Call the NVC for the I129f petition with the reciept number. This information is not put into the automated system.

The I130 will be on the automated system. They wil first send you a bill. When you recieve that bill do nothing, if you want to follow through with the K3/129f visa. They will just put your I130 petition in a file until you file for AOS.

Average time at the NVC for a I130 is 2-4 months. Some of the time depends on how fast a petitioner can get the information back and forth. If you go this route get the NVC porcessing timeline to get everything ready in advance. Unlike my lawyer who has taken our case 6 months at the NVC.

That is when you call USCIS and select the option that they have sent you an Request for more evidence. The exact numbers to press is posted here someplace. It gets you to an adjudicatory who can touch and see where your file is.

My experience with info pass is that they can't help you anymore then the Customer Service Line. They see what we see. The info pass is helpful if you need help filling out forms or the other 4 items on the info pass appointment page.

I figured out that my lawyer was tracking my case with an incorrect receipt number. That was helpful. She wasn't very friendly no matter how appreciative and thankfully I was.

Have you tried The RFE trick yet?

Congratulations! That is good news to hear. It validates that the USCIS can't change the rules int he middle of the game. They need to produce some new policy before they can actually act on the change. I think they thought they might be able to get away with the happy people with approved I130. I bet the didn't know VISAJOURNEY could have so much collaboration on what they were doing. They were caught with there Hand's in the cookie jar.

It is great to have a choice! Isn't that just what America is about.

The CR1 is a better way to the US, if your embassy isn't difficult and time consuming.

Sorry, your profile says K3. NVC won't send you anything on the K3 and you really want to let it go on to the Consulate. The best outcome is to end up using your K3 interview date for the CR1 interview.

That's what we hoped for in the old days when both petition would routinely get sent to NVC when approved.

Actually this is only partly accurate. You see my wife was approved for a K-1 in Jan. 2007, got married. But, then she had to return home because of an emergency and we could not wait for AP. So, we had to start over again with the I-130. The received date for VSC is 09-21-2007, NOA1 is 01-04-2008, Online with USCIS 02-24-2008. No touches....nada since that time. So, we are in the same situation as every one else. The entire system is flawed on every level. I mean we get married here, but she has to leave for a bona-fide emergency and she cant come back without filing I-130?!!!

Hello Ose n me,

I just wrote this letter to my brother in law. I thought some of the time lines I cut and paste into the note might be helpfull. Actually most of the information I obtained from the K3 forums. My lawyer messed up our K3 by filing it 2 months after our I130 noa1. It got there the day after my I130 was approved.


Here is the information I was telling you about. The USCIS is trying to approve the I129 Petition with the I130. This prevents them from having to process to separate petitions (I129F & I130) with the same information. Thus eliminating twice the work they were doing in the past. So if you get your K3 in before the I130 is processed, the USCIS will put them together and slap them both with an approval.

If both get approved together, the I129F will be forwarded to NVC and the I130 will be sent to the Nation Records Center for storage until you file for Adjustment of Status. This is the policy they announce more than a year ago in this press release: http://www.uscis.gov...e/PN_i-129f.pdf

They had some initial problems implementing this but are now pretty good at it. If both of your petitions were going the NVC, the easiest way to tell would be to look at the NOA2 for the I130, if it says it is being forwarded to NVC, it will be forwarded. If it says you are already in the US, then it will go to storage at NRC, and it will tell you to file the I824 to get consular processing started on the I130.

The I129F will be sent to NVC. This NVC process for the I129F takes about 2 days (but could take up to 5). It only take 1 month to get an interview at the Nigerian embassy.

The NVC processing time for the I130 is 2 months. It take 2 months to get an interview with the I130. So we are looking at Micheal being here around April I the NVC gets our check or the processing. NVC will not touch our case till they get the check.


The average processing time from sent date to receipt of check notice from the NVC is an average of 8-10 days. Today makes the tenth day and the NVC still has not received payment.

