are you prepped / is she prepped - for the P3 shortcut ? :D

O.K., I searched and found the GUZ P3 Shortcut article. Thanks. BUT, being the cynical person I am, I can read the OP-169 in such a way as to make everything self destruct. Not my fault, that is the way they write it. Here is the OP-169 quote:

"Complete and send the enclosed form DS-230 Part I, Application for Immigrant Visa and Alien Registration as well as this document (Form 169) together with a copy of the bio page of your current passport. Obtain the following documents on this checklist that pertain to you. As you obtain each document, check the box before each item. Do NOT send the actual documents to the Consular office except for the Mailing Address Label, as we will have to destroy them. You will not be scheduled for an appointment until you submit these forms."

I see this as:

1. Do not send the DS-230 Part I or OP-169 or passport bio page because as these are actual documents and "we will have to destroy them."
2. Send everything and we will destroy everything except the mailing label.
3. NO appointment until you send forms, but if you send forms "we will have to destroy them." Except for the mailing label.

So what is she supposed to send once GUZ mails the P3 to her? I think DS-230 Part I, the checked OP-169, copy of Passport bio page, and mailing label. Is this my Final Answer? I don't know, I'm confused. You tell me.

Also, if she sends these things in prior to receiving the P3, she'll be lacking the mailing label which I think is in the mailed P3 that she hasn't received yet, yes? So she'll be incomplete and no interview will be scheduled. I know I am misreading something here. Help me out. :help:

are you prepped / is she prepped - for the P3 shortcut ? :D

Oh oh. What P3 shortcut? So far what we have done for consulate is this:

Me:
Sent via express mail I-134 with cover letter and these things:
Copy of annuity amount letter from Office of Personnel Management (yes I make enough)
Copy of birth certificate
Updated Letter of Intent to Marry with consulate address on it
Copy of latest bank statement

I sent to her in PDF via email: All boarding passes and these things:
luggage receipts, hotel receipts
copy of credit card bill containing airline and hotel charges
copy of transcripts for tax returns for last 3 years
copy of passport bio pages and visa stamps/stickers
copy of receipt for currency exchanges made at Chinese bank
copy of OP-169
screen images of our video chats with us looking oh so happy and smiling.

Her:
Divorce certificate with translation
Something from the police, clearance I think.
Able to marry certificate
Resume with translation
copy of passport
Her airline receipts, boarding passes, luggage receipts
Her phone bills detailing our infrequent cell calls.
samples of our emails.
samples of our online chats
3 or 4 letters I mailed to her
Photos of us together
Practice copy of DS-230, first half

So what's with this P3 shortcut? Thanks for letting me know.

ok - that was one person. how strange. did you hook up with a supervisor ?

No I did not talk to a supervisor. I was so convinced that they were clueless I just said thanks and hung up. I did call a second time today only a few moments ago. This REP named Gary at least was able to confirm that my file was sent electronically a 2nd time on 7/27/10, and he assures me the consulate has it because he can "see it" on his screen. He asked for and I gave my finacee's email address.

Again he avoided my query about SAFEFILE, so I'm kinda guessing I'm hitting my head against a wall with this. At this point I am happy that GUZ at least has the electronic file and I will email my finacee this info. My plan is to allow the consulate a few days to send my finacee her P3. If she hasn't received anything in a reasonable amount of time, then I will write the consulate directly. According to the Consulate website, they will not actually schedule an appointment until they receive the physical copy of the file which I understand can take up to 3 months. So I'm not sweating an appointment date--much to early for that.

I'm still doing a little burn because of all the delays like "pending administrative review" and "clearance delay" and "oops, they didn't get the email package" delay.

Thanks for all your advice, I appreciate it very much. Just as a side note, in my timeline I will use the 7/27/10 as the "Date Received By Consulate" date.

oh. some clarity. NVC knows 'how' it was sent, SAFEFILE SOLELY or 'DHL with SAFEFILE'. You might have to badger the Tele-Operator to dig, go to 2nd page of screen, or ask for supervisor. IMO, DOS won't know exactly HOW it was sent.

SAFEFILE ain't email.

Thanks for the replies. Still no progress. Probably will just have to wait this out. I called NVC today and they have no clue what SAFEFILE means. I was told that they (NVC) send packages DHL and electronically and she has no way to see from her side if consulate ever received anything. She said when consulate processes my papers they will notify my fincee and she is not aware of consulate policy as to whether I would receive any notice.

Well, I called DOS again a few minutes ago. First the good news, I think. The guy said all packages sent to embassy go Solely Via Safefile because of the other security documents sent. On the downside, still no acknowledgment from GUZ that they have either the hard copy or electronic version of my casefile. Today's DOS rep said that the electronic version is sent only 1 time and was done so in my case on 7/7/10 and was advised to wait for GUZ to set up my file. Huh? The last DOS rep I talked to 2 days ago said she would request NVC to resend the email package. So I really don't know what the heck is going on. This is beginning to look like a 3 Stooges comedy, only this isn't funny--at all. So it's been 22 days since my file left NVC for GUZ. I getting a little worried. MOE LARRY CHEESE, MOE LARRY CHEESE.

I do hope you get SUPER Lucky - ie - the casefile sent over SOLELY VIA SAFEFILE.

If that's the case, then no DHL, no mucking about with China Customs, no longish wait before GUZ IV actually receives the casefile.

I've got my fingers crossed for ya !

Thanks for the reminder. I will ask them if in fact this is how it was sent. Thanks. I'll hope for the best but prepare for the worst.

