I want to know why the USCIS is taking so long to answer the ombudsman's questions regarding the I129f petitions. I think Vermont users should make several phone calls regarding the quickness of approvals at the Cali Service Center versus the Vermont.

We need to track the processing time now at the NVC, since the increase I130 approvals we might see a delay in processing times, but hopefuly they have different people passing the I129f petitions along.

Where did yuo file? Vermont or Cali?
IF Cali I thinkt here is a great chance that your I129f and I130 will be approved together as the rest. The vermont center is still on last month pattern. I am away on buisness so I have not had time to check.

Sean, An approval is just what it is. Approved. So I have never seen someone not get congratulations for an approved petitions.


You know what makes me laugh about this. I was talking about administratively closed petitions since December 5th. I have been searching out timelines and reading peoples signatures. Cut and pasting them to prove to my lawyer he messed up our case. Take your negative & brooding personality someplace else.

I am creating this chart to discover the patter of what USCIS is doing with petitions, if you read the first post in the thread. I am curiouse to see what happens to the petitions that where administratively closed.

Sean U pushbrk I was surprised that I did not see you harassing people in the January, February filers forums. So stop harassing me or I will report you to a moderator.

For those who have recently received a I129F/K3 approval there is an extremely good chance that it will be sent to the NVC, which is the pattern for other VJ users who have had both petitions approved at the same time.
At the time my friends case was administratively closed in December I started chart to follow the pattern. Things have been shaken up, but it looks good for you. So if you think it, it shall be. Always think the best, the best is what you will get. Be like sean and you will be going to live a miserable life.

Sean, if your approval date is 3/4/08 it is a little hard to get the NVC information. They are just working on I129F petitions from August now. There are a couple that have been pass the NVC and interviewed. Do the search yourself. That is not what I am looking for in this thread.

Through the information I have read in other forums and the information in this thread, i have assessed that the USCIS did what they needed to get through quick fast and dirty. Lets see what they have to say to the ombudsman.

I see you can't get enough of me Seanconnery. You really should get rid of that chip on your shoulder. I created the list, I have submitted the final paperwork for CR1 at the NVC So why would you consider this a wish list? What exactly would I be wishing for? Go spread your misery someplace else.

This list is exactly what it is. Do not hate on people who have received approvals. You should congratulate them. If you want meaning full data collect it sean. No one is stopping you. IF the USCIS gives an approval for an I129f that is meaningful to me. It means they are completing the process differently then they were last month. There is an inconsistancy to what they are doing to the petitions. There appears to be an inconsistance from the CSC to the VCS. That means a lot to my research.

It must be real frustrating to see people approved with a month, while you have been waiting months. I just do not understand how they can play that way. I guess it takes longer to follow up on information then some other places.

I guess they're cancelling the I-129F's (K3) when the I-130 is approved as it was originally developed to bring your Wife/Husband over while waiting for the CR1/IR1 number to come up .... so technically once your I-130 is approved, there is no need for the K3 visa. CSC ha been putting both petitions together and then approving them both at the same time.

I am so dissapointed to hear this. This notice of action usually signifies that your I129f petition was approved either prior or along with your I130. This means your documentation for you I130/CR1 was never forward to the NVC. Have you checked the status of you I129f?

You need to get right on this by first seing if your I129f had been approved and forwarded. If this was the case your embassy would have this petition by now, plus you should have been notified. I know you said in the past that time was more important then money. The CR1 is much better then the K3 as I explained to you in the past. But if your I129f had been approved that would have happend when or prior to your I130.


You need to contact the USCIS to have your I130 pettion removed from storage and forwarded to the NVC if your I129f has not been approved.

There are several argumentive forums around VSC and CSC not approving I129f/K3 petitions. For over 4 months now vermont has not been approving the K3, because they would approve the I130 instead. CSC was approving the I129f and the I130 peitions together and forward the I129f/K3 petition to the NVC.

As I predicted Vermont has recently started back approving the I129f petitions too. They cannot just change their policy without informing the USC. When you are trying to get your SO here with little hassle, it is hard to argue when the gov is wrong.

Lawyers know less then the VJ members. He does not know where you case is at or when it is close to being done. He can't get anymore information then you can by calling the USCIS now will he call for you unless you are way over the time frame. Lawyers are only good if you do not feel like dong the process at the expense of loosing valuable time and money.

When I was waiting for an interview date, I would check the scheduled interview date for our embassy to see which month they were on. You can do this by going to the immigration Timelines tabe above. Then do a search using only your embassy. The sort them in order by interview date. That gives you a grasp of hour far out they are scheduling interviews.

