I don't know if they will request all of the missing evidence at one time, or if they will get to the first thing missing, stop processing it, and then send an RFE for that one specific item.

In either case I would recommend sending EVERYTHING once you receive the RFE. You can compile the required evidence now while waiting.

Photos are secondary evidence and by themselves would not have been enough to prove your meeting. Primary evidence sought by USCIS is things like your boarding pass to the States and copies of your stamped passport from visiting here. Receipts from hotel stays or anything else that's sort of "harder" evidence than more touchy-feely photos is good. If there's a photo of you standing anywhere obviously American, even if he isn't in it, include it.

Read the guides here and look around the site for what other people sent in for evidence.

When my fiancee calls me from the Philz, she uses a pre-paid SIM card. When I call her, I use the Yahoo Messenger w/voice telephony. Does anyone know if there are records of these kinds of calls anywhere?



If you are actually calling your fiancee's phone then you are using the Yahoo! Voice Phone In/Out service and you can download all call history from http://www.voice.yahoo.com .. log into your account and click on the history tab I believe ..

by the way, you are doing it exactly opposite of the way I do it .. she calls my cell phone from her computer and I call her computer from my cell phone using yahoo! phone in/out service .. free for me to call her as long as I don't go over minutes, 1 cent per minute for her to call me .. to call her cell phone I use mobilecaller.com phone card because it is cheap,easy, and clear

if you are just using voicechat (pc to pc) then there is no record of calls .. Mylene and I took several screen shots of us chatting with each other and our kids using this service (the date and time is displayed on the webcam/message window showing the current connection), we also made screen shots of message archives, etc.

prepaid sim cards have no history as far as I know, but you can show them from your phone in or cell phone records as incoming calls.

You said "Well, it is coming up to 30 days now since NOA1." .. looks to me like it is more like 90 days if your receipt date was Feb. 2.

I certainly hope that you haven't made any non-refundable deposits.

You can expect some extra scrutiny during the second process. You need to file an waiver ( free) that is basically a statement that you are filing for a second ( or more ) beneficiary. I don't think they have a form for it. Look in the IMBRA forum to see sample of what you have to write. Make very sure that your new wife to be knows all about your ex and any bumps with the law you may have had.


My fiancee (Yani) is very aware of my ex wife, I actually met Yani 3 days after I met my ex wife on a dating site back in Sep. 2006 and I just chose the wrong one. Yani and I chatted casually while I was preparing my exes documents (she did chat with my ex wife too during this time) and once my ex got to the country I stopped chatting altogether. Late last year when my wife was gone for days I logged into my account and was only logged on just a short time and Yani said hello, after all these years she hadn't forgotten me.. she was the one that helped me get thru the times when my heart was breaking and the ex was running around all the time. I made a mistake the first time but now I can make it right.

We never had any bumps with the law during my marriage.

If the previous I-129F was the only one you've ever filed then you don't need an IMBRA filing limits waiver. It's been more than two years since your previous petition was approved. If you HAVE filed another I-129F (whether or not it was approved), in addition to the previous one, then you need an IMBRA filing limits waiver. You just include a letter asking for a waiver of the IMBRA filing limits, and explaining why you believe a waiver is justified. Unless you have a criminal record that falls under the IMBRA then the waiver will likely be approved. There is no special waiver request form. You just write a letter. Read the I-129F form instructions. This is only my 2nd I-129F Petition (or petition any kind)

You can file a petition as soon as you've met the requirements - divorce is final, you've met your fiancee face-to-face within the past two years, etc.We have yet to meet face to face but have been chatting for a while and I will go to phils soon to meet her and her family. There is no mandatory waiting period imposed by USCIS. Make sure your divorce is actually FINAL. Legally separated in Dec. 09 Divorce final in Aug. .. no waiting periodIn some states, the divorce doesn't become final until a mandatory waiting period has expired.

You can expect some extra scrutiny, especially at the consulate stage. Your first wife lifted conditions on her green card late last year, and you're already divorced and looking at petitioning a new fiancee. This is easy... when she lifted her conditions she didn't need me anymore; she started leaving for days without calls or texts, she stayed with her friends in the bar till all hours of the night leaving me to care for her child (which thank god I didn't adopt), etc... She said she got bored with me but she is only 6 years younger than I.. what can I say, I am just a simple person and I found a simple lady to petition this time. They may suspect you're doing this to help girls immigrate to the US. If your income is low then they may even suspect you're being paid to do it. I make over $75,000 per year and provided proof of support from the bank that I had a balance over $60,000 in my main checking account for my ex wife.If, by any chance, you happen to be disabled and these girls are nursing school graduates then you can probably expect them to crawl up your tailpipe with a microscope looking for evidence of fraud. I am Temp Total Disabled but she isn't a nursing student.. Bachelors of Science in Commerse Hopefully, none of this stuff applies to you, and you'll sail through. Good luck! Hi, in my experienced 6 years ago I had my misspelled name corrected. I went to the civil registrar to file "correction of entry". They can give you information or advise how to process it especially in your fiance's case family name is different from her father's last name.

the "consulate listed" means the country where your fiance resides or lives. the NVC will send the consulate of the country where your fiance lives and then the embassy will send your fiance a letter that states she need to appoint an interview.

I am so happy that my I-129F was approved. But I am wondering about the consulate and priority date. On the NOA2 the Priority Date in blank, and nowhere is a consulate listed.

When I checked the USCIS case status site I had this message:

"Post-Decision Activity
On June 10, 2010, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."



I received the NOA2 in the mail and it said this:

"The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about visa issuance, or if you would like them to forward the petition to a different consulate. The petitioner can also file Form I-824, Application for Action on an Approved Application or Petition, with this office to request that we notify another consulate of the petition approval for visa processing purposes. THIS FORM IS NOT A VISA..."

That is the problem, there was no consulate listed. What does that mean? Should I worry about this, or will NVC tell me later where they send the papers? What about the Priority date that I don't have? Thank for any help.

You might want to have a 2nd set ready, in her hand, just in case.

'Forced to by the authorities' - without that 2nd set, IMO, could take up to 6 months extra. Forcing is painful. Not trying to scare ya, but GUZ IV is a hard place. No - I'm not saying 'better safe than sorry' - is easy thing, really, if you meet the income requirements.

W-2 income is easiest, always - so if you have any gov pension or disability, or disproportionate amount of non-taxable income - you'll need to be able to show the source and it must be continuous (for the future).

If you do go with the appraised value on the house, - you'll need an appraisal, from a licensed appraiser - and 'to generate that documentation' is never, ever, free.

I now understand the poverty guidelines of $18,212 is required for a family of 2 which will apply to me and my future wife. I also now see that my govt. pension (which is permanent) of $25k+ meets this requirement. I have already requested my tax transcripts for the past 3 years and of course I still have my W-2's for the same period. I am a recent federal retiree so I have not yet had a full year of retirement income, but this I won't sweat because this income is steady and permanent until I die. The income will only increase in the future with COLA's. After the Office of Personnel Management (OPM) determined what my final pension amount is, they sent me a letter to notify me that I will receive $25k+ from them. I will attach a copy of this letter along with the tax transcripts to the I-134 before I mail it to my fiancee.

But now I wonder why you say that Guz IV is hard. Needless to this, this worries me. Is there a Guz I II & III that may be better? I am honest and straight about my answers on all forms. I have nothing to hide, and I try to research so I can provide the authorities the info they require. But now I'm worried about GUZ IV.

The 'stand up evaluation' done at GUZ IV, on interview day, is done , using the computations and requirements from the I-864. There's some clear language in the I-864 about using a house - you absolutely have to have an appraiser's appraisal document attached to the I-134. I know of no way 'around' this requirement. Not to say it doesn't exist, only that I don't know of it.


Thanks for letting me know that. I will have to read the instructions for the I-864 more carefully. Anyway, it does seem I have the required income. So I won't be using any other assets unless forced to by the authorities. This is good information to know nonetheless. thanks.

You're fine. I would simply state and document the income and leave the asset portions of the form blank. Your income is close to double what is required for a household of two.


I guess I worried too much for nothing. As savings, property, etc. were asked, I see I erroneously assumed it was mandatory to answer these questions. You did not say what your household size is to properly determine if the amounts given are correct.

Let's say you earn $2938 a month total including dividends in the form of the annuity, then your yearly income is about $35,256 assuming no significant losses from investments or businesses.

