Others here are better versed in USCIS regulations than myself, but my interpretation of the question that you have quoted above can be interpreted as such ..


IF you have EVER been arrested, detained (held by authorities / like in jail), charged, indicted, fined or imprisoned for breaking a law then you would answer yes.

IF you have ever committed a crime but were not arrested for it then you would also answer yes.


In reference to your DETAINED / DENIED ENTRY statement, without more information as to why you were denied entry I cannot offer an answer. Detained by definition simply means held (as in jail) by authorities for breaking the law. Denied entry simply means that you were refused entry into the U.S. This being said, unless you were denied entry because you violated a law or an ordinance then your answer would be NO.

A conditional greencard is a 2 year greencard based on being married, she cannot file AOS until her divorce is complete. ie: she needs to have an actual divorce decree (legal documentation) she may have adjusted her status, but she still needs to remove the conditions of that status (ie: her 2 year to her 10 year greencard) If she files for divorce and the divorce goes through, she can immediately file to remove conditions prior to the 90 day requirement of married couples. She should file immediaely after her divorce decree is in hand despite that 90 day requirement of married couples.

I'm pretty sure that you will have to at the very least know what his actual case number is. There is one on the "Verification of Inclusion" letter but it isn't the actual number that is used for biometrics. I have been told by a couple of VJ members that without that number they CANNOT do the biometrics for your son's application for ROC.. simply because they don't have any reference where to enter the information. Hopefully the letter arrives soon.

You might consider calling USCIS and use the "address change" option to get a speaking person on the phone to find out Mathew's biometric receipt number so you can check his case status online .. you might also consider asking if a letter was ever sent out ..

I did just that and they said a letter was never sent out and did give me the receipt number to track the case status ..

just a little trick you might try, my wife and daughters applications both had the same receipt date, Sep. 10.. if you get on USCIS and search for the numbers immediately following your wife's BIOMETRIC receipt number and verify the same date of receipt with the same petition type (CR189) then there is a pretty good chance that the first number you come to will be Mathews .. I did this for both AOS and now ROC and it worked both times (my daughters biometric receipt number this time is 13 after my wifes)..

Sorry Guys, we had a machine shed burn down TOTAL LOSS .. lots of stuff to do !!!

My wife and I took our daughter down with us for a biometrics appointment yesterday and was told that all of her biometric information was transferred to CSC by computer on Sep. 17, 2009. The girl behind the counter showed me the printed information stating this and assured me that a child her age (7 years old) often doesn't even have to do any of it, she actually said that the information from 2007 (AOS) will be used... hopefully she is right !!!!

Wondering now if I will get a refund for my daughters biometric fees .. hmmm ?????

Just kidding, I know it won't happen !!!!

My wife has really been sweating this one !!! Her biometrics appointment is for Monday afternoon and it is now Friday (3 days before the appt.) and we still haven't received my daughters biometrics appointment letter ..

UGHHHH WHAT ARE WE GOING TO DO ??????????

Well, I just got off of the phone with USCIS and explained the situation to a customer service rep and he said, "Just take her along and they should go ahead and do her while you are there." I then explained that everybody I have talked to said they got appointment letters for their minor children as well and at the very least I thought I should have her biometrics receipt number when we go, he replied, " Please hold while I research your question." About a minute later he gets on the phone and says, "I am going to have to escalate your case, will you please hold again?" About 15 seconds later another individual answers and I explain the situation to her, she asks for my daughters A# and looks up her case.. She then tells me my daughters biometrics receipt number and tells me to go online at uscis.gov and print out the case status page and to present it on Monday when my wife has her biometrics so they will do my daughters biometrics at the same time. WHEW !!!!

Well, for now it seems we have the problem solved but only time can tell what Monday will bring. I'll let you know for sure when I know for sure ..

that is what we did for my wife and daughters removing of conditions and both were approved at the same time.

My husband & I live in Brooklyn, NY. His appointment is not until Oct.15. We read that going early was easy so he decided to try it. He went last week on 2 different days & got denied. They said he had to come back on the exact appointment date. Although discouraged, we decided to try one more time. We went this Saturday & the manager (I think) was very nice & let my husband do it. So it's worth a try...even a 2nd & 3rd try. Good luck!

My wife hasn't gotten her bio letter yet, but for some odd reason a member whose NOA was dated 10 days after my wifes received his bio letter today... looking at past timelines I am not late, he is just very, very early .. I guess anything is possible.

