It is all well and good to post timelines- but it doesn't fix the IMBRA, and bigger picture, USCIS problems.

Please, call your congressmen. Ask to speak to the immigration specialist on staff. If you live reasonably close, go visit them. Express your rage at the entire application process not only being stopped, but REVERSED! (interviews canceled, approvals reversed)

This is insane.

It drives me crazy to read posters say- Just wait. Be patient. Be a quiet sheep. That is #######- our rights as citizens to pursue happiness and love where and how we chose to was trampled by the IMBRA law.

There is no earthly reason a fiancee visa should take more than a couple months from application to approved visa. There is no excuse. People must be held accountable for this not happening.

Today I made my 4th call to my Congressman's office and I will continue to call them until somebody fixes USCIS.

The squeaky wheel gets the grease. Don't be a sheep! Make some noise!

I posted this to a different thread but the message needs to be communicated far and wide.

I think this is good advice. Now that I know how things work, it seems we'd all be better off getting our fiances air tickets to Mexico. Then it's simple, you drive down to Mexico, drive back into the US with the one you love. No waiting no, hassle. In a couple of years congress will make them citizens ahead of the people who did the right thing and went through this bullsh*t process.

We found out about the recall on the 11th also...but I have not received a letter in the mail as of yet

We first found out last week when my fiance emailed the Montreal Consulate to ask if our case was likely to be affected. They responded by emailing him a copy of the letter they'd sent us about the recall. He just received the actual letter yesterday.

We found out about the recall on the 11th also...but I have not received a letter in the mail as of yet

I sent my 129f on March 10 to VSC, received NOA2 on March 24. NVC has already completed processing and my financee already received her packet from the Moscow Embassy. Her interview is set for June 13.

I was after the March 6 date completely, and it moved fast for me.

My only concern is that USCIS will re-assess their approvals made after March 6 in order to conduct the criminal investigation and such. I have not heard any word about people getting their approvals "revoked" yet, but would be interested to know if anyone else has heard such a thing.

I highly doubt that the USG has the energy to revoke the approvals made after that time...they are probably still trying to figure out what to do with the ones coming in.

I must have called the NVC, USCIS, and the embassy abroad a dozen times today!!!!!! They all seem to be pointing the fingure at each other. And finally I just told the very nice gentlemen on the phone at the USCIS
I WANT TO SPEAK TO THE PERSON WHO IS INTERPRETING THIS LAW!!!!!
I would really like to! He was a very nice man so I didnt feel right to hang it all on him, but really I think some bozo just picked up my file and said, "oh so they met on a russian website, well then we should check it , it must be what they mean in this new law!"
I am so frustrated with no one ever READING!
When I told the woman at the embassy that if our cancellation was due to this new law, they have made a mistake because it does not apply to me. she was taken aback, and asked why not? I told her because I did not meet my fiance through a Marriage Broker, she seemed surprised and later just said it makes no difference it has to do with the date of your petiton. She wasnt very nice to me AT ALL!!!!!!! :devil:

Like I said, I want to talk to the person who is interpreting this law and causing all the delays!! I have a hunch its at the embassy, but I will never know for sure, this is the sad part!

Any approvals of people with NOA1's after March 6th?
Any word on how this will affect those of us with NOA1s after March 6th? All I can find is "if you are before March 6, don't worry. If you're after March 6, you're screwed." Probably true but not very specific.
Not screwed.....the ones affected are those that have met through a marriage broker and/or have filed multiple petitons etc. If you havent already....have a read of the act in various threads pertaining to the IMBRA. Right now I think there is a settling in stage which may have slowed things at the various service centers including NBC.

I am wondering, particularly now, how important it is going to be to write more then a few words when it comes to Q18 on the I-129F as to how one met especially if one has met over the internet. Whilst meeting online itself, in various chat rooms, groups etc do not seem to come under this act.....how are they to know if one leaves too much to the imagination. My advice is to perhaps go into a lot more detail under these circumstances to safeguard against being caught up in it. Any thoughts?????

The thing is........some interviews have been cancelled and petitions sent back. Only time will tell just how much of an affect this is going to have on approved petitions that are waiting or have an interview already.

I have to agree here. I have a gut feeling in my stomach that they are just more cautious about you if you met online. How can they know which site is a mariage broker or not? I did not specify this in my answer to question #18. I NEVER thought it could effect me so much!!!
I think this is why I got caught up in this :crying:

We met online on a free Russian site, so I think they just panicked because Russia has a tendency to utilize the mail-order bride routine. This is just a hunch......I dunno :huh:

I hope I get to hear something from them tomorrow :unsure:

I'm sure I am not the only lonely soul checking up on the processing times of the centers. However i do find it interesting that Vermont is still on March 6th. This gives me an idea that once they receive back the RFE's they may be keeping an order in accordance to priority dates. Of course when I spoke to someone from Vermont last ( a week ago or a little more) I was under the impression that they will process the cases in any order to just gain some speed at least and not build up the delay even more. The lady told me that this was the "logical" action, which really pushed my buttons at the time. I do not know if she meant working on the cases or just sending out the RFE's. Yet looking at VJ, I don't see that happening either. Seems like they are still waiting on something. I think we will for sure know after the individuals that already had NOA2's return their RFE's to the center and see OR NOT see some action on their cases.
I am just brain-storming here--please feel free to add anything

Its gonna be alright. Listen, Ive been waiting for a touch forever also. Today was the one day out of a million that I didnt even bother checking to see if it was touched, and today is the day it happened. Try to think about anything other than this miserable voyage for at least a day. Maybe some of us have become so wrapped up in this that its driving us crazy. My social life has taken a 90 degree angle nose dive, not good.

I am also thinking of a one month timeline to be approved and another 2 months for the interview. My fiance hopes it´s gonna be faster.

That's about what I'm expecting. I'd rather expect the worst and be pleasantly surprised than be disappointed every week that I'm still not touched.

I wish I could feel that way too, but I keep checking my status online for at least 20 times a day.

so am I, and I am ready to scream every time I get the same message...this case has been approved blah blah blah..... but whats the use of stressing? it doesnt help the situation one bit.

I'm cdngirl06's fiancee, and I'm sorry to be the bearer of bad news.

The expectation is that the RFEs to recalled petitions will not be issued for 2-3 weeks, as they sort out a bunch of computer issues dealing with recalled petitions. They basically can't generate the RFEs, nor can they process them, the way the system is set up.

Not sure where you been, but RFE's are being sent right now. Just not to the cases one would think is and should be at the head of the line (NOA2). Also, some have recieved theirs and also sent it back.

I know for a fact that it's not 2-3 weeks BEFORE they START sending RFE's. they are doing it right now. But don't be surprised if it takes at least 2-3 weeks to get to your case due to how many there are.

I think what he meant by 2-3 weeks for RFE's is only to the recalled petitions. The ones getting them now are just the people who were waiting for their NOA'2. Yes, USCIS is sending out RFE's and yes its all out of order. But it is the fastest way for them to clear up their backlog since these applications are easily available in front of them and the recalled petitions (those that were approved once already and sent out of the USA) are somewhere in a separate facility or storage perhaps. So it can easily take them another 2-3 weeks to get to us; the recalled petitioners.

I already prepared myself for another month of waiting just to receive this stinking RFE, and then another month after that for all the processing including the mailing back to NVC and then Israel.....and then I'm hoping at least the consulate will take pity on us and give an interview date immediately since we already had one. Like my mother said he'll be here in September, hope for the worst and you'll be presently surprised at best. Honestly having your hopes up only makes it worse. Well well I finally got through to VSC on my 4th try! And yes my case is back with them, thank goodness. This is good news for the Russia people. She didn't have a timeline for when the RFE's would go out but she DID recommend filing an expedite request. And since we haven't heard anything I'm going to do that at the end of the week if I don't get an email from them and let you know how it goes.

I sent one today; here is the template. Also include the State Dept. memo highlighted with the quotes from the letter. You may want to modify it according to your specific case:

I later discovered an unclassified memo released by the State Department (00077044) that states “Some petitions were approved in error under the old procedures and sent through the National Visa Center to posts for processing.” It logically follows that if the USCIS is responsible for approving I-129F petitions, then the USCIS is in error. The memo also states “The DHS Service Center Operations (SCOPS) Unit of USCIS, Status/Family Branch requested that posts return to NVC all K1 I-129F petitions with priority dates (date received at the DHS office) on or after March 6, 2006” which demonstrates USCIS error.

Our petition was one of the petitions that was caught up in this error. I have included all relevant documents to this matter in this mailing which include a copy of the approved I-797C, a copy of the notice of approval from the NVC, and a copy of the letter from the Ciudad Juarez consulate informing us that our case was ready to process. At no time was I or my fiancée informed by the USCIS that this recall process had begun. We had to find out through press releases and a phone call from the consulate. Therefore, I request an expedition of my petition due to USCIS error.

