I hade my interview Last Tuesday and the Women Asked me to bring 2 more new papers ( Court paper and the single paper) i think it is new !!!!!
After and in the next day i took my 2 papers to them and i was Told to Go untill Receive a Call from the Consulate ,
i Receive a Call the Friday aternoone telling me to Come back on monday With My passeport in hand .
Does everyone please Seen a case like That before and i wanna know if they will issue the visa the Same Day ???? i was Ask to Come At 13:30

Folks,
I am a US citizen with CR1 immigrant petition for my wife. I am the agent for my wife. I get the DS-230 form Part 1 via mail by NVC.My wife completes it and I send it back. Once the file goes to the Embassy, do they send the form DS-230 Part 1 back again to my wife in Packet 3? But dont we already fill it out at NVC stage? Is it required to be filled again with the same information?
Someone please help....

My wife received her CR1 VISA from New Delhi Embassy on August 24. Thank God!!. She received the VISA from Courier. Anyone traveling on the same date as her on the Wednesday Aug 30 from Delhi to Newark, NJ? She is a bit anxious about traveling alone for 15 hours. Thank for all your best wishes and help. The journey is far from over but this is a new beginning..

I think if he comes and indicates he's visiting family for the holidays, there's a good chance there will be no problem. He can be truthful without mentioning his full itinerary or the marriage plans. Entering again after filing the petition is somewhat more delicate. You can see many discussions about visiting during the spouse or fiance visa process.

I only responded to the entry on the VWP in December question. Of course staying to adjust status is out of the question. Staying to adjust status doesn't entail future entries during the process. It involves "staying". Not a good idea at all.

Hello,
I'm seeking some help concerning a K1 or K3 visa.
Due to surrounding circumstances, my fiancé & I would like to marry January 3rd, 2009 in the US. However, it's difficult to plan a wedding if I don't know when/if the K1 visa will be approved in time! My fiancé is a UK citizen, and is allowed entry to the US on the visa waiver program.

My question is, if we marry while he's on the visa waiver program, returns to the UK - will this jeopardize the K3 process?

Any help would be greatly appreciated!

This is confusing b/c some people think of a K1 visa as a non-immigrant visa. In this case, no one has, but if you consider a K1 visa an immigrant visa, then the answer is yes.

Wow it must be my lucky day! biggrin.gif For proofs of relationship she only asks for PICTURES! That’s all and I brought a lot in my folder! Glad it all went well though. The pre-screening took only less than 3 minutes then I was asked to sit down and wait for my number to appear in the queuing board again. After wards I proceed to number 31 for the consul interview. This is the scariest part of the day! wacko.gif A nice man in his middle age years appears to me and asks to raise my right hand to swear if all my information are correct. He asks the same questions just like from my pre-screening interview. He checked my pictures too. Then he said Ma’am your visa is approved. I thank him a lot with a smile... Thank God…

I waited for my name to be called then proceed to window 37. The lady gave me instructions how to pay delbros. Then I went to the delbros counter and paid Php250. That’s it! I’m done. I head to the exit with a gleeful smile.

I first looked for food because I was so hungry and then called my fiancé to relay the BIG news. We are very happy…dancin5hr.gifdancin5hr.gif

I need your insights regarding the I-134 or affidavit of support. What are other docs aside from income tax return coz my fiance just sent an income tax return for 2007 with affidavit of support. He is a self-employed person and want to know about other docs. He doesnt have a pay stubs. One more thing, on the second page of affidavit of support, he has an erasure and he uses a white ink on it, in the portion of "with a cash surrender value of: and then $ he uses a white ink. Do you think it will create a problem but it has been notarized.

Need your advices guys asap!!

Yes i do understand him, at that time i wanted not to be selfish so he would stay with me long at that time. I also care for his mother's health and she was truly so sick at that time, she needed to undergo with a gastric bypass. In fact, i was the one telling him to just go back in the US coz he supposed to stay with me for a week. But i think im just so lucky coz he still gave time to show how important i am to him and how he truly loves me coz of his situation. Plus his business no one would really take care about it, he supposed to go back here but coz of the economy now, he needs to work. I hope the consul would understand that during on my interview.

Im having my interview tomorrow February 11, 2009. I just have a few questions regarding my fiance's name, he uses different spelling like Stephen and Steven. On his brith certificate and passport, his name is Stephen but on other documents like his IRS or 1040, he uses Steven and also to some of the docs on our K1 application. Do you think it would create a problem? What shall i do?

I have talked to my friend also last night and told her about I and my fiance's meeting here in Philippines, We only met for 2 and half days, She said maybe the consul will question about it and have to be ready for it. It's just that no one would really take care of his business in the US and his mom was so sick at that time. We've known each other for two years, first we just got to know each other for one year and on March 6, 2008, that's the time that i decided to say yes. We do have enough proofs for our fiance interview application.

Plz guys i need your help and i hope you could share with me your ideas as soon as possible.

yes you can file for her..but you need to prove your domicile in the US you'll be questioned...and if she'll be out of US for more than a year by the time the application was approved ,she needs to apply for a re-entry permit...otherwise ,she can be out 6 months,then go back in the US again...

You're already in the US whay go back?It's safer here for you,if there is any problem in the USCIS at least you can ask help from an immigration atty.,but when you go back and if problems occur it'll be difficult to follow up or appeal at the US Embassy because the consuls have thier own "decision" that you can't appeal or if you do ,,,it'll take time..and much faster if you're here already in the US...we have the same case i guess ,i didn't go back to my country i just stayed and get married here, and w e filed for the change in status it's faster;that was the advice of the immigration atty.Good luck

Has anyone here that filed in January-February timeframe out of Vermont Service Center seen any changes to their case status? It would appear as though Vermont has come to a halt.

We have checked to see if we had any RFEs, and as it turns out, we do not have any coming to us, but all they would say about the case is that it is "up for review" and we would be receiving an answer shortly. I am to the point where I want to pull my darn hair out (if i had any).

We recently had our I-129F approve, as well as the I-130s. We have received the NOA2, and we know that the case is with the NVC. Trouble is, we do not know much else. I received a letter that was signed "Bureau of Consular Affairs" stating that the case was received by NVC and in a week it would be sent off to the Embassy in London. However, when i called NVC, the said that they still have it and we will eventually know when it has reached the UK, but will not specify how we will know, other than we my wife will eventually receive packet 3.

How did some of y'all find out where your cases were at this stage of the process? Will we receive any notices? We could use some help in understanding this stage of the process.

Unfortunately, AR sometimes happens. It will take as long as it takes. In the meantime you're in a black hole.

You might have a clue why. Perhaps its a sensitive occupation or a really common foreign name that got a hit.


don't have any clue. my wife and i have never been anything close to a criminal. our last name is extremely common. that is the only thing that i can think of. the problem is, it is not just her and i that this will effect. their are children involved, and the longer this goes on, the less time there is to make a stable life for them prior to the start of school. hope NVC doesn't take forever. What is scary is that i think that USCIS had to do the same thing, and it took forever to get processed. now NVC is at it. what happens when the Embassy comse into play? sorry, just venting at this point.

I went through the K1 route and i had previously been married and divorced - I was able to get a copy of my marriage certificate from the courts here in Leicester, UK where I was married to my first husband - I took that along with my divorce decree at the interview - and well they didnt even ask for it all they wanted was the decree absolute - which is what I also sent a copy of when starting the petition originally. ( I thought it was best to have it with me at the interview just incase they wanted to see the paper trial of name changes and from a post I read here sometime ago saying they wanted to see the marriage certificate too. - my solicitor took the original when we did the divorce)

Hoping for some advise. We are both previously divorced and got married last year. Looked at the check list from packet 3 and it seems that they possibly want my marriage certificate from my first marriage. I don't have it, solicitor took it when I got divorced. Called the State department and she said she didn't think I would need it, just the divorce decree.......not convinced. Thought maybe someone here would have gone through this and be able to give me first hand knowledge.

I guess it wouldn't be too hard to get hold of another copy, but don't want to if I don't have to. Not sure if my Husband would need his from his first marriage either......he also does not have it.

I will be so glad when this is over......but we are so close!!!

If anyone can help, I would be really grateful.

If the dimensions are correct, they will be accepted. These look square, so they are probably right. USCIS is not so picky but NVC and the Consulate will be. After you file the I-130, don't be tempted to file an I-129F. K3 is an obsolete visa category. Just follow the IR1/CR1 guide for the immigrant spouse visa.

hey doc glad that its working out on your papers.base on my case i got my pre interview notice from the embassy last Jan 17 then I got my interview date online Feb 6.Recieved my packet with the interview appoint from
DHL Feb 8.
I knew u might be very anxious by now but it will be arriving soon.Check the embassy site every now and then
to keep track of the schedule.
