The I-130 is just to establish a relationship which would make them eligible for the next phase of immigration. Is it messed up on the G-325? If so that could be a problem. The DS-230 is the most important and you need to make sure that all the information is exactly as it should be. I'm sure during the review process you will get a RFE at that point you will submit biometric page of passport, birth certificate, etc to show actual date of birth and that the ds-230 is corrent.


The G-325's are both correct.

I suppose I will wait and not take any actions. Hopefully this will pass without trouble as I'm a bit upset with my mistake and really don't want to be forced into waiting longer.

It's difficult to not be upset (and a bit panicked) right now!

I'm not sure I understand "correct it with the DS-230 intake later at NVC".
Shouldn't the I-130 be 100% correct to prevent any issues?
Or is it OK to forget about the mistake and continue waiting for the later stages without contacting USCIS about the problem?

Hello VJ!

I received my hard copy of the NOA1 in the mail a day ago and noticed the birthday of my spouse (beneficiary) was not correct.
After all my reviewing, it appears I made a mistake on the I-130. :(
I entered my spouse's birthday wrong (for some reason I wrote it a day off...).

Clearly I need to call USCIS about this.
What should I expect to see happen?
Will have to to send another copy of the I-130? (Just the I-130 or more?)
Will this change the RECEIPT NUMBER they have given me?

Please assist.

Hi again, everyone.

I had some more questions!

1a.
For both the AOS and IV Packet, the cover sheet will have a "bar-code". What is this? Where/when do I acquire this bar-code?
Please be specific with response to this. :)

1b.
On the form DS-3032 (80023), I see "Place Case Barcode Strip Here Before Mailing to the National Visa Center". Where/when do I acquire this bar-code strip?
Also, what's the difference between the bar-code strip on form DS-3032 and the "cover sheet" bar-code?
OR, instead of mailing the DS-3032 (80023), should we email it as seen in : http://www.visajourn...il_DS-3032_form ?
Is there a government-designed email form or should this template be used (if emailing is the better way to go, that is)?

For the IV Packet, I am to send an original of the beneficiary's police certificate. When should this be acquired?
I am going to visit my wife (the beneficiary) again in October but I don't expect to have a response concerning my case status until November. (Also, I will not be able to visit again until, most likely, everything is completed.) Should I have her acquire the police certificate then in order for me to mail it with the IV Packet? Or should I wait until a response is given from USCIS then have her mail it to me? (I do not like the latter as Cambodia's mail system isn't exactly great.)
Please be specific with response to this. :)

3.
Third, a photocopy of the biographic data page of the beneficiary's passport is to be sent, not the actual passport itself, correct?
Please be specific with response to this. :)

4.
Next, when sending out the AOS Packet and IV Packet, are they going to two different addresses? If not, should these two packets be placed together into one envelope or separate?
Please be specific with response to this. :)

5.
Lastly, I will be visiting my wife (the beneficiary) in October as mentioned above. I plan on taking printed copies of the DS-230 for her to sign. Should I be taking anything else with me as far as paperwork for her to sign? Aside from the DS-230, I don't believe I need anything else but could be wrong.
Also, aside from the original marriage certificate and original birth certificate, should I be taking anything else from her that I may need to send in the AOS or IV Packets? (Other than the issue with Original Police Certificate as mentioned above in #2.)

Hello, everyone.

I was re-reading the EZGuideSpouse (http://www.visajourn...p/EZGuideSpouse) and had some questions I was hoping to have some help with.
The site states the following:

7) Express mail AOS packet and IV packet to NVC
AOS Packet
a. Bar-coded cover sheet
b. Completed and signed form I-864 by the petitioner
c. IRS tax transcripts for the last three years
(Call IRS at 800-908-9946 to order them for free)
d. Petitioner's employment letter
e. Petitioner's pay stubs for the current year

IV Packet
a. Bar-coded cover sheet
b. 2 Passport-sized photographs of the beneficiary
c. Completed and signed form DS-230 Part 1 by the beneficiary
d. Completed and 'unsigned' form DS-230 Part 2 by the beneficiary
e. Photocopy of the biographic data page of the beneficiary's passport
f. Original/Certified birth certificate of the beneficiary
g. Original/Certified marriage certificate of the beneficiary and the petitioner
h. Original police certificate(s) of the beneficiary
i. Original/Certified divorce decree of the beneficiary's prior marriage(s), if applicable
j. Original military certificate of the beneficiary, if applicable
k. 1 set Photocopy of all the above civil documents


For the AOS packet, this says to submit an employment letter. My workplace does not provide this. Instead, we use theworknumber.com which requires the person requesting proof of employment to log in with an assigned code. Will this be an issue?
Also for the AOS packet, this says to submit pay stubs for the current year. Is this right? 52 pay stubs should be submitted?

