I thought you were talking about the divorce laws in his country. If they stated that he couldn't marry for 6 months then you wouldn't be able to file the I-129F, but if it's just a Wisconcon thing then you don't have a problem.

If you could get married somewhere other than Wisconson (say Vegas for instance) then you can file immediately. You don't have to stipulate to USCIS where in the USA you will eventually marry so I can't see how it will matter. Just make sure that you marry within 90 days of his arrival, whether that's in Wisconson or elsewhere.

Your boyfriend is right I'm afraid. In order to file the I-129F you both have to be legally free to marry and he won't be until his divorce is finalised.

You don't need a CRB check for US immigration. Just get a Subject Access form from your local police station and follow the instructions.

If you fill in your timeline it will give you a reasonable estimate of how long things take. Since your fiance is from London the form for requesting a police certificate is here http://www.met.polic...forms/3019b.pdf . He needs to check the box 'If you require information held on the Police National Computer about Prosecutions, Convictions and Cautions History, tick here' . The certificate takes around 40 days to get and will be valid for one year. I ordered mine about 2 months after we filed the I129F petition so that I had it in plenty of time.

I have heard of people getting turned away at customs. It seems to depend on who you see at the point of entry. When I entered Detroit in May they asked me a lot of questions but I was allowed entry. I am hoping that I will be as lucky at the end of August as I have another visit arranged. I will be bringing proof of ties to the UK such as pay slips, tenancy agreement, utility bills, return flight tickets and the car park ticket/booking for the airport. I've never been asked for such proof but it is better to be safe.

The K1 visa comes with a temporary work permit built in but most employers don't seem to recognise it and require a work stamp. The only point of entry that will give you a work stamp if you ask is JFK. The work permit that is built in only lasts for the K1 which is 3 months. After you get married and you apply for Adjustment of status, Advance Parole (so that your fiance can get back into the US should he need to leave for any reason) and EAD (work permit). This can take 3 months or more to get.

I'm going to continue this discussion here not to argue with you but purely to help you and some of the newer members understand this process.

Yes it's gruelingly slow, especially compared to most other business processes in the modern world. But believe it or not, it is much much faster than it used to be. It's much faster, even, than when I joined this site. I am not certain how old the timeline data is in the VJ database, but if it does go back a few years, check out overall processing time for nearly any type of petition and you will see the facts bear me out.

Prior to the K1 petition being developed, there was no way to bring a fiance here. The CR1 or IR1 were the only avenues (may have had another name then) and INS answered the call to speed up family unification by creating the K1 as a way to speed the process. Since that time, CR1 and IR1 moves along more quickly than it used to.

Also, the largest part of the 'speed' problem is a lack of modern technology and adequate personnel. You cry that it shouldn't be this way, but dollars pay for these things. DOS is completely funded by petition fees. No tax dollars flow into the system - the national debt doesn't prop it up. Because of lack of funds, much of the system remains paper based. Research about record retention of immigration documents and you will be deeply dismayed. A big fire in one facility could wipe out decades of documents with no way at all of retrieving that data.

I mention the security checks for a reason. The workload of the agency was multiplied vastly by the mandates after 9/11. Prior to that, the background of individuals seeking visas or applying to adjust status were randomly spot-checked. Now EVERY petitioner is checked. You are probably early in your petition stage to be crying foul about your particular case. Try being one of the 400,000 plus applicants for naturalization who are caught in a namecheck crunch with USCIS purely because USCIS has not had the funds to pay the FBI enough to put more agents onto background work.

As I said, I agree with you in principle. It takes time to gain a thorough knowledge of this system. When you understand a bit more fully how it operates, you will see how they are operating (in most cases) the best they can under the circumstances.


Hopefully the recent fee increases will help to alleviate the problem over time.

That can depend on which centre you are filing at but at CSC they receive your petition, cash your cheque, issue you a notice and then put it on the shelf for about 3-4 months. When it reaches the front of the queue then it is assigned to a service agent who will look at it any either approve it, issue an RFE or deny it. It is worth checking out the posts of Huskerkiev to find out what actually happens at the centre. He used to work there and answered quite a few questions a few months ago.

We included a copy of my (beneficiary) birth certificate with our I129f. It isn't stated as required but I have heard of some people getting RFE's for one. I think it depends on the person who is adjudicating your case. A printed copy of a scanned image should be fine.

What is the embassy definition of "strongest ties"? From what I have found, it means she has to show intent that she will indeed come back to Thailand, but for a K1 visa if theyre trying to become a US citizen then why does she need to show this? The K1 visa is generally applied for by the US Citizen in the US for a fiance who lives abroad. When the visa is approved (approx 6 to 8 months (this could be longer depending on the time the local embassy takes to set an interview date for the fiance (eg. UK is around 2 months but the dominican republic is closer to 2 years) the fiance has to use it within 6 months to enter the US. Once in the US you have 90 days in which to get married.

A fiance will need to show strong ties if they are visiting the US during the visa application period but not after they have the visa. Entry to the US is not guaranteed before the K1 approval since the officer at the point of entry has to be sure that the fiance will return home after their visit and not marry and try to adjust status.

I don't want to bum you out but I mailed my packet in April. It was received May 1st and although online it reflects 5/1 I didn't receive a paper NOA1 in the mail until 2 weeks ago. 101 days and no NOA2 now.
I mailed to TSC and it was forwarded to CSC. I'm curious where I am in line. Everything on this site makes me think I should be getting something any day now but the USCIS website says CSC is processing applications received Jan. 13th!

Anyone on here received an NOA2 from CSC who applied April/May timeframe?

I know it feels futile but I would urge everyone here to write letters to congressmen, etc - weekly. This whole process is ridiculous in the way no real information is provided. There's got to be a way to let those in charge feel some frustration too.

I don't think you can retrieve it or correct the error until they send you a request to do so. I called USCIS. She told me the " Received Date" is the date that I need to know. Because the notice date is only when the I-797 (NOA1) was sent. And I have Received 4 of those.
My sent date is May 21, 2007
Received Date is May 25, 2007
NOA1 dates 7-9-07, 7-9-07, 7-25-07, 7-26-07 (late because of computer problem in May.)


I hope you are right because my package was received by NSC on April 25th but because of the transfer to CSC the notice date wasn't until 21st May. It would be nice to think that they processed packages in the order of receipt and that I hadn't lost a month because of internal transfer procedures.

It's good to have your number for reference purposes but you are unlikely to see any movement for a couple of months. If you timeline.gif then Visa Journey will give you a fairly accurate estimate of when you are likely to receive your NOA2.

You may not get turned away at the border. You could try going with your company to Florida, spend time with your fiance, leave when your work is finished and then enter on the K1 when it is approved. You would have to return to Canada for your interview though. It is only illegal and risking a ban when you try to defraud the system. The K1 is generally a bit quicker than a K3 (marriage visa) and since you have already filed it is probably better to stick with that.

You need to have met in person within the last 2 years before you file. You will need to produce proof of this such as boarding passes, passport stamps, photographs together (with family if possible). Read the guides for more details.

Well I arrived at the airport yesterday and because my seat was toward the back of the line I was near the back of the line at the immigration booth. When I got to the immigration officer he was interested in getting people through as quickly as possible so he just asked whether it was business or not and who I was visiting (I said a friend) and didn't ask anything else. kicking.gif kicking.gif kicking.gif So I am here for 2 weeks with my fiance smile.gif The icing on the cake would be an NOA2 so we could go out and celebrate. I didn't mention the K1 visa at all. I told them I was staying with a friend, which is he smile.gif. They asked me about my previous trips, whether he had made a trip to see me, which he had, and about my job. If they had asked me about whether we were engaged I would have given them an honest answer but it didn't come up. They also asked 'You are not going to get married while you visiting are you?'. This has been asked a couple of times so it might be a standard sort of question. They didn't ask for any evidence that time but I will be prepared with it this Friday just in case. I have visited again 6 months later for 2 weeks and was asked a lot of questions at the Point of Entry but was allowed to visit. We never did receive an NOA1. I don't think it matters so long as you have your case number. The important one is the NOA2 because that will be needed to Adjust status after you marry.

The worst thing that could happen is that they refuse you entry and make you go back home. If you can afford to do that then visit. It is unlikely that you will be refused entry. I have visited a couple of times and have not had a problem yet although they asked me a lot more questions when I went in May. I have another visit planned for the end of this month and I am keeping my fingers crossed that I won't have problems.

The first time they asked a lot of questions (I had an earlier visit 6 months before for 2 months) and the second time they asked me hardly any questions at all (I think they wanted to get the people through so they could close the immigration booth). Our main proof was passport stamps, photo's, my bank statements showing withdrawals in the US and a travel itinerary. In the answer to Q18 we referred to the evidence provided.
