K-1 Fiance(e) Visa Process & ProceduresCan a UK citizen enter the US and then apply for a K1?
This is what I'll be doing! I'll be entering the US on the 90 day visa on the 19th Nov - the next day we'll be sending the K1 application off (which we've already put together) and then I'll be staying there for 87 days before I leave back to the UK. At least then we would have waited 3 months together during the long process! We also arranging a trip for Jamal to come to the UK when I get back too! We've been living together for a year and been in the same country for 2 so we are trying to keep the time apart as little as possible!!!

K-1 Fiance(e) Visa Process & ProceduresQuick Check about evidence for K1

Oh you've got boatloads of evidence!

Probably don't need to send it all with the visa app....they want proof you've met in the last 2 years. Send a small sampling and save the rest for the interview in London.

What would be the best things to send from the evidence that I have?

K-1 Fiance(e) Visa Process & ProceduresQuick Check about evidence for K1
OK - So we've finally put together the application for the K1 visa (we'll be submitting it in November but will be travelling before hand so want it all ready for Nov) and I just want to check that we have everything that we need in regards to evidence.
Jamal will date everything on the day that we send the packt.

(i) We have 7 photos ranging from Nov 05 - Sept 06 - all dated with location and persons in the photos - they are in different locations - in the USA, Italy, Salzburg, Cyprus, his airforce graduation to sergent in uk, one at christmas time with my parents and one at home.
(ii) We have a copy of Jamals military orders - 1 to his base in the UK stating that he will be there for 24 months and the other to his new base in AZ stating the date he will be returining from the UK.
(iii) We have several bank statements and home phone and utility bills for both of us each showing our names at the same address for the same period in time
(iv) We have copies of 2 official passes into the us airforce base in the UK with my photograph, my full name, Jamals full name and his signature - as jamal had to present with me during the trip this will show proof that we've met also. The dates for these are May 06 and Aug 06.
(v) We have several confirmed itenaries for trips that we have taken together - one for Cyprus in June 06 and one for Salzburg in Sept 06 - these show the date and both our names - unfortunatly we dont have the plane passes as we kinda threw them away!

I do have plenty of emals that we sent each other wile he was deployed to Qatar for 4 months last year - do you think I should include that?

Also - I'm going to get my passport photo taken tommorrow. Will just a standard photo taken in a photo booth be ok? and do people smile in them or not???!!!!!

Thanks

K-1 Fiance(e) Visa Process & ProceduresPassport photo problems
Ok - so i had my photo taken at Mildenhall base - people in the military go there for passport photos, spouses go there for visa photos and I assumed that as it's the us govenment that have these people on the base (an american company) that they would do it right. Everything looked good - got my 2 passport pictures taken for $5.75 and now I've checked the photo spec and it says about having to have 1/2 inch between the top of the photo and the top of my head - but there is just over 1/4 inch space! Does this mean they wont accept this photo? My fiance got his passport picture taken there and his was accepted and when i was there i asked if anyone had been turned away with the photos they take and they said no. What u guys think?

K-1 Fiance(e) Visa Process & ProceduresDoes anyone have a list of translators in the UK?
We need to translate a divorce certificate from Swahili into English and need to know which translators will be recognised by the US for the K1 application! Thanks
JamalNTamFemaleUnited Kingdom2006-10-04 05:59:00
K-1 Fiance(e) Visa Process & ProceduresPassport photocopies
For our K1 application we will be sending photocopy of all pages of Jamals US passport as proof of citizenship. The reason for this is his birth certificate has the wrong last name on it - it took him years of problems to get his passport to the correct name and we are worried that it will delay the application. Also his passport shows millions of stamps to the UK from when we've been on trips to Europe. Do we need to get this notorized? We have more proof that he is a US citizen as he is in the US Airforce - would it be worth it to send a photocopy of his military ID? We've also got copies of his orders to the UK and to his next base.

K-1 Fiance(e) Visa Process & ProceduresBankruptcy

Could you not file bankruptcy before going, perhaps,
Im in a similar situation , total to date £30,000,

do you think they'll find us????...lol
The US is a big place...

ok, I know... morally wrong,
Id seek advice from National Debt Line, in the UK, they can send you
a big advice pack on Bankruptcy free of charge.

Personally, Im not trying not to think about it at the moment, it brings on
a migraine...

Good Luck x

Lol - me too! I just dont want anything to complicate it - plus it would look like i was using the visa to run from my problems in the UK!! I was thinking that saying after I'd been in the states for a while (after getting my greencard) that i just couldn afford the repayments wouldn't seem so bad. I dont know!! :)
JamalNTamFemaleUnited Kingdom2006-10-08 15:10:00
K-1 Fiance(e) Visa Process & ProceduresBankruptcy

I am not quite sure about your situation, but in my case I (the USC) would probably get a personal loan from my bank in the states to pay off that debt in UK, transferring the debt to the USA. Bankruptcy can affect you for many years.

The trouble is that my fiance the usc doesnt have a good credit rating - also i've been told that bankruptcy on the UK would not effect credit rating in the US. The amount is quite alot - around £20,000 and it would mean having to pay $40,000 loan and we would be paying alot of money a month for the rest of our lives! I guess I dont want my fiance to suffer for the debt that i accumilated from being young and foolish!

