Right now things are looking good for us, my Senator has gotton involved and after much fuss and the embassy literally attempting to throw Stephen out (on Thurs, Mar 26th), he got what he wanted, an "inquiry" for another interview, he was told to return on Monday, Mar 30, 2009 for his next interview date. I plan on being at the next interview.

Before you marry make sure that your K1 petition is expired. They will not consider your CR1 if your k1 is still active.

You paid all that money for her legal assitant to fill our your paper work. She really did nothing, but review your documents (hopefully). I had the same problem. I got half my money back though.

If you do not supply the letter you will delay your case. Easier to say that you type the wrong year then have your case on hold till you get the letter and then have to explain after the wait.

There are always two sides to the story. I am sure it is not just because you were not getting paid on time.

There are many stories of Nigerian men using women on here, which could have lead her to have concerns. This is an expensive, trying, and difficult experience. IF somethings do not make sense you do not wait to figure them up. You give up.

She should go with her gut instincts. Sorry to say. If it doesn't feel right today, It will not be right tomorrow. Plain and real simple.

A lawyer will slow your process down. They do not give the same dillegence and attention you coudl give your petition. There are amazingly knowledgable people on this site.

I haa lawyer that cost us 6 months time. He was fired and I got back half my money. I learned more then he knew at this site.

I had express concer that the processing time would increase with the increase number of I130/CR1 increasing and the number of I129f/K3 decreasing. I did an average of VisaJourney users who entered both the NVC Rec and NVC Sent date that have Interview's schedule from The end of march to the Newest Intervew date.
Since I have been watching the NVC timelines the processing has increase by 2 months Since the increase in the increase at the USCIS and the fee waiver on the I129f.

Called the NVC automated system. Acknowledge the receipt of the DS230, but stated I need to submit the Affidavit of Support or pay the Fee. Well the Ds230 was submitted with the Affidavit of support and the fee bill was paid in December so I requested to speak with a CSR. She stated that the automated system could not state that it has all documentation. She confirmed that they have everything they need and it would take up to 2 weeks to process.

My lawyer had the wrong reciept number for our case. The NVC sent out a request for payment October 15th or law office did not tell us until November 15th.
We overnighted the check to law office. NVC still does not have our check.

Well Mercy I almost know how frustrated your felt a few weeks back. You have been waiting much longer then me so I do not feel so let down.

I have requested my paperwork from the lawyer. Here is my letter to him:

Good afternoon,

I have just took an hour of work to visit with the
USCIS here in Portland to get some information
regarding my case.

1. The NVC sent you request for payment October 15th,
2007
2. Counting snail mail time it took your office 20
days to contact us for payment. We paid the expense
to overnight you are payment.
To my dismay The NVC has yet to receive it.

I am so heart broker for my husband. We put our trust
in your staff. We paid you to put our trust in in
you.

Where is our check? I need to know if they need
another check. Do we need to cancel the one we
overnighted to your office?

How dare you be so careless with my husband's lively
hood. This is about two more months we have to
maintane two households. I thought you
were compassionate and understood the process.

Can you please send me our files and turn this over to
me. I cant wait 20 days - 2 months for someone to
take action on our case.

I hate to assume, but I had sent him an email around that time asking a question. Then I recieved the bill. I think he sent it to keep me appeased for the moment. He probably didn't know How much I have learned since I have been here. He told me that after they recieve the payment he would send us the forms, which are completed online (like doing taxes) When I spoke to him regarding the rumors that K3's are bieng closed if the I130 is approved (which he confirmed, but does he know what the hell he is talking about). I asked him when he was gonig to be sending the forms? He sent them to me that night. The NVC did not request them. He just sent them to make me think I was one step closer. Here is my email I sent to them:

When the NVC sends a bill regarding a case they attached a case number to the petition. What was the case number on the NVC bill? What date did you mail out our Money order to pay the bill? What is the tracking number?

I would appreciate a prompt response.

Does anyone really know what is going on with our case?

When you said we are still going the K3 route I was excited because July filers are getting approved now. I did not realise that their reciept date for the K3 was in the same month they received a reciept number fo their I30. Why are you generating affidavit of support forms when the NVC did not request them?

I guess I am at your mercy. I feel violated & trapped. When we paid to feel supported, expedited service, secure in the process, and informed.

Why was the K3 mailed out 2 months late? We paid for K3 support. If we go the CR1 route we will not need the working paper and adjustment of status. My husband will come in with a temp green card in hand.

Now mind you I sent it to his father (lawyer) his wife (assistant, reception), him, and his new assistant yesterday. Nobody has gottem back to me.

AFter I go to the UScis, I am going to request he send me all my documantation. I will fire him.