I called Vermont and USCIS this morning, Vermonts automated system said that their system is curretly not working so no information could be given on my case, and I couldnt hit a key to speak to a rep this time. Then USCIS just simply said that the RFE's are in the process of being sent out. I asked him about the order being kept and he KIND of said they will go according to the notification dates, but when have they ever known the truth? :angry:

The latestest in USCIS Screw ups

Hello again to all,
here is the latest stupid person at USCIS Comment.
Today when actually getting a live person on the PHone at USCIS, I inquired as to our Case and as to where is it ?
It was returned after 3 Months in Guangzhou China, and now after more time no response from either NVC or USCIS. When explaining the details to the customer service rep at USCIS, get this, He asked me what is IMBRA ? Do they actually hire ####### that are this stupid ? He did not know what IMBRA was,who processes it, or how to find information. I asked to speak to a supervisor, but he got back on in two minutes claiming the supervisor had the same answers as he did. Thank God no terrorists are trying in infiltrate our Country ! What a joke.
The DOS in DC told me the case was returned on July 1, but on July 5 I received an email from Guangzhou China that they had not received the file, Hey how can You return a file before You have even received it Duh !
well. to conclude my opinion that there are many incompetants working for USCIS, NVC and the Guangzhou embassy, I wonder why my Fiance is unhappy as she has not received one scrap of paper since we applies back in April. and wonder how these people can even sleep at night making all of uswait for unconsionable amounts of time.

Of Special interest to You fellow New Yorkers, It seems our illustrious Senator Hillary Clinton does not have time for us either, I sent her a cordial email in July asking if she could look into where our file is and after the usuall automated response, Nothing ! Nothing ! Nothing !

At least they have the decency to acknowledge that you at least exist. Mine hasn't done much since I sent a letter via snail mail in July, but she did send a letter to the embassy in Israel...which of course has not been answered. Well, I do wish you better luck, but congress reps are a lot better in these immigrations issues I think.opinions opinions

hi, quick question, when you check online about the imbra return, does it actually sayImbra RFE or it only show the most recent updatre and assume it is the visa received??

No,it only will say that they sent out a request for some additional information. this doesnt make it IMBRA, it could just be a regular RFE. The online system will not specify this. Hope I helped!

) saying that the CIS re-approved my case and that they forwarded it to the embassy. BUT even if it was the 18th, I re-tracked with DHL and it was delivered! on the 21st. Go figure...I just hope next week is the week for us!

The last email reply from them was in BIG bold letters "WE DID NOT RECEIVE THE FILE YET. "......after two emails from me....hmmmmm

I am officially pissed off with this embassy in Tel Aviv. The people are beyond rude! They are obnoxious. When I spoke to someone this morning about my petition being received at the embassy via DHL the most UNfriendly woman on the phone asked "and WHO are you? DO you work here?"
I'm going to kick some a*$&%^ All she could tell me was, I dunno, I cant answer anymore of your questions. All this was in a tone of disgust and a get lost attitude!!! Grrrrr

Aw, aque, I'm sorry. Have you called NVC to check on the date your petition was sent? It usually takes them a few more days to actually mail it out, it seems. Then wait for a few days and call the consulate back, or try and e-mail them...

Thanks mew, Yes I did, NVC mailed it on the 14th using DHL. As I checked before there was only one going from DHL to Tel Aviv in the time between 13-16of Aug. I just know it was mine, and they received it on the 17th. (last time it took exactly the same time to get from NVC to israel)Apparently they are too lazy to get off their behinds and do some work there! :ranting:

I dont mind the waiting, if the waiting is for a reasonable delay. But when I asked her if it is possible to have received the petition and just not have entered it into the system yet.....again the retarded "I don't know i cant answer anymore questions for you" i'd like to strangle her!

I wonder why some consulates are saying come anytime while others are saying in a month? whats the deal with that? I 'm nervous now

The Moscow Embassy schedules the interviews 2+ months out. Last time I looked they had interviews scheduled through the 2nd week in October. So our interview won't be for at least another 2 months.

Fortunately, I just returned from holiday with my fiance 2 weeks ago so I'm not complaining (at least not yet).

I just wanted to say that I have much respect for the people in our group. We've been through a lot - a very dark period, but now at least for all of us the finish line is in sight. I feel like I'm part of a championship team here.
My RFE is back at Vermont, at least according to USPS.
And Jello, start emailing the US Embassy in Moscow now. Let them know it's coming. I think and hope your speculation on 2+ months is overstated in our case. And my intel is at least as good as yours.

Yep, and we should all throw a gigantic party at the end of the finish line! It really does feel like "mission impossible" to get your loved ones here. All these super spy-like investigations being made just to find when and where our petitions shipped...haha
My baby still cant believe that I was able to track the petition going to the embassy :lol:

I'm not even talking about the multitude of information all of us collected from numerous "top-secret" sources!! :lol:

My congressman representative still hasn't called me :whistle:
