As long as the child is listed on the forms she can "Follow to join" at any time within 1 year of her mother's Visa approval. After that you would need to sponsor her as your step-daughter (CR-2 Visa).

Either way the child will require the father's consent and a South Korean passport.


Thanks for your response, it is perfectly understood we need consent and a passport. The question is: does the window to gain a K2 stay open (within the year) and granted once consent and passport are in hand?

Looking for any insight on how to approach adding child for K2 visa during the K1 process when there is not current consent from previous spouse who has custody. Child would follow K1 applicant once consent is granted. Child currently does not have a passport as father has sole rights of required documentation.

My fiancés interview will be scheduled shortly in Korea and currently completing D230 and on-line appointment. Looking for any experience regarding adding a child for K4 eligibility where consent has not yet been granted by the custodian, and the child currently has no passport. The child has been indicated on all documents properly with the appropriate information supplied i.e., under father’s family name, address etc. The on-line application stipulates the passport number is requirement.

Unfortunately in South Korea children of a divorced couple almost always without exception awarded to the male spouse and his family. Family names stay with the family born into and does not change with marriage. My fiancés daughter has lived with his parents for the last 7 years. My fiancé sees her most weekends at her mothers. Our intention is to hopefully gain consent and have her follow my fiancé in the summer after the school year. It is not our intention to have her leave Korea without receiving consent. Since this is delicate matter, and the father has clear rights, my fiancés family will work with him and his family in attempt to gain his consent. If at this time we confront him head on, he will merely shut the door and hold her hostage (so to speak) to get back at my fiancé.

No grantees here, but need to know if she can be included as a K2 and processed at a later date under this circumstance. I do recognize the K2 is good for one year, and if the immigration is not done in one year she will need to go through the entire process.

so i sign into my yahoo,all fine and dandy,then i get the message that i have a new email,from USCIS about case status,which is odd,since my SO already received our noa 2 and even our ankara case number.i even email ankara embassy asking them when they are ready for me to send in packet 3,so the ankara case number status is legit.we were approved November 17th

As others have stated, really depends on the embassy. Good suggestion is to look at the link for your particular embassy. Took the Korean embassy about 10 days to issue PK3.5 and 30 days for the interview. It was somewhat challenging in making the appointment as the embassy did not receive the online request we completed. They responded to emails within one week, but their fax machine appeared to be turned off and it was nearly impossible to reach via phone. However, once I finally made phone contact they were super speedy!

The Consular services folks "kept" not "took" your originals because you gave them to them without asking for them back and providing copies. CBP officers never give you anything back from the sealed envelope. That's your actual case file. You simply failed to learn the process and properly prepare. No worries. The medical is in your file and a photocopy of a certified copy of your birth certificate is all you need for AOS. Check with the marriage license office in Michigan for their specific documentary requirements. I suspect all you'll need is your passport.


Thanks for your reply; the issue is more related to handing over more than what is required initially to the embassy as you indicated they keep everything. Not being able to be with my fiancée at the interview, she gave them what was needed plus more. Fortunately I have copies of everything except the medical. The issue with the birth certificate is one of preparation. Luckily I have the first original and notarized translation that expired, by one month (over a year) at the time of the interview. I will be able to use it for the marriage license, which is required in the state of MI. The embassy did give back a copy (not certified) of her BC along with the original for her daughter who is arriving at a later date for which I was initially most concerned about.

I think the point is that one should be sure to get an additional original BC with notarized translation while in their home country. Know where have I read this suggestion, which I believe to be a helpful one.

It is great that we are now together in the US! Now it looks like we will need to get another original birth certificate and translation as the Embassy took the original. This will be the third time as the first documents exceeded a year due to the wait! Additionally, no copy of the medical! What documents the Embassy didn’t take customs did! Did not know this until yesterday -- went back to the airport to retrieve, but customs said they sent them to USCIS. Have copies of everything else since the start with the exception of these two documents.

Questions:

Know we need an original Birth Certificate and translation for the Michigan Marriage certificate; do we need an original for the AOS?

Do we need the medical report for AOS or is understood it would have been given to the Embassy, the hospital has refused to give us copies?

(her first answer was: how soon after we get off the plane????) I have no idea what her response will be during hte interview... she has some really interesting answers. She is very, very playful.....

I just imagine the interviewer at the embassy or the Customs official.... She might actually ask the Customs official, "can't you marry us?.... No, well hurry.... I want to get to the little white chapel...." (and she is wearing a leopard print dress with a red ribbon sash while saying this.)

Just as a matter of reference to get a divorce in the US in 30 days may be considered magic. Obviously this all depends on what state and county you reside, if it is contested by your current spouse, if there are children involved, the amount of assets and division, etc. Judges in many areas will not even put the prelim on the docket until 30 days after a petition has been filed. Below are 2 State examples.

Michigan: “If there are no children involved, a divorce may be granted in 60 days. When children are involved, a divorce cannot be granted until six months have passed. It should be stressed that these are minimum statutory times. More often than not, doubling that time would be more appropriate, based on the level of contention, the court docket, and many other factors”.

California: "While California has a six-month waiting period for divorces, your case will not necessarily be resolved within six months. The California divorce timeline for simple cases can often be finished in less than six months and complicated cases could take several years to complete. The point of the six-month waiting period is that it’s the earliest point at which the court can restore your status as a single person. You cannot remarry or file taxes separately until the court has granted your request to have your status restored as a single person. Nothing automatically happens in six months".

Hey all, as mentioned on VJ in various different posts the NVC is a mess as far as timing.  We got the NAO2 for my stepdaughter last month and it took about 3 weeks to start the on-line process (we called and got the case number and invoice number) with the  AOS and then another 3 weeks to get to the benificiery app. That's with us paying and doing the apps as fast as possible.  So now from last Friday when I mailed in the supporting docs I expect another 60 days (because that's what they are saying, and most at this stage on VJ are confirming) that we will have an embassy appointment set that will take another 30 days.  So by the way of my calculations show it, it is running about 4.5 months from getting the NA02 to getting a green card.  And that is if you do everything you have to promptly and don't end up with a checklist that could extend by another 2 months or more. Really!

Coming from Ireland?!  You'll have your visa within a month, once the embassy has it, IF you have your ducks in a row and have all your required documents together.  Dublin is very fast and efficient.  I would:  Book a medical for about 4 weeks away, get any and all Police certificates you need from every country you've lived for more than six months since age 16, make sure you have an original birth certificate from the govt (They took my husband's at his interview), and get your papers from your American fiance.   My husband got his packet 3 about a week after the embassy had it.  Once he turned it in, he received a letter (packet 4) giving him an interview date.  This date was less than a week away from receiving the letter!  Read up on the embassy info page here on VJ and also the interview reviews.  They were invaluable to us, and once we went through the process, we updated the info. 

 

One final note: it'll say you need to mail in a copy of your whole DS160.  You don't.  Just the first page.  Good luck!  :D

 

I'm thinking this may not be possible as there is an apparent NVC backup that based on the experience of others and what the NVC is saying (60 days to review any last doc sent) it can currently take up to 5 months from USCIS approval to embassy interview. Of course thinking the OP has some true magic in getting the USCIS approval in the blink of an eye!  Miracles can happen!  Congrats
