I was under the impression they did not take your passport unless they are putting a visa on it. My husband was put in AP and they did not keep his passport. Other people who have been on AP, once their case was completed that was when they were requested to submit their passport.

I am hopefull that a more experience person in your embassy will help you.

They usualy know before your interview if they are going to put you in AP. That is when they request nothing new and hand you a 221g. LIke us. Then you might be missing someone and they will request that information which puts you in ap.

Hello AP can take as long as a year. Since it is just missing documentation and they requested your passport with the missing document, you should be quick. There is no guarantee that it will be just 6 weeks. There is not enough information on AP to even give you a rough estimate.

Called DOS. Had a female that sounded patient and friendly when she answered. I got excited. She was so positive and uplifting too. She first said, "oh, NO". Your in Admin Processing". That can take a very long time. I see some people that go past a year.
I asked can you let me know when the last time they accessed our case. She said, Oct. 17th. Unfortunately it was to send me an email. Prior to that it was October 2nd. Probably to not home visit.

Everytime we call them we should post what they say in this forum. Lets see if we can identify a pattern.

That is great news. You are just in Admin Processing, which is typical in your region. It is just further work that needs to be completed to approve your case.

Let me correct that, great news that they admit you have a relationship! Bad news that you have to wait. Although disappointing at first, just consider this another part of the process.

Did you add your name to the AP tracker thread? This will help us get an average for different regions.

May your AP be expedited.

USC should get a lawyer. The lawyer will request in writing reason for denial and supporting evidence. Then you can go from there. Only a lawyer can efficiently and in an expedited way help you now. Good luck!

After the knowledge and experience I have gained through being on AP I believe that it is important to consider this just another part of the process. There is nothing negative associated with AP other then the fact that you have mroe wait time. This is common in your SO's area and as mine. Do not be discouraged. Accept the stage and prepare for the best. Everything will be returned to favor you.

This is great news to me, since there is an actual relationship that can be proved. I am not sure how you would get a responce using a lawyer. They ususaly make sure thath you have what is required to establish this, sinc ethye do not want to do more work in the end.

I didnt call my husband but 1x every 2-3 days for less then a 15 minute conversation. Our emails where only 1-2 a week.

I did not realize that the embassy would give all that informaiton to the bene.

Apparently a year's worth of phone records (calling more than 2 times daily, spending hundreds and hundreds of dollars), pictures of us together, with other people with us, attorney receipts, my itenirary, visa stamps, copies of hotel bills, letters, cards, emails, affidavits were not enough. If we are able to keep the petition there, by the grace of God, I am flying in for the interview. Nonetheless, if it gets sent back, and we have to start from scratch, I will still be there for the interview. I guess the good thing, they gave him back all of our proof so we have it for the next round.

Just in time morocco4ever. Accurate advice. DOS can't give you much info, but sometiems tell you more then you have already.

Do not do anything regarding a wedding until you know the petition has expired or why you were denied. This could complicte things. Do not do anything without legal advice from several lawayers. Even if you have to pay a recommended experienced lawyer a consultation fee.

Actually they can deny you the information. And the DOS probably won't have this information this quickly.

The fact is that they have the right to extend the date if they choose to do so. They may have decided to let it expire, and they might have other reasons for sending it back. Here is the link specific to returned petitions,

so if it has been sent back it would be wise to go through this. But here is the case, if they haven't actually sent it back there is a very small chance that they may give you another chance.

You can take the number they gave you (the diplomatic pouch number) and call this number:

The person that assisted me was Steve Ferrell. He didn't answer the phone so I left a message. He is very good at calling back.

Keep in mind, even though they said that they have already sent it back it is not always the truth. They told us the same thing when in fact it was almost 2 months later.

Contact your representatives and tell them your story. You will need to sign a form giving them permission to discuss your case with them. They can not get the visa approved, nor can they get them to act faster on your case. But when you get them involved it makes the consulate more accountable for their actions, and helps that the case does not fall between the cracks.

If it does get sent back there is a good chance that they will expire the petition. But make sure that it has actually expired before proceeding with another petition. My suggestion is that if they do expire it, and you have written proof from them, then it might be wise to go back and get married.

Anyways I am getting ahead of myself. Just work on keeping it at the consulate and giving you a second chance. Please review your evidence and the questions at the interview. You will need to come up with proof of their suspicions in order to win.

Don't despair. You can win. I have known of at least 3 couples that kept it from going back. I have known of several more that have been denied, fought it in the US and won, I am one of those couples.

Manish is your SO? The department of state, embassy and USCIS owe nothing to the beneficiary. I can't even believe your lawyer has advised the wait for the beneficiary to receive something. Sorry I had a horrible experience with an immigration lawyer. He was fired and returned half my money. If I didn’t have so much to catch up on and learn regarding the process, I would have all our money returned.

I am not an expert, but I think the lawyer needs to write to request the results of the findings. You can do it yourself, but you have paid for your lawyer already. They are better at drafting the letter.

Do not give this lawyer another penny until you find out why your SO was denied. Call a couple of other immigration lawyers regarding what the next step is without informing that that you worked with a lawyer. Just state the results of the K1 approved petition being returned, ask what he would advice next if you were to retain there service. I know that someone here can recommend some good waiver lawyers who have been through this battle. Many immi lawyers are just paper pushers. Ok lawyers who hire someone to push paper. You now need a lawyer who knows what to do when denied. Not to say that yours doesn’t.

Have you called the DOS to see what they read on their screen? The might be able to see something mroe then what the embassy is saying. Ask for the most recent update to your case. This lets them know that you know they can see updates to your files from teh embassy.

You have been hit with a ton of bricks! Please brush your self off gather the bricks build yourself a fort for the battle that can be won.

Please trust that if you can afford a lawyer and your husband has not committed any fraudulant actions and has not falsifide information, the decision can be overturned. There are several people on VISAJourney that have been denied and have over comed that obsticle.
The Embassy?USCIS has to have documented proof of why they denied your case. Your lawyer will put in writing to get the request of why your case was denied.

Please relax and wait for the verdict of why you were denied. Then you can go from there.

Although we did not have an engagement ceremony, I do now have pictures with his family, and our rings, along with every single receipt of proof of this trip. We took over 200 photos of us together, and our trip outside of Delhi. Now, I believe withdrawing my petition would raise flags. I just want to know what the best scenario would be. We had originally decided we are waiting until we here from California that they have expired our case. I wanted a CR1 so it would not expire. I just don't want to waste money and time trying to hurry with a new K1 when they may just deny a second time. And if they do deny a second time, what other option would I have? Doesn't that run the risk of then applying for a waiver? Would a waiver be needed if we apply for K1, and it got denied, so we applied for CR1? I wish I had psychic powers to see what the best scenario would be. wacko.gif

They know already if you are going into AP, before you have your interview. Of course it is different from embassy to embassy. There could be something in the answers that might cause doubt that put someone in AP, but for the most part they know you are going in AP before your interview.

I have heard people say that they passed their interview, but now they have to go into AP.

The AP can time anywhere from 4-8 months or longer. They gave it pack incase you need it to travel. Your documents you submitted might have to be verified. Sorry for another bump.

AP is way better then denial. The news is devistating to hear and frustrating at times because there is not a time frame. AP is not common in the UK, but are more common in India. So they are probably doing doucment verification in India.
I pray that you will find favor in living arangments and confort during this difficult part of the process.

Dairyfarmer kindly directed me here after I was put into AP today. In short, considering some horrendous difficulties to do with cultural issues with my family, and after leaving home in late November with my cat, it's taken me a great deal to get to this point. I went to my interview full of hope this morning only to be told they were going to put me into AP while they do some administrative stuff, without specifying what it was. It might have to do with issues to do with my birth certificate, as I was born in India but estrangement from all my family and relatives has meant that it's been nigh impossible to get a hold of a certified copy (I only have a photocopy).

I was hoping to travel after my university exams finish on the 18th May, but before June 12th -- that's when I can't stay in student halls anymore, and I don't really have anywhere else to go and I can't impose on anyone.

I'm just very sad and broken today. I wish I could offer something a little more cheerful.

This is common in your country. Chances are they knew you were going in AP before the interview. Unfortunatly, you will not get any informaiton out of the Embassy other then you are under AP. It is very dissapointing, but part of the process. You have anywheres on average from 4-8 months. Sometimes shorter and sometimes longer. Contact your congress or senator representative. You must get the visa to stay at the embassy level. You might want to contact a immigration lawyer that specializes in denials.

There reason for denial is not a valid reason. The shoudl have requested more information. You can't deny someoen because their family was not at the wedding. Period.