Hello End,
Ap is just another way of saying that they are touching up the paperwork. My husband was in AP for 6 months. They were verifying his documentations and did a home visit to make sure he did not have wife and kids. Wow talk about a great backround check. A little expensive though.

You country is typical for AP. Although it could take 2 weeks to over a year. I wish you an expidited AP.

I think it used to take 2-3 months to get a K-3 approved in 2006 at VSC. Now it is not clear what they are doing.
I-130 NOA2 seem to take 6 months as of now, but with an improvement trend...

I am now wondering if filing the K-3 petitions was a mistake... We filed the I-130 and the I-129F this month hoping that it's better to have two horses in the race... I do not mind if they cancel my I-129F AND approve my CR1 in 3 months, but if -like it seems at the moment- the NOA2 for either of those petitions is around 6 months (if you are lucky), then I hope that at least I can get the K-3, so that the NVC process (and perhaps the embassy too) are faster...


I am not an expert in statistics, but I think that the peak of Jul, Aug and Sep. should be out of the system by now!!!
WHEN is VSC going to go back to 2006 levels?

Then when I called back I was told that the USCIS will not close your case that they are working on September 20th, 2008 and yours will come up soon. HE also stated that if I do not receive a NOA in a month to call back. No who should I listen to? I have been waiting since September for this I129f petition, while I have an approved I130 petition. The waiting period at my husband’s embassy is 7-9 months for a CR1 interview and for a K3 it is 1-2 months.



Under the LIFE act I have a right to utilize my pending I129f petition for a K3 Visa.



The petitioners need to be informed.

You sound like you have a pretty good surmise of what is going on.

Everyone who states their claimed was admin closed was verbally told by a USCIS customer service rep or an adjudicator. No one can get a response in writing.

My states that it is pending, but I do have an approved I130 from September.

The USCIS has to give you a NOA on your petition as stated on the petition. Are you Vermont or Cali? Seems like Cali is running long just fine right now. I am keeping an I on Vermont. I think they will post some approval this weekend for many people.

Was this all at the Vermont Service Center (where our petitions are also pending) or at different ones?

I am just trying to figure out what the current situation is.

Furthermore, what happens de facto if your I-130 is approved before your I-129F? In an immigration book ("Fiancé and Marriage Visas", by Ilona Bray, 4th edition, p. 146, I read: "(...) If the I-130 petition is approved before your interview and the paperwork gets forwarded to the consulate, you're no longer eligible for a K-3 visa, and will have to go through the entire immigrant visa application process. (The concept behind the K-3 visa is to compensate for the delays experienced by married couples as they wait for approval of their form I-130.) But it is unlikely that the I-130 petition will be approved until after you've arrived in the United States".

So I am kinda puzzled by all these early I-130 approvals... and the possibility one still has after this, to still hold on to the K-3 visa, whether this is interesting anyway (timewise, I do not care so much of the bigger paper hassle for the Adjustment of Status once in the US), and - if not possible - what this will mean timewise.

Do you know what the de facto difference in processing times of the NVC is? (the Consulate, I assume, varies from place to place.)

All of this makes me wish we had just applied for a K-1 visa anyway.

What in heaven are you talking about Sean. People who have approved I130 are starting to get Approved I129F.

hhmmm Didn't I already state that working on getting a petition open that was claimed to be in Administratively closed was going to take too long and it would be best just to go thought the approved I130.

I am going the CR1 route, but I am still pursuing my I129F to force that they give me a notice of action on my case.
Contacting someone who was reading by the book (remember I said a text book answer)

That was just phase one. My petition is not up yet since they are only working on September 20th.

Rule number 1 do not bother the adjudicator when your case is not over due.

So now I have a recored conversation with someone telling me my case is pending and it will not be administratively closed.

I can't do step 2 until my case is over due according to USCIS processing timeines.

Stop being a misserable person and spend your time spreading joy and happiness. It feels so much better to make people feel good then it does to make people feel bad.

You have some seriouse anger and pain issues. I hope your wife knows what she is getting into.

I don't see how any of those steps would "reopen" a closed 129F." Customer reps have no power and often feed misinformation as many of us can attest. And if, as you say, it will take too long, what's the value? You'd get more respect if you'd stick to the truth and the facts of what you actually know...and drop the guessing and "wild goose chase" suggestions.

You sould like me K32007. I love to get answers automated or online. NVC has Customer service rep to do just that anwer question. Feel comfortable calling them. Getting the NVC information on your K3 will be helpful to you and US.
