pushbrk you are giving out adamantly giving out false information. To tell me that I have no chance of getting the K3 was inconsiderate at best let alone inaccurate. We are here to share our experiences, but I do not believe this was yours. I can see you say you heard, but you have not seen.
First off, it has been common for them to approve both the petitions at the same time and store the I130 then forward the I129f to the NVC. I have seen more then ten cases that both petitions were approved together and they went the I129f. Hours of research in forums taking not of everyone’s timelines.

The Divine gave you examples of other people being approved. They cannot legally cancel a petition they offered me for any reason other then denying me. I will not let them get away with it if they do.

Semantics. In cases where the petitions are on the same desk, the I-130 is approved and I-129F is consecutively, not simultaneously administratively cancelled. Splitting hairs.

I'd like to hear some more about anybody who was told their I-129F was cancelled and then later got both an approval notice and an NVC case number.

Nah! I am not offended. Through GOD all is possible! We Cant go on to the next step of the process because my lawyer is taking sweet as time releasing our paperwork, since I fired him.



I have seen 3 people approved! If USCIS is going to close something or cancle something, they would send notification or post the new guidelines on the website.

I have shown you profen individuals that have approved I129f and Approved I130 that have stored their I130 and are moving forward on their I129F.

I have showed you people who had approved I130 and then their I129f was approved. And now I am showing you documentation from the USCIS that the I129f can be used to bring my husband into the country as a non imagrant as long as I show proof that I submitted an I130.

Now you show me documentation that states differently or a scanned letter from the USCIS stating that your petition was terminated.

I give up! Where is your terminated petition? Where is one shred of documentation stating this information?

If it is not documented it is not true. Divine Mercy was told by 3 different USCIS people that her case was going to be terminated. She pulled her approved CR1 out of storage. Started the petition, paid all the NVC fees. Forgot about her K3 Visa then bam she received an email from USCIS that her I129f petition was approved. Now she is going the K3 route despite the fact that she paid all her fees at the NVC.



I posted 3 people who had approved K3 after an approved I130. It is just not common to have a late I129f because it should be in with in weeks after the reciept of your I130.

You need to research your interviewing embassy. After I realized that the Nigerian embassy was only taking few CR1/I130 interviews, I decided to see how long it takes to get that interview. 7 months for a cr1 interview. plus the our embassy is more picky and seem to require more when you are going for a cr1. Research your embassy before you make your decision.

some embassy are quick and painless when it comes to a I130/CR1. it all depends.

Lurking... K-3 visa is being terminated by USCIS as of July 2007...It's not a rumor. There are new guidelines that were put into effect that have not been communicated to everyone yet, but it's a fact! By USCIS cancelling tons of K-3 visas....including ours. sad.gif

Sending date has no barring on the USCIS. You could have sent it January 2006, but the NOA1 date is February 2007. Your time starts when the USCIS receives the petition.

But NOA1 is NOT IMPORTANT !!! Important is SENDING DATE.

When the K3 Visa was incorporated to assist married spouse to reunite during the I130 approvals. That is why they use the term "pending". To make sure that know one skips the I130 and just submits a petition for the K3 visa. The uscis looks like it is trying to eliminate a step of working on 1 person’s case on two separate occasions.



I called USCIS and they never stated that my I129f was going to be cancled. They stated that they go in order and mine will not come up for a while yet. That was a month ago.

This may or may not happen to you. But looking at all the timelines around here, it seems that even if they approve your _129F, you're looking at only a month or two advantage.

you're not looking at the whole picture

NVC for K3 : 30 days
NVC for CR1: 120 days

wait for interview may also take a lot more time for CR1 than for K3, depending on where the interview will take place


For a lot of us, saving a thousand dollars and being able to work right away just isn't worth the wait

husband is spending 2k on plane tickets every couple of months, waiting any longer than we should doesn't make any sense at all to us



A few months ago, we/I were/was discussed the relative merits of K3 vs CR1/IR1 visas for a spouse. My answer would have matched yours above. If working and money are less important to you than being together a couple months sooner, then K3 is what you want.

The problem is that by all but one exception, recent evidence indicates USCIS is no longer approving I-129F petitions for a spouse, if they were filed after July 28, 2007 and paid no fee. This new unannounced policy effectively renders the K3 visa unviable.

There is 3 examples of I129f/k3 being approved after their I130/CR1 was approved. You do not see many because most people do not send the K3 petition out so far long after they send out the I130. Please read an email I sent below to my brother in law after hours of research.

Here is the information I was telling you about. The USCIS is trying to approve the I129 Petition with the I130. This prevents them from having to process to separate petitions (I129F & I130) with the same information. Thus eliminating twice the work they were doing in the past. So if you get your K3 in before the I130 is processed, the USCIS will put them together and slap them both with an approval.

