1) So she is planning to get the MMR. Did anyone here or their fiance(e) need the MMR and does it require six months for three shots?

Its best to follow the hospital & therefore embassy criteria. She should get whatever they think she will need.
The follow up shots can be done in the USA later. She doesnt need to stay there to get them all if that is your concern. Later in the USA you can take her to your local health clinic to get the follow ups. We did it that way & got the three shots for 23 bucks. I took the form required by USCIS for the AOS meeting & asked them to sign & stamp it at the clinic. The officer at the AOS meeting didnt ask to see the form.

ONE last question (probably not really last). Does fiancee need NOA2 or a letter from the Embassy to have the medical done or can she simply take in the photos, the DS forms and of course the money to get the medical done ??? It seems like no letter is required since someone suggested you can go immediately after NOA2 or even NOA1.

She can go at any time now. The hospital will have the forms or she can get them from the embassy. There is nothing to be gained by people having medical exams they dont need hench no letter required. Have her call the hospital to clarify.

Packet 4 is the interview date letter. My experiance was same as Johns. If you know your case is in BKK just send in the P 3 info & they will set the interview date & let you know by letter & Email. Youi can find on their web site the interview schedual to see how busy they are & find your own date if you give them time to post it. Lately they have been giving the interviews very quickly after they have the P 3 so the schedual may not be current.

Thailand is a high fraud country with a long history of not issuing tourist visas. My wife was denied 3 times. To get one you must understand & meet the strongest ties criteria. It is almost impossible to do for average Thai people. Your situation is unique because you are a citizen of the P I & the daughter is a Brit. This will cause the embassy to review your request even more I think.
When you disclose your reason for the visit is to meet an American man you will be denied outright. A tourist visas is for tourisum. Remember as you decide what to do; all people requesting visas are considered intending immigrants.

Hi guys. For the proof of ongoing relationship I have some E mails that I can send with my I-129f. However, most of the e mails are in Spanish with some English words. Can I still submit those E-mails even if they are in Span-glish? What else can I include in that section?

Anything submitted for review has to be in English to be useful. If you want to send in something like these emails as an example of how you communicated it might be ok. You can translate them to English yourself if you include a statement that you are fluent in both languages. Copies of plane tickets, boarding passes, phone records ect can help.

The above is absolutely incorrect. First, the visa expiration date is meaningless once the holder has entered the USA. There is no deadline for filing to adjust status but the status after entry is derived from the I-94 which is good for 90 days. There is no actual penalty for filing to adjust status after the 90 days but things get more complicated if the marriage doesn't occur within 90 days of entry. Bear in mind, the K1 and K2 visa holders need to stay in the USA without work authorization until at least about three months from the time the AOS is filed and are at risk of detention and potential deportation once the 90 days is up. If there are no arrests or detentions, any "overstay" or "delay" in filing AOS is forgiven if LPR status is eventually granted.

Nevertheless, planning for the wedding and status adjustment within the 90 days or as soon after that as possible is a VERY good idea.

So the correct answer is he has to do the AOS before the 90 days is up?

How soon is the adjustment of status money due?

The adjustment must be done prior to the experation of the visa. The medical they recieve will be good for one year or must be re-done.
Have them taken to the local county health department to get follow up shots prior to school registration to save some money. My daughter was free & my wifes shots cost 23 bucks at our clinic.

Hi everyone...my mistake I knew it was $455 initial filing for I-129 & yes I know Kids are included here.
I am the best friend of Mexican fiancee, I am also great friends here in USA with her American fiancee. I am helping to organize everything. Nothing has been filed yet. I am trying to organize papers for each & we are traveling to see her & kids for 15 days in September (I am going cuz kids are like nephews to me, I love them & have known them since birth)
I am a bit freaked out that he will be paying per person in Ciudad Juarez, but we are trying to plan the money in advance...it will be costly! Flying everyone there, & staying for at least 7 days while waiting on visas.
I certainly appreciate everyones fast response. This is going to be a long haul for them...I hope that she will be here with kids by next summer if all goes well. that would mean filing in late Sept.2010 then waiting up to 6 months, March 2011, going to Cd. Juarez maybe April or May 2011. Things we are trying to consider is kids missing school etc. They do plan to cross over at Cd. J to el Paso & fly from there to Minnesota, so May would be less freakin' freezing cold for everyone! LOL! I have many Mexican friends here, all legal, but every visa story is so different! This is the first K1 with kids!
If anyone has been through Juarez with Children I would appreciate any advice! I had read every review here! Wonderful stuff. I am considering goping with them to help with kids & to make it like a fun vacation/adventure for the boys who will be 10 & 14 by next spring.