Because Michael’s I 129f was not sent till 2 months late the I130 was automatically forward to the NVC with the assumption that we were not filing the I129f. They came to this assumption because no one in their right mind, who is going to go the I129f process , would wait two months to send their petition in. Especially if they are getting profession council from a lawyer. Once the NVC and embassy has the I130 they will not revisit the K3, because they do not want to do twice the work.



If Michael’s I129F petition was at the USCIS at the time they were processing the I130, He would be home with us right now.

I think that is enough to prove my case. Most of the money for the K3 goes towards the processing of the AOS and the work visa. The actual petition is just a form created out of the information we gave for the I130.

i have not seen much of a difference between centers. As posted in a link several post up, they are moving files from center to center to even out the work load.

mine has been going as planned, but usualy everybody does right up until now. The every ones experience changes from here.

i will always keep my timeline posted.

I think she meant her travel visa for nigeria. my passport did not get here until the day before i was traveling. talk about swetting bullets. my friend had someone he knew at the nigerian embasy. he was supposed to be handling everything. so much for that. he probably forgot about it in his back seat.

Has your I-130 been approved and sent to the NVC? It sounds like it hasn't and your timeline does not indicate that it has been approved by VSC yet. If that is the case there is no way you will have the visa at the embassy by December. I'm sorry to have to tell you that. Secondly, keep my situation in the back of your mind. If you sent the I-129F to VSC a few months AFTER sending the I-130 just be careful. The NVC will not know that the USCIS is going to kill your I-129F once the I-130 has been sent to the NVC. I also called the NVC when my I-130 was sent there. They told me they will hold it in storage until the USCIS requests it to be sent back when it comes time to adjust my husband's status once he's in america. They told me that the USCIS has no further dealings with the I-130 until than and they will continue to process the K3. (i was scared back then that they would terminate the K3 and force me into the CR1.. the NVC assured me that wouldn't happen and look where I am now!)

Since you sent your petitions in so far apart this also could happen to you. Just remember, if your I-130 gets approved and the I-129F is still pending, then you get the first packet from the NVC just forget the K3, they're not going to let you have it.

Things are going really slow right now. I don't foresee you getting the visa at the embassy stage by next month. Go to Nigeria, enjoy your stay, kiss your husband a thousand times (and give Nigeria a quick little hello from me wink.gif ) Then prepare yourself to come home and deal with all this waiting.

If you are going to pursue the CR1 it might be helpful for you and your husband to collect some of the documents you will need to send to the NVC so he won't have to ship them to you later.

Maybe that is why they are not posting the k3 visa processing time on the uscis website? Maybe that is why they are now waving the k3 processing fee? my 130 went to Cali and my 129F is at vermont. When i check the status of my 130 it just states the received date, despite the fact that i received an approval. Also everyones time-lines talk about being touched but neither of my cases state that they have been touched. i am calling my lawyer to see what he says about this new policy and my case.

i will let you all know what i found out. mercy you can see us both. it really wouldn't be cheating, since you were with us first.*wink

My I-129F was rec'd before they approved the I-130 but it was rec'd at Chicago then Missouri then Vermont. I didn't get notice that it was pending at Vermont until September 7, 2007. By then the NVC already had my I-130. They were probably never at Vermont at the same time. I think Urge is right in his line of questioning.. is your I-130 still at Vermont being held for the I-129F approval or have they sent it to the NVC? If they already sent it on, you're probably terminated too.

Not only did I call using the RFE trick and find this out... I called two more times and had it confirmed by a supervisor and two immigration officers. Despite my pleas of mercy they insisted it is policy.

