In that case my Fiancee sho has been living in Russia for past 6 years as student has to obtain a certificate from Russia and from back home (Iran)?

i Receive a Call the Friday aternoone telling me to Come back on monday With My passeport in hand .

I believe the official US stand on that is it's visa fraud. At least that's what I was told that by an official at the USCIS when I asked that question. He doesn't go into girlfriend, fiance' talk, etc. Sometimes they have said, "you come here alot" and he says, "yeah, I like it here. I always have fun" or some small talk like that. They don't have to admit anybody, but I just wanted to give an example of many visits with no problem. I think part of the key is to look like a happy, casual tourist and not like the cat who ate the canary when he comes to visit you.

You should look at the top of the page where the blue tabs are and read the Guides, look at the flowchart for K1, and read the FAQ and get a good picture of how the K1 process goes if you're not sure. It might help you figure out what to do or help you understand things better if/when you select a lawyer.


Yah, I actually have friends of friends who've acquire a greencard for a British citizen b/c they had a spur of the moment wedding while he was over for 6 weeks. They paid a lot of money to a lawyer and it was settled right quick. That said, I think we want to do things the proper way. That joke is that if the US can't/won't grant us a K1 by May, I'll fly to Scotland and apply for citizenship there. tongue.gif

This forum is awesome. I posted this question in the K3 forum, but I thought I might post it here too.

While waiting for feedback, I called a lawyer who gives free consultations. He said once my fiancé is over here on the VWP, we can marry and then we can apply for a Adjustment of Status. The problem is, and I think this is where the scare tactic comes in, is that he said the visa waiver program is a luxury, and my fiancé can be turned away at any time if suspected that he's coming over so often due to a relationship.

Here's how often he's come over. Again, he's a British citizen - I'm not sure if that impacts anything.
He has an aunt, uncle, and 2 cousins (we met through one of the cousins)
2005 - stayed for 3 months.
2006 - arrived briefly I think (we hadn't met yet).
2007 August - arrived for 3 weeks as a groomsmen in a wedding - was held for 1 hour by customs interogating him as to why he was coming over.
we met during that trip.
2008 May - arrived for 2 weeks.
We plan to have him come over in mid-December 2008 and marry early January. The lawyer said that at any time the US can reject his visa waiver. I'm wondering if he holds to the fact that he has family and it's the holidays, it shouldn't be a problem?

I'm in the process of getting my I-129f package together. I know the Affidavit of Support is not required, but I'm getting things in order now.

My question is this:
I'm currently a student, going full time. I have a Pell Grant and state grants, and student loans. I do not work to support myself, as I live rent free with relatives. Both of my parents are willing to be co-sponsors - one makes a 6-figure income, and the other is an employee of the US Treasury, so I'm not worried about their potential to qualify.

Unfortunately, I didn't even bother to file a tax return this year because I had no income. Should I get a statement of my student financial support for the 2007 year to explain why I had no income? Since my income really isn't what is important here - I'm kinda lost as to what I should do.

So I finally got the NOA2 (yay!!), and I'm getting things together for the 2nd haul of this K1 process.
Regarding the I-134 form -
I'm a student, and I have been for the past 2.5 years. I graduate this May. Last year, I had 0.00 income, and used student loans + grants to fund education/living. My mother is co-signing and makes way over 5x the current poverty level.

I'm concerned about this from the guide tips for the I-134:
However, that IF the US fiance has been on welfare or other
government benefits for a lifetime or has no plans to work actively, the consulate can still deny the visa based on
the likelihood that the foreign fiance will become a public charge.


Are federal/state grants applicable here? I've had no income, but I will be graduating in May with a degree & minor in the sciences, which is a marketable degree. Should I be concerned?

First your petition will be going to NVC for a brief visit then forwarded to the Consulate/Embassy of the beneficiary's home country (presumably UK/London). *You'll get a notice from NVC then of course a notice from the Embassy/Consulate as well (once they receive the petition).

The number above the beneficiary's name is his/her A# (Alien Registration Number). Make a note of it/where-it-is, you'll need that later.

To be honest, I would put off the religious ceremony until after the legal marriage, or until after POE. IE - if you marry in the UK, and try to use that prior to entry into the US, USCIS could claim you should have filed a K3 instead.
But the only way it's a legal marriage that will be accepted for AOS is one you file for a marriage license, have signed by who ever legally marries you, and files with the gov.

This is not the right advice.