Check with the schools in Minnestota & you will find the following:
English as a Second Language (ESL) or bilingual services. Students may or may not
actually be in an ESL or bilingual program. M.S. §124D.59, Subd. 2 (1sp2003) defines pupil of limited
English proficiency as a pupil in any of the grades of pre-kindergarten (grade EC) through 12 who meets the
following requirements:
(1) the pupil, as declared by a parent or guardian first learned a language other than English, comes from
a home where the language usually spoken is other than English, or usually speaks a language other
than English; and
(2) the pupil is determined by developmentally appropriate measures, which might include observations,
teacher judgment, parent recommendations, or developmentally appropriate assessment instruments,
to lack the necessary English skills to participate fully in classes taught in English.
The kids will be put into the ESL classes & all other class work adjusted until they learn enough to participate at the correct level.
These ESL programs are amazing & kids respond very well to them. The boys you are talking about will be fine & everyone will be suprised as they go thru the program.
My own daughter came here knowing 3 words of English. In two short years she won a state speech contest & is now helping to teach others.

I know that Kids are included in the $335 fee to file in the US for the original pettition, the information I cannot seem to find (or maybe I just don't understand the language) is when arriving at Cuidad Juarez, Mexico Consulate do we need to pay seperate fees for the kids?
Like approx. $400 each? or are kids included under mom again? (I realize medical fees are all seperate, just wondering about the visas fee)
Need to get an idea of fees so money can be saved up!

I made a huge mistake in my original understanding of this & caution you to look into this again. If not read & understood correctly it leads you to believe the kids are part of her petition. They are not.
Each child will need their own seperate 130 petition which will result in a seperate visa. You will pay individual fees for those petitions & visas.

Hi...someone will correct me if I am wrong but I think the short-cuts was meaning for you to PRINT out three copies of each form...Send 3 copies to your Fiancee and have him sign them....he keeps one copy for himself and send you the other two copies back...this safeguards so that when you the Choice of Agent/Petitioner mails these forms to USCIS....if one gets LOST, you will have another for back-up to send to them. USCIS loses and misplaces forms, etc due to so many files and moving around from desk to desk I have read here.....He keeps one incase he goes to his interview and needs one or needs one for his records. .but I think you are to print two 325-A...one for you and one for spouse to fill out..use this short-cut to understand and help..... I agree with everyone here. You need to keep excellent records of your relationship and they ask him questions when your wife visited you in Morocco and how long she stayed and what you did when she was here, etc....also you as the petitioner need to know that once it reaches the second stage of the process which is NVC...you sign an Affidavit of support form which is a contract between you and the government saying you are financially able to support this man for basically 10 years! You support him until he has earned 40 working credits which averages 10 years and if he has worked all these years to earn 40. If you are not able to show you are stable enough to meet this man or he can't pay for you to come to him, they will not approve you. You have to make 125% the poverty guideline the government sets each year. You have to show you can support him entirely so he does not fall upon the government for assistance. The government can sue you for paying them back too if he was to ever have to do this. You haven't met this man in person to know his true self and character. You need to meet his family and possibly friends to make sure he is who he says he is. So many women are falling into the Moroccan scams for quick visa and other country scams by not protecting themselves. At least meet this man especially if he is way younger than you... the consulate is turning down couples who have made several trips and they turn down people too on disability. Sometimes cases are hard to prove to the consulate to accept as genuine. Go read the reviews and obtain knowlege here on VJ. I am afraid, you have wasted your money too by starting the process too soon. Keep in mind too, even though USCIS homeland security may approve you, an operator told me they were separate from the NVC and US Consulate and they don't look at the same things in a relationship so nothing is a guarantee. I have been there twice and I am still worried after reading all the discrimination coming from Morocco's US Embassy. It appears sometimes its whatever mood they are in that day....Good luck to you whatever you decide.

