Apply for your police record now. Its called Acpo. Its 35 pounds for standard and 70 pounds for express delivery. You need a photo. Its a bit more official looking than the subject access. I have VERY similar worries to yourself when I went through the k1 in 06. got the subject access and it showed no police record. the embassy were fine with that. Now im going through the CR1 i was worried as the acpo search is a new search it may show up. However the acpo certificate showed no trace. So Im fine. If the acpo shows anything at all, it will be no live trace going by what youve said. In this case you will need to search for court records for the offence. Ive searched high and low, driving without insurance is borderline when it comes to 'criminal' or not.

However, from the extensive research Ive done, the police database had some kind of overhaul in 2006 and deleted a lot of petty/spent records. So there is a good chance you may show up as no trace. In which case you are fine.

Worst case scenario, you would need an i601 waiver if your record blatantly shows up on your acpo report.

Indeed, I am not encouraging to lie, if the police record shows 'no trace', the embassy has it in black and white as proof. if you want to know anymore drop me a pm.

EDIT - sorry, i didnt see the line about theft. YOu may want to consult with a lawyer there. I have had a few chats with Mr Steven Heller, he used to work at the uscis and the us embassy in london, he has been very helpful with his advice on the phone and has not charged.
However, London is apparently bcoming more stringent on Crime of moral turpitude. your best best is to go for your ten pounds subject access first. if theres nothing on there, there'll be nothing on the 35 pounds acpo report, as the Subject access contains more details of any offences.

If it shows up, then address the issue in your own words, when you go to the interview. Id say a CO would be more willing to look at it more sympathetically if you are upfront and honest.

If the acpo report comes back as no live trace, it means the offence has been stepped down - ie theres been a rehab period. Something major would give details regardless of the time period. Try the forum at www.immigrate2us.net too, thats very useful and there are people in the same position as yourself. For peace of mind I would advise the acpo certificate premium service, it takes a week tops, you need a photo with it too. The acpo cert is more basic than the subject access, but more 'official looking' hence the requirement for the consulate. The subject access is cheaper but it will also give you the details for your peace of mind or how you need to approach the issue you're concerned about.

im guessing you were arrested? apply for your acpo certificate and if it shows on there you will have to address it. how long ago was it? the reason i ask is it may not show up on your acpo cert. although the us doesnt recognise spent crimes or convictions, sometimes certain things dont show up on the acpo. i know its not themgreatest of help but apply for it and see what it says. now of course im not telling you to lie but if its not on your police record then there is no crime to address. id say. if it does, then you will need to obtain all the official info relating to the crime and address it in a waiver packet.

that said, a consultation with an immigration attorney would help too.

I dont think the i-94 number is vital to include, I remember when I did the k1 and didnt include the i-92 number on the i129f.

you may have chance to correct it at thenvc stage or contact the uscis and ask to add an addendum. better than that to be questioned about misrepresentation. thats something to steer clear of. always be upfront with hard facts. thats just my opinion though.

i was expecting them to make me strip, it was not as bad as i expected.. oh i forgot they made me do an eye test to, checked my ears, and mouth..

it was like a regular check up, except they did take a blood test, i was getting uneasy when i saw the needle so i was looking the other way and the doctor was laughing because i was like noo i cant see it!!!

the medical went well from what i thought, i went in there with my friend was told to give them my photo, my passport and my form then told to wait, the lady brought a clipboard with another questionnaire, they had all sorts of questions about drug use, abuse, suicide, self harm, diseases, and i looked and saw the section the doctor fills out about mood, how the patient seems, if they seemed like the lied about something etc..
then i went to speak to the nurse about injections.. I didnt have records of, she asked questions, said id only need to have 2, can do that at my GP and fax them the form.. I asked if I needed to give Urine sample - no, so i went to the bathroom (i was trying to keep a fresh sample incase tongue.gif)

then i went and had the xray done, had to wait around, the technician showed me my xray looked fine, went into another room with the doctor..

he asked how i was, I tried to be very positive and upbeat, he asked how healthy I was, i said Im in good health i try and take care of myself.. he weighed me and measured my height, made me lay on the table/bed checked my pulse on my foot, asked to look at my arms, checked under my arms, then listened to my heart beat told me to cough, then breath in, hold my breath, blablabla.. listened to my heart beat chest, and then on back.. then pressed his hands on my stomach, asked if i felt pain.. no.. asked if i have ever taken drugs, been cautioned by the police, ever lived with anyone who had turberculousis.. No.. and then that was it.. went to the waiting room.. then called by the nurse to pay.. that was it

i think they go by what you look like when you go for the medical.. they just gave me a quick look over.. raise your arms lets see this that.. and that was it.. i asked if they needed to do a urine test they said no... they dont give you a hard time...

i wouldnt suggest lying but if he only did it the one time.. then id say no because its not like you "do it all the time"

I appreciate your response. It was definitely a difficult decision to make. Anytime I attempted to tell them, it only ended in me crying uncontrollably! I think there are three factors in why our age won't be something that will break us up, but bring us closer together:
1) We made all of our mistakes early! smile.gif I think we're old souls, done with the party scene and ready to take the next step.
2) We have been exclusive for over 3 1/2 years. We know each other like the back of our hand, yet we haven't gotten to spend that much quality time together. The time we did spend together and even apart we learned an enormous amount about the each other, we just missed out on all the fun things, holding hands, going on dates, etc. We've been able to handle all this not so fun stuff without being able to balance it out with those little things that so many people take forgranted. I think it's our turn to get a little bit of that balance.
3) I can already see our little bilingual babies running around! biggrin.gif But at the same time, I want us to enjoy being married and life as newlyweds(while saving up to add on to the family) So I think we should get married as soon as possible so that we can start building a family a couple years or so down the road.


