K-1 Fiance(e) Visa Process & ProceduresI-129F Q18
We gave them an outline of our entire story along with a couple of emails/skype logs from the period to set the scene so to speak. Our main proof was passport stamps, photo's, my bank statements showing withdrawals in the US and a travel itinerary. In the answer to Q18 we referred to the evidence provided.

I visited while my K1 was in process. I think there is only a problem when the K1 is in the passport and you have to be careful that is is not activated before you are ready.

K-1 Fiance(e) Visa Process & Procedurespossible RFE?
I have seen some posts where some people have received an RFE and others have not. It seems to depend on the mood of the officer processing your case. In your situation I would have a couple of copies of photo's of the correct size ready so that if you do get an RFE you can turn it around as soon as possible.

Photos are secondary evidence and are not necessary, but can help.

What you do need to send is evidence that the two of you have met, like receipts, board passes and passport stamps.

Alright thanks. Yeah I sent my hotel receipts, travel itinerary, passport stamps, boarding passes, even the passenger service charge receipt.

I only sent 5 photo's and was approved.

i am filing the I-129f petiton and sending in proof of relationship with emails, letters, pictures, receipts while in Colombia. Where in the application should i put all these things and should i put them in a plastic bag?

Make sure you send proof of meeting such as copies of stamps in the passport, boarding passes, travel itineraries. Secondary proof would be such things as photo's, atm receipts, credit card receipts (number crossed out), hotel bookings and such. The relationship information helps to paint a picture but it is not asked for when you first file the petition but is more needed at the interview stage.

I put my application into a folder in plastic pockets and enclosed a summary sheet at the front so that the adjudicator knew what was in the package.

K-1 Fiance(e) Visa Process & ProceduresWhy such different times?
QUOTE (WilliamB @ Sep 20 2007, 05:12 PM) <{POST_SNAPBACK}>
I was looking at the timelines and it shows that someone who applied for their K-1 in July has already received it. Did they fill out the timeline wrong, or is this real? I applied in May at the same (Vermont) service center, and still haven't received mine. I know I need to be patient, but its just strange that someone would get theirs in 65 days. Especially from Iraq (no offense), since it would seem they would need more background checks.

Any thoughts or reasons?

I know that one of those approvals actually submitted in April or May but never received their NOA1. They re-requested it and got the hard copy in July and used July as their NOA1 date. This made the approval time a bit misleading.

hi everyone,
freaking out again, been 3 months and a half and no noa2 and i am starting to freak out about interview.. my fiance is 20 years older ( i am the beneficiaryand i am 21) but he doesn't look like he is 6-7 years older than me. everyone says so, and our relationship is very very real and we have plane tickets and boarding passes, receipts and tones of fotos to back us up, we've been together 2 years now.. could that age difference be a problem , does anyone have an opinion? thanks!

You only submitted on 2007-06-01 and there are still a lot of May filers who haven't been approved yet. The VisaJourney estimate was pretty accurate for me so I wouldn't worry until after that date has passed. The first stage they are checking that you have met in person in the last 2 years. I submitted travel itineraries, passport stamps, photo's and that was enough to get my petition through. The proof of relationship is more important at the embassy interview so logs of phone calls, emails, birthday cards with postmarks and such would be useful there. Start collecting as much proof of contact as possible. You might find posting in your regional forum might get you some information about what to expect from the US Embassy in Romania.

I am sorry if this questions has already been asked, I couldn't find any posts on this topic.

Here is the story:

We have been waiting for our NOA2 for 3 months so far and our case hasn't been touched even once.

we called the USCIS about 2 weeks ago and they said not to worry but I would like to ask if there is anybody in the same situation as we are. I don't really know how normal it is and if we should keep on calling them to keep on asking the same question.

Any help will be greatly appreciated. smile.gif

This is normal. We filed at the end of April and didn't receive any touches until we got approved at the end of August.

K-1 Fiance(e) Visa Process & Proceduresproof of ongoing relationship
For the initial submission of the I129F you need proof of having met in person within the last 2 years and the important information for that would be passport stamps and boarding passes backed up with other proofs such as photo's, travel itinerary, atm receipts, hotel receipts etc. I only included a small amount of relationship proof (skype logs and a couple of emails) as a scene setter.

I sent copies of passport pages with entry stamps, copy of travel itinerary, copies of bank statements showing atm withdrawals (account number blacked out), photographs and I also sent in a couple of emails and skype logs to show relationship background although that is not required.

Even if they can easily remove the sheets out of the plastic inserts? The pages (forms, documents, etc.) are not 3 hole punched. They are inside transparent proctetors that are punched.

I enclosed ours in a binder in plastic pockets. It made it easy for me to group items together for me and it seemed as thought it would be easy for the adjudicator just to pull them out of the plastic pockets. It didn't seem to cause and problems with out petition.

I live in England and have just got engaged and my fiance wants to file the forms. I just wondered how long it will take for the whole process to be over. Also are there any other forms apart from the I-129F and the G-325a forms that need to be signed. Also is it an easy process or can there be any problems with it.

It is mostly pretty easy but slow. It is taking around 7-8 months from filing for the UK petitioners at the moment but hold-ups can occur at any time through the process that may make the wait longer. Read the guides as they are pretty helpful in listing exactly what you need to include for your petition and even provide sample forms filled out. You should also read the 'RFE - referral for evidence' thread which is stickied at the top of one of the K1 forums to find out what other people have had problems with.

She is going to get more passport style photo as well. Thanks for the help.

I believe the police report is good for only 6 months, so it will depend when your fiance has the interview.

The police report is good for 12 months in the UK but I am not sure about Peru. It might be worth asking that question in your regional forums.

QUOTE (Flo&Chris @ Oct 6 2007, 05:43 PM) <{POST_SNAPBACK}>
HI just wondering how long we could be waiting for NOA1 notification. We have a lawyer in AZ taking care of our K-1 process due to me being denied a student visa and a tourist visa previous to our K-1 application...I have never overstayed any previous visa or done anything wrong but they decided to deny me student and then tourist visa.

Does anyone know how I would go about trying to visit my fiance in America even though I have 2 denial stamps on my passport? I am Irish. Surely it is ridiculous that I cannot visit my fiance in america? As a result of me not being able to travel to see him he cannot keep a regular full time job because he has to come here to see me.

HELP US!!!

If you fill in a timeline then visajourney will give you an estimated date for the NOA2 which is pretty accurate.

QUOTE (ddkm @ Sep 19 2007, 06:07 PM) <{POST_SNAPBACK}>
We plan on having the visa January time...6-7 months, not too unrealistic i dont think even with all the backlogs. To reduce the added stress of having a wedding date riding on the progress of a visa processing we are going to have a small civil ceremony right away to do it legally then next summer we will have the proper wedding which has all been booked and sorted (just about!) I figure even if the visa is delayed rediculously then we will still defo have it by june 2008 as that will be 11months. right now all i care about is getting my noa2 though, not really thinking about much else in all honesty

I would add at least a couple of months onto your estimate if you must plan a wedding to avoid some stress for you. There are no guarantees about the visa process and you can hit obstacles at almost any stage. We filed at the end of April and if I manage to get to the US in December I will be please. At this point I have only received the NOA2 and have no idea at what point I will receive package 3 but looking at other people's timelines I am expecting it around the second week of October. The embassy could take another 2 months to arrange an interview. Problems can occur at USCIS, NVC and the Embassy so if you must plan a date then build some slack into your timings.

OK, I've seen on here that people will print out pages and pages of online chat history. How much is really needed? For his interview, I sent my fiance several pages of it (some from a year ago, some more up-to-date) but it's certainly not the entire log! That would be a huge book!!

I've also sent a few sweet e-mails we've sent, some pages from my phone bill (again some from a year ago, some from now), plane tickets, boarding passes, about 30-40 photos, my letter of intent, and a couple other misc. items. But now I'm wondering if that's enough...

Also, off the subject, but when can he get his police certificate? He hasn't received his packet 3 yet, but it's on the way.

The police certificate is valid for 1 year from issue and takes around 40 days to get. I would suggest he go down to his local police station and order one ASAP as the mail strike might delay his receiving it. I am planning to use similar relationship proof as you except a few less pictures. We didn't get that many pictures as most of the time it was just the 2 of us and so we didn't take that many.

Does it cost anything?

The visa waiver program is used for visits and not for residency. If your stays add up to more than 6 months in a year then you are residing more in the US than in your own country which would probably cause problems. The final say is the the immigration officer at the border. Whenever you visit the US you run the risk of being turned away.

Thanks for reading. For my fiance, entering as a tourist is not a problem. However the greencard process will heavily interfere with our plans after marriage. Can we forego that process until we are ready to settle permanently in the US? Can she, after our honeymoon, reenter the U.S., as a tourist with no problems? It seems logical but does the goverment work logically? Thanks a bunch. It is much appreciated!!! cool.gif

If she leaves the country after marriage before getting Advance Parole they will not let her back in the country and she will have to apply for a K3 or CR1 visa which will take another 8 to 12 months.
