I am just starting out applying for a visa to join my fiance and get married in Boston USA, I am from UK.

My fiance has just started filling out the Affidavit I-134 form and my initial question is How does his finances effect this application? He has a steady well-paid job in th USA that he has been working in for 4 years with all benefits like health insurance included. Like so many of us his balance is minimum at this time of year...how will this effect us? Do they just want to see he has a steady income and long standing job or are they looking for the amount of savings?
Also, do they look into my finances?

I love him and we just want to be together! crying.gif Are there any other visa options for me?

I am sure i will have many more questions as already i am finding all this very confusing.
Any help or advise would be appreciated.

Hi Liam, i just wanted to say the same thing happened to me. Which airport did you fly to just out of curiosity? although im sure they are all as bad as each other.
I was just as naive as you, even more so since it is actually my husband who is a USC so as soon as they heard that they might aswell of not listened to anything else i had to say as they didnt believe me.
When i think about it now im like 'how could i have been so stupid to say that'....but i didnt realise i was doing anything wrong to be quite honest - didnt do enough research. BUT now when i think about it i kind of see the goodness in it that i was (mostly) honest because if i lied i think that would cause even more problems in the future.

Its been 3 months now and just trying to get on waiting for the paperwork to go through, its really bad that i cant go and visit him over there now, as he has work which he cant get much time off from, so have to wait another couple months til see each other again sad.gif

but yes we learn from our mistakes and things happen for a reason!!

Hi

I found getting through the immigration easy It took all of 2-3 mins to look at my paper work and stamp my passport, BUT waiting in the line to get to immigration was over 2 hrs. However I did fly after bomb threats 2 yrs ago and the sercurity was extra high. My advice for what its worth is make sure you have plenty of time between flights (if you have another flight to catch) you never know what is going to happen.

My fiancee (USC) and I (UKC) are halfway through the K1 Process and have been doing everything from the UK. She is here on a work permit. We sent everything from here using trackable Fedex and used her parent's address who then emailed across our NOAs. As Pushbrk says the only issue is that her UK income cannot be used as part of the income requirements as it will not continue when we go back to the US. Her parents will be our cosponsors.

It can be any US Citizen or Permanent Resident providing they live in the US. The joint sponsor does not have to be a family member and can be a friend. Check Page 3, What is a Joint Sponsor:

It does happen, but very rarely. Providing your fiance isn't trying to circumvent the VWP rules and coming in and out of the US often, I wouldn't worry about it. I'm most of the way through the fiance visa process and recently was in the US. Although the POE officer was very curt, it was no problem getting in and although I had evidence with me (rental contract, return flight details, letter from employer, tickets to future events in the UK) I didn't need any of them.

He'll be fine I'm sure!

It took just over one month for my NOA2 to Packet 3, I didn't bother chasing NVC and just waited foor the NVC letter and then Packet 3.

You will need to check the State marriage requirements for where you plan on marrying. Each State is different. Also check this link for tips on visiting.

Yes but he still can do what he suggests, except unless he's overstaying the leave given to VWP visits, he won't need a visa. USA has fiance visa but they are for foreigners intending to immigrate to the US. The visa facilitates the immigration and requires the marriage but if the foreigner can get here on some other visa, they can marry and leave without any special visa.

The caution is, you don't want to mention you're coming to the USA to get married because you could also be turned away. I would suggest giving a more general truthful answer, like simply "pleasure" or "vacation" (a honeymoon is a kind of vacation) or visiting family and friends.

I believe JFK is the only airport that issues the temp EAD so you won't get one through La Guardia.

If you don't use email to communicate just make sure that you have evidence from whatever means of communicating that you do use. Or are you saying that you only communicate once a week?

Still, if that's all you have that's all you have. You'll just have to take it along and explain to them at the Embassy, it's not like you can make something appear that doesn't exist. Could you talk your fiance into communicating a bit more between now and the interview? Just a thought.

I've visited too with no problems. We filed the I-129F on 3rd July and I visited at the end of September. I took lots of ties to the UK but wasn't asked for anything. The POE officer just wanted to know my reason for visiting (I said vacation) and how long I was staying for.

I do believe that if you are from a country that can use the VWP it is very difficult to get a B2 visa from the Embassy.

When my fiance flew in to visit me in April he was chosen for a random stop-check by the Metropolitan Police in the baggage claim area of Heathrow Airport. We sent the paperwork from that in as evidence that he was here. smile.gif

It's only available for the I-129 and not for the I-129F so K1 filers can't make use of it I'm afraid.

Will this work, so that I don't have to be FedEx documents. Where does the STEP that requires pictures of us together and proof, etc come into the process and can I hold up any progress to MY benefit as far as time goes without having to start over?

In #20 I wrote 'self employed' and I wrote my home address as the employer's address and in #21 I put 'Internet Researcher' (you would put 'writer') and my form was accepted just fine. I didn't mention my clients at all. Hope this helps and good luck.

I wasn't aware that the London consulate would allow the petitioner to sponsor themselves. I don't own a house or have any other assets yet, but so have some money in the bank, so perhaps it will help to take those details along to the interview...when it finally happens...
