Here's a list of what I was thinking of sending, would appreciate your feedback on what you guys think:

- last 2 yrs of taxes
- employer provided health insurance info (stating both names, and indicating "spousal coverage"
- beneficiary info for life insurance
- beneficiary info for 401k
- copies of car insurance cards stating both names, dates for the 2 yr period
- copy of joint checking acct statemements for 2yrs
- copy of savings account indicating joint acct
- copy of cell phone bill showing the same 2 lines from the time my spouse (then fiance) came to the US [although only my USC name shown on bill/address]
- copy of itinerary and boarding passes from trip to Europe this yr
- pictures from trip together
- copy of loan info for car we purchased this yr
- pictures, about 10-15 during the 2yr period


You guys think this is enough? I sure hope so! Hopefully I'll get this all together by the end of the week and send of next Monday and add myself to the list.


Here is a list of what I submitted ..

• Copies of my wife and daughter's passports, permanent resident cards, and social security cards.
• Originals of the USCIS reminder letters for both
• Copies of our drivers licenses showing the same home address.
• A brochure for the non-profit country music jam and dance that our family started in May 2008 and have hosted weekly on Fridays ever since.
• Copies of our Food Service Sanitation Certifications issued by the Illinois Department of Public Health which we use for preparing food at our weekly jam and dance.
• Two sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
• Our 2007 and 2008 joint US tax returns.
• Our 2008 IRS Economic Stimulus Payment statement dated May 9, 2008.
• Bank statements from our joint account showing payroll deposits from both of our workplaces.
• 2 voided checks from our joint account with our family picture and both of our names on them.
• A copy of my wife's employers life insurance statements naming me as beneficiary.
• An original form establishing life insurance on my wife and daughter thru my work.
• A copy of health, dental, vision, and life insurance coverage on all family members.
• Copies of health insurance statements for my wife and daughter’s doctor visits.
• Various vehicle insurance statements, cards, and declaration pages.
• Copies of our visa and master cards from joint accounts.
• Copy of our Sam's Club cards on a joint account.
• Copy of our family membership cards at a recreation center
• Copies of credit card transaction details for hotel room purchases for our 2008 and 2009 vacations.
• Copy of my leave of absence insurance paid for with my wife’s credit card.
• Various pictures of our family together over the past 2 years.


I tried to include more than what was required but not so much that the individual reviewing the packet would have a hard time finding the information that he/she considers relevant in establishing that our marriage is genuine and that we live as a happy family unit. My wife was pretty insistent that we also provide documentation that would show that she has never been a burden to society (welfare, etc.), and actually included documentation that proved that our volunteer efforts as a family have benefited our community overall.

I probably did overdo it a bit .. HOPEFULLY NOT TOO MUCH .. smile.gif

I ended up sending Mylene's packet off on Friday Sep. 4, 2009 .. she was actually within the 90 day window the third week of August but very much unlike me I procrastinated so that we could add a few extra goodies that we didn't think about in time to send when the window opened.

I'm very happily married but I tried to do a little research from posts here on VJ and think I may have found your answer..


If you are wanting to waive the removal of conditions you would just return to phils and the GC will expire on the exp. date found on the card.

If you are looking for a divorce waiver there isn't one, all you have to do is check the appropriate boxes on the I-751 and submit ample documentation to support your claims (abuse and/or good faith) along with all of the other documentation that everyone else is filing.

Could someone please verify this?

Sometimes the forms, instructions and rules written by the government are vague, ambiguous, contradictory and even incorrect* that's why these can be interpreted a lot of ways that lead to our confusion.

The instructions in the older packet say that documents must be "current". What may be current to us may not be considered current by the embassy. To play it safe, Manila thread suggests for documents to be 6 months old or less for it to be considered current. If your I-134 and other support documents are 7 months old at the time of your fiancee's interview, I would personally think that to be okay but not sure how the embassy would feel about it as we have not had anyone report that they were put on AR because of older documents. But then again, the embassy does not tell the visa applicant the reason for AR (except when they ask for co-sponsor) so we really do not have a way of knowing. We've heard reports though of the embassy directly requesting NSO for BCs and Cenomars even if applicants submitted them already. Not sure though why submitted documents were not acceptable to them that they have to order another one. Was it older? Did they suspect it to be fake? We don't know.

In your case, if you feel comfortable with a 7-month old I-134 and employment certificate, by all means, have your fiancee use that during her interview. But have another one made if you are not comfortable. It all depends on how far you are willing to take a risk. Ultimately, the decision is yours to make.

*An example of incorrect info given by the US govt/Embassy can be found in the instructions contained in Packet 4. Embassy states that BPI will validate the DS-156 form when in truth and in fact, it is the DS-157 that the bank validates.

Thanks so much for your reply PW .. your information is ALWAYS insightful as it is generally based on past experience and fact.

I will not commit either way at this time, but am leaning toward getting a new letter from my employer and bank depending on what the Embassy has to say about it Monday morning, Manila time. I think it is best to request the definition of current from them as it is a "gray area" in the forum .. I will post their statement here after contacting them.

Hi Donnie and Maylene,

I will answer your query based on my experience.
My fiance sent me his affidavit of support and its supplemental documents such as employment, insurance and savings certificates, 5 days before it is in its 6 months. He sent it to me Nov 27, 2006 and i had my interview last May 22, 2007 and good news we were approved, got the pink slip! Right now we are waiting for my visa to arrive hopefully soon next week. I also agree to what PW posted here...hope this would help u though :) .

I had my interview April 20. My husband brought with him all his "current" Affidavit of Support Documents: 2006 ITR, 2007 employment/business, bank and Insurance records. We have a copy of the Affidavit of Support (I-864) including documents that we submitted to NVC (December 2006) and a new AOS form and documents for 2007. CO was impressed of course as we are updated and well-organized.

do you have a document to reference that says, "the recent dates the better" ?? or perhaps one that says proof of support documentation must be no older than 3 months? or 6 months? or 1 year? (the I-134 says 1 year, so does the K-1 Visa Guides here)

I appreciate your imput, but I would much rather have concrete statements based on fact which can be backed up with experience or documents stating an actual timeline .. not "the recent dates the better". If someone has been put on AR because of support documents being "too old", then I want to hear that.

Mylene often gets worked up over people's opinions being posted on VJ when reasonable people take them for what they are worth, the paper that they are written on. I would rather have the ones that are written on paper as established by the US Government.

Obtaining some of these documents are very time consuming and I don't look forward to getting them again.

Could someone that knows the TRUE answer to this question and can reference materials or experience please reply to this question.

First of all let me say, I hope it turns out much easier for you than it did for us ..

Next, you seem to be in a rush about the police clearance .. as you should be since the consulate already has your packet. Everyone I have talked to that has needed a police clearance from Japan has had to jump thru hoops to get it, and I have never heard of it taking less than a month and a half to get it back.

Whatever you do you need to get it done quickly, if you find that you are required to have the request for police clearance from the embassy then you should personally call the embassy to request it as it seems that the people working there are much more receptive to the petitioner; perhaps they can make additional arrangements since your fiancee lives far from Manila and it would be inconvenient to personally pick up the request from the embassy handling the process of her visa .. but this is just a guess.

Good luck with this issue, you will need it as the whole process stinks to high heaven.

My fiance is required to get a P.C. because she was in Japan a few years ago for six months. We both called the Japanese Consulate in Davao as everyone says that is the procedure but when we both call we got two different stories on how to get the P.C. First they say just come down and bring her passport. Then she calls and they say she has to go to Manila to the Bureau of Immigration to get the departure and arrival dates?

I don't see why they need this because they are just going to run her name through their records system in Japan to see if anything pops up. So why go to Manila for this other stuff?

Anyone have any insight to this? It seems like every other day some other requirement pops up or is changed or nobody agrees on how it is done.

Mylene (CountryGirl above) had to get a police clearance from Japanese Embassy as well .. here was the procedure we had to use to get the clearance ..