OH yes, I want my paper work back. Did you read that he didnt send out my 129f until September? I was getting excited because July filers are receiving there 129f approvals. I compared my 129f receipt date to others to realize that they did not send the petition out until September.

Hello, I need some advise.

I have been have trouble with my lawyer. I have requested several times for the date he mailed our affidavit of support bill to the NVC and the tracking number. They will not respond to my request, because they either do not know (assistant quit, new assistant who knows nothing about immigration law) or they have not sent it out yet. I received my I130 Approval extremely early, I have recently come to discover. His old assistant stated that my approval time was about right. (obviously she did not know what she was talking about) On November 15th the law office requested our payment for the NVC bill. I called the NVC using my I130 receipt number to get out NVC case #. The automated system states that there is not a case number for that receipt number.

The USCIS website still only shows my I130 as received and that is it. When I called the help desk, he said there was nothing he could do for me and to make an appointment at my local USCIS office. My appointment is today at 12:30. After tearing apart my house, I can not located my I130 approval. AAAHAHHHHHHH

The question is: Should I still go to the USCIS appointment even though I can not locate my approval letter?

I would resubmit the form right now with the correct information. Include a letter explain why you are resubmitting the form.

1. Summary. Consular posts are now able to access the details of approved nonimmigrant visa petitions through the CCD in a new report called "PIMS" (Petition Information Management Service). The Kentucky Consular Center (KCC) has ceased e-mailing scanned copies of approved petitions to posts. The electronic PIMS record created by KCC will now be the primary source of evidence to be used in determining petition approval. The following guidance will soon be found in 9 FAM notes and procedural notes covering all nonimmigrant petition-based visa categories (H, L, O, P, Q). End Summary. New FAM Notes

2. A general note on CCD Access to approved NIV Petition information will be inserted into all relevant NIV petition-based visa category sections (H, L, O, P, Q): a. Posts are able to access the details of approved NIV petitions through the CCD. All users with roles that allow access to the current NIV Petitioner Applicant report will be able to see this information. The new report is called the Petition Information Management Service (PIMS) Petition Report and is listed under a sub- category of the NIV menu called "NIV Petition."

The electronic PIMS record created by the KCC is now the primary source of evidence to be used in verifying petition approval.

b. This change allows all information on a petitioner, petition, and/or beneficiary to be linked through a centrally managed CCD service. The PIMS Petition Report contains a record of all petitioners recorded by KCC as having approved petitions since 2004. In addition, many of the records contain information from KCC's Fraud Prevention Unit. Each new, approved petition is linked to a base petitioner record, allowing superior tracking of NIV petitioner and petition information.

c. As a result of this change, KCC no longer e-mails scanned copies of approved NIV petitions to posts. If you cannot immediately locate information on a specific petition, then you should send an e-mail to PIMS@state.gov. KCC's FPU will research approval of the petition and, if able to confirm its approval, make the details available through the CCD within two working days. Posts may use approved I-129s and I-797s presented at post as sufficient proof to schedule an appointment. The electronic PIMS record created by KCC is the primary source of evidence to be used in determining petition approval.

d. Soon posts will be able to link the NIV case to the PIMS petition record and automatically populate the relevant NIV petition data fields. The new process will validate the petition and provide all available information on the petition and petitioner. Posts will soon be able to add information to petitioner and petition records. Posts will be notified of each innovation and the effect each will have on NIV petition processing as these capabilities expand.

Evidence Forming Basis for Nonimmigrant Petition-based Visa Issuance

a. The basis for (H, L, O, P, Q) visa eligibility consists of an approved Form I-129, Petition for a Nonimmigrant Worker and a Notice of Action/Approval, Form I-797, presented by the visa applicant. The Form I-797 must show either that the petition on his or her behalf has been approved or that his or her authorized stay in NIV petition-based visa category status has been extended. Approval of a Petition for a Nonimmigrant Worker can also reach the applicant from a telegraphic, e-mail, or telephonic notification from the Department of Homeland Security. For visa processing purposes, only the PIMS record constitutes verification of petition approval.

b. Posts are able to access the details of approved NIV petitions through the CCD, through the Petition Information Management Service (PIMS) Petition Report. The electronic PIMS record created by KCC is the primary
source of evidence to be used in verifying petition approval.

c. A valid form I-797 must include the date of the Notice, the name of the petitioner, the name of the beneficiary, the petition/receipt number, the expiration date of the petition, and the name, address, and telephone number of the approving DHS office. The paper Form I-797 is an unsigned computer-generated form that is printed on blue paper. This can be confirmed and used to initiate adjudication processing through PIMS. In the event PIMS does not contain the record, send an e-mail to PIMS@state.gov. KCC's FPU will research approval of the petition and, if able to confirm its approval, will make the details available through the CCD within two working days.