If both get approved together, the I129F will be forwarded to NVC and the I130 will be sent to the Nation Records Center for storage until you file for Adjustment of Status. This is the policy they announce more than a year ago in this press release: http://www.uscis.gov...e/PN_i-129f.pdf

They had some initial problems implementing this but are now pretty good at it. If both of your petitions were going the NVC, the easiest way to tell would be to look at the NOA2 for the I130, if it says it is being forwarded to NVC, it will be forwarded. If it says you are already in the US, then it will go to storage at NRC, and it will tell you to file the I824 to get consular processing started on the I130.

The I129F will be sent to NVC. This NVC process for the I129F takes about 2 days (but could take up to 5). It only take 1 month to get an interview at the Nigerian embassy.

The NVC processing time for the I130 is 2 months. It take 2 months to get an interview with the I130. So we are looking at Micheal being here around April I the NVC gets our check or the processing. NVC will not touch our case till they get the check.


The average processing time from sent date to receipt of check notice from the NVC is an average of 8-10 days. Today makes the tenth day and the NVC still has not received payment.

Because Michael’s I 129f was not sent till 2 months late the I130 was automatically forward to the NVC with the assumption that we were not filing the I129f. They came to this assumption because no one in their right mind, who is going to go the I129f process , would wait two months to send their petition in. Especially if they are getting profession council from a lawyer. Once the NVC and embassy has the I130 they will not revisit the K3, because they do not want to do twice the work.



If Michael’s I129F petition was at the USCIS at the time they were processing the I130, He would be home with us right now.

My embassy is a seven month wait. Only a two month wait for THe K3.
Plus they do not give you much of a hassle with the K3 in Nigeria as they do with the CR1. I rather show proof after he is livin here and on the mortgage, rent, life insurance, and part of our church.

I agree that there is more hassle, but like I said it all depends on which embassy you are dealing with. The money is worth the wait for us.

K3/K4 may still be viable but they suck compared to CRs and IRs the way USCIS is processing them now.
More cost, stress and possible delays especially when doing AOS.

You do not have to bring the 2007 tax paperwork until after April 08 when they are due. I did file Singe/head of household, but will file and amended tax return shortly.

3. Can we already fill out the forms even before it has been generated?

They can not create a law/policy to cover what they are doing now. It has to have an effective date that starts the day of or further.
That is why I do not know why people are just accepting this as so. As a USC we have the right to be informed. It is the law. They have to have a notification of every petition the acknowledge receiving. So far I have read only three options in there employee manual regarding responses to I129F petitions 1. Approved kicking.gif 2. Denied crying.gif 3. FRE sad.gif I have read how they have to process these three responses. Right down to the type of ink they use for the approval stamp. They have to provide us with this information, because it is the law.

So it is Illegal for them to do anything different, because they did not "inform" us. If they try to say that my petition has been "administratively close", I will demand this in writing. Even though my petition was approved 2 days before my receipt date. There is not one law that states that if my I129F is received after a I130 approval, your petition will be administratively closed.
The directions on my I129F states that you have to have a petition pending. At the time my I129F was mailed, my I130/cr1 was pending.

IF you want to stand by and help them get caught up with there petitions, it is awfully nice of you. This will help them process my K3 that much faster.

I have ready the employee processing manual, i have read both directions for the petitions, and I have ready every policy update regarding them. IF I want to use the K3 visa for my husband, I will.

I am just glad your FRE was for you K3, since everyone is saying that the USCIS is not doing any work on I129f peititons. I am not glad you received it though. I read that they have to respond to your RFE in a certain amount of time on the USCIS webiste in the employee manual. If i see it again, i will let you know what the time frame is.

My case is at the NVC, I am getting ready to submit the last part the affidavit of support. My husband paper work took a whole month to get here. Then it was taking me two weeks to pick it up at the post office. My lawyers package is at fed ex right now. I will go pick that up tomorrow. I am never home. I hate it when people send packages to my home and not my work.
So I am calling the USCIS and doing the RFE trick for the first time. I want to hear them tell me my case is close and ask them to send me documentation stating this information. Then I am going to ask where there policy is around this.

My I129f petition was sent in before my I130 was approved. That is the directions. I will keep you all posted.

Youtoo, have you ever logged onto the USCIS website to check the status of your petition? THis site will tell your reciept date. Then you can judge what the time frame was from NOA1 to NOA2.

IF it was you filing you would have doing anything you can to discover the Reciept number so you could file your I129f petition. Your lawyer/his assistant has 50 other cases they are worried about so some people get forgoten about if they do not recieve stuff to trigger a responce.

There is a lot you can do. Good question is your case being processed at the NVC? Lawyers are still takeing money for the k3 petition despite that the uscis has been aproving the I130 before the I129f.

HAve you figured out what your lawyer's fees are for just a marriage visa petitions versus a K3 visa. Most of the cost for the K3 visa comes after your wife arrives in the US.