Another factor is that my parents (especially my mom) are in no way, shape, or form ready to let go. I love them to death and I'm especially close to my mom, but there's no way to ease them into it. Whether I tell them a year in advance or a couple months before, it's not going to make it any less difficult for them. Maybe even telling them a year in advance would just make her worry more.


you dont have to explain yourself or your feelings to anyone, its your life and your mistakes to make.. i have issues with my fiances family always being negative and making him panic because they make it seem impossible..sometimes you just need to put your head down and do what it is that you want to do in life and not worry about other people, i know it sounds harsh.. but.. your parents have lived and made decisions and done what it is that they needed to do.. you should never feel guilty for making yourself happy

i dont understand how or why they got approved but i realy think some of u need to take some sort of chill pill and stop being so ####### retentive and making a big song and dance about their issues,

firstly, keep busy, keep talking spending time and keep positive.. it will happen.. so be patient.. you wont get denied.. if youre honest and genuine it might take long but as long as you arent doing or havent done anything dodgy in the past you will be fine..

read the net for information, i found it helped when I knew what to expect

be prepared for how it will affect you.. depression is really difficult, from talking to people on here, and experiences, one of you will get cold feet or start to doubt the decision.. its normal, it happens, make sure you visit each other if your can and remind each other why you are doing this..

save.. as much as you can, esp wit the economy... ive lived like a poor student for the last year and a half.. putting all the money i can away.

Has anyone been through the medical for the K1 visa with children please?

We have two children, a boy aged 8 and girl aged 4, I just really want to be able to talk them through what happens...ive said it will prob be just weighing and height....temp, checking of their ears, eyes and throat...I know they dont have the chest xray as I read that on the London based USEmbassy. What really concerns me is where Ive read they check your genitals...I can possibly understand this with adults but surely they wouldnt need to check children???? Im really concerned and confused about it.

Any experience on this please????

To the person who is 19 wanting to marry the 23 year old:

I am 18 and my fiancee (USC) is 19, and we have an interview 3 weeks tomorrow. I will of course let VJ know how the interview went, but I don't think our age will be a obstacle at the interview. We have a ton of proof of a bona-fied relationship, and even when we filed for the I-129F, I had my parents consent in the form of an affidavit sent in with the I-129F application.

I had a bit of a look on the forums but could not find a clear answer to this. My apologies if there is one already posted but I could not find it.

My fiance and I have nearly prepared all our documentation and evidence etc for our K1 visa application and we intend to send this at the end of November. Once this has been sent to the Vermont service centre and we are waiting for the various processes to take place, am I able to travel to the United States for holiday/vacation etc or do I need to stay in the United Kingdom until the K1 has been approved?

If i must stay in the UK we will delay our application as I have already booked tickets etc to go and spend the Christmas and New Year period with my fiance and her family.

What should i try and have with me to prove my intentions of returning. Because we plan to marry, in order to save money i moved back in with my parents so i have no mortgage or rental agreement. What else would be good supporting evidence. I am a type 1 diabetic so i must return for medication and diabetes care etc, could this be one form of evidence?

My fiance and i will shortly be sending our I-129F pack to the VSC. I think this will be at the end of November.

I am going to stay with my fiance and her family for 5 weeks over the christmas and new year period. I am worried that the border guards will consider me an immigration risk partly due to the length of my stay and the fact that we are engaged. Would it be more advisable to tell the border guard that we are just boyfriend and girlfriend?

As the date we are sending the I-129F form is going to be the end of november and it is early december that i go for my vacation. Could it make life easier if we hold off on sending the I129F form until I am there?

I know that with these things honesty is the best policy but I am terrified of being turned back by the border guards, it would destroy christmas and new year for both of us.

I'd just get married now and file for a CR-1 spousal visa if I were you. The CR-1 takes about the same amount of time and gives the beneficiary a green card and the right to work upon entry into the US.

I'm pretty sure you can begin the filing process while she's in the UK with you and finish up the process after she goes back, but someone else should be able to confirm that more definitively.


Does anybody know if we will be able to marry whilst she is here, obviously we will need to apply for a UK fiance visa but did this need to be done before she entered the UK as a visitor and can we still apply?

I've tried to find this information everywhere, especially the US embassy websites etc, but don't seem to be able to find an official answer.

Does anyone know if I (a UK citizen) would be allowed to visit my fiance (US citizen) while the K1 visa is being processed? We did not realise how long it would take, and i can't face the prospect of not seeing him for that long!!

My fear would be booking flights and then being refused entry once i get here!

I would usually enter under the ESTA, visa waiver programme.

He is not able to visit me in the UK because of his work commitments.

If anyone knows, or can point me in the right direction of where to find the answer i would be eternally greatful!

My British fiance and I are about to do the same thing! We're flying into the States on the 5th, so we can let you know what happens. His situation is pretty similar to yours - sold his house and quit his job to go travelling, however, he doesn't have a single family member. So as far as proving "strong ties" to the UK ... he really can't.

We just know that he has no intentions of staying, so we're bringing just about all the proof we can through bank statements, car registry, etc. I'm trying not to get too nervous since I know our intentions are good ;) But I understand how frustrating it is since everyone would like a clear cut answer.