K-1 Fiance(e) Visa Process & ProceduresBankruptcy
Just a quick question - If the alien fiance gets married (after being on a K1 visa) and adjusts their status for the greencard, which is approved, will this have any implications on them declaring bankruptsy back in their home country? I'm asking this as I have quite alot of debt in the UK and I dont think i'll be able to keep up the monthly payments when i'm in the states as the $ is almost half the value of the £! Thanks

Ok so we're about to send the K1 application off and i just have a small question. Can we send the fee in a money order or does it have to be a personal cheque? Thanks

You were silent about this, but if there is any documents being provided as evidence that is not in English will also include a "certified" translation.

The Tanzanian divorce certificate is in English so I dont have to worry about that. Thanks though :)

K-1 Fiance(e) Visa Process & ProceduresQucik check
Ok - so we have everything ready for our K1 application and i just wanted to double check with everyone if it all seems ok. We have
-Cover letter
-$170 money order made out to the Department of homeland security
-I-129F form signed and dated
-Letter of how and when we met signed and dates (also explained that we lived together)
-G-325a forms for both me and my fiance
-Passport size photos of both me and my fiance
-Copies of all pages of my fiances US passport
-Letter of intent to marry for both me and my finace both signed and dated
-Copies of US airforce deployment papers showing my fiances permanent change of base to Mildenhall, England with date and the deployment papers showing the new permanent change of base to Davis Monthan, Arizona with date
- A few printed email itineries with both our names on detailing a trip to the states we made together
-A printed itenary for a vacation to Salzburg we had together with both our names
-A few bills dated around the same time with the same address for both of us
-Yet another itineray on a trip to Cyprus we took together with both our names and our address
-2 copies of US airforce base passes dated, signed and with a photo of me on them.
-9 color photos of both me and my fiance together - many of them on trips we took, one in our house, one with both my parents at christmas and one at his military graduation to SSGT
-A few emails dated during the time that my fiance was deployed to Qatar for 4 months.
-A copy of my Tanzanian divorce certificate, notorized, dated and signed.

Is there anything we're missing? Do you think we should send a copy of my fiances military ID for extra ID? Im actually in the states right now in our apartment and Im dreading the day i have to leave and not know when i can return because of the time the visa takes. I want to make things as smooth as possible so the time apart wont be as long and finally we can get back to life like it was before Jamal was stationed back in the US. Your comments would be really appretiated.

K-1 Fiance(e) Visa Process & ProceduresReally need some help with the I-129F form
Well we've filled everything in on the I-129F form but we're a little stuck on the section asking if the alien fiance is currently in the US. I am in the US (alien fiancee) but only on a 90 day visa waiver and i'll be going back to the UK in Feb. I just arrived and we wanted to submit the petition while i was here visiting so that we dont have to wait so long apart from each other. When i entered the US i told the immigration officer i was here to visit my fiance so i wasnt lying and i will be returning on the 14th feb, when my flight is booked. Do i still need to put in the information on my arrival/departure record? Will they think im trying to go against the system if i say im in the states as a visitor? I called USCIS before I went to the states and asked if we could file the petition while i was in the states visiting and they said yea. Does anyone know or anyone have any advise? Im worried now! Thanks

Thanks :) I lied when I said I had one last question!! On the form in the 'year' boxes i put for example 2006 and when i print it it shows with a + sign on top of the last number. I guess its because the whole 4 digits wont fit in the box. How can I get it so all 4 digits fit? or is it ok to send it with the +s? I hope this makes sence

K-1 Fiance(e) Visa Process & ProceduresG-325A Form help

When you complete the first page on Adobe the next 3 are automatically completed with the same answers. You each have to sign 4 pages.
They're not exactly the same in the sense that each page goes somewhere differently so you need to sign all 4.
If you have a supplement for one page then you should include it for each page.
Hope this makes sense.

Thanks :) Its clearer now! lol! So do both people fill one out each? Or just the USC?

A lil confussed about G-325A! I see there are 4 pages to fill in. Does the USC fill all 4 in about themselves? Or does the Alien fiancee fill them all in? or does the USC fill 2 in and the alien the other 2? Sorry if its an obvious question but Im just not sure. Thanks

K-1 Fiance(e) Visa Process & ProceduresMy last 2 questions on the G-325a
Really ... :) Ok so in the section about previous marriage it asked for the ex spouse birthdate. I have truley forgotten! It was over 5 years ago since i saw him! I was only 18 when i got married the 1st time and i was kinda tricked into it - anyway its a long story! Do i really need to put that piece of info? Also on the part 'Applicants last address outside of the US of more than 1 year' Im a uk citizen and have never lived in the states. Is that part just for the USC? If I do have to fill it in - do I just put my current address or the last address I lived in for over a year? Ive moved alot and the last time I lived somewhere for more than a year I moved out at the beginning of 2005. Thanks

K-1 Fiance(e) Visa Process & ProceduresParents names on G325a

Just need a lil bit of help on this. Everything seems complicated for our applications! On the part about parents names etc we have a lil confussion. My fiance (USC) father has legally changed both his first and last name from his birth name. Which name do we put on the form? To make matters more complicated, his mother has also changed her last name which actually differs from his dads last name. Do we just put her maiden name or the new name that she uses? Hope this makes sense.