Next, for the IV packet, this says to submit Original/Certified marriage certificate of the beneficiary and the petitioner as well as other Original/Certified papers like the police report, etc.
I have heard many times that these original papers should not be sent and should be taken in by hand by the beneficiary into the interview. Could someone give me some clarification on this?


I am hoping to receive some assistance as I am going to visit my spouse next and want to make sure I can have as much taken care of as possible (as the 5 month average processing time is nearing).
I would appreciate any and all help.

Hello again, everyone!

I have a question concerning the DS-230.

#14-18 are questions concerning the spouse (me, in this form).
#19 Father's Family Name ..etc..
#24 Mother's Family Name at Birth ..etc..

My question is this: Is this form asking for the immigrant's parent's information, or the U.S. citizen's? As it's worded, I'm thinking it is the parents of the immigrant who is filling out the form (otherwise it would state "SPOUSE'S", correct?)

Just hoping for this tidbit of clarification!

However, there is one clause in the definition of spouse that if your spouse is a non-resident alien and you choose not to treat them as a resident then you are considered "un-married".

"Nonresident alien spouse. You are considered unmarried for head of household purposes if your spouse was a nonresident alien at any time during the year and you do not choose to treat your nonresident spouse as a resident alien. However, your spouse is not a qualifying person for head of household purposes. You must have another qualifying person and meet the other tests to be eligible to file as a head of household." Based on the quote above, might filing "Single" be the best option due to my situation? (Please read below.)


Additional Information:

I did some brief reading again on the W7 form and it would appear as though I'd need to submit original documents (or certified copies) for verification in order to receive the ITIN.
As we are so far into the USCIS, I'm wondering if this would be a good idea or not. With some luck, we will be into, or maybe even through, the NVC stage within the next couple months. This is the same timeframe given for receiving the ITIN. I'm uncertain as to whether or not sending the documents out at this point is a good idea. [Also, due to the horrid government in Cambodia, the simple act of receiving a certified copy can take a month or even longer - based on experience. And the same goes for the postal service.]


I'd love some suggestions.

As stated, we are not yet even to the NVC stage; she does not have a social security number, visa, green card, etc. As such, she obviously doesn't meet any IRS requirements at all to file.

Due to the above, the only reason she would need/want an ITIN is to file jointly. And that doesn't seem worthwhile at this point.

Hello, everyone, and Happy Holidays!

I had a small question.

Soon, I will be filing my income taxes. I was curious about the filing status.
My wife and I have been married since March of 2011. We are still in "Initial Review" with USCIS and assume that we could still be at this point over then next month or two. That means she is still residing in her native country of Cambodia.
So, when I go in to file my 2012 Income Tax, since we obviously cannot file jointly, should I choose "Married Filing Separately" for my status? If so, will any information be needed concerning my wife?

And how will this differ from all my years as filing "Single"? (Just curious about that one as I've never been married before.)

I don't think I would have made it through the stress without the assistance of VisaJourney. I thank you all!

Beginning this next stage with NVC, I have some questions I am hoping I could get some assistance for.




1. First off, should either of us be expecting another letter/mailed information from NVC? If so, which of us should be expecting it? And will it answer the below questions?

2. Second, when sending the AOS packet and the IV packet, should they be sent together in the same envelope?

3. Third, I have a bit of confusing concerning the documents used for the IV packet and what documents should be taken to the interview.
I am taking information from the EZGuideSpouse VjWiki page --- According to this, original (or certified copies) of the following should be mailed out with IV packet: Beneficiary's Birth Certificate, Marriage Certificate, Police Report.
But, according to the OF-169, "Do NOT send them to this office."
So, should those documents be sent in the IV packet or not?

my other concern is about the police clearance i need to get here in the PI...in the sample packet it says a police clearance from the police authorities from the locality...

but then it was further explained in the site that you mentioned in your previous post..that they require an NBI clearance from a philippine born like me..

is NBI clearance enough? or should i still need to get a police clearance from our locality?

