i bring my fiancee? the reason why so many people, and i said so many people...because i am sure that actually might happen to anyone who immigrate to a new country, you kind of loose contact with the other person, so you start a new life,,and what if you don't have the money to travel thousands of miles just to get a divorce or even worst paying for a lawyer who deals with it internationally, back at the time i could not afford it... and my ex wife wanted

The reason why i am asking openly here, it's because this issue always brings a lot of differents reactions and answers, so obviously yes, doubts always arise, maybe some of you here don't know anyone who has been in a similar situation, but if you do and know what happen, i'll appreciate your comments...

I know some of you might have seen me around here for a while, ever since i've been planning to bring my (girl), fiancee to the US...but..i really have something bothering me a little bit, so i thought that i might post it here as well, maybe you guys can give me some of your best ideas, thoughts and opinions...

I am gonna start with a question that i've asked in a lawyer's forum before, and trust me "It's Complicated" but not hard to analyze...

"Is it illegal to get marry in the US while being marry in another country?

I immigrate to the US from Brazil, i was separated from my wife but not divorced, I got marry here, it didn't work, so i got divorced, now i am a US citizen, and by the way I did not obtained any immigration status from that marriage, i came legally under a family petition made by my father! I went back to Brazil and found the person that is actually married to me, we are back together! But a few month ago we filed for divorce, so we can get marry again in the US, since i am trying to bring her as my fiancee, with a fiancee visa. My I-129F was approved and it's already in the US consulate waiting for "that day"

Hello all visa journey members :dance: ,it has been 2 years since me and my fiance from iran had applied for k1 visa,at times it seemed that this day would never come but today my wife to be was given her visa at usa embassy in abu dhabi,I am so happy I could cry,it was very tough for us at times,she had to go to the embassy 3 times in the last 2 years but finally today she got her visa,what a mind numbing expierience it has been,it seems so confusing and discouraging when you have to wait so long and you never know when it will happen,To all who are in this situation our prayers are with you,don't give up hope :thumbs: your day will come,thanks to everyone who has given us advice here on the forum :)

I think the nice lady handles the English speaking interviews. Unfortunately my Fiance can only speak Thai and will probably have it with the mean guy if he handles the Thai interviews. I hope at least he is proficient in Thai.
i would not worrie about that because my fiancee does not understand some words and she told me when she did her interview that the nice lady speaks thia also so dont worrie about that pluse the lady told my fiancee she just trasferd back to thialand she worked there about 5 years ago so i think she uis on her next rotation

I'm assuming VoIP companies are considered "telephone companies" in their eyes. Most of our phone bills will be PDF phone bills w/ detailed call lists from VoIP services and some web printouts of call lists from other VoIP services. Has anyone done anything similar? It's pretty expensive if you don't go the VoIP route, so I would be surprised if people are calling using POTS services anymore, but I guess I want to make sure.

We used a calling card and all I did is print out all of the logs they didn’t even have our names on it at all just numbers and it worked today the interviewer even made a joke about how much I call because I call 5 times a day

My blood is boiling this morning. I need to tell myself to just calm down, this will all be fine. Hopefully we just need to straighten out their minor confusion, and get things back on track.
We've been in this process now for almost 9 months. They held us back at NVC. They held us back at the Embassy. Now after sitting on our file for 6 weeks at the embassy they finally take a look at it and decide they're "missing" a document that's been IN THE BLIPPIN file all along mad.gif

Anyway, we just need to go through the process here. We don't control it, they do. And we want a successful outcome. There's just no point to railing against the unfairness of the system. Go along meekly and give them what they want. Advice easier stated than followed.

I am going throe the same thing but I have a lawyer I emailed the embassy last week and they said there was a lot of stuff missing I forward the email too my lawyer and he said that all the stuff that they said is missing is in the packet and he does not no what they are talking about so I guess I am in limbo but the good news is if you look at the schedule they have posted on April 10 2009 for the embassy you will see the last date on there is may 27 2009 so I think there will be a new one soon and I hope every buddy is on there I check it 3 times a day to see a new one pop up

Currently I have been gathering all my info to file for a fiance visa. My fiance's mother is in the USA I believe as a permanent resident with her youngest daughter, his sister. She applied for a family visa in august of 2009 to bring over my fiance and his brother. He has tried to get a visiting visa twice now but because he is younger, and does not have the ties the country he has been denied. We want to file a fiance visa. Will his mother's filing affect his approval for a fiance visa? Would it be easier to just get married in his country??

Getting "hitched" and her leaving still would not improve the OP's situation as he would still be facing a new petition/visa... The solution was for the OP's fiancee to have stayed (regardless of marriage or not) as her status could be "repaired" from inside the USA if they married outside the 90 days.



Go back and read the thread. We were hoping that in retrospect, the couple went to the courthouse BEFORE the 90 days expired.

That would of been a predicament - she could not AOS, since she entered on a K-1, and didn't marry in the 90 days.

In retrospect, you should of just got married by going to the clerk of courts, to satisfy the requirement of the 90 day rule and go from there.

I am still looking through the FAM to see if there is something you could use, but most it points to it's at the discretion of the embassy.



I was hoping that this would have been the outcome as well. Take 2 hrs out of the day and get hitched at the courthouse.

Consulate/USCIS is heartless when it comes to "tough luck" stories.

You can K1 again, 'cause IMBRA really isn't a problem for 2nd try, so ignore if someone said it is.

It's up to you if getting married overseas is an issue for you or not.

You could get a lawyer to plead to the Consulate your request for extended K1, but it would be a futile battle I am certain.

You will have to refile for a new visa, bottom line. Small error, yet major mistake by letting K1 90 days slip by you.

Note though that evidence of meeting in person is a requirement for petition approval. It is not evidence of a bona fide relationship and that's what's needed to get the visa. So anybody who thinks any kind of proof of meeting is enough to say, "so hand over the visa" is in for a rude awakening.

A popular "proof" photo in China is to go inside a Bank of China branch and have the security guard take the couple's photo in front of the money exchange board, that has the date, time and exchange rates.


Smooth move! And at the same time, Kano can calculate how much getting her to his home is gonna REALLY cost him. :lol:

I consulted an immigration atty at one point, just because I have a pre-paid legal plan, and can sue at the drop of a hat :lol:

But let me tell you, this atty was USELESS and even didn't catch a simple error that caused an initial RFE on the 129f.

It's so true and consistent here when folks tell of their USELESS and EXPENSIVE experiences with immigration lawyers to help you file a visa petition.

Only if you have complications, legal convictions, questionable character or going thru a difficult consulate with mind-numbing cultural requirements and guranteed AP/AR, then consider getting an immigration atty.

Just DYI here, but ignore the windbags, weirdos and blowhards.

13 years, older woman could be problematic, even in low fraud countries.


I've got closer to 10 years than 9 over L, and we're pretty sure we won't get thrown into AP unless they wig about the age difference, and if they ultimately deny us, I'll just move to Brazil in the fall, become fluent in Portuguese, get a job, and in a few years, we'll DCF. Not our first pick (but a wicked cheaper one), but our families support us either way.

Try to have as much evidence as possible just in case you get an RFE from the USCIS before they approve the I-129F. It will also help for when your fiancé goes for his interview. Evidence can be things like copies of e-mails, chats, pictures, itineraries, etc.

And don't worry, many people meet only once for a short period of time and still get approved.

I know my office in montreal had a mandatory rule that it had to be mailed......

I am throwing myself to the mercy of the board. My fiance moved to the US about 5 weeks ago. Well there was an unexpected emergency in her family, (not a death) that required she return. She was here for approximately 30 of the allotted 90 days. So now, the question I have is what do we do now. The situation with her mom has resolved itself, but now we are lost as to what to do next.

Thank you in advance for all the practical advice. Please don't beat me up too much about the error I've made. Believe me, I am fully aware of the situation I am in.

She may not get far using the normal phone number. Have her go to post office & buy a pin number that will allow her to call embassy direct to get info about what might be done.
It been said many times here on V J that the K 1 is a one time visa. It may be that you have to start over no matter what occured. Hopefully this is a special circumstance that they will take into consideration.

My I-129F will hit 5 months on Saturday. I'm going to call USCIS on Monday to make an enquiry. I was just wondering, for people who have been in this situation before, does this ever actually make a difference? Were they able to tell you anything of interest? I'm really worried they're just going to give me some vague statement like, 'it's under review' or 'we're working on it.'

If they aren't able to do anything for me, what's the best approach to take from there? Politicians, lawyers? Or is this all a waste of time? My petition is straight forward: no children, criminal convictions, previous spouses, etc. Can't understand why it's taking so long.

Forget the idea of expidite. That wont work in your case. Forget the politicians; they require forms ect & take about 30 to 60 days to respond with anything useful. Their staff is trained to placate the citizen & not much more in most cases.
Best way to get first hand info & help from people that can access you case info is to make an INFO PASS appointment. Do that by finding the link on the USCIS site. I did this & got some results after many months of waiting. They will put in a request to find out whats up. Prepare to hear excatly what you said they would say. If there was something they needed from you, you would know.
I went to INFO PASS only to be told it would be at least 60 days before I heard anything. Two days later the case was approved & I recieved a letter from USCIS telling me so.

does my fiancee need to go to her bank, credit union or savings and loan to notarize her g-325a and letter of intent and other documents? after notarize what she will get? a paper of notarize? what should be on that paper of notarize?

if i go to my bank to notarize the i-29f, my g-325a and letter of intent and other documents what do i get? same notarize paper like my fiancee?

Notaries only verify the signature is that of the person signing not the content of the document.

Many banks no longer provide notary services except for internal documents.

K-1 Fiance(e) Visa Process & ProceduresProblem with I-129F Filling Package

Hi Guys,

I finally sent the packet to USCIS on monday and just realized that I have made a major mistake. I think I may not have attached my fiance's photo with the G-325A. Every thing else is in order.

So, I called USCIS to see if that could be a problem and the gnomes that are sitting there have NO answer for this. I called twice more and each time I got another gnome or gnomette and just told me to contact a immigration attorny. WHAT? I about reached thru the phone and .....

Sorry if I sound so pissed off, specially when I am the one who made the mistake.

Anyway, may be you guys can help me with this.

1.) First of all, how much trouble I am in? --Scratch that, I am already in trouble with the ONE
2.) Will the USCIS still start my application and put me in line and just ask for a photo?
3.) IF not then do I have to start the whole process again but loose the fee I already sent?

All you can do is expect the RFE & respond to it with the photo. I did almost the same thing; got the RFE. It cost me almost 3 months.
Your case will be processed to the point the photo is required & then put on hold until the photo joins the case by use of the RFE.
You will not be asked to begin the case again or lose the fee.