Darlene...You posted here for help, and the more you tried to explain, the more Private and financial details you had to give about your financial wealth and circumstances on a public board. I would not go into how much your ex has given you, etc. You never know who is reading this board for starters. Also it opens up for all kinds of thoughts and I too like Life-journey had wandered too what the connection is and we are not CO's. With our thoughts going in opposite direction, it can help you see what thoughts might too go through the CO's mind and Morocco consulate is TOUGH! They try everything to DENY these men from coming. They might not understand how a woman can live with an EX for 10 years and then meeta foreigner and fall in love. You know Morocco is very high in Fraud and Scams. Alot of these men are known to prey on the weak and emotional and lonely and wealthy. Because you may be wealthier than most, have not moved on in 10 years, and marrying a foreigner...They will most likely have lots of questions like anyone would. Please don't beat us up here on VJ. We are trying to understand and give opinions how we see things to HELP, not to HURT you. Some of us at VJ may not have a way of wording it sensitively. Just know and have your Fiance prepared to answer all these questions and how he will need to reply. Yes, some remain as much friends with the Ex's as possible with children involved but we usually don't continue living with the Ex's for 10 years for sake of the kids. I'm not saying you are wrong. It is your choice and you are giving up a lot financially to marry the love of your life. JimVaPhuong, thanks so much for your reply. I see what you mean by having three independents now. As far as the 401K plan yes I can cash it out with only federal and state penalties. I received this under the divorce laws and filed a Quadro which means I don't have to pay further penalties. So even, if I decided to cash it out, I will still end up with a six figure amount. By the time we are married, I would assume to be working with intent to be working soon. It has just been too soon to start looking for a job since I just moved out of my original home and into a new one. I have spent more than 20,000 dollars in the last year and a half traveling to Morocco in hotel, car, plane, apt rentals, food, etc., but one thing for sure, until this journey is over, I will continue to make great effort in keeping this relationship happy by seeing him as often as I can. I wonder if others are in the same boat as I am when it comes to this financial burden that weights on my mind daily.


Darlene, I made only about $44,000-50,000 a year with some overtime and award money figured in from my current employer. I have been to see my husband twice... once about 9 months after we started talking and another trip about 4 months later....and now the month of April 2010, marked a year since I have seen my husband in person (14 months- spent our 1 year anniversary APART!)...yes it is a sacrifice and a financial burden, and we all wish to see our husbands/fiance's often as we can,(every 3-4 months would be NICE) but sometimes we have to both have common sense and LOGIC and LOTS of patience to know that spending all this money traveling back and forth should not just be the financial burden of the wife...sounds like you are paying it all on your own.....You are just starting your process, but lucky for you...you are filing the Fiance visa which may get him here sooner "IF" consulate approves him.... Lucky for you, you have a large sum in 401K settlement from the Ex...My question would be as a CO...why would you consider using child support money and possibly take from her to sponser your fiance? Would this open the CO to ask him more questions? I know your daughter is only 12...I have a 13 and 15 year old daughter and a 24 year old son & I can tell you even with my OWN EARNED money my kids have at times resented me spending the little I have spent to get my husband here. Kids have a different mind when it comes to love. Yes they accept him and is ok with him coming but still there are lots of unanswered and unasked questions on their part and jealousies of what he may be taking that they feel should be theirs. I have fought lots of battles for our love to stay in tact.....if your fiance loves you which I am sure he does...(you appear to be a beautiful woman and I am sure kind-hearted too from reading about your spending)...your fiance should understand and also should encourage you to travel less so you can save what money you do have until you are more settled in with your future and finding a job. I would think find a sponser too would be easier.