You can't get the bio done without the appointment letter for sure .. if it gets there tomorrow then go for it OR if you are leaving late enough on Friday and the letter arrives that would work too, however just showing up without the letter is out of the question.

Even if you don't do your bio until you get back then you'll only be 2 weeks later in the entire process. To be honest with you, chances are your actual bio appointment will probably be scheduled for a date after you return anyways..

I went a month earlier and they accepted .
Go there on weekdays ( but Monday is closed ) early in the moring.
I went there at 9am and very few people were there and it took me only a half hour.
Don't go there on Saturday at noon. It was so crowded and it took me THREE HOURS to get done.

I called this morning and asked that my call be escalated so I could speak with an immigration officer, she said nothing to worry about and about 2 hours later we got the email for both of them ..

In reference to the following post ..

Are there any other filers on the list from the Denver ASC office that can say how quickly after their NOA receipt date their Biometrics appointment was scheduled? I know this information isn't necessarily a way to get a set in stone date, but it should give some indication as to a trend. I'm sure there is some way to find this information from the board but I am not as "board savvy" as some here are..

I send my wife's in the day before Labor Day weekend and I got the NOA today but I paid with a money order which in the past sped the process up at least a couple of days .. I'm sure you'll get yours very soon indeed ..

Got my wife's NOA (I-797C) today .. got my daughters Verification of Inclusion of a Dependant letter yesterday.

Case number is not working yet but the NOA says .. "Upon receipt of your ASC appointment notice, you can find the status of your case on-line at www.uscis.gov." so I'm not too worried just yet. Is it normal for the case number not to work after receipt of the NOA?

Yes I got both notarized .. I used the exact same affidavit that is posted in the example forms at ..

I had the two individuals write up in their words what they would say in covering our marriage, activities, family life, my relationship with her daughter, and if the person believed that our marriage would last .. I then typed it onto the form above and gave it back to them. One took it to their bank and signed it in front of a notary and the other went to the county clerks office and did the same ..

- copy of cell phone bill showing the same 2 lines from the time my spouse (then fiance) came to the US [although only my USC name shown on bill/address]
- copy of itinerary and boarding passes from trip to Europe this yr
- pictures from trip together
- copy of loan info for car we purchased this yr
- pictures, about 10-15 during the 2yr period


You guys think this is enough? I sure hope so! Hopefully I'll get this all together by the end of the week and send of next Monday and add myself to the list.


Here is a list of what I submitted ..

• Copies of my wife and daughter's passports, permanent resident cards, and social security cards.
• Originals of the USCIS reminder letters for both
• Copies of our drivers licenses showing the same home address.
• A brochure for the non-profit country music jam and dance that our family started in May 2008 and have hosted weekly on Fridays ever since.
• Copies of our Food Service Sanitation Certifications issued by the Illinois Department of Public Health which we use for preparing food at our weekly jam and dance.
• Two sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
• Our 2007 and 2008 joint US tax returns.
• Our 2008 IRS Economic Stimulus Payment statement dated May 9, 2008.
• Bank statements from our joint account showing payroll deposits from both of our workplaces.
• 2 voided checks from our joint account with our family picture and both of our names on them.
• A copy of my wife's employers life insurance statements naming me as beneficiary.
• An original form establishing life insurance on my wife and daughter thru my work.
• A copy of health, dental, vision, and life insurance coverage on all family members.
• Copies of health insurance statements for my wife and daughter’s doctor visits.
• Various vehicle insurance statements, cards, and declaration pages.
• Copies of our visa and master cards from joint accounts.
• Copy of our Sam's Club cards on a joint account.
• Copy of our family membership cards at a recreation center
• Copies of credit card transaction details for hotel room purchases for our 2008 and 2009 vacations.
• Copy of my leave of absence insurance paid for with my wife’s credit card.
• Various pictures of our family together over the past 2 years.


I tried to include more than what was required but not so much that the individual reviewing the packet would have a hard time finding the information that he/she considers relevant in establishing that our marriage is genuine and that we live as a happy family unit. My wife was pretty insistent that we also provide documentation that would show that she has never been a burden to society (welfare, etc.), and actually included documentation that proved that our volunteer efforts as a family have benefited our community overall.

I probably did overdo it a bit .. HOPEFULLY NOT TOO MUCH .. smile.gif
