Short background. Last year I filed K-1 for my fiancee. As we were not ready at that time, I withdrew the petition and the case was "administratively closed" by USCIS "without prejudice." Next month I am headed to China to marry my fiancee. I intend to file the I-130 shortly after I return to the U.S. The longest she and I lived together will be 17 days. The wedding date is set, marriage dinner booked, etc.

2 questions:

1. Does Guangzhou consulate still handle all CR-1's?

2. The I-130 requires PROOF of a "FAMILY RELATIONSHIP" which can include: Any other relevant documentation to establish that there is AN ONGOING MARITAL UNION. Well....

We don't have any joint ownership in property yet, but I guess I can put her name on my condo title and send a copy of the title with the I-130. Will this help?

We don't have the other things either: NO joint tenancy lease, no docs showing co-mingling of financial resources, no common children.

This being said: How does one prove AN ONGOING MARITAL UNION when as she lives in China and I live in the U.S.? I thought about living in China, but too many serious health reasons require my U.S. doctors to regularly treat me.

I thought about using sworn and affirmed 3rd party affidavits having personal knowledge of the bona fides of the marital relationship. Not too hard to do. But what are "bona fides" for this purpose?

What we do have, or will have are:

Photos of us together
Soon, photos of us and other family members together
Boarding Pass copies,
Hotel receipts,
Wedding photos
Wedding dinner photos + receipts for the particulars.
Wedding ring receipt.
a genuine certified and translated Chinese marriage certificate.
Hundreds of emails, and a few snail mail letters
Chat records as we video chat almost daily now.

I think she's taking me to the Police to register my staying with her next month. Don't know if that would help.

But really, I marry her, then a month later file the I-130. Not much time to establish an ONGOING marital UNION. What Can I do? HELP!!!!!!!!!

she's right about the 10 days.

you don't have to send everything that you sent in with the I-130, but some folk do send in additional relationship evidence with the DS-230 e-submittal.

There's a wiki here on EP for GUZ IV - note it's not the same steps for Canada and Mexico.

It's a good thing that she's urging you to do this stuff - you should practice on the DS-3032 with her, nowish.

If you not have any scanner or MFC thingie - tis time to get one, also hire a teenager if you need one of those for technical issues on scanning to pdf.

EP kills the 'dead zone time' between NVC-OUT and GUZ IV Open Casefile TimeTicks (remove 2 to 5 months, yay) and the scheduling is handled at NVC (remove another month, yay) so for a casefile bound to GUZ IV - EP is really useful.

Background: I am the USC, we are filing electronically, AOS fee is paid, we are awaiting IV invoice email at this time.

Question about how to answer question 18. "My individual annual income is currently _________"

I will explain my confusion, and I will give you some sample numbers. If I have a 30k pension and a 401K annuity of 12k that is a total of 42K total income. As you can see, the pension alone is more and enough to qualify.

My tax transcript for tax year 2010 will then say Total Pensions and Annuities.....42K
This line does not separate pension from annuity. But, I am only supposed to use earned or retirement income to qualify.

So what number do I put in for question 18? 30K or 42K?
I will not be sending my W-2's because the instructions say not to if I am attaching a tax transcript. That is the problem. The transcript does not separate pension from annuities.

Our decision is to send in a bit more evidence that we believe to be helpful. Everything that is in the DS-230 email will be taken, in original form, to document intake day and she will go from there. Thanks to all for the useful advice which is much appreciated.

One reason I would not like her to take the docs to the interview is that I understand the VO's at the interview are not required to accept additional evididence. On the other hand, giving them at document intake (1 day prior to interview) is an option. But here again, I don't know if they'll accept additional evidence at that time.

I am the USC and we are about to email the DS-230 package to NVC. We would like to include some additional evidence. Photos of us and my boarding passes from my most recent visit with her. My police certificate to show I lived with her during my stay in China. Printouts of chats we've had since I filed the I-130 back in June.

The problem of course is whether to send or not send. I have read that if you include additional information not required for the DS-230, that this can delay the processing. But others say to send because this is the last chance to include information that the VO can have in their hands to review.

So my question is: When is the best time to give this additional evidence, in the DS-230 email to NVC, during document intake day at GUZ IV or not at all?

Has anybody experienced any delay because they included additional evidence with their DS-230 package?

The basic DS-230 package (without any additional evidence) that will be emailed to NVC will include:
1. IV bar coded Document Cover Sheet
2. DS-230 signed
3. Wife's birth certificate
4. Our marriage Certificate
5. Wife's divorce certificate from previous marriage
6. Photocopy of wife's passport biographic data page
7. *Although not required, 2 scanned passport size photos
8. Wife's police certificate

Any input will be appreciated. Thank you.

*Note: for those of you wondering why I said the scanned passport size photos are not required is because the photo instructions say to provide the photos at the interview. DS-230 photos. You have to scroll down a bit to get to the DS-230 DS-260 part.

Good luck to you both! I was checking airline prices for January as I will be going to GUZ to be with my wife. HOLY COW! So expensive. I thought prices would be down because of the cold months, but I forgot about Chinese New Year. Probably explains the high prices. Again best of luck to you both!

in the grand scheme o things, any checklist that is generic, is really a 'false rfe'.

the staging is weird, as well, as that came in from nvcinquiry@state.gov, and not from nvcelectronic@state.gov

I wish they'd fix that auto-response system for EP filers, truly.

It's broken, I can understand how she'd freak out after seeing that 'send us ds-230' checklist when you've already got it prepped to go. it's an autogenerated thing, not even related to EP.


Ah, so that's what's the "false RFE" everybody been talking about. The wife finally got her auto-reponse email after sending in the P3 package, so she' s happy again. I told her tomorrow she'll get another email from NVC, this one saying "We received electronic documentation for this case. Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed. "

So we wait....

no paid receipt ? i'm learning this is optional, as the barcoded coversheet is only available after the IV fee bill is marked 'paid'.


We have not any instructions to include paid receipt. Our AOS and IV bills show as "paid", and NVC sent "checklist" thingy instructing her to send DS-230, which she did a few moments ago. Only she's crapping bricks now because she hasn't yet received the auto-reply email receipt from NVC for her DS-230 package.

Looks good, I just made a list of all attached PDF's in the body of my e-mail. I do not think the cover letters for the supporting evidence is required! You need to keep the total e-mail size smaller than 25 MB or NVC mailbox will reject the e-mail. Good Luck, Robby


Wow, 25mb? No problem now. I think 8-9mb will be the final size. I'm using the 30-day trial version of Adobe Acrobat X Pro. It does a very good job at smallarizing a PDF document, sometimes I think by 80-90%. Nitro PDF has been invaluable at combining different formatted source docs into 1 nifty PDF file, then I smallarize it using either Adobe or Nitro.

We are about to email the DS-230 package to NVC in 1 PDF file.
Please take a look at the following sequence and advise if this is good or needs adjustment.

1. Bar-coded IV document page
2. Email (checklist) from NVC instructing to submit DS-230 and to place case number in upper right hand corner of each document. This email copy included per NVC.
3. P3 Supplemental Information Sheet.
4. The DS-230, Part 1 signed, part 2 unsigned
5. Mandatory documents, such as birth certificate, marriage certificate, police clearance, etc.
6. Unsolicited additional post I-130 evidence, such as more photos of us together in China, plane/baggage receipts of my recent visit with her in China, notarized statement from me re: adding her to my medical and life insurance, more chat printouts, etc.
7. 2 PDF'd passport style photos (although not required).

Lastly, we are going to include cover sheets for all documents listed in 5, 6, and 7. The cover sheet will be simple, like: Cover sheet Birth Certificate, Cover Sheet Marriage Certificate and so on. Good idea or not??