Because the police clearance takes 1.5 to 2 months to get back, we tried to get the clearance very early.

When she went to the Japanese Embassy they told her that they will only entertain a request for a police clearance from the US Embassy;

she then went to the USE and asked for a request to present to the JE but they will not give it out until her case has been forwarded to the USE by the NVC.

We waited for a few months and once the case had been received by the USE in Manila (electronically) Mylene called and requested an appointment time to pick up a request for police clearance.

She was given an appointment the next day early to see the person at window x; she was told to bring her passport, NOA-2, and case number.

The next day Mylene went to the USE and picked up her request for police clearance; she has to insist to the guard that she had an appointment to see the person at window X; this was the most difficult part, getting past the guard.

She then went to the Japanese Embassy and presented her request for police clearance, they made her go to Camp Crame to have her fingerprints taken (they give her a request) and also gave her some forms to complete in triplicate. (go as early as possible so that she can do both of these in 1 day).

When she returned from fingerprinting and presented the request for police clearance, forms in triplicate, and fingerprints .. she received a receipt number. She was told to start calling in 1 month to see if the clearance is back yet, it has been over a month and nothing yet.

After a month and a half of waiting, Mylene received her police clearance from the Japan Embassy today. She was told by the Japanese woman at the embassy that she was not to open it. The Police Clearance is in a sealed brown envelope and says on the front,

To be opened by the addressee only. To return this police certificate unopened to the issuer should it not be submitted to the addressee.

To the authorities concerned, United States of America.

Perhaps somebody else can confirm, but the I-751 only requires your wife's children (so only her 21 year old son), as your wife is applying to remove conditions, and it is she that is submitting the form.

My wife (the conditional resident) and I (the U.S. citizen) are filling out the I-751.

 

We have NO children conceived by us together or adopted children or any children living with us.  From a prior marriage in China my wife has a 21 year old son and still lives in China.  I have two adult U.S. citizen children from a prior marriage.

 

In I-751 Part 4, I will be listing all three children from our prior marriages.

 

My question is on my son:  He was born on an overseas U.S. Air Base while I was stationed there.  He is a citizen by birth.  He was issued a Form N-560 Certificate of Citizenship.  This Form N-560 has an ?Application No. Axx xxx xxx.?  It looks like an alien registration number but it is called ?Application No.?

 

Should I list my son's Form N-560 Application No. in section 4 where it asks for a child?s Alien Registration Number (A-Number)?

Removing Conditions on Residency General DiscussionSecond Biometrics Appt.

I am the USC.  My wife completed her biometrics 2 weeks ago.  However, she just received another 797C scheduling her for another biometrics appointment early March.  Reason given her was, ?FBI was not able to process your fingerprint card.?   I'm not comfortable with the 6-weeks delay this brings, so hopefully somebody can help with these 2 questions:

 

1.  Can she go to the local Sheriff?s office and execute a fingerprint card there and take it to her second biometrics appointment?  This would only be precautionary on her part in case her prints aren?t good again by USCIS.

 

2.  Last biometrics appointment there was a large waiting room but only about 5 or 6 customers waiting.  So I was wondering, could we re-schedule for an earlier appointment or even maybe just walk in?  Anybody done this?

Hello, VJ community!!

October 28, 2013 we attended the U.S. Embassy of Phnom Penh, Cambodia for my wife's CR-1 Visa interview. 

The last step in the process!!!!!
...wait...

No.

 

Our interviewer was young and seemed really frazzled.  The single and only issue he was concerned with was our wedding happening days after our first in-person meeting.  Fact is, we'd known each other for 9 months already; we had mountains of evidence proving both this and for every moment after.

 

We were told to return after about 2 weeks (tomorrow  now) for the result.  Since then, we've prepared affidavits from my wife's mother, father and three brothers stating that they all met me at the same time I met my wife, they have all been in near-daily communication with me and all approved of our relationship from day 1.  (I'd even asked her father for her hand in marriage - which is reflected in his affidavit.)  All affidavits were prepared in English and scribed by each family member by hand & signed with telephone number included.