My other question would be...why does it seem less is pushed on Fiance visa's with the affidavit of support from reading here like it is a mere option but yet on the Cr-1's we are FORCED to sign or a chance he gets denied?? I don't understand why it seems one is less important than the other when no matter HOW he gets here he can still be a government burden and they should be treated equally. Am I misunderstanding the AOS? I read and felt like it was no option and that is why we had to pay for the AOS fee bill BEFORE we could proceed to the next step and documents at NVC.

Darlene, I hope you get this all figured out. Talk to the fiance and Darlene, sacrificing NOT seeing him in person DOES NOT mean you love him any less. He will understand and if not, he is not worth having (just my opinion). Your daughter and her welfare should be his main concern and not how many times you can make it to Morocco. (why is he letting you pay for everything?) $20,000 is ALOT of money on trips to not share in the expenses. Maybe you can afford it but I know I can not on $44,000-50,000 year with kids to care for. You are lucky,lol. My EX refuses to pay any child support for his children.

for the I-134 I just gave them the employer letter and a copy of my bank statement,

after marriage and you fill out the other support document, then they want the tax form, I didn't give them any check stubs or employer letter or bank statements with that, but at interview time, they wanted it.

The USC visiting the petitoner wouldnt case any issues. I travelled from the UK to see my fiance who is the USC and was prepared for loads of questions at the boarder however I was lucky and got none.

I have heard alot of stories of Canadians having issues travelling to the USA in between and some being refused at the boarder.

If you are going to do it take loads of evidence re your ties to Canada. Rental agreements, a letter from an employer stating the day you are going to return, details of plans that you really wouldn't cancel lik concert tickets to your fave band etc. Even with this I have heard of people being refused entry so take as much as possible. I also took a copy of my NOA1 to prove that we were in the process.

A comment on something you wrote in your first posting. I noticed your fiance filed in CSC or the California Service Center. Based ON JV member statistics, about 75% of the I-129F filers at CSC have been getting NOA2 in about 50 days. So that process is not 5 to 6 months. Some members have been longer though.

No, everything he listed is new. You might want to go to the US Embassy or Consulate web site for where you will interview. Look at Fiance Visas or K visa packages. They will probably have Package 3 on line. Start reading the forms and checklists so you know what to start preparing.

Also, keep all records of your trips and communication with your fiance. Phone records, emails, chat logs, airline tickets, border crossings in a Passport. Photos of you two together when visiting or even better is of you two with the parents of each.


Hey Audy Rob, I'm actually the petitioner. :) I'm trying to find out everything since my fiance is clueless. So it's been about 30 days already I guess, and I haven't seen any changes happening at the CSC website. I check almost daily. I'm getting impatient. So what happens when I get NOA2? Do I go with him to the US-Embassy in his Country and he has the interview?

-I'm wondering if we have to marry right way, does he have to fly here right away then the 90 days starts right away? Because We're hoping he can finish another semester of school before he flies here to marry me. How does that work?

Work on collecting proof of ongoing relationship (phone records, letters, emails, photos of the two of you together).

Also, begin work on the beneficiary's birth certificate, any/all divorce decrees, passport. If there are children involved, get their travel authorizations in line, get all vaccination up to date.

The petitioner should be getting his financial records together (tax transcripts, W-2's, letter of employment). Will need up to date letters of intent to marry...

Use this time wisely and you'll be ready for the interview as soon as the petition reaches the Embassy from NVC.

So the beneficiary should file the same stuff use the same pictures right? I'm confused. The guy is clueless, maybe I should fly there again and organize his stuff for him?

Hmm, what should I do? I got the NOA in March, and I've been checking activity daily. Of course there is no updates since March. :( I guess I really want this to hurry up. *SIGH*

This would be our first marriage and we don't have any kids so that would make things easier hopefully :)

I'm not sure exactly the whole process of NOA2 but I will go with the flow and wait for the next step.
(meanwhile 5-6 months wait, any suggestions what I can work on at this point?)

At this point I'm also wondering if me or my fiance either of us, can we travel back and forth to one another's country without any particular restrictions we should be aware of? I'm going to visit him next week and would like to avoid any problems that may delay our process of becoming one :thumbs:

The foreign fiance will be contacted by the Consulate after the case clears NVC. NVC knows where to send the case file. There is only one US Embassy in Canada, and it's in Ottawa. Montreal and Vancouver are Consulates. An Edmonton resident's case file for a K visa should be sent to Vancouver no matter which consulate you listed on the petition. If not, you can request it be transferred.


Will he be contacted by Mail from the Consulate or by phone? And what is NVC? Should I at this point wait till his Consulate contact him before I take any action? I don't think the procedures list this clearly of when I should take action to do anything or when he should take action.

Do you know how he finds out when he will take his medical examination and interview? Hopefully it's on the same day? It wouldn't make sense for him to fly to Vancouver twice right? We are very confused.

And another question I'm not sure if anyone can help. I forgot to ask. He needs to finish 1 more semester of school which will be until December before he qualify to apply for grad school over here. Since I got NOA2 so soon, how can he stay there to finish fall semester? Or does he have to come marry me right away? We are very worried about this issue.

Before reading my question I hope you all understand that I have read the "procedures" many of times, so please don't reply to me by telling me to go look at the procedure. I want to direct this question to experienced people here that knows exactly what's happening. :)

I've received my NOA2 last week. I know I'm supposed to fill out the I-342 or for sponsors. My question is my Fiance (the beneficiary) supposed to get notice too? Is he supposed to get notice from the Service Center? Or his embassy? [he is according to the NOA2] right?

My problem is that we didn't realize his location (Edmonton Alberta) was suppose to put Vancouver Amer. Embassy on the I-129; so we put Calgary! So, at this point, how do we know if it's Vancouver or Montreal? Is he supposed to get something from the Embassy before we take action?

Thanks...I just had confirmation from NVC that they has just sent the file to RJ..I called a few days ago and they told me that unfortunately the date of birth of my fiancee was wrong, that i needed to send them a copy of birth certificate to correct this, i freaked out, so i immediately sent a copy of her birth certificate and a copy of my passport, with case number RDJ...etc, both via email and snail mail, (just in case) and then i got the following email from NVC:

"Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC). The
NVC has completed its processing of the visa petition you mentioned in
your letter and has forwarded the petition to the assigned US
Embassy/Consulate General for further processing.

As the file is no longer at the NVC, we are unable to honor your request
to change the date of birth. We will forward your correspondence to the

what a confusing question, since she is gonna live with me, of course i intend to do so.. For how long?, well...until death do us part.

OK. so, apart from submitting two I-134 Form, would i have to submitt an I-184 or I-184a? I am really stuck on this matter here, the forms are confusing.

Who Completes and Signs Form I-864?
I-864 Reads: "The U.S. citizen or lawful permanent resident who filed aForm I-130 for a family member, Form I-129F for afiance(e), or Form I-600 or I-600A for an orphan."

I have already received a notice from the NVC that my fiance file is about to be sent to the consulate, but i was wondering when are they gonna ask me for the affidavit of Support? Also, i don't meet the income required under the poverty guidelines act...my dad is gonna help me by co-signing, so how do i do this? the form it's too complicated! i have done everything by myself, except for this...where can i request for help with this form?

If first package was sent via regular mail, is normal to have such delay, the Post Office in Brazil is having troubles delivering lately, and that's the reason why is being held at customs, it's the Brazil Post Office the one in charge of releasing that..it happened the same to me recently, with the whole package copy...i used Priority with Delivery Conf. and by this number my fiancee called the P.O. and they told her they got it, and it was going out for delivery soon...i guess it took like more than 30 days to get there...i sent it earlier...but it wasn't like that before, it's just now...something is happening with their delivery schedule...email is the best way to contact the consulate, let them know what's going on, and about the current P.O. issues, i am sure they will know. good luck.

