Thank you all so much. It is a relief to know that a co-sponsor should be enough, and that my fiance not having a bank account etc shouldn't cause that much of a problem. We will make sure he files taxes from now on, so it will be sorted in the future.
I wasn't aware that the London consulate would allow the petitioner to sponsor themselves. I don't own a house or have any other assets yet, but so have some money in the bank, so perhaps it will help to take those details along to the interview...when it finally happens...

Do you have assets yourself? London is one of the few consulates that allows the beneficiary to self-sponsor which is another option open to you. But if you're happy with your co-sponsor then there's no reason why you won't be fine.

A straightforward K1 takes around 6-8 months to get and everyone has to go through that wait. You made a decision in the past to break US immigration law so your process will take much longer. I'm afraid you're going to have to take responsibility for that and accept that it's your own fault your process will be much longer than others.

Hi there.

1) At this stage you only need to prove that you've met in person within the last 2 years so things like passport stamps, boarding cards, photos of you together etc. are good. You can leave out the phone bills and birthday cards because you don't need proof of an on-going relationship - save that for the interview.

2) Just put what you can remember.

3) Take anything you have that proves you have ties to the UK. A letter from your employer stating what date you are due back at work is good.

After you marry your fiance must apply for Adjustment of Status, Advanced Parole and a work permit. Your fiance must not leave the country until Advanced Parole is granted. If he does he will not be allowed back into the USA and you will then have to apply for a marriage visa (either K3 or CR1) which will take as long, if not longer, than your fiance visa.

They don't take the passport at the medical. They just wanted to look at it as a form of proof of ID.

If you enter through JFK airport then you can request a work stamp which will allow you to work for the 90 days but I think that is the only airport that does this.
I have seen it advised that you wait 2 weeks before applying for the SSN as it takes that long for you to get into the system.

Firstly after waiting in line for an hour, they let us into the building on a first come first serve basis i think. They called my number and took me up to booth 1. About 15 minutes later i was called up to a separate interview window, again in a line of booths. I was asked how i met my fiance. I answered this and was immediately told i had been approved and to arrange for it to be couriered, as long as my medical (later on in the day) was all ok. It took roughly 5 minutes, and i was never asked for any evidence of our relationship.

A job well done, now i am travelling on my visa on 10th december on a 1 way flight! Finally the hard part is over.

The letter form the departme of public safety clearly notes that the records of that deparment don't relfect if you have been arrested by any state, local or federal law enforcement agencies. Further that inquiry was based upon name check only and is not supported by a fingerprint comparison

Did you also send a letter explaining that a mistake was made on the first submission and that the new submission was made on the advice of a lawyer. Perhaps it might be worth adding such a statement/explanation and getting that notarised as well as resubmitting the proofs of a clean record.

At my interview they asked how and when we met and when I had visited my fiance in the US. They also asked when I was planning to travel. In respect of finances I was asked for his tax return, Affidavit of support and I also provided proof of my assets (savings account). It was pretty quick but proving you will not be a burden on the state is important so have all your financial proof (co-sponsor forms and tax returns) in place.

It just takes a month or so to cash the check lately because there is a bit of a backlog. When they do cash the cheque it just means that you are good to wait for around 4 months or so until a case worker takes it off the shelf to work on it.

If your case is straight forward then the guides here are all you need. A number of people that have used lawyer's have had problems. If you read the guides, read up about what type of things people have had RFE's (Request for evidence) about you should be fine. Lawyers tend to slow things down and they are not as motivated as you are to get things right.

Good luck with your application. You might want to set up a timeline as it will give you an estimated date for your NOA2 and will help make those estimates more accurate.

Another thing to be aware of is that after you marry she cannot leave the US and re-enter until she has Advanced Parole. This can take around 3 months after you apply to adjust status. If she leaves before she gets Advanced Parole then you will need to apply for a K3/CR1 visa before she can come back to you which can take another year.

The reason so many people recommend a personal cheque is because you can get your USCIS case number from the back of the image of the cashed cheque. This is not always possible with a money order and USCIS are not always very prompt in providing you a case number to check your progress with.

I would just use the Visa Waiver program but bring proof of ties with you such as letter from employer, tenancy agreement, mortgage documents and such. It has taken us around 7 months from filing to approval but we had a smooth process without any RFE's and we applied before the July rush of petitions.