Then you can look on the I-864P Poverty Threshold guidelines at USCIS and see you are able to cover yourself and fiancee which only require $18,212 with substantial margin. Even if you have more dependents you will still be very safe.

You should not mess with the house. It is unneccessary.

If you NEED to depend on the home's value to help you qualify, then you should find a qualified cosponsor. Maybe you know one who is also a licensed appraiser. For people with qualifying income that is marginal, they can save some money using the tax assessment. Of course, it's not accurate but it is generally considered to be less than actual value, if recent. Even if discounted 20% in the Consular officer's mind, it will serve the same purpose. They don't believe you'll liquidate the house to support your spouse but they'll get it that your low income is sufficient with no housing payment.


My regular government pension brings in a gross total of $2,138 per month. I also receive an $800 monthly annuity form my Thrift Savings Plan (govt. version of 401k). The $800 monthly annuity can be varied (or canceled) if I so apply to change it to another value. The regular government pension of $2,138 is permanent until I die. Is this enough for the I-134? Will this later satisfy the I-864? If this is enough, then I won't bother with home value, savings amount balance, or Thrift Savings Plan balance. Thanks to everyone who have replied so far.

I am preparing my I-134 to send to my fiancee. I want to list my home on the form. The mortgage is paid off. I have already obtained from my County Clerk's office certified copies of the Satisfaction of Mortgage and the Deed itself. But I need the value of my home. So my question is this: Can I use a free online service like Zillow.com and use their "estimate" of my home's value and send that print out with my form? Hey, it's cheaper than an appraiser. This whole thread was about taking action. I blew 3 week wait time by ASSUMING NVC was doing their job right. And you know what happens when you ASSUME. :bonk:

I suggest one more thing - an evolution of relationship letter. EOR

You should cover, among other things - the COMMUNICATION ABILITY between you two. NOT so much which mediums you use - ie telephone, IM, email, postal mail, but in WHAT LANGUAGEs, and her ability for English, your ability for Mandarin/Putongha/Hokkien/Cantonese/her local dialect.

GUZ IV 'dings' interviewees about COMMUNICATION ABILITY, will either send blue slip or white-slip-outright denial (not a bonafide relationship) - and the EOR is useful.

Most people have that notarized - some do it in USA (easy - go to bank, get notary stamp) then some ppl do it at GUZ IV unit during the ACS appointment.

The 'end game' is when she hands it over to the VO, on Interview Day. If the USC fiance is there in Guangzhou with her - hey ! give her yer passport - she hands the passport over with the EOR letter folded lengthwise inside of it, to the VO.


Thanks for the two suggestions. The EOR should be easy. I have plenty of time to do that. I'll have to look into the Venn Diagram©. Sounds interesting. Lastly, I read further down on the OP-169 and it does clearly spell out what she need to mail in. My bad. I'm out the door to take care of business. Thanks again.

O.K., I searched and found the GUZ P3 Shortcut article. Thanks. BUT, being the cynical person I am, I can read the OP-169 in such a way as to make everything self destruct. Not my fault, that is the way they write it. Here is the OP-169 quote:

"Complete and send the enclosed form DS-230 Part I, Application for Immigrant Visa and Alien Registration as well as this document (Form 169) together with a copy of the bio page of your current passport. Obtain the following documents on this checklist that pertain to you. As you obtain each document, check the box before each item. Do NOT send the actual documents to the Consular office except for the Mailing Address Label, as we will have to destroy them. You will not be scheduled for an appointment until you submit these forms."

I see this as:

1. Do not send the DS-230 Part I or OP-169 or passport bio page because as these are actual documents and "we will have to destroy them."
2. Send everything and we will destroy everything except the mailing label.
3. NO appointment until you send forms, but if you send forms "we will have to destroy them." Except for the mailing label.

So what is she supposed to send once GUZ mails the P3 to her? I think DS-230 Part I, the checked OP-169, copy of Passport bio page, and mailing label. Is this my Final Answer? I don't know, I'm confused. You tell me.

Also, if she sends these things in prior to receiving the P3, she'll be lacking the mailing label which I think is in the mailed P3 that she hasn't received yet, yes? So she'll be incomplete and no interview will be scheduled. I know I am misreading something here. Help me out. :help:
