My British fiance and I are about to do the same thing! We're flying into the States on the 5th, so we can let you know what happens. His situation is pretty similar to yours - sold his house and quit his job to go travelling, however, he doesn't have a single family member. So as far as proving "strong ties" to the UK ... he really can't.

We just know that he has no intentions of staying, so we're bringing just about all the proof we can through bank statements, car registry, etc. I'm trying not to get too nervous since I know our intentions are good ;) But I understand how frustrating it is since everyone would like a clear cut answer.

I literally feel like i'm going to explode at the moment, i have so many concerns running through my mind! Like you said, a clear cut answer would be amazing, even if it was a NO! At least i'd know exactly where i stand, and wouldn't waste the money on flights, and all that time travelling...... but then i guess that's the small price to pay when you fall for someone who lives on the other side of the world :)

Hi everyone smile.gif My name is Trang and I am currently engaged to my fiance whos name is Binh.

I am new here but me and my fiance are stuck on one part of the I-129F form and I am terrified of making any mistakes at all that could delay the visa! So any help would be great. We was going to hire a lawyer to help us with the visa process but I think that would be a huge waste of money and the money would be better off being donated here. Any help would be greatly appreciated.

I am stuck on Part A Question 10. My fiance is the american citizen, he recently received his passport but I just want to make sure If he is filling the form out right, It seems to me that question 10 asks the same thing twice? For example it asks:

My citizenship was acquired through (check one)

We checked : Naturalization (because he was not born in the states)

Give number of certificate, date and place it was issued. (we gave the number and date + place it was issued)

BUT then it asks

Have you obtained a certificate of citizenship in your name? Are they still talking about the naturalization certificate? because he does have that but also he has his passport, but we have already given the certificate number and place of issue above this part though? I was going to tell him to enter the number and place again but I just want to make sure if thats the right thing to do.... the example form is great but nothing is filled out in that section on the example I-129F I have.

I have a mountain of questions but at the moment I really just need help with this! Thanks alot smile.gif

I forgot i made this thread a little while ago! My petition has been approved!!!! smile.gif It is now at the US Embassy in London! I am very happy seeing as I got my NOA2 within 5 weeks of my NOA1! Also I have been bugging my relatives in Vietnam since I made this thread and ...... I SHOULD BE RECEIVING MY BIRTH CERTIFICATE IN THE MAIL within the next 2 weeks!!! I hope it arrives soon..... since Mails sent from Vietnam seems to take forever to reach england!

Oh, by the way, wen i contacted the UK Border Agency for a letter of my families asylum paperwork in case I did not have my birth certificate..... they never replied! NOTHING! Very Evil and no help at all.

You do not need to call the embassy for paperwork. They will send you a letter with instructions on how to fill forms out online and then you just print them and mail them back. Try to get a birth certificate. I have read here on VJ about British citizens from Pakistan/India who were put into Administrative processing by the London Embassy because they did not have a BC. If you can not get one, get school records, doctor's records, baptismal records etc.


Years......? Oh my god....! I have asylum papers from when I first entered England in 1992. My family was what you called "one of the Boat people" who fled Vietnam. My birth Certificate was lost at sea in 1988. I have tried calling back to Vietnam to get my Birth Certificate but there is no luck! The Vietnamese Embassy in London do not answer phone calls however much I try calling...... I do still have my travel documents from when I was 8 or so... would that be any good either?

I am a british citizen with a passport. How i got my citizenship? Living in the UK for over 10 years..... No Birth Certificate because....... Ever heard of the Vietnam War? If you look at the website, timeline etc.... The guy "Dan" is the beneficiary... and it says he called the US embassy for some forms? Im just wondering what other things do I (the beneficiary) need to gather apart from everything on the I-129F.

Save some of the evidence for the interview. At this point you have to prove that you've met within the last 2 years. (passport stamps, boarding passes, flight coupons, a couple of photos of you together, etc.) Again, the guides will help you.

British passport will be fine. However, if needed I am sure that a certified copy of your birth certificate can be obtained in Vietnam. I know that my wife didn't have a problem as she is "old" ( born in '82). smile.gif

Do the work to prepare your case and things will go well. Be lazy, and you will have delays.

Hi everyone!

I know there is a search function on VJ but I want to ask quite a few questions and also I want to get to know the people on VJ and also let everyone here know about me and my fiance smile.gif

My name is Trang and my Fiance's name is Binh. I am from London, England, and he lives in Fort Worth, Texas =P We are both Vietnamese.

I met Binh back in September 2005 online by chance on a game....... (yea...... a game..... ) . We have spoken literally every single day since then! Of course we stopped playing the game back in 2006 but There has not been a day I went without speaking to him! I know it sounds crazy but sadly its true! We no longer use messaging programs anymore since we found out about "Skype" He got himself an unlimited phone plan with T-Mobile, and I got myself a Skype subcription which gives me 3 online numbers of my choice! I chose a Fort Worth Phone number as my own, so he can call me with his unlimited minutes straight to my phone or my computer.


Here are a few of my questions and I would appreciate it if some of you guys could answer them personally for me biggrin.gif

1 : How often are fiance visa denied? I am so impatient and I miss him so much, and I have a habit of worrying like crazy about the visa ever getting denied... I dont know what I would do!

2 : I do not have a Birth Certificate! I was born in Vietnam back in 1987, my birth certificate has been long lost since then. I have never returned to vietnam eversince I left when I was only 6 months old. I do however have a british passport. Would this affect our petition? Most people born in Vietnam will not have a Birth Certificate, my fiance Binh doesnt have one either but he has his naturalization certificate and his passport. This is driving me mad worrying!

3 : There is a 2 year age difference between me and my fiance. I am turning 22 on the 21st of august, and he is 20. I am nearly exactly 2 years older then him...... Would there be a problem with our age? A lot of people would think that "we might be too young to make the right decision" to get married so soon etc. Do you think we should get our parents to write us a letter of support? I am nearly 22..... I really dont think thats young at all.

4 : When will he need to meet the poverty line requirement?

5: He wants to send 20 photographs of me and him with our I-129F package, is that too many photos?

6 : In 2007, I did not get to visit him and he couldnt visit me because we both had college and no jobs, we couldnt afford to go anywhere that year! Would they question that? But in 2008 I went to visit him twice, once for 18 days and another for 89 days! The border patrol wasnt so happy to see me staying nearly the maximum allowed days in the US and gave me quite a hard time! tongue.gif


I know that was a very long read and that I asked alot! But from the evidence that me and him have provided, and everything I have told you about me and him, what are the possibilities of the visa getting denied? The birth certificate thing really worries me! sad.gif


We will be sending our I-129F to the USCIS very soon! He lives in Texas, so the place he should be sending it is the vermont centre correct?

5 Hotel Receipts (photocopies) from Worthington Hotel (one from the day he proposed to me!)

Huge skype phone bill... approx 12 pages each month and 75 items on each page..... haha...........
His T-Mobile phone bill
My skype account details which shows my skype numbers
My paypal account overview which shows payments to skype for my online number


Anything else I should add? Do you think that is enough evidence?

I'm filling out my petition now and have a quick question on the G-325A, Biographic Information form....

1. Why do they provide forms where the answer (date) won't fit? I am trying to enter date of births for parents and I can only fit six digits. So for example I could fit 01/01/60 but not 01/01/1960. Should i a) use the short date format (I guess not when the instructions clearly state mm/dd/yyyy), or cool.gif hand write this information in ink?

2. For similar reasons to the above, is it ok to use abbreviations for city, for example Phil, PA. Or again, should I hand write Philadelphia, PA to be complete?

Sorry for the pedantic question, but I'd prefer to be safe than sorry if the form is rejected due to the above. Many thanks in advance.

Judging by the experiences of others, it looks like our application will take in the region of 8, looooooooooong months blink.gif .

So, I'm meticulously preparing the K-129F Fiancé Visa Petition now, and hope to have it sent off quick smart. I hear that the Vermont Office is shifting towards a blitz on the K-129F visa, so hopefully we will have a quick response time too. kicking.gif

Can I just clarify a few things on the process:
- Can I still come to visit my fiancée in the US from the UK on the Visa Waiver Programme, while a K-129F Visa Petition has been filed? Yes you can. Just make sure you have PLENTY of prove to ties back here in the UK. Rental agreement, letter form work stating when they expect you back, return ticket (although I don't think this is much good on it's own) that sort of thing

- Once I obtain the K-129F Visa, we will not be allowed to go abroad to get married? We must get married in the US, right? K1 Fiance Visa - You HAVE to get married in the US

- Will it affect/harm my application if I state my parents address for my place of residency? I am in the process of renting out my property and will move back in with them until my petition is approved. Not at all

- I hear the process can be speeded up by paying of the fee online. Is this possible to do with the K-129F Fiancé Petition? I'm not aware of this, or for that matter, any other way to 'speed up' the process. I think the best way to make sure it doesn't take longer than they has to, is to do your homework and have PLENTY of evidence to show them. Dot your i's, cross your t's and then go back to check them again!!

Out of interest, when you say you had some trouble entering the US last time due to the frequency of your visits. How frequent were they? I'm just asking as I'm also traveling to the states a fair bit now, and wondering how frequent, is TOO frequent. Thanks!!

Not that often to be honest. Dates and durations as follows:
- November 2008 (12 days)
- December 2009 (14 days)
- March 2009 (12 days)
- April 2009 (10 days)
- June 2009 (31 days) [this is where I was sent for seconday interview]

The immigration official advised me to spend a little more time outside the country than inside. I advised him I was planning to return again around November 2009 and he said that shouldn't be a problem. However, it will be in my mind next time I travel to the US wacko.gif

Does the frequency / duration seem excessive to anyone?

Just curious, why are you preparing the I-129F petition? Your fiance is the one who has to sign the petition and submit evidence for it. The petition is her end of the process - the visa application at the US embassy is your part. The only things you should be preparing for the petition submission are your G-325A biographical data form, and your signed letter of intent.

You are correct when you say she has to file, however, there's nothing to stop me preparing the forms on her behalf. Teamwork you see! Once I have everything prepared, I'll send the information over to her and she can add the things she need to add and then file. She will still have to sign and date everything and, ofcourse, include the cheque for payment. Do you forsee any issues with this approach?

Hi guys,

My fiancée has just submitted our I-129F Petition for K-1 Visa. A thought just occurred to me and I researched more about consulates. Much to my great horror, I've read that the Edinburgh consulate does not handle any non-immigrant visa processing. However, for question 20 of the I-129F we stated that I would apply for VISA at Edinburgh as opposed to London.

Will this in any way affect the application process? Should I write to the USCIS? Please advise.....

I had my interview yesterday at the London Consulate. I was worried about my NOA2 date expiring on the 18th April, 8 days before my interview, however, there was no mention of this at all during the course of my interview.

I did prepare a notarized statement from my fiancée reaffirming her intent to marry me within 90 days of entry into the US, however, that was not requested either.

You should not have to have another medical exam when applying for your AOS.

Since you are K-1 and your medical examination was completed in London, your DS-2053 should have been included with your package that you handed over at POE. However, there have been reported cases where the DS-2053 has gone missing. In which case you will get an RFE unless you have submitted your I-693 with your AOS package.

So, from what I can gather, you would be well advised to include the I-693 with your AOS application.

If you have the DS-3025 immunization record that the Knightsbridge Doctors should have given you a copy of, you should be able to have them transcribed into an I-693 locally in the US by a Civil Surgeon. There is usually a small admin fee of $50-$75. In my case, it cost $100. You may have to be prepared to convince the CS that you do not require an additional medical.

Yes, it's just for the UK; thanks for the link(s). Do you have any idea which shots I will need? Or is there a way of finding out? Or is it merely a matter of making an appointment with my GP and asking him to update me with all my shots, if so, is it normally all done at once?

Yadrak is correct it does not need to be official, and also you will be ask by the consular to swear to that all the documentations are correct and truthful to the best of your knowledge .
i nearly made the mistake of paying £82.50 per translation to a notary who is sending my papers off to somewhere else , which would have taken another month of waiting, when it was not necessary.

You could elect for him to come over on the visa waiver program, get married, and then return to the UK with him. He is NOT allowed to adjust status to get a green card right then if you do this (you have to file a DCF or a CR1), but then you can stay together through the process.

Or you could file a K1, which takes anywhere from 4-8 months on average. You can stay in the UK if you are legally allowed to do so. Please read the guides at the top of this page :) welcome to VJ and good luck on your journey.

It's the same there as it is here. Americans do need a visa to be in the UK if they are doing more than just visiting, and they have work visa's, fiance visas, spousal visas, all just like the USA. But the OP is saying that she was already in the UK legally, so there is really no reason to have to get another visa to the UK, as she also said she's a dual national which means she never needs a visa. But she is trying to get information about them both coming to the USA.

To the OP: Unless you want to get married in the UK, you are more likely to have to be separated as DCF isn't allowed. The main problem is one you bring up of the affidavit of support. You will be his main sponsor, even if you aren't working. I would suggest trying to find a co-sponsor in the USA that is willing to provide proof that your fiance won't become a public burden.



well my mom and all my family are currently in california...so if one of them were to agree to be a co sponser..would that be alright?? if i just apply for the K1 fiance visa..and send it to cali and then wait for it to get sent back and all that..would it be enough to have my mom sponsering him..or would it cause problems when we got to the point were the financial info was required because i wouldnt have a job there?

If you were to go about this via DCF (explained above) you would need to get married first. You cannot do DCF for the K1 fiance visa route.

Well, basically, me and my fiance have been together over a year...we met in person in the UK (I'm american but I'm legally allowed to be here). We live together and have for the past 6 months, but now I want nothing more then to go home to California. He'd also like to live there having visited in Dec with me for 2 weeks right before we moved in with each other. My question is...if I want to apply for a fiance visa so I can get married at home, how do I go about doing so?? Am I allowed to apply for the K1 without being in the US..and if so...what happens when I need to show that I can support my fiance?? Im just a bit confused because it seems that everyone is seperated while applying...and seeing as it takes so long ...we wanted to make sure that being seperated for however long it was...isnt the case..help!?

Hello all.

I was wondering:

We're at the stage now of waiting for the (London) consulate to process all my paperwork post NOA2 - completed medical and sent forms DS-230, IV-15 & Checklist, Form DS-156, Form DS-157 and Form DS-156-K which they requested. I also completed the online DS-160, just to be safe - for which I have the confirmation page with the barcode etc.

I mailed all of the physical forms from America, as I was visiting my fiancee at the time. FOOL I was, I didn't do recorded delivery! I was wondering if I should get any kind of notification that they've recieved my documents. It may not matter, considering I used the DS-160 which seems to be surplanting the physical sheets, but considering they specifically asked for those forms I've sent, I'm keen to know that they got them. And I've had problems with the USPS before!

Hi Lily. I started calling DOS about a week after I sent packet 3 back and called every day until I got my interview date. They gave it to me a few days before I received packet 4 but it was still very short notice. In my packet 3 I included a cover letter saying that I was ready for the interview and I could attend with no notice and would be prepared to fill in any cancellations that they had. I have no idea if that letter is why my interview was at such short notice or if it was just because it was around the Christmas period.
