Thanks so much for responding. I am praying it is minor. My fiance thinks we didn't have enough pictures. I sent 4 or 5, and wrote the dates and i think location on the back since I forgot to set the date on the camera. My other concern is I couldn't show cell phone calls because we actually communicated mostly on messenger to save money and when we were on the phone(not a cell phone) I used an international phonecard which you just keep adding money onto. I did print out a copy of when I added money on every time trying to show that it was a good amount. Now we talk on Skype and I use Rynga to talk to him. it's awful though not knwoing yet what they are going to want and praying it is minor, and then wondering how the heck you missed something. lol



I had that same problem with the cell phone and phonecards, but if you are using yahoo messenger you can print the voice call logs and send those instead to show how often you talk on there, only if you were using the voice call. Also you can print the chat log with name and dates.

They do require you to show proof that you are able to support him while he is here (in the US). Staying with your mom is not helping the issue either, unless she can sponsor him. Now the job you found him (without him being here) seems to be understanding people, see if they are willing to sponsor/vouch for him?

Your situation is....you have two kids by him, have medical issues which will lead to SSI (gov't bill), so in the gov't eyes they are not seeing where you are able to support your family, unless you can get someone else who is able to sponsor.

It is required by law that the petioner has to sponsor whoever they are trying to bring over....(the gov't just don't want the bill on them).

You can write a letter of Hardship explaining everything you just wrote, that might also help.

This is my first post on this site. I am a UKC and will be marrying my fiance who is a USC and have applied for the K1. We were given a receipt dated 13th September and have heard nothing since. I realise that this is only 6 weeks but what is the optimistic and realistic idea of when an interview might be offered. Our lawyer, websites etc are all so vague. I was hoping to have been able to go over in December but is this now out of the question?

Realism required please!!!

Have you registered on the USCIS site as of yet? IF not, you need to do that in order to see your case last update. And if you read other's timeline on here it will help you know what to expect or at least what kind of wait you are looking at.

GM,

You will need to make a copy of your original birth certificate FRONT and BACK....in Florida we no longer have the half version B/C (wish we did), but now their 8x11 (long version). So you might want to call your local Vital Statistic office to find out if they ae now offering the long version B/C instead of half.

Second, I included an extra letter explaining the the days we were together (within the last TWO years), to give insight of what they are looking at in our photos. So it won't help if you have something extra, but just not too long.

I refused to call my Congressman he is not all for the immigration process he's pushing for a law something that is not interest in immigration rights, so I decided to write and call my Senator instead. I am 5 months and weeks into my process and I am told to give it until April 6th, which will be my 30 days of waiting from the Service Request.

I see the Vermont Service Location has 11,746 cases PENDING!

No wait because you never know if it was really needed or not. So just wait for the RFE and they will tell you where to send it.

Well once it gets to the Vermont location and has been assigned to someone to review it, if the supporting documents (depending on which) are missing- you will receive an RFE (request for evidence). They will send you the RFE with a deadline given to send back to them. You want to do that ASAP!

My Toney got his poolice clearance when he was in Liberia back in December, but he realized (NOW) :bonk: they put his OLD passport number on it instead of his NEW number from the renewed passport (he had completed). What should he do in this little timeframe? There is no way he can travel back home to get it (takes too long), so can his mom email (scan) it and he take a copy version along with the wrong one with them at his interview? Do you think they will allow this to happen?

Ladies and Gents,

I am a first time user of this forum so please accept my apologies if I am asking questions that you have answered a thousand times already.

I just need a couple of things answering mainly about after I move to the USA. I have my interview with the US Embassy in London on Tuesday 12th July. So far everything has gone pretty smoothly and I have jumped through all the relevant hoops that have been asked of me. At the interview, do they even ask for continued evidence that you are still in the relationship? I have the bill for the ring to prove I have bought it and we are engaged, I am also going to supply my mobile phones bills to prove we talk to each other, and e mails as we talk everyday. Will this be enough or do I need to supply more?.

I am looking at moving around mid September and wondered what passport I will use while I am out there. I really want dual citizenship where as you have 2 passports, an American and English. But from what I have read this will not happen. My English passport does not run out until 2016 so once I have obtained my social Security Number, completed my AOS and obtained my EAD and finally the Green card, do I need to apply for an American passport or is my English one good enough to travel on for the years it is valid? Once my English passport expires do I get an new English one or do you apply for an American one? If someone could explain that would be of great help.

I also don't know if I can drive on my English driving license once I am there. I am moving to Wisconsin and don't know if I can insure a car using my English license. I assume I will be able to drive my Fiancée's car under her insurance with my English license. But will I need to apply for an American license to insure and own a car. Or will I under law, have to apply for an American driving license anyway because I have moved over.

Again, sorry if you have answered these questions before. But I have searched for the web and am sure unsure. Any help would be greatly appreciated.

You will need the divorce decree to send it in with the application..the information will be on there..i know i had the same problem :) and i actually put in the wrong date of the divorce..and i noticed later it was on the divorce papers..her birth date, the date of the marriage and the date of divorce. at least that is the case in my state. The petioner will have to send a copy of his birth certificate when he files the application..He/she will also have to have a copy of divorce decree, and things like that..the beneficiary will have to have a birth cert also, and one for each child if they have any..but they dont need to be sent with the original application the petitioner sends to the uscis, you will need those at the interview..the instructions are all in the uscis website..good luck to you..

Since no one has answered I'll give this a shot. What I would do is include the wrong name, because the name was technically used. You should also attach a sheet explaining everything that surrounds the circumstances of the name and include any paper work you can that verifies your explanation. That may be the only thing you can do. Unless someone else comes along with actual experience with this matter, this may be your best bet. But with anything that I thought they may question all I did was back it up with all the possible evidence that I could. I hope this helps. Good luck to you both.


INCONSISTENCY of names in your applications may cause you a denial. There are places in the application forms where they ask you to fill in ANY OTHER NAMES USED. I have alias that i filled there and they didn't even question it. They just want to know if you have used any other names before for background checks. Just don't fail to include the OMITTED name in ANY OTHER NAME USED section. You will be fine.

(FONT SIZE: 8 with a margin of 0.25 x 0.25 on all sides) i tried to show it to him, guess what the consul did? he just smiled at me and said, "nah, its all good!". I WAS SOOO HAPPY, however, on the other hand, i saw myself there, imagining myself printing all those papers for more than 3 hours plus the drive back and forth to the mall just to get them new ink cartridges.. haha! i guess it was all worth it after all! :D

you guys check out the rebtel website.. www.rebtel.com. me and my husband has been a loyal and happy customer since '08. the best part of it is that you can keep track of all the calls that you guys had... except for the fact that it was cheaper, everything was so transparent. all the detailed cost and the duration of the conversation.. it was very helpful too between me and my then fiance. i could also suggest you guys to safe keep all the travel receipts that you guys have had in the past. pictures taken together from different places at a different time is what i can say, one of the TOP proofs you could ever give. i remember bringing our first ever movie tickets and showing it to the consul. (its soo funny cuz its all blury and almost unreadable) stuff like mc donald's receipts when we were on vacation in the philippines and etc. small stuff like this can play a substantial amount of evidence of your legitimate relationship.

Have you looked at the information on the Consulate website? http://ciudadjuarez....g-a-k-visa.html It explains the process.

The beneficiary should have received a packet of instructions from the Consulate as well with the same information.

The DS-156K is the actual visa application form. Without that, no visa can be issued.



They just sent us a letter telling us to fill out form DS-260 and then set asc appt. and interview online. It doesn't have the list of documents to take and the websites are kinda confusing. Some list different things. I doubt they will send any other info because our appt. is next week!

First of all, no matter what you decide to do you will be OK as long as you can provide proof of continued financial support. This can come from you, or from a co sponsor. She doesn't need to mention that you might be in Puerto Rico, unless the consulate officer specifically asks her. They will look at your financial information (the I-134, and supporting documentation) and more than likely will not question anything more than that. They will also more than likely base their decision off of your CURRENT income. So as far as being approved for the visa, this will not be an issue.

I was planning on just using my income from 2012 and the first half of 2013 for the interview and then showing the Affidavit of Support from my friend for the adjustment of status. In my case, do you think that should be okay? Due to the timing, I am almost more concerned about the adjustment of status than I am about the interview, but it sounds like as long as I have a co-sponsor then everything should be okay, even if I were to be making below the required amount in Puerto Rico.

Also, on an unrelated not, I noticed on your timeline that your third visit was on the day before your fiancée had her interview. Did you accompany her to the interview or did you just come for moral support and/or to have a little extra evidence?

I'm sorry, maybe I am confused, why is it an issue for you to attend graduate school or move to PR? You are a US citizen, why shouldn't your fiance mention it?

The issue will be financials, if you cannot prove you make above the requirements then you'll need a cosponsor.

Secondly, the second adjustment of status is not an adjustement of status. It is a removal of conditions and read up on that process

Could you provide me with more details about how you believe you the USC moving to PR to attend graduate school (aside from $$$) will be an issue?

To clarify a bit, my only real concern with moving to Puerto Rico is the way my financial situation might impact the immigration process for my fiancée. As far as mentioning this during the interview, I thought it might be best not to bring this up (unless asked, of course) since we are planning on showing my finances in order to get the K-1 visa and then a co-sponsor for the initial adjustment of status. Additionally, while Puerto Rico is a pretty sure thing, I will need to wait until receiving financial aid before being able to commit to the move. In any case, it sounds like as long as I have a co-sponsor then things should be okay on this end.

One quick follow-up. You mention that the second adjustment of status is actually a removal of conditions. In your opinion, would likely making below the minimum requirement for two years during a grad program affect my fiancée's ability to receive permanent residence?

I recently submitted form I-129F and received the receipt of this (NOA1 I believe it's called) at the beginning of October. I was in a graduate program in 2010 and 2011 and did not make enough those years to be a sponsor, but this year I made above the minimum income requirement. I also have a friend who has had sufficient income during the previous three years who is willing to sponsor my fiancée during the Adjustment of Status process. Based on the typical K-1 visa timelines I have seen, this would likely be around May-August 2013.

The problem is that I may be moving from my current state to Puerto Rico to pursue further graduate studies in August 2013. The program is a dream of mine and for various reasons I would not be able to do it at a later date, but I am also nervous about it because I want to make sure that it does not hurt my chances to be with my fiancée. I am concerned on two fronts: Firstly, I want to make sure it doesn’t prevent my fiancée from obtaining the K-1 visa (though we aren’t planning on mentioning grad school during the fiancée visa process, since it is not yet a sure thing) or, especially, successfully going through the Adjustment of Status. Although I will possibly not make enough money during the program, is there any chance this would become an issue? I also don’t want things to look fraudulent if my fiancée doesn’t mention Puerto Rico in the interview stage and then after getting the K-1 visa we up and move before/during the Adjustment of Status. These are my immediate concerns.

Secondly, I am also concerned about how this would affect her status longer-term, as I know we will have to go through a second Adjustment of Status at the end of two years in order for my fiancée to obtain permanent residence. Oh I knew that you could file overseas if you resided there and married, that wasnt the issue. I just didnt realize that it cut months off the waiting time as figured it went thru the same process that it would if I filed here. That was what surprised me, that by doing that it seemed to go around the normal processing time.


If one prepares ahead with all the documents required to obtain the IV, then time can be cut dramatically by doing DCF. At most embassy's, the I-130 can be adjudicated the same day. That cuts 3 - 6 months off of the wait time in the US alone. Unfortunately in the US, there are too many steps involved...pay this first, send document, pay this next...etc.

Yes, it's been a loooonnnng time. We were able to file for my DH after I was told I couldn't do it there because we were not getting married in Romania. Fortunately, my persistence won out when I got them to explain to me what requirements would be acceptable for us to file. And, interestingly enough, I saw that they had a file for us prepared in my maiden name, with all the correspondence I sent to them BEFORE the initial interview. Good thing I kept my cool when they iniatially told me I couldn't file there. :blush:

Dwar,

Each country has its own rules on who can file DCF. In Romania, to date, USC do not need to be residents of the country to file DCF for their Romanian spouses. However, the USC does need to be in attendance at the first interview appointment when the I-130 is submitted. That is why it is important for Maimu to contact the embassy stating her plans to marry with a specific date so that they can get her an appointment while her husband is still in country.

Jaci's advice is golden. Contact the embassy before you make any decision with your plans to marry. They will reply in a timely manner and most likely will get you in for an appointment to file at the embassy. There DCF process is one of the fastest. It took us 16 days for my husband to get his visa there.

Did they deny you or ask for more information? The way the usually do it is ask for more information regarding your meeting your fiance. If they denied you I think (don't hold me to this) that you can ask that your case be reopened. Can you give us some more information? When did you meet and when did you file?

i sure can i am new and a little pissed so sorry for my vagueness belive i have the actual engagement documents and i also have emails concerning my trip there i also belive i have plane ticket stubbs to its a long story she is actually my mothers best friends neice and we begining emailing and tlaking on the phone last fall i went to her country and had the ceremony and filed as soon as i got back


It would help to know what country you were denied. There are sure to be more responses from people familiar with your consulate.

Christine, I think - if they filed for a K-1, that it doesn't matter where the fiance is from, as the case apparently has been denied by USCIS. If so, what matters is whether they were able to meet the requirements and support the petition with adequate evidence of such, and, of course, send out the appropriate forms and documents.

OP: Have you gotten an RFE asking for evidence (or more) evidence of having met within the last 2 years?
