You can not listen to that information. Divine mercy was told 3 times that her I129F was canceled because her I130 was approved. Yet when it was time for her petition it was approved. Her I 130 was approved and already stored. There has been plenty of people who I129F has been approved after their I130 and some people who's have been approved together. The I130 goes to storage until the petitionee is in the us. Then the forward the I129F to the NVC.

I have done much research around this.

I just wrote this letter to my brother in law. I thought some of the time lines I cut and paste into the note might be helpfull for you peaches. Actually most of the information I obtained from the K3 forums. My lawyer messed up our K3 by filing it 2 months after our I130 noa1. It got there the day after my I130 was approved.

Here is the information I was telling you about. The USCIS is trying to approve the I129 Petition with the I130. This prevents them from having to process to separate petitions (I129F & I130) with the same information. Thus eliminating twice the work they were doing in the past. So if you get your K3 in before the I130 is processed, the USCIS will put them together and slap them both with an approval.

If both get approved together, the I129F will be forwarded to NVC and the I130 will be sent to the Nation Records Center for storage until you file for Adjustment of Status. This is the policy they announce more than a year ago in this press release: http://www.uscis.gov...e/PN_i-129f.pdf

They had some initial problems implementing this but are now pretty good at it. If both of your petitions were going the NVC, the easiest way to tell would be to look at the NOA2 for the I130, if it says it is being forwarded to NVC, it will be forwarded. If it says you are already in the US, then it will go to storage at NRC, and it will tell you to file the I824 to get consular processing started on the I130.

The I129F will be sent to NVC. This NVC process for the I129F takes about 2 days (but could take up to 5). It only take 1 month to get an interview at the Nigerian embassy.

The NVC processing time for the I130 is 2 months. It take 2 months to get an interview with the I130. So we are looking at Micheal being here around April I the NVC gets our check or the processing. NVC will not touch our case till they get the check.


The average processing time from sent date to receipt of check notice from the NVC is an average of 8-10 days. Today makes the tenth day and the NVC still has not received payment.

Because Michael’s I 129f was not sent till 2 months late the I130 was automatically forward to the NVC with the assumption that we were not filing the I129f. They came to this assumption because no one in their right mind, who is going to go the I129f process , would wait two months to send their petition in. Especially if they are getting profession council from a lawyer. Once the NVC and embassy has the I130 they will not revisit the K3, because they do not want to do twice the work.



If Michael’s I129F petition was at the USCIS at the time they were processing the I130, He would be home with us right now.

I think that is enough to prove my case. Most of the money for the K3 goes towards the processing of the AOS and the work visa. The actual petition is just a form created out of the information we gave for the I130.

Yes Devind and I have spoken. She was the first person to suspect that my timeline looked like I was going to CR1 route. So I emailed my Lawyer to request my receipt number for my 129f, which he provided. When check the status at the website it only states the receipt date. my 130 only shows the receipt date, despite the fact that I already have the approval. So right now using the website to check the status means nothing to me.
I will do some research on Monday with my lawyer.

I am not too worried about the cr1 process, because I have already paid the bill and just days away from submitting proof of support. either way is fine with me. i just feel for my husband which is in limbo right now. we thought he would be here for Christmas, then januaryand not maybe not till March.

Well you were approved very fast. However to answer your question, it appears that your I-129F has not been approved. NVC (National Visa Center) does not send out a bill for I-129F's. It appears you are going with your I-130 (CR1). Since your I-129F has not been approved, your I-130 was forwarded to NVC for processing. After you pay your bill, complete and send back the choice of agent form, send your I-864 to NVC and IV payment...after you complete all of these documents (which NVC will send out each at a time) that's when they send your case to your embassy. Your embassy will then send you an interview (I'm not sure how long this takes).

Hope this helps. Ohh by the way, you should ask for your I-129F receipt number and check the status of your case by calling USCIS.

I understand the reason you don't want to take the CR1 route, because the wait time is a lot longer. You should consider contacting VJ member DivineMercy. Her I-130 was approved before her I-129F...and she decided to wait on the I-129F and not continue the process at NVC for her I-130. She waited for a long time just to find out USCIS cancelled her I-129F because her I-130 had been approved for several months...so she was forced to take the CR1 route. She lost precious months due to her waiting for the approval of her I-129F and by the MISINFORMATION she was given at USCIS.

I just don't want you to wait for a long time and then for USCIS to tell you that your I-129F was cancelled and lose several months.

This information seems embellished since the last spread sheet I showed you had approved K1 that had priority dates for January and February of 2008. Why is that date the same as the K3 when we both know that is the farthest from the truth.



Thank you for your time. I just want to get to the bottom of this discrepancies. I had a USCIS officer state that I could do nothing about K3’s being administratively closed. I like to think that you know differently.

I have created a spread sheet with three tabs: I129f K3, I129f K1, and I130 Cr1. As mentioned in my email Vermont Center has only approved 2 petition for I129f/K3 visas. I can’t understand why the approve so many K1 and ignore our K3. I have been waiting 6 month for my K3 visa, which still shows up pending. As I stated before many of the Cr1 profiles originally where waiting on the K3, but gave up waiting through all the confusion.

Here is a list of Visa Journey user’s timelines. As you can see there is no consistency between the centers regarding the K3 Visa. July and August Vermont petitioners gave up on the K3 and changed their profile status to a CR1. How can one center give approved I129f petitions while the petitioner has a approved I130, while the other center is ignoring the I129f petition. They are not even providing the waiting petitioner a notice of action. I am one of those petitioners that have been waiting since September.



The list below is in order of I-129f NOA1 . I know my rights as a United state citizen. I know what they are doing is not right. It is discriminatory, preferential, and bias. Under the life act US citizens have the right to use the K3 petition. K1 petitions approvals are only taking 2 months. When K3 are barely being issued.

Attention CIS Ombudman:



The confusion on USCIS new self-created policy on administratively closing I129f petition is causing much hardship on petitioners. We has United State Citizens have a right to be informed on this new policy. Through timelines posted in a forum VIsajourney.com it appears that the California Service Center is back on track with approving the I129f petitions, But the Vermont Service Center is still Ignoring (administratively closing) without any notification to the petitioner.



This new policy has petitioners waiting for the I129f approval without any notification that it will be ignored at the Vermont Service Center. We the petitioner deserve a notice of action on these petitions. One center(California) can not approve the I130 and the I129f, while Vermont ignores the petitioners request for a notice of action on their I129f.

I was told by an USCIS office that my case of was administratively closed. Then when I called back I was told that the USCIS will not close your case that they are working on September 20th, 2008 and yours will come up soon. HE also stated that if I do not receive a NOA in a month to call back. No who should I listen to? I have been waiting since September for this I129f petition, while I have an approved I130 petition. The waiting period at my husband’s embassy is 7-9 months for a CR1 interview and for a K3 it is 1-2 months.



Under the LIFE act I have a right to utilize my pending I129f petition for a K3 Visa.



The petitioners need to be informed.

After reviewing the questions regarding The K3 Visa Family Unification Process: How Is It Working for You? Questions from CIS Ombudsman's Teleconference on January 31, 2008, I have surmised some further question regarding petitioner concerns and comments.

Can the USCIS create a new status and policy of "administratively" closing I129f petitions without notification to the public?

The policy for "administratively" closed cases is not located on their website. There appears to be confusion around this new terminology. Why does the USCIS list information regarding Approved, Denied, Pending, and RFE, but does not proved information on Administratively closed cases. Under the freedom of information act the USCIS must provide this information, why don't they have it posted on the website or in the application directions?

The question around I129f petition time frames not being posted is a great concern for me, since I have a pending I129f petition. It has become apparent that USCIS is already providing approval dates for I130 with a priority date of October and November 2007 at the Vermont Service Center, where my petition is pending, with a priority date of September 2007. My I130 petition was approved in September, but I am choosing to wait for the I129f petition for a quicker interview date with the embassy. This embassy give K3 visa interviews within a month to two months time. It takes an average of 8 months to obtain a CR1 interview at my husband's designated interview.

What type of notification process are they providing around this new term "administratively" closed. My case is still pending. I am still waiting. I have called the USCIS customer service center. They did not notify my that my case was "administratively" closed. Had I been notified that my I129f petition would be administratively closed 6 months ago when my petition was submitted I might not have paid my lawyer an additional $1000 to process this petition and I would have moved forward with my I130.

Thank you in advance for you assistance in this matter. Any information regarding the above questions will assist me in elevate unnecessary stress and further financial strain.

I just wanted to let you know that yesterday I sent the Embassy an email that was returned in less then 24 hours with an answer to my question. I have noticed that many of the reviews have gotten better since I have been on VJ.



Just a heads up on a common practice: I have read in other peoples post in regards to non American securing the perimeters around the embassy requesting money/tip/exchange to get into a closer seating area. I have also heard of individuals getting inline that doesn’t have business with the embassy. Then they sell their spot to someone further down the line.

I fired my lawyer and recieved a $1000 of $2500 refund. I could have gotten the whole lot back, but I did not have time to convince him since I have to now had to figure everything on my own. After I found Visajourney, I now know more then him.

If I did this on my own, my husband might have been here in Dec of 08 on a K3 visa.

Things my lawyer did to delay my case:

1. Mailed the K3/129f petition 2 months after our I130 reciept date. Our I130 was approved 1 day before the reciept of our I129f.
2. NVC contacted the lawyer on Oct 15th to let them know we had to pay the fees. Laywer contacted us on Nov 15th to tell us.
3. We overnighted the nvc fees to lawyer. He did not actually mail the fees out until Dec 5th. Lied about sending them in November when I asked for the tracking number.
4. Sent a list of items requested from the nvc to my husband. My husband expressed them back costing over $100. He never requested the DS230 that was filled out two months prior through a web based program. I kept asking him for the forms so my husband could ship them back, but he never answered my emails or calls.

OH and the lawyer doesn't do any of the work. His paralegal does. He just reviews it when she is done. His paraleqal quit in the middle of our case. It was a mess.

Have any of you called the DOS? If you ask when was the last time your case was access, it can atleast give you a glimpse of what they are working on. Some operators are not so helpful, but call again in a couple of days you will get someone else.

Every case and experience will be different. There are people who abuse their power in every role. Thhis usually has nothing to do with the position, but the person's ego.
The USCIS has to have documented evidence to deny your case. they cannot go on assumptions. They can use their assumptions to make your life hell through the process, but at days, weeks, months and even years end they have to have a documented and verifiable reason to deny your visa.

If they have that documentation, they can use it to deny your case.



On the other note I enjoyed reading that "1" person's perspective from their role in the process. It was enlightening and validating even if it conflicted with some of "MY" perspectives.


WE all have a bona fide relationship with the beneficiary. Unfortunately, our reality of the relationship may differ then the beneficiary and the USCIS.

As much as this site can help you ..it can also hurt you by knowing the negative of the process too. My husband thought his interview went great until he spoke with me.

I trusted the AP process. And was disappointed but pull up my boot straps and kept going.

I found the examples of fraud interesting also.

I only posted this article for informations sake. I am not all that well versed in immigration but I do command a basic comprehension of what I read...so here goes. according to the article:

I have not put out any inaccurate information. Let me see what inaccurate info I have put out? I can cut and paste a few from you.

Oh one is that the I129f/k3 is dead. I said that it was not. hhhmm who was correct. ME!

LIke I stated before I knew about Admin closed cases before you! I have a thread way back asking if anyone's case had been closed. that is why I started my CR1, because I heard that peoples cases were being Admin closed. Now my Cr1 is almost done. but when a friend of mine I129f was approved 6 months after her I130. I started to research what was going on. I read the USCIS employee manual and every direction regarding the I129f petition. To know that the USCIS has no right to do this. Will they get away with it? Absolutely, because no one in their right mind dares to stand up to them during this process. Plus, most are just happy that their I130 petition was approved.

You are the one that gave in accurate information. I gave facts.

So stop harassing me. I walk with authority and faith, which you do not like coming from women. Will you put your wife in her place when she gets here? I am not that girl!

I will update the timeline soon. I have been super busy with work and my son. I look forward to updating with the new information.

Thanks dodson01, Yes I know my I129F petition will be approved because it was accurately filled out and with required documentation. But my next verbiage when speaking with the USCIS and Senator that meets the requirements of the law is Notice of Action on my case.
They are required to give me a notice of action. If we did not have a forum like Visajourney, none of us would not know what was going on. If you do not like my list do not look sean. I have 4000 people looking at my thread. Keep your negativity for another forum.
It does no good here where we support each other not harass each other. Remember I knew about Administratively closed cases before you, so please do not get my attempts confused with anything other then my own good and others. You are the only one that is confused here.

In any event, I will let you know what happens. She is going to call them tomorrow and find out what's going on. By the way, if it helps, her petitions were filed at different times. I-130 was filed August 17; I-129f was filed January 2008.

Hey Sean, I did not say a K3 or an approval, I said a notice of action! meaning the can deny it RFE it or notify me that is has been closed. But I will get a notice of action.



I am not sure what confusion you are talking about. You are the confused one to think that the I129F approval has something to with the NVC or the Interview. First you were saying, yeah but none of them made it to the NVC and then you are saying well no one has an interview. Get over it. They got approvals.

This is a I129F notice of action table not a I130 and if you find the date useless stop looking at it.

Once the Vermont center figures out they can't get away with this they will get right back on track too. The action they are taking is illegal and would not stand up in court, but who is going to bother going to court over that petition when they have a I130 approval. That would be stupid to wait for a court hearing. That is the only reason they are getting away with this action.

I did not create this type of table. I got the idea from another thread that i used to follow before I realized my times were off because my lawyer was not processing my items on time. Then it was not useful for me to follow because I had no control over when my paper work was being sent or bills were getting paid on time.

This is useful for new people who are just filling to see the dates and time frames. i enjoyed looking at that table so If people do not like they can not look.

You keep coming to look for some reason. LOL

I guess you do not understand my action are for the betterment of other petitioners not mine. There is an injustice going on here. I am attempting to take action to bring this to light. You can just sit around and bring doom to everyone or you can help.

Yeah, it is a little too late. At the time the controversy was around whether or not the I129f was "dead". Every time a created the naysayer kept complaining about the I129f date, therefore I made sure I had the sent and NOA1 dates.
It is very time consuming to put all those dashes in. LOL I really like to see more NVC dates.

I am now a CR1, since I filled my husband's DS20 and my affidavite of support, which is the alst step for the CR1 at the NVC. THis will initiate our petition to the consulate. Once he has notice that we have an approved I130, they will not acknoledge our I129f approval.

My I129f date was Sept 26, so close yet so far, because of the controversey around my NOA2 for my I130 and NOA1 of my I129f. I am still confident that I will get a notice of action on my I129f. I am going to force it out of the USCIS despite that I am going the CR1.

I appreciate you compiling that list. Have you thought about putting the I-130 Sent Date or Received Date as these correlate to the Priority Date by which petitions are being processed?

As you can see by your own list, the I-129F Sent Dates range anywhere from July to January. As it stands, in most cases the I-129F Sent and NO1 dates have no bearing on approval time frames. I understand if it is too late to change it, but you might want to at least make note of this when you post your list.

Nope K3 filers. USCIS likes to grap easy cases and pass them through to make their numbers look good. I had a quick approval for my I120, I was confused by what was going on. 84 days from NOA1 to NOA2. but my lawyer made so many mistakes on my case it is criminal. I just finally finished with the NVC. My K3 is september, but I can't wait anylonger, since we are done with the NVC. We might have to wait 8 months for an interview versus 2 months with the K3.

I am on the phone with the USCIS.

They are working on I29f/K3 petitions with the date of September 20th, 2007. He said that my case is not administratively closed and that they should get to it soon. Now I will not take a chance with my case since, my husband now has other options to travel to canada.

I just wanted to give you a textbook answer to what they are saying. I will persue my I129f/K3 petition to the end, whether I need it or not.

He sais that the USCIS does not administratively close cases.
Now I know that people were told there cases where administratevily closed. I just want to let you know that there is not a policy around closed petitions.

He was extreemly helpfull.

Hello Jason,
I have added you to the list. When you get your I129F Approval please let us know. Your situation is similar to mine. You have an approve I130 already and a pending I129F. The Service Centers are standing strong on letting the I129F dangle because you have an approved I130. The I130 petition for the CR1 is actually a better way to enter into the Us. If you have a difficult embassy that takes longer to process the CR1/I130 then you might pray for the I129F.

MY I130 is almost competed at the NVC so I am going the CR1 way. But I believed so strongly that the I129F was not dead as others stated, I created this thread.

Your process will be expedited and smooth the rest of the way!

Yes, it does seem that way. One difficult thing about waiting in a forum with other petitions is seeing other people get through the process twice as fast. It can be confusing, but we can not question uscis with the information that we have regarding our timeline vs. theirs.