We have also contacted the Embassy to inform them of this (as well as involving my Senators) and that every family member, especially her mother, are willing/wanting to attend the interview should the interviewer wish it.

We received near-instant response from the Embassy stating this wouldn't be necessary but thanks to everyone for setting time aside for it.  (It was a rather nice response, really.)

 

So, tomorrow our fate rests in the hands of the frazzled young man we faced 2 weeks ago. 

We, and so many others, believe that the fact we have been asked to return versus being simply denied is a great sign.

But, as I always do, I like to be overly prepared for the best as well as always prepared for the worst. 

 

So today we go again to ask for blessings from the unseen as well as from the many blessed living.

And any prayers from all of you great community members is of course appreciated!

On November 13, the Embassy called my wife and asked her to return at her leisure on Monday, Tuesday or Wednesday of the following week and to bring her passport.  As Monday was a holiday and the Embassy was closed, she visited today, November 18.  Upon her arrival, she was given an appointment set for a few hours later.  Her passport was taken and the necessary papers were fixed up; her visa would be ready on November 22.

Hello again, VJ community!

Felt the need to update from my previous topic

 

Our 2nd visit (a second interview, really) after our initial one 2 weeks prior came and went.  The specified time was moved back 2.5 hours, which just added to the worry; having to wait an extra long time while watching/listening to others get denied was dreadful.

 

We ended up having a much more specific interview separately.  As I went first, I did my best to overwhelm them with information so they didn't even have to ask many questions.  The questions asked were rather generic anyways.  The two men who did the interviewing were fantastic.  They were incredibly friendly and we did a lot of joking around.  Before I swapped places in the private room with my wife, the two commented on the preparation of every document as it was done much better than any lawyer they'd seen.  (This made me happy.)

 

My wife, as expected, answered everything spot on.  I was even called me back in for the ending of her interview just to add in extra jokes and laughter.  Everything seemed to be fantastic.

 

The downside. 

Due to this 2 week delay in a proper interview, she may not be granted the visa in time for our flight.  (Assuming the visa is issued.)

So, assuming it is issued and later than hoped, it means a lack of support flying together (her first time) as well as a financial loss.

 

I pray things are well and in our favor.  We'll find out through a phone call from the Embassy tomorrow; they will inform us of whether or not the visa will be issued as well as the date to visit again for the visa.

Hi. My wife's biometrics appointment is scheduled for next week, but we were wondering if she could get them done today?" Any suggestions, tips, or advice on what to say or how to approach "them"?...sounds good to me.. star_smile.gif I think that was my pitch except it was for my biometrics. Just be polite and smile.


I never had a problem with mine . I did it..1 week earlier. At first I was told they don't take 'walk ins'. I was also asked if I had a valid reason. I said there was a conflict with my schedule. He asked me if I can provide proof. I just stood there and didn't show anything innocent.gif ..then he asked for my appointment letter, green card, and ID and told me to fill out the form. While he was looking at my ID he was telling me that he decided to take me because they were not busy that day but otherwise they stick to the schedule of appointments. I don't know if he was telling the truth..maybe..I guess it depends on which office you go.

yep .. find out the number from the back of the cashed check then click the USCIS/Touches link in my signature to enter that information and find out your NOA-1 (I-797) date of receipt and if you have received any "touches" (these are just date changes, no actual information otherwise until approval).

I got my NOA2 almost 2 weeks ago. I haven't heard from the NVC yet but I need to know about the Support document that I have to send her. I am self employed now. (I wasn't when I filed at first) But the I-134A says that if I am self employed then I have to submit my tax return for last year. I didn't earn a lot of money last year but have a letter from where I was explaining why( I was a full time voluntereer). But I am making ok now. Do I need to get a job from a company so that they can say that I have a ----- anual income? I have 2 ones willing to be sponsors. One is my parents. The other is a rich lady that I know. What do you think? Am I in trouble or or can I still get the visa being self-employed. Thanks for your help. :wacko: :help:
