when i came to the US in 2009 my husband and I was having some financial problem because he came out of the military and he was doing construction work which didnt pay that much at the time.I was also looking for work but where I was I couldnt get a job. we live in ohio. so he ask my sister who lives in Texas if I could stay with her a little .while in texas i got a job for which i was saving up to go back to my husband or for him to come to texas to live but things didnt work out that way so i ended up going back to ohio. my question is since i will be removing condition on my green card this year do we have to write an explanation of why i was in texas and provide all the records of phone calls etc to the USCIS? and also do you have to have a joint account?

i have been readin the forums and people seem to have a lot of eveidence I will be sending my package next month. Here is what I have do you guys think its enough?

Tax transcript for 2009 and 2010

utility bills for the past 2 yrs

car insurance

bill from hospital showing address

lease

walmart discount card for both of us

Sams membership card

GC back and front

we dont have any joint account but our information is on each other account

copies of a few pay stubs showing same address

and also a letter from the military for my husband to report to inactive duty training


so what do u guys think?

I spent some time away from my husband couple months after i came to the US because we were havin some financial difficulty i went to texas to stay with my sister for a while and he stayed back in ohio . It was hard finding a job in ohio and with my husband being out of the military was challenging too . my husband was supposed to come to texas to live but things didnt work out so i ended up transfering from my job in texas to ohio. my question is should I send an explanation letter to the USCIS? or just leave it out atleast i think they know i was in texas dont they keep tab on you? so what do you think I should do?

Note that you need as much evidence of financial co-mingling as you can. Your list seems to lack some of this i.e. joint taxes, join bank and credit card accounts - and over a period of time too.. not just as of this moment.



If you`d look closely we DO have joint tax returns of 2007 and 2008, also we do have two credit cards with the same account listed..
I did take the advice of Jasminelily and had our inlaws write a statement mentioning we live with them in their house and therefore can`t present a rent and or mortgage bill.

Hello everybody..
It`s been a while since I posted on here...after all it`s also been about two years that USCIS has bugged
me for the last time, however as I read on here; back in the loving arms of the USCIS"..lol
Anyway, I am as well about to file the I-751 and I would love to hear people`s opinions on my assembled
package so far.....
At the moment this is what it looks like;

- I-751 forms (filled out jointly completely and accurate) 2 forms
- A money order for $545 USD, Associated Bank. (Filing fee and Biometrics)
- Copies of Airplane/Train tickets from our 3 week European trip (2008) and other trips.(4 pages)
- Copies of envelopes of holiday/birthday cards received on our address. (6 pages)
- Copies of dental statements showing our jointly dentist visits over the last two years (3 pages)
- Copies of Employer benefits enrollment listing spouse as dependent (4 pages)
- Copy of confirmation of 401-K plan listing spouse as beneficiary (1 page)
- Copies of forms of 2007-2008 taxreturns listing both names (3 pages)
- Copies of front and back of Permanent Residence Card (2 pages)
- One photo CD containing 130+ pictures taken between 2006-2009 verifying our ongoing relationship (vacations, trips, family photo`s)
- Copy of Sheraton Hotel bill listing both credit cards being billed. (1 page)
- Copy of letter from Dep. Of Homeland Security to file for a joint petition to remove the conditional basis of my permanent resident status
- Copy of pet adoption contract listing both our names as pet owners. (1 page)
- Copy of pet trainer organization listing both names on same address (1 page)
- Copy of Sears Credit Cards showing joint account. (1 page)
- 2 sworn affidavits by close friends verifying our marriage. (2 pages)


We don`t have our own car and at the moment we still live in our Inlaw`s house so we don`t pay rent...
(I know living with inlaws doesn`t sound that great, but I`m very luck and got the best inlaws in the world smile.gif

Any advice or suggestions would be highly appreciated!!

Thanks for the responses.

I was living at a different address (#1) and the plan was for her to come into the country and live with me at address (#2). She has never lived at #1 always at #2. I did not know #2 at the time I filled out the CR-1 paper work. So #2 is all she has ever lived at. I sent the I-865 change of address form in already for me. She has always had address #2 but in filling out the original forms, I suppose I put #1. So bottom line, I don't need to have her submit an AR11 because #2 is where she has always lived.?.

Unless anyone sees this as a major deal, and we need to get a lawyer involved (can't afford... ;) ) I'll just complete the paper work with the new address and turn it in. Just anxious about this. I don't want to screw anything up :).

Hi, well we made it! I hope :). Living with my spouse for two years now and we need to file for the removal of her conditions or form I-751.

Couple questions: I know the sponsor has to fill our form I-865 for a change in address, I have and sent it to the correct location, it is a little late, but I am assuming they won't care as long as they know where I am now.

In reading the I-751 instructions, do I need to fill out the change of address for her to? On form AR-11?

Ok. Update on this. I did turn in a cover page with most of the additional requested evidence and low and behold we received her green card...all conditions removed!

I guess the examiner was job justifying.

It would be an interesting however, to see which countries do generate the most RFEs.

So, here we go, second marriage...will not make the same mistakes as the first--money goes to separate accounts and contribute to a combined account to pay bills, take vacations etc..

Thanks to all for advice and good counsel. Will be back after she accumulates enough work time to become a citizen! :thumbs:

I have assembled copies of my 2010 and 2011 joint tax returns, the w-2's, and the 8879 form which I believe is what they want to prove that I submitted the return? On the affidavits, I will use family members. For the co-mingling of assets and debts I plan on submitting my auto insurance policy that lists her as covered and she works for the public school system here teaching Spanish and carries dental and vision for both of us. I will also submit our lease for the past two years. And she is a user on one of my credit cards and I will submit a copy of the card. I have read other folk's comments in this forum where they submitted their driver's licenses to prove they are living at the same address. I guess I'll do that as well.

I was frankly surprised/shocked a little that it took close to a year to get back to me with this. This leaves me very little time to correct any more issues; her extension runs out in March.

Are you confident that we will get an interview if there are any other questions?

Ok, I have no problem if there is a real concern about being used as a green card daddy.

However, when they say, and this is a quote from the RFE: "...you submitted a 2010 tax form without supporting evidence such as W-2's for both of you and your spouse or proof of filing..."

Proof as in W-2's? and "proof of filing" What the @%$*? Ya, that is what we are doing...ya that is my gig...I am filing false income tax returns, which, is a felony. That is exactly what I want out of this process--to become a felon.

It seems like someone is purposely trying to go out of their way to mock this process. I am standing in line and doing this the hard way because this is the legal way. YOu should not have to hire a lawyer to fill out this paper work in order to get into this country.

So, I have assembled what they want and will resubmit with a lawyer. And if they still insist that I need to produce more proof and run out the clock on us, I'll visit my congressman/woman.

Ok, so I have read here that most people have payed the fees $585 and upwards to remove conditions and that they sent in what most would agree was solid evidence of a bona fide marriage. However, I too have received an RFE notice and am trying to assemble additional documentation to show we in fact are in a bona fide marriage. My question is, what if I cannot provide enough evidence for whatever our examiner wants? Is there a three strike rule? Does she get deported?

I'd apply ASAP and hope the NOA1 comes before she departs so that she has it with her on her return trip in case she is questioned at the POE about the March 2007 expiration date. You never know with these POE guys what could happen if she returned without an extension.