Anything you send now will never get to your petition so sending it is a waste of your time and energy. Can you imagine them digging through the thousands of petitions they get to find yours??? no0pb.gif

Not everyone has sent a cover letter or letters of intent and not everyone has received an RFE for doing so. Just prepare the documents just in case and sit back and hope for the best.

Anyway, i would want to take a step than not doing anything about it that you will regret at the end.

To hot guy, I don't agree that they will not process any letter send to them aside from RFE. Each petition has assigned case number which is easy to locate.

To Steven_brenda, it's up to you if you want to wait for RFE.
Me and my fiance sent the whole package with the letter of intent to marry and all those proof of relationship. A cover letter is not necessary though but the letter of intent to marry is necessary if you have not provided pictures that you were engaged or receipt of the engagement ring.
Note: These documents are not the reasons to deny your petition. You will just have to expect for an RFE and will extend your agony of waiting NOA2 approval.

We werent able to submit a letter of intent to marry when we applied our petition. im just kinda worried and confuse what should we do and afraid we might get another RFE again. I think letter of intent to marry is one of the requirements in filing the K1 visa? But i knew it after we filed our petition.

And one more question, since they also asked our G-325A, can i change my old address to where im presently living now? Or i still have to stick on the address that i wrote when we filed the petition? And just have to call the cutomer service about changing my address?

I need some insights from you about the rfe that we received yesterday. I checked our status online and it was updated last December 16, 2008. It says that they mailed a notice requesting for initial evidence in our case not additional evidence to prove our bonafide relationship. My fiancee would just like to send those documents that they have asked from us like his birth certificate, divorcee decree, our G-325 and passport size photo. But im thinking maybe it's better to send the whole I-129f package to them again even though they dont ask for the whole package.

Do you think we just have to follow what they said? Send only those documents that they needed?

You said it right!! Really depressing and even annoying!!!!! Grrrrrrrrrrrrrrrrr.... Before, the first processing dates on our timeline may be adjudicated on December 5 to December 15. But now it changes, getting further and went to January 7-December 31, 2009....

I really hate of waiting for another two months again.....

Let's pray together guys that we will get our approval this month.

All i wished for this chirstmas is our NOA2...

We also sent our RFE last december 23, 2008 but until now we're still waiting for our NOA2. Do you always check your petition online USCIS site? I do check ours everyday and since they received our RFE reply December 30, 2008, we've got six touches from the time they received our RFE dec 30, 31, Jan 1, Jan 2, Jan 5 and Jan 6.

How about you?

Le'ts keep our faith that they will approve our petition and hopefully soooonnnnnnnn...

My fiance texted me earlier that he got our NOA2 hardcopy already.... God is soooo great!!!! He always answers our prayers!!!!! I just checked our K1 application status thru USCIS site and YES we got approved!!! And we got an email too from them....

Receipt Number: EACXXXXXXXXXX

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: Approval notice sent.

On January 14, 2009, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

WE got an RFE too last December 15, 2008. And we sent it back last December 23, 2008. USCIS received our RFE reply last December 30, 2008. Then after several touches, December 30, 31 January 1,2,5 and 6, we havent heard anything yet from them. Still the last updated date is January 6, 2009. No changes yet. I hope we will get our NOA2 soon.

Im just worried of you gurl. Why dont you just wait for the petition that your first bf have filed? Coz i think like the others have said, coz filing two petitions with different man wont be granted and it's a fraud. That can even lead you into trouble.

What's really the reason why you want to agree with your second bf to file for a petition? Do you really love your first bf or not anymore? I mean im concerned with your situation, because if you would really analyze what you have wrote, it's like you are just after of going to the US not because you love your bf? Plz forgive me but you have to elaborate more your side and explain it more.

What's really your reason why you want to have two petitions? One more thing, just an advice, it's better to tell them the truth even if you will hurt one of them still you are being honest to them and to yourself too.

You didn't give full details of your problem,anyway if they said it needs administrative review,it's always good to call the embassy if you already have the interview,because thier customer service is the one who cna answer your questions well,they can tell you what documents they might want from you or why is it taking so long..

Read the website;details of what you need for a K1 visa all stated there in details...it's also important to gather evidences while you're waiting for the result of your annulment.Like,pictures of you and your petitioner;if you have a child, then picutres of the 3 of you if possible;get your birth certificate from the NSO;print your emails to each other,remitances if he sends money;tell him to get a copy of his income tax return for the last 3 years . I have an immigration atty here in the US,just because my husband wants us to have one..but if you will just read visa journey,it's all here..i mean the procedure and time line and experiences they had during interviews;how they were able to solve problems.Personally,i would say you don't need an attorney.Waste of money...