With all the questions and confusion you have had trying to put your documents together I think it is time to find a different fiance'

ooops .. it seems that I didnt actually reply anything in my last post and it seems that Im confusing everyone! Sorry bout that. What I meant was that I have a certified copy and I took it to a notary, who made a copy of the certified one and notarized the copy he made saying that it was an exact copy of the original document. Thats ok right?

K-1 Fiance(e) Visa Process & ProceduresDivorce certificate

Tamzyn,

What you've got is a certified copy. Don't know how to overcome the fact that the stamp won't photocopy. Maybe try playing with the darkness and contrast (if any) adjustments on the copier. Or go to someplace that has a very fancy copier that might be able to bring out an image of the seal.

How did you get a notarized copy of the divorce certificate? What person, of any relevant authority, signed the certificate in the presence of the notary here in the USA?

Yodrak

Thanks for the response. The trouble is that the Tanzanian divorce certificate doesnt have a gold seal. It was stamped with the Tanzaninan government stamp thing - but its an imprint in the paper and doesnt show on the copy (aparentley alot of the countries and courts now use stamps that show up but Tanzania isnt as advanced).

I think im getting confused. What I did was take the original, certified copy of the certificate to a notary in the US - he made a copy of it and then notarized a copy of it confirming that it was an exact copy of the original document. Is that acceptable?

First off I don't think they need a notarized copy, what they require is a decree absolute or fnal decree. I don't know what they givein your country but in the sates ou get it from the court in which you wre divorced. NO gold seal doesn't make much difference. You can shade it with black dust for the copy machine.

I would agre with the prior poster. Who would notorize something without the erson being in front of hm? That is a criminal offense in my state

But its my divorce certificate and i was the one who took it for notarizing. Isnt that legal?

I assume the only one who has the ability to certify a divorce decree would be the Clerk of Court (or its equivalent). What value does notarizing your signature to the document add... I think that is the question.

K-1 Fiance(e) Visa Process & ProceduresQuick question about expiditing your case
My fiance is in the military and has been told that he may be deployed to the middle east in March for 4 months. This will effect the process in the fact that we just mailed the K1 off and probably will be approved in March and we need all the things to send to the embassy in London, like the NOA2 and the pay stubs etc etc. Would we be able to expidite the case and receive an approval quicker so that we can send all the information to the embassy and not have to wait until he returns from the sandbox to do it? I dont think I could cope knowing that another 4 months would be added onto the already 6 month waiting time. If it is possible does anyone have a link or any information on it? Thanks x

K-1 Fiance(e) Visa Process & ProceduresDeclaration of having met in last two years.

This is probably a really stupid question, but I'm trying to write the declaration of us having met in the last two years. We've met *numerous* times -- we actually lived together until a few months ago. Most of my actual proof -- photos, airline ticket stubs (I also have a phone bill and engagement ring receipt) -- comes from a vacation we took to Italy over the summer. But between then and now, I've gone to see him an additional six or seven times. What exactly do I write about? I'm so confused!

We have been in exactly the same situation! We lived together for abiut 1 year and Jamal just moved back to the states. The only airline tickets etc for us was when we took vacations together - to Italy also!! Because Mal is in the military we sent the orders he was given proving that he was based in the UK for 2 years. We also sent bills and letters addressed to both of us around the same dates at the same address. Because Mal is in the military I couldnt be on the lease too or pay for any utilities but I sent my bank statements with the same address. We wroe how and when the 1st time we met, how our relationship progressed and when we moved in together. We also said that we took many vacations together and sent in some itinery (we used cheap planes so the boarding pass really doesnt show anything on it plus we threw most away). Anyways - they are just really looking for proof you've met in the last 2 years, so what you have should be fine. You'll really need to prove the relationship at the interview! Good luck xx

K-1 Fiance(e) Visa Process & ProceduresK1 Visa and Driver's License in DC

We went to the DC DMV today with the K-1 visa, I-94, temporary employment authorization (stamped at airport) and marriage certificate.

DC has a rule. Cannot get drivers license on a K1 until either you have:

1- Permanent EAD, or
2- Green Card.

Just FYI

WOW - I hope that AZ doesnt have the same rule! U cannot live out here without driving! Even to go to the store you need to ba able to drive! And I've heard that to receive your greencard is a very lengthly procedure!!

K-1 Fiance(e) Visa Process & ProceduresJust thinking in advance

Some calling cards provide call detail. You may pay a penny or two more a minute but ......

I dont know of any in the UK- plus we have so many other things we want to save for - all the small amounts add up - especially the phone! We are terrible - even when we lived together we would call each other from work and speak for 30 min or so! Surely the us government can understand that some people just dont want to spend all their money on phone calls! O well, aside from that do you think we'll have enough evidence of an ongoing relationship?