In fact, I argued with them profusely that they were wrong in doing this. One lady there kept saying that I just don't understand what the K3 is for. I asked her to explain it to me. She said that the purpose of the K3 visa is only to have the foreign spouse wait in America while the I-130 is being processed (no sh*t sherlock). Now that I have the I-130 approved there is no need for the I-129F (even if it is still faster with the K3, like in my situation). So I asked her, why then, has it become the trend in the CSC to approve both petitions together. They clearly know the person has the I-130 approved at that point, why continue to work on the I-129F and forward that to the NVC while keeping the approved I-130 at the CSC? She said I am not aware of any such occurance. Of course not. She's retarded. The right hand doesn't have any clue what the left hand is doing. In this case the east coast doesn't have any clue what the west coast is doing. She continued to stress to me that I do not understand that the ONLY purpose of the K3 is to enable the foreign relative to wait here while the I-130 is pending. I continued to insist that explaination may be the intended purpose of the K3 but it is not being treated that way in other service centers or they would NOT pair the two petitions, approve them together, and continue to forward the I-129F onto the NVC. They should live by their own rules. Do you see what I'm saying? She didn't. Maybe I'm not expressing it very well.

Either way, you may not be convinced that these people knew what they were talking about. I am. And i'm not going to waste another day waiting for something that is not going to happen. If I were you, and your I-130 has found its way to the NVC... USE IT. Don't wait for the service center to approve the I-129F when they clearly believe they are not supposed to do so.

As for the baby.. I'm so sorry. I don't know anything about that type of scenario at all. Like Urge said, my son was born in America, we don't have that issue. I really do feel for you being apart from your baby. Everyday is agony for my husband. I can't imagine him having to worry about getting the baby a visa too.

Since you already have the two NVC bills in hand, I would guesstimate your NVC time at about 6 weeks (conservatively).
2 weeks to receive, accept the payments and generate the two forms (Affidavit of support and DS-230).
You use James' shortcuts here.
1 week for NVC to receive/accept the forms.
2 weeks to case complete.
1 week to get your case to the embassy.
Look up what documentation is required by your embassy. The bare minimum is tax transcripts for last 3 years, letter from your employer and 2 months worth of paystubs, copy of your spouse's passport. You also may need police certificates and birth certificate of your spouse (possibly with translations).

ok the jig is up. lol * i am working witha lawyer. ihave no idea what is going on. i know when the 130 was recievedand andapproved. And when the 129F was recieved. i know the nvc contacted my lawyer for two fees totaling $ 450 made out to the department of state. The rest was guestimate so i could get an estimate from vj. From looking at other peoples timeline the information i am sure about looks accurate.
i have not had to do much thinking about this process. every thing i answered was via the internet and then it created the forms. kinda like filling your taxes out online. AFter you answered the questions this created the forms. the lawyer said what is next is the papers that show i can afford my husband. lol

The process just sounds standard to a background check around his intention. They are pure and good so your case will be forwarded soon. I am relieved to see that I am not the only person that wakes up at 3 in the morning worried about my case. I am at a lawyer's mercy how had an assistant messed up our case.

Was this information given to you from a lawyer? They tend to give you the worse case scenario for you to feel that there service is needed. I had the luxury of having a lawyer in the beginning, but I soon discovered that I was nothing but a number in his office $$. He had an assistant that did not know what she was doing and he was not following up on her work.

Out of frustration I started doing searches as you or information. These people know the process in and out and are all to welcomed to help anyone through the process. It really is how we all cope with our journey.

You are not alone in your journey with someone from a third world country. You will not be anymore scrutinized then anyone else. A lawyer does not make the process any faster then someone who files on there own.

I am not sure if you have read any of my post regarding my lawyer, but he sent my I129f petition 2 months after he recieved my reciept number for my I130. My reciept number for my I129f is 2 days after my approval of my I 130. My husband would be here right now if he sent it on time.

Yes they did......but with new structure of Chicago lockbox dont think they can go like that anymore in same package, sorta clueless but yes on your original questions and there are quite a few of us that did this (most that I know are August and September)

Thank you mate, no on the I-129f put call into lawyer will see what they want to do, I aint messing this baby up now - but would be interesting to see where that went, probably was in same package as the I-130 and when they scanned in the I-130 they saw the I-129f and sent it off to CSC - guessing, well not a good thing to do, but its about the same results that I would get over the phone from USCIS-

The people who answer the phones at the USCIS are no more informed then the customer service reps you call regarding your credit card. The are only trained on specific things to say. If you notice they are very automated in their communication. They only communicate what they are trained to. Which is how to read our screen, as we can already and change our address information.