My lawyer charged 1700 for premium marrige service. $2500 for the addional K3. I was refunded $1000 when I fired him. Does that help you a little?

My layer did the same thing to me along with other things. I fired him and demanded he refund me for the K3 process I paid for and $400 off for mishandling our case. Which would have come to $1200. I ended up with $1000. I could have gotten more, but this was not my priority and I did not want to waste more energy on him as he had already wasted so much of my time.

My lawyer received the Bill from he NVC on Oct 15, did not tell us until Nov 15th. We overnighted the money to him; he did not send it until Dec 5th.

How sick is that. We would have been done the NVC process right now too. His delay was what made me revisit the K3 petition. Then I discovered that someone who was told her petitions was terminated got an unexpected approval.

I am not arguing. My goal here is to gather accurate information for people who have concerns and misconceptions of what is going on. There is a lot of confusion that needs to be cleared up right now. I really would like someone to demand in writing the result of their I129F petition. Once this is in writing, then we can move forward. What they are doing is illegal and against the laws established around the process to protect the USC and the USCIS.

I state facts that I discover through reading the USCIS, employee manuals, laws & regulations, and petitions directions!
Then I state my opinion through interpretation of the above facts, VJ time-lines, and forum topics and discussions. But do not through out general terms that will confuse people reading to discover information regarding the process. Save that information in the "off topic" forum.

I try to make it clear whether it is a fact or a surmise of my understanding and the source.

Your statement was inaccurate and you did not state why you thought that people where not processing their CR1, which I have not found anyone that was doing this. Not even I, who wants to go the K3, has stopped the processing of my CR1. You also stated that the service at NVC would be better. Better then what? I have not heard any complaints yet, around the NVC processing times and policy.

"I" "think" that this quick turn of events of approving I130's and supposedly "administratively" closing I129F petitions will create a back log at the NVC. I have come to this conclusion through "my" understanding of the NVC process through what I have read here on VISAJourney.

So not only is there going to be an noted increase in petitions, but also an increase in types of petitions.

He quoted what I said to you. That is why I assumed that he was stating I was in denial. I am not in denial about anything. OK maybe a few things, that have nothing to do with the visajourney. *wink

I have never been one to go to big events, but I sure wish I could be there to witness history.

Obama deserves every penny on his Inauguration day. First this includes the cost of increased security. Obama will have to have double the security then any other president, because there are still ignorant people out there that will attempt to kill him just for the pure fact of his race. Increased cost on security will go hand and hand on the fact that this Inauguration will have a historical turnout.

There are amazing things to come out of his election term.

Whether you are Democratic or Republican, you can see the worst in each party. So there is no need to spend time arguing over who is right and wrong, spend time on what is needed to be done today to right the wrongs of yesterday.

We can find things each party spends money on that we do not agree on. Lets focus on things the money is spent on that we agree with?

Bringing the focus back to the people and not the business is a good thing. Our founding fathers started this government of the people by the people for the people not government of the businesses, by the businesses for the businesses.

Afternoon Sub and boo boo,
I am blessed every mornig I wake up next to my husband. The minute he feels that I am awake he is ready to pray with me.

My mom drove an hour in the snow to pick us up and go to church 30 minutes away. I just love my mom!


Now we have the rest of the day to ourselves and I have been blessed with Martin Luther King day off. My son is going to a speacial MLK breakfast with other youths his age. My friend has a nonprofit called Interfaith Youth that is sponcering this event.

I just hope the snow lets up to allow us to travel.

So sorry to hear about your car. Only by the grace of God mine is still running. My car broke down this September, so I had to get another one. I do not like car payments so i usually pay cash. Well no cash no car. I was going shopping to buy one with a loan and i decided that I will go without a car. Now if you live in Maine, you will now that there is not many resources for mass transit. I had faith that something would happen for me so I did not have to have a car payment.

That day my neighbor heard my story and told me he could get me a car for $600. 1997 Pontiac sunfire in great condition. Because he buys and fixes (flips) cars, I trusted his opinion. It is an amazing little car. It has just needed an alternator, which my mechanic put in for just $20 and part cost. WOW Yes God is great!

I am not a car person. As long as it is safe and reliable, I am pleased. Now we are looking for a great price on a mini van for a large family.

If I lived near you, I would come and help you. I love outside manual labor. We just discovered a nonprofit organic farm that does a lot of community outreach and education around planting organic. My son, his friend and I did some work to close up the farm. I am the kids loved the work. Great experience that I look forward to doing more this spring.

Good morning! It ws pretty watching all the smoke stacks over the city this morning.
Ok it was so cold that my nostrills froze up walking form may parking space to my office three blocks away.

My husband did walk to the library yesterday in this freezing cold weather. Crazy African should keep his but in the house on days like this. I wount even go out if I do not need to.
