You have to prove that you make 125% of poverty level, Click Here to See the 2007 Health and Human Services Poverty Level, if you don't meet that requirement then you would either have to have enough in the bank already to support your fiancee while she is in the USA or have a co-sponsor. (I know absolutely nothing about co-sponsors)

A guy I know here in Illinois was barely making the required income and his parents didn't want to be responsible for sponsoring his fiancee in an ongoing manner so here is what they did for him .. right or wrong, you be the judge .. whether it is what did the trick or not I haven't a clue.

One of the options that you have for proving support is a statement from an officer at the bank where you have accounts. They simply write a statement on letter head of how long you have an account at the bank, how much you have deposited into that account in the past 12 months, and your current balance in that account. The petitioners parents called the bank and had $20,000 transferred out of their savings into his account in the morning. In the afternoon he went to the bank and got the letter written up like it was supposed to be according to the instructions on for I-134. He went home and called the bank to have the money transferred back into his parents account.

Keep in mind that you do not need this information until interview time and you don't want this information more than a couple of months old I have been told.

The following statement is only my opinion; I believe that if someone wants to bring a fiancee to the USA then they should have to be able to support them on their own, however, after considering your extenuating circumstances I thought I would share this story with you.

we were denied because the CO felt we had conflicting answers to her questions. She suggested that we file for an appeal.

From what I understand, conflicting answers is not a good thing .. depending on the questions that were asked.

The only thing we did not have were pictures of together during my trip in 06 because my camera lens broke

This along with the above does raise some questions as to your actual visit to meet in person.

For the interview we printed out 2-3 emails per month since we met, call records from skype and tel-3, my plane tickets, reciepts from different events we attended together in June, and pictures from our civil wedding ceremony that included pics with my family and children.

About this evidence ..

Plane tickets are ok, but you definately need the itenerary and boarding passes to show that you was actually on the plane.

Unless your names are printed on the receipts to events attended, those receipts would be useless as far as proof of being together goes .. the pictures along with the wedding certificate would think be fairly strong evidence that you met in person for one day at least.

At the first interview, Oscar was asked for more pictures.

This may be the root of the issue, you didn't have more pictures to present so you couldn't fulfill the request for specific evidence.

Our answers conincided in everything except maybe 2-3 questions. Nothing I would think that crucial. She asked for more pictures, I explained again why we didn´t have any and she denied our visa.

Hmmm .. what those questions were .. who knows.

Pictures, pretty concrete evidence and she insisted on seeing more pictures at the first interview. Maybe you could have taken a few snapshots before the interview. Hind sight is 20/20

We have hired an attorney at this point, but your input is invaluable to me.
