Very true but in this case it is a bit too late.........

I sent in a covering letter and they scheduled my interview very quickly for which I am grateful and I have heard of London doing the same for others. It certainly doesn't hurt to try since not setting dates is no longer an option in this instance.

During the last year from now I visited 3 times for 9 weeks, 2 weeks and 2 weeks. I was asked a few more questions on my second visit but I made sure I had ties to my home country such as a Tenancy agreement and I had a return flight in all cases. It is up to the Immigration official whether they will let you in or not.

The Visa Waiver program is for visits and using it for too many long visits would be frowned upon. You are expected to spend more time in your home country than in the US (eg. more than 6 months out of every 12) . When visiting it is best to have a return ticket and bring proof of ties to your home country (eg. tenancy/mortgate agreement, employers letter etc.). Even with this it is still possible to be turned away by immigration if they have any doubts about the purpose of the visit.

Make sure you get proofs of having met during your visit. It would be good to take lots of photo's with both of you and maybe friends and family also. It would have be good if you could meet his parents too and keep any bording cards, atm receipts etc. as proof also.

Were you planning to stay with your boyfriend? You need to give them the address of the place you are staying for the first night. If that place were a hotel and you said you were holidaying with a friend then it is very unlikely that they would question this given that you have not spent a lot of time in the US.

How long the process will take depends on how complex the case is and how long the local consulate takes to schedule interviews but typically it is taking around 8-9 months to process a K1 visa at the moment.

This is what I was told by the excess baggage company I am hiring to ship my stuff for me. They need to have a copy of a work authorised visa and your photo passport page in order to ship your belongings to the USA. According to the Social Security document that someone else posted on this site a K1 is work authorised.

Thanks very much smile.gif I didn't provide any proof of a wedding date but there is a field on the form for you to enter one. In my case my tenancy for my flat was expiring at the end of this month and I needed to be able to ship my belongings before then so I sent them a copy of the tenancy agreement with a cover letter explaining my circumstances.

Your NOA2 must be due very soon now and London can move pretty quickly if you provide them with a specific wedding date to meet. I personally found that the last few months after the NOA2 and before the interview were the hardest. Although they were the shortest period it seemed to drag for me especially when work required me to work 2 months notice. I had to hand in my notice before the interview in order to be able to leave when I wanted to.

Some people come from countries where it is not easy to get a visa. There is also the financial hardship and the risk of not being admitted to the US. If he tried to enter and was turned back then what would his circumstances be? Would he find it easy to get affordable accommodation back in the UK again if he had sold his property? A lot of people rely on work for their income and are not retired and so would have a problem in that circumstance.

If he has sold his house what address has he used for the Consulate to contact him with Packet 3 and would he be maintaining that address should he come to stay with you. In the unlikely event he encountered a problem with name checks and got put into administrative processing would he manage to find somewhere to wait it out in the UK?

It's unlikely that you will have problems but it is best to be prepared for the worst.

The use of an immigration attorney does not guarantee no problems. There have been a few members of this forum who have had problems with their cases due to attorney error and in one case they were denied. If your case is straight forward then the guides here are very good and there is no one who is more committed than yourself to make sure that your case is correct.

You should be ok with a joint sponsor. The UK is a low fraud consulate. Make sure you read the guides and it is also worth reading the RFE thread since it covers all those items that people have been asked to provide as part of their petition (such as beneficiary birth certificate) which are not mentioned in the guides. It is taking around 8-9 months or so from filing to visa for most UK cases at the moment. When you file your petition then set up a timeline and Visa Journey will estimate an NOA2 date for you.

The fiance visa takes a long time to process. At London the embassy is pretty quick (around 2 months) and the whole thing took around 8-9 months. I don't know where your parents live but I believe the Montreal embassy takes closer to 5 or 6 months which would make the process longer than 8 months. I am not sure what the situation is for Canadians and the US but I believe that the US frowns upon visitors staying longer than 6 months out of a year and you may be stopped at the border and asked for proof of ties to Canada and if you have none then you might be turned back.

If you do decide to visit and stay for the maximum allowed time then make sure that you do not overstay because that can result in a ban that you would have to file a waiver to overcome.

You are right it is a very slow process and it is very wearing on your relationship. If you fill in your timeline the Visajourney can estimate an NOA2 date for you. I found it helpful to have some idea of when I might expect something from USCIS.

At my interview in London I initially gave them the Affidavit of Support, Pay Stubs, Letter from his employer, proof of my assets/bank statements ($162600) but they still required a tax return also. As the guide says they require a minimum of 2 of the options. It is generally best to have as much information as possible as if they need to ask for anything else it will delay your case. Tax transcripts can be requested by the USC online. He should google them and put in a request quickly.

Not necessarily. A lot of IT contractors form limited companies and then pay themselves a salary. It's not illegal although some changes were recently made to the UK tax laws to make it less lucrative than it used to be. I am assuming that the US laws are similar for companies.