The approval of a nonimmigrant petition-based visa category by the Department of Homeland Security (DHS) does not establish that the alien is eligible to receive a nonimmigrant visa.

These people work very hard with very little appreciation. The get the brunt of our grief and frustration. No one calls to say how great they are for processing a case quicker than normal. It is what it is.

Hello CR 1 Filers,

I am new to this forum, since I was going for the K3 too. My 130 was approved unusualy early from looking at other timelines. I paid the affidavit of support bill for $70.00 and an application processing fee bill for $380.00 for a total of $450.00. Last night I discovered in another forum that it meant I was moving forward the CR1. I thought it meant my 129f/K3 was approved. I know this is the better route though, but much longer processing time at the NVC.

Ok to the questions, After adjusting my timeline to CR1, I see that there is an IV Bill. What is the IV? And how much is the IV Bill?

Hello, We do not have an interview scheduled yet and no there were no extenuating circumstances, I have questioned them several times on why is our interview date is taking to long. they keep telling me the embassy only allots them so many slots for appointment each month. And they have no control over it. I sent in my I-130 Oct and it was approved in Jan. on my husbands birthday and we filed the other forms with NVC on time we only had one form sent back because of the dates that delayed us by 2 weeks but other than that no delays or denials. I was so happy when we were approved June 14th I had no ideal we would still be waiting on an interview..... how horrible this is I pray your time goes by much faster than ours. Have a blessed day.

Remember this man has the future in his hands. I would not make any threats or through out any harsh words until the case is put back in your hands. You would have to write a letter, maybe certified/notarized that he no long represents you. I am at the NVC process. We had already filled appointment. To change it I would have to resubmit.

My lawyer used to have time frames on his website. He has since taken them down. Smart man.

Sorry to hear this but it is typical for lawyers to promise the world and deliver you just a small piece of a city. Did he or she actually put down in the contract the 8 month timeframe? That would be the key. Otherwise, most say that timeframe but as well know from this great site, and being pro active that it is not.

Its your call, but what I have done and ours is good to a point, I let them make sure all doc's were in order, and then I was the one that made each call and researched what was going on. I was prepared to do this anyways, because it is my style.

Finding a new lawyer if you need one that is, will be another chip out of your pocketbook, but that is entirely up to you. If he is that rude, suggest to him that if things are out of order with the paperwork or written promises, you can file a complaint with the bar, they dont take litely to that suggestion, but no money is compensated for this, just a smack on the face or if he has other complaints, sometimes they can suspend him. You can check his track record through numerous ways, one being going to www.crimetime.com and clicking on your state and checking status of lawyers/attorneys. Most will link you to Martindell for reference tho, but its early in the am for me.

mrs jibowu, I know the k3 is faster i'm praying mine gets approved and gets to nvc before cr1. I contacted senator office this morning they said there should get a response within week 1/2 they will try to put pressure on them. Where is your service center? In Vermont they are currently processing I130 with the NOA date of June 6, 2007. This site is usually at best updated once a month around the 14th or 15th. Now it is not accurate, because mine has a NOA of July sometime and was approved in September. They are supposed to work on them on a case by case basis, but they often grab easy cases, and put more difficult cases aside. This is done in an attempt to keep their processing numbers up.


Everyone is the same from the USCIS to the NVC for processing times. The processing times change at the embassy level, although, petitions from third world countries often take longer with APs. Angel ,(cant remember exact profile name) case (CR-1)was completed at the NVC June 2007. She still does not have an interview appointment yet.

It takes only a month to get an appointment for a I129f/k3 visa, but significantly longer for the CR1.

The Vermont USCIS timeline has been updated to Feb 15th. From the research I have been doing for time lines it seems about right. I am under pressure because of rumors going about the K3 petition. Lawyers can make cases complicated. My lawyer has delayed my case by 6 months already. He had my husband submit the final paperwork for the NVC. My husband paid $100 to ship here, took a month to get here. When I put the paper work together to send to the NVC the lawyer never requested the DS230 form. He has made so many mistakes on my case. I am sure there are great lawyers, but be carefull.

OH i was sending the stuff to the NVC because I fired my lawyer. If he wasn't fired I would love to hear the excuse he would have come up with as to why he did not request the DS230.

My lawyer advice, which at this point does not mean anything to me, that they may ignore everything that is regularly requested and ask for something that was not.

I thought he said that just to scare us, because I am demanding a substantial refund for his errors that he has admitted to.

When you said "CV" I had no idea what you were talking about. I would assume Certificate of Vaccination too.

How have you been? I have not visited or posted here out of frustration. I have not hear d anything on my I129F. My lawyer is sitting on our DS230 that they NVC cent a week ago. He is too busy trainning another assitant. I guess I have some catching up to do.