I am now indeed looking for any information which might help me on how to proceed, and by which means? Do i have to file an appeal? how? by using Form I-290B? Since there are other options like motions to reopen or reconsider decisions made in your case, but these are exceptions! From what i am saying here, it looks lke i wanna do this myself, but definetely not, i have found a good attorney, but i also want to be aware of the different possibilities i could have, lawyers can make huge mistakes too, now i have seen it in Rio, they charge a lot of money to file your Fiancee and other visa petitions, but they don't tell you'll have to print the electronic form 156 twice, and they end up giving you the paper version...that's funny

The application will be returned to uscis through NVC. It could be reaffirmed, they could send an NOID as you stated, in which case you should respons appropriately or most likely, it will be allowed to expire and you will simply receive a notice to that effect.

You must decide what you want to do to proceed, you do not even need to necessarily wait for the USCIS response.

I recently came back from Rio de Janeiro where my fiancee had such interview and the K1 Visa Application was revoked...(see attachment)I certainly might be able to understand why this happened, i made a few mistakes when submitting the I-129F to USCIS, by ommiting certain facts which i did not believed where necessary at the time i filed the petition... everything's is on my previous post It's Complicated
But the C.O in this case, was more concern with my fiancee's answers to begin with, and my father's past, the questions were horrible, nothing related to "us" as a couple, i was there, but not allowed to go in with her, and the denial was based on the fact that he thought she was seeking immigration benefits, and literally told her "I think you are trying to get a green card" my fiancee and i were married before, when i lived there, we were separated when i left Brazil, but not divorced, i don't know if i wrongfully or logically recently filed for divorce, in order to bring her as my fiancee, because is faster...and maybe this had a significant impact on the C.O's decision, but it's obviously not what he told her...

The denial decision was based on the grounds that the relationship upon which the petition was based, is not genuine and was entered primarily to confer immigration benefits on the beneficiary, now, i guess i must wait for a Notice of Intent to Deny from USCIS or something like that, and i could have the opportunity to present aditional information regarding the validity our relationship, but what i don't have any clue of is how does this really works? perhaps anyone here have heard of a similar case or can point me in the right direction for information, etc.
any help will be gladly appreciated..

Noooo...That's not a problem here trust me, i haven't give many details about this, cause it's really not that important, i am safe when it comes to that, perhaps you guys never heard about this before, but my petition, which came from my dad, started in one country and it was finished on another, under a parole status, etc... for many reasons..but they are not relevant to this, my dad was born in the US, and i have 2 other nationalities, because of my mom, etc.. so don't worry about it. everything's cool! and i am positive about this.

Bingo! Youa re already married, file for a CR-1. YES it was a CRIME to marry someone else while you were married in Brazil. So what? Who is going to enforce that now? USCIS? No. Will your mariages overlap on the G-325a. Yes. Everyone will see you commited a crime. And no one will do anything about it.

You might be right..but, FYI, Noooo...See... that's what brings trying to read fast, i am not married to anyone...i will personally go to that interview after having seek legal help of course, and i'll be totally honest about everything, the fact is that i did not know the consequences when i marry my 2nd ex-wife, and c'mom, let's be honest..this is something that happens so often...how many people get divorce and then get marry again to the same person...? i did not cheat anyone either, i was separated from my 1st wife when i came to the US...and now my best defense will be.."i am trying to do the right thing" i hope my attorney will advise me on how to do this...
Another thing i wanted to add here, some of you have made a good point about this, when i got marry in the US, nothing was requested from me..at all, just our ID's and the fee..that's it, i don't even remember having taking any oath, nor either i had to make any statement that i was free and legal to marry...OMG!

If your US citizenship is based on a green card petition filed by one of your parents, then you should not have a problem with bringing in your first wife.

Of course this would be the time for the CIS to re-examine your file. The important questions would be whether you revealed the fact of your existing marriage at the time you got your green card and also under what category your parent petitioned for you -- unmarried child of a permanent resident; the unmarried child of a US citizen or the married child of a US citizen.