I been running around VJ thinking I was a July Filer. My I130 was approved in September. I was thinking my I129F/K3 should be approved by now or within the next couple of days. Well then I compared the receipt date of my I129F to other peoples receipt date. I have come to the conclusion the my lawyer did not file my I129F petition until Middle of September. I129F receipt date is September 26th. My lawyer has a new assistant now. How can I be sure that the rest of my process will be on time.

I have already submitted the NVC Bill for affidavit of support. So looks like I am well on my way to the CR1 process. I am still going to keep up with the September filers.

Has anyone started a spread sheet yet? I will do one if you guys would like and post the updates. All I ask is that you put your time lines on your profile or in a post, so I do not have to look into everyones profiles.

Hello,
You have to file the CR-1 to file a I129/K3 petition. The I129/K3 is a petition that allows you to enter the US with a K3 Visa while you await the approval of the CR-1/I130. Once your I12f is approved your Cr-1 is put in storage until the petitionee arrives in the US. Once you are here you will have to file a Adjustment of Status and also EAD for employment.

OK, Has anyone recieved any documentation that states their I129F petiitions was closed? has anyone logged into the USCIS website to check their status and discovered that their I129f petitions was cancled?

Because I have a friend, Devine Mercy, you can find her in the Nigerain portal, that was told the same thing by 3 USCIS people after doing the RFE trick. Her I130 was in storage. She had it forwarded to the NVC to get the CR1 back going, since she thought her I129f/k3 was going to be terminated. This lead me to think the same thing, because my lawyer sent out my I129f petition out 2 months after the reciept date of my I130. The reciept date for my I129f is 2 days AFTER my approval date of my I130.

Ok, I had dropped of the visajourney site for a couple of weeks. I logged back in to check Devine Mercy's process to discover that her I129f petitiion was approved and she was now going for the K3 visa instead of the CR1/I130.
She stated that she did nothing. The information she was getting from the USCIS office was a lie. There would be a policy in place if this information was true.

I do know that if your I130 reaches the embassy before your I129f they will terminate the I129f.
Which for me would be devistating because it is a 2 month wait for an interview for the K3 and a 7 month wait for the CR1

The lawyer gives all the wrong to his assistant to do He takes your money. pays her 15 and hour to process 100 petitions a month. they mail things late, notify you of stuff late. They can not do it faster then us.

you do not need your lawyer to find out where your case is. Call the NVC to see if they have yourpetition. it is an automated system that uses your reciept number on your I130.

That is exactly what happened to me. I thought that my k3 was filed in July. My lawyer was keeping the fact that he filed it late. I was not thinking about the process either. Until Divine started talking about her I129F/k3 petition visa being terminated because her I130 was closed. Then I started getting worried. So I called my lawyer, who was not returning me call or emails right away. Then is started to read more about peoples cases. i was getting excited because my I129F should be getting approved soon. then i realized the receipt date of my I129F petition was in Sept not July. The shirt hit the fan then.

You can do both up until the embassy. you have no choice to make right now. just move forward to the NVC. it take two months at the NVC. by then your I129F petition might be approved before it hits the embassy, if not you are almost done with the NVC.

I am going the K3 route. Even if they tell me I am "administratively closed" I am doing my homework. and preparing for the battle. So far everything looks good on my side. I have not met one problem other then "hear Say". I will worry if i see it in writing. The owe me a timely process its the law. If they tell me I can go For a k3 visa, i wait 6 months for it, while my I130 is already approved. With out any type of process law or policy. nope they can not do it.

You can start the process at the NVC with you I130/CR1. I have everything done except submitting the affidavite of support informaiton. I had just fired my lawyer. I am still waiting for him to return my documents. So far I have not started to delay the process of the I130. My ex lawyer is by taking is sweet time to deliver my documents. He is not to partial to my side of the family. LOL

Good Luck, Please let me know when you start requesting information on your K3. I do have to let you know that now that they have changed their way of processing the petitions. K3 petitions alone are taking longer, because they are pearing them up with the I130/CR1. So it is pushing the time pack for I129f's that stand alone.

that is why they are probably telling individuals with approved I130 that they are going to terminate it, so they more forward with the I129f/K3.

I can understand why you are confused, because the information he is providing has not been documented anyplace. Until the USCIS states that thisis the policy do not listen to that information. They have been told this information from the USCIS, but people who have been "told" the same thing got approvals a couple months after.

here is some information that can be proven through the USCIS website and through documentation recieved by VJ members.
IF you fallow the uscis directions and file where you need to in the right order your peitions will be approved together and your I129f will be fowarded to the NVC, while the I130 approved pettion will go into storage.

The I130 is a petition for a CR1 entry, which is for perminant residency. Just a year ago it took the USCIS almost a year to approve the petition so they rectaed the k3 visa. now to elimanate doing twice the work they are now putting the petitions together and approving them both at the same time. They will put you I130 petition in storage and forward your I129f/K3 on to the NVC then from the enbassy for the K3 Visa. if the oppiste happens as they say happend to them, no big deal you are on your way to the I130. It is only a big deal ifyou have an embassy that is difficult with long waiting periods for interviews.

The K3 /(I129f petition form) visa is simular to the K1 visa(fiance) and was created to allow a spouce entry to the us as a nonimmagrant to wait for the I130 approval.

There are pros and Cons to both depending on your embassy. If you want your SO here asap at no expense the I129f visa is the fastes. But she will not be able to work until you file an EAD , which allows her to work until you file AOD (adjustment of Status). These are peitions that will run you another $1000. If you do not mind your so not working for 3 months and the extra money go the I129f.

The I130 approval allows entry into the us with a temporary greencard. They can work when they get of the airplane, after two years of marriage your request to have the temp removed for a perminant ten year GC.


Time difference 129f/K3 uscis SAme amount as I130 NVC 2 -5 days Embassy to interview date 1-2 month (depends on embassy)

I130/cri UScis same NVC 2 months Embassy to interview 2-4 months till interview.

if you have a difficult embassy it is better to use the I129f because they know you are entering on a K3 visa as a non imagrant. you will have tto go to an AOS in the US that will handle your GC.

Pushbrk , long standing procedures? Oh where are these procedure written? Because I have only recently read people stating that there I129f was administratively closed. My I130 being approved is not a common occurrence, because my I129f was not there to be approved at the time my I130. If my lawyer was not paid to delay sending my I129f late, my husband would have been home at Christmas 2007. This is not the norm for someone to submit a I129f petition two months after an I130. I have seen now 4 cases that have been approved after the I130 was approved.

You are telling people that after July 07 the k3 is no good. That is inaccurate and uninformed information. I showed you were 13 petition with i129f noa1 in August have been approved. So you are giving new member in accurate information. Choosing to admin close some and approve others is a "long standing" term in America called Discrimination. Unfortunately, it still exist in America, but it is illegal.

I might be under different circumstance, but my k3 will be approved too.

Did you know that there was 13 I129F VJ user petitions approved with a NOA1 date of August? You must be wondering why other people are getting approved with an approved I130 petition? The last one documented on VJ was on FEb 16th.

I do not ###### or complain about the USCIS. I have no complaint at all. I will complain if they "administratively" close my petition. I have not called them once. They never have someone call them up and say "thank you" for approving my petition on time. I have only called them because my lawyer gave me an incorrect receipt number for my petition. I have never did the RFE trick. I am waiting for my turn. They have to listen to people who are driven by emotions who take it out on them whether they are responsible for the petition or not.

Obviously if the administrative closing of petition was becoming such a problem that eveyrone is complaining about, why haven't they posted and update to their website to clearify this information?

That solution would seem so simple? hhhmmmm things that make you go hhhmmmmm

I think that sometimes people forget that there's always been a long line at INS/USCIS and that we chose to be on this line. When the line is not moving fast enough or people are not being processsed the way we like it, we b*tch.

I wonder if we are forgetting that our spouses are not citizens or residents of this nation. That marrying US citizens doesnt grant them automatic "right" for entry.

Yes its hard to be separated from your spouse but I knew it will be a long process beofre I married her. I also dont like that my K3 got cancelled but Im still grateful that I could bring my wife over.

The US govt is doing NOTHING illegal.

Good, I am glad you complained, but if I never contact them until they have started aproving K3's before mine that have a later noa1 date. I will ask when did they plan on notifying me and how? Then I will ask them for documentation telling me that the petition had been administrativly closed and under what law and terms. They have to provide me with a reason that is documented. they can't make up something. They have to site a law or policy that has been established. I will demand the information documented. I do not care if they are the USCIS they can not mess with peoples lives.
I am someone that walks in faith. If my husband is not meant to be here, then he is not meant to be here. I was on the wrong path when I chose to get married. I followed the directions the USCIS gave me.

I think everyone might have their reasons. After adm. closure of our I-129, my husband wrote to outbus.,to senator, and ambassador without any real results. And after that we sent USCIS to hell and give up.

This problem(so many NEED K3 much more than CR/IR and it should be a free choice anyway) can be solved only on government level ...and they have already our complain.

I think that it is fear, but I have GOD, Law, & Love on my side!.. Do not mess with it.

USCIS is not GOD! The do their job and get paid for the work, but they cannot start canceling petitions to save them a shortcut. Plus they cannot cancel something and never tell you either. You filled a form that requires them to respond in a timely manor in accordance of their policy first come first serve.




I have asked this a dozen times. does anyone have a documentation that states their I129f has been terminated? Scan it an let me see. Then I will get on the phone and start ruffling some feathers. Until then i will wait patiently till its my time.

Yes the consulate will deny a K3 visa, if the I130 petition is also there. That is why I am holding off on the NVC right now. I have everything done till the last drop. Just incase. I spoke with a different lawyer for advice. He told me to just wait with the NVC. Our I130 petition will go in a file. When the I129f/K3 petition comes through it will get forwarded to the Consulate/embassy.

All that is required when I submitted my I129f petition is that I have a I130 pending. At the time I submitted the I129f it was pending. There is not a clause for approved I130. They cannot cancel the petition until they make a law. I do not know why everyone thinks the USCIS can just do what they want. There are hours of meetings, numerous approvals and lawyer review that go into any type of laws, acts, or policy that they put forth.

I am a usc, I have rights to be informed and have my rights protected.

Maybe they thought that if they said that people would just walk away carmly and accept it as so, but I will not accept this as so.

Other then USCIS approving I130 petitions earlier then normal, they are right on time from the research I have done on visajourney. I not only use the timelines, I also go in every thread and cut and past signature timelines too.

I also wanted to let everyone know I got our paperwork from my lawyer overnighted today and a $1000 refund. I am not one to be reccon with. I have a degree in communication. I can use it for good and bad. *wink

pushbrk you are giving out adamantly giving out false information. To tell me that I have no chance of getting the K3 was inconsiderate at best let alone inaccurate. We are here to share our experiences, but I do not believe this was yours. I can see you say you heard, but you have not seen.
First off, it has been common for them to approve both the petitions at the same time and store the I130 then forward the I129f to the NVC. I have seen more then ten cases that both petitions were approved together and they went the I129f. Hours of research in forums taking not of everyone’s timelines.

The Divine gave you examples of other people being approved. They cannot legally cancel a petition they offered me for any reason other then denying me. I will not let them get away with it if they do.

Semantics. In cases where the petitions are on the same desk, the I-130 is approved and I-129F is consecutively, not simultaneously administratively cancelled. Splitting hairs.

I'd like to hear some more about anybody who was told their I-129F was cancelled and then later got both an approval notice and an NVC case number.