hi BOO. oh im glad to know you are from Pasig. By february we might go there in pasig. Im from cebu. I really hope that i ll get the phacket soon. I have everything prepared,except for my police clearance. I asked louiejane 2903 if she sent NBI only or police clearance and NBI and she said she will send both. What about you? did you already file for your NBI? will you also send both? My problem is: i worked overseas for two years and i know they will ask for my police clearance during those time. I have one, but i got it on 2004. I dont know if they will honor that. If not then ill just get a new one when i go there in manila.

as for the appointment for interview and medical..some get lucky..in less than 2 months they got a letter from the embassy. and some are bound to wait much longer ...i already prepare myself for the worse: (maybe up to six months.. :cry: ) its really case to case basis...

during my sister's time(2001) : it took them only 6 months from the submission of the I-130 to the release of the spouse visa. Back then the flow of the processing isnt this slow and complicated. :ranting:

hi louiejane2903.im happy for you. im waiting for my DS-230. I called the NVC and they said that they already sent the said Phacket . in my calculation i should be getting it by now but i guess there is delay in the delivery of mails because of the holidays. I also have the same question as yours. As what ive observed in other's cases , after the submission of the DS-230 it usually takes like a month or two for them to review and check everything , before they will forward the case to the US embassy in the country you are in. as in our case ( as we live in the philippines), it will be in the US embassy in manila. when the case is already in manila they will send an appointment letter as to when is the medical and interview gonna be. Some got appointment letter within 2 months some even up to 4 months or even longer than that ...and that i wonder how they will assess each case ....

it happened to us as well. when we called the NVC, the operator said that they sent the packet on dec 24, 2006. My agent didn't get the packet till january 16.. almost 1 month. :crying: I was beginning to think that it might have been lost along the way.But thank God my agent finally got it.

i just open my e mail today and im so surprised that I got letter from the NVC which says:

Dear Sir or Madam,

All documentation necessary to complete the National Visa Center's
processing has been received. As soon as an interview date has been
scheduled, the designated representative of this case (petitioner) will
be notified. The US Embassy may require additional documentation at the
time of the interview.

its only been less than 2 weeks (10 days to be specific) since the day they received my ds-230...My question is..does it mean my case is complete @ the NVC and anytime they gonna forward it to the US embassy in manila? this might be a stupid question and i may be skeptical but i dont want to put my hopes high. im expecting a message like Your case has been forwarded to the US embassy of your country or the likes.....or maybe something like Your documents have been reviewed and appoved.i called the NVC but the automated system is not updated yet.i will only be able to talk to an operator on monday..im confused. :unsure:

does anyone of you got this kind of message?hope you guys can help me with this.

thank you so much for all your help with my visajourney..finally im done with my interview and thank GOd!...i was approved :) ..im so happy and very thankful that it went fine.

my interview was at 6:30 and i went to the embassy at 5:am.
didnt remember the exact time when they let us in but i was done around 9:30 AM.

i had my fingers scanned first before the pre-interview others had vice versa.

during my pre interview..the interviewer asked me these questions:

who is your petitioner?
what is your relationship with him?
how did you meet?
when did you meet?
when is your birthday?
you already travelled overseas right?
how many times?
what countries?
how long in each country?

he wrote down everthing he has asked from me and all my answers.
then asked if i have pictures of me with my husband...I just held my folder upright and open the pages one by one so he can see them through the glass window.. it didnt fit when i tried to slide it in.
after that he told me to wait for my number ...for the interview by the CO..

He never asked for any document except for the pictures..But i got everything ready ..

I was so nervous..i can literally hear my heart beating...prayed in silence.

Then my number pops in the screen...THE CO was so nice...she had a big smile made me feel little at ease..

i was asked the same questions the pre -interviewer asked from me..with a one addition: what does my husband do for a living...then I saw she was holding the same paper in which the pre interviewer wrote down my answers..I saw all the documents that we submitted to the NVC..she looked at them one by one..read few words..frown from time to time , looking so engrossed with what she is reading and then smile at me..then looks like she is thinking of some questions she can ask but she didnt...then ask if i got pictures with me...
she never ask for any document but just look at our pictures..this time my folder fit in the little hole of the glass window...she typed something in her computer ..then signed on one of the document that we submitted before..

then told me i am approved..with eyes wide open i asked her again?? did you say im approve maam..she smiled and said YES and wait for your name to be called for the next step..she said have a nice day..I was so happy i said thank you so much maam..couple of times and told her have a nice day too..

GOod luck to others who will have their interview...soon/ in the coming months..