K-1 Fiance(e) Visa Process & ProceduresLesson Learned on Status Update
Well, I just called DOS human and was told that consulate has not received either the hard copy or electronic copy of my approved I-129F case as of 7/26/10. I had called NVC on July 7 and I was told that my papers were sent to Guangzhou the day prior. So I gave them some time to receive and process the paperwork. My fiancee heard nothing and I received nothing in the mail either. So I called DOS toady. Now DOS has requested NVC to resend by email the electronic package. They tell me to call back next week. Still must wait on hard copy. So I blew 3 weeks blindly believing "action" was being taken on my case in Guangzhou. :bonk:

Moral of the story is keep track of your case and call them every day if necessary. If I had listened to the elders on this board I could of saved 3 weeks wait time. Man this is stressful.

K-1 Fiance(e) Visa Process & ProceduresApplying for 2 Visas at a time?

I agree with the other post, if your relationship with your fiance started after you arrived then you can simply marry and file for AOS. And as far as I know, applying for 2 different visa's is fine. There have been other people that have applied for the visitor visa while their k1 was processing, and some were approved and others were not.

For those others who were denied the visitor visa, can this affect their K1 process?

K-1 Fiance(e) Visa Process & ProceduresCase Number Back on Check

Bank account shows that they just have cashed the check for K1. So which number is actually our case number since there are many numbers on the back of the check?. And none of them started with EAC?. I file the case in Vermont so they said it should be started with EAC.

Please help. Just can't wait until get the NOA1 hardcopy. Thanks.

I read somewhere they were not doing this on the back of checks any more, but I can't verify this. My canceled check, from back in April, did have EAC followed by a 10-digit number. This EAC number was the last of 4 lines that started with "For Credit to U.S. Treasury." It was the same EAC number later printed on my NOA1.

K-1 Fiance(e) Visa Process & Proceduresonce meeting and call me wife
Wow, this is incredible about the use of "wife" or "husband" in chats and emails. Recently to buttress our morale I have, on a few occasions in emails and chats, called my fiancee "my November wife" as I wishfully guesstimate when we will wed. So now I'll just stop that. If it weren't for some being denied for this, I would consider this tactic silly childish rubbish.

K-1 Fiance(e) Visa Process & ProceduresSign Tax Transcripts?

oh my. she's listening to the 001 BBS 'girls' again.

Remind her, please?

Tax Transcript is not tax return.

Tax Return is signed, tax transcript is not.

The girls at 001 are very pesky, you are doomed if yer wife listens to them, on any regular basis.

Also, info there is 'time sensitive' - so ask yer wife if she is looking at something posted from 2005 or yesterday.

Yes, the 001 BBS thing and unfortunately her "sisters" on that board do have some influence with her. My gawd, the things she tells me to send her.

I placated her already with my "proof of residency." She insisted that I must send her my condo deed. I told her the instructions for residency said copies of bank statements and bills are fine (which I sent her). But knowing a little about Chinese culture I know it is important for the man to own his own pad, so I sent her the deed any way. But really, if I send her everything she asks I'll have to rent out a cargo ship.

I will remind her again about the dated material she is reading and that Tax Transcript is not tax return. I like to double check these things here. Thanks for your help.

K-1 Fiance(e) Visa Process & ProceduresSign Tax Transcripts?
My fiancee insists that she read on some net forum, us100 or something that I MUST SIGN my IRS tax transcripts. I sent her, via email PDF attachment, 18 pages of my tax transcripts covering the past 3 years. On the top left of the print outs it said IRS User Short Form Request with the page number on the top right. Nowhere on the form is there a place to sign, so I didn't sign them. I got the transcripts from the local IRS office. I also got duplicate copies via snail mail.

Does anyone know about a requirement to sign these transcripts. I can' t find any such instructions. Can she fail the interview because my transcripts are not signed? I think she is reading her forums and confusing somebody else's deficient forms with mine.

No, I'm not really lazy and cheap. I have plenty of other legit documents to send her and really don't want to struggle with needless tasks like this. HELP!

K-1 Fiance(e) Visa Process & ProceduresWhat is going on in Vermont K-1 visa NOA2 Approval?

Does any one know what is going on in Vermont K1 visa approval? It seem if everything is slow down or stall. Are they changing remodeling or something? It seem to me looks, if everyone file was touch on 10/03/2010 and nothing is done with it since. i wish they will just look at our files and do something with it. I know it not pass the 5 months mark yet, but it be nice if they would touch it once a while. This waiting really sucks... bad.

Sorry peeps, just wanted to let out a little steam.

That makes me feel good to know that I'm not the only one. I got my NOA1 July 17 and noticed that several people got approved in October, but I'm still waiting. My last update is October 3 also. Are there a lot of people who have their last touch listed as Oct. 3 as well? Have you tried contacting the USCIS?

K-1 Fiance(e) Visa Process & Proceduresany updates? VSC

I notice that for the past 30 days Vermont Service Center has gone very slow processing K1-visa, or I can actually say it is at a complete stop.
I don't know if this information is true, but I heard that some employees have been transferred to process other type of visas.

I this information true? Does anyone has any updates when can we expect the VSC to start processing petitions the same way it did before one month ago?

They're going very slowly, but someone from our forum (See July VSC filers forum) just got approved on Nov. 23. He got his NOA 1 on July 13, 4 days before me.

K-1 Fiance(e) Visa Process & ProceduresCan they ask for RFE at the 5th month ?????

On the contrary, I can fret about the 5 month mark for as long as i please, i have complete control over my feelings sorry to tell you and you CANNOT do anything about that as well. The agreed time is 5 months. Lucky for your "good" friend, he's got too much patience to wait for 10 mos. And you don't tell me to move to another country, i have a mind of my own and i'm not even asking for your suggestion in the first place and of course i know how the visa approval process is.

I see that you have the same NOA1 date as me. I agree with you; sure, the 5-month timeline is only a "goal," but most reasonable people understand that it doesn't seem very fair or consistent for some people to take only 3 months and others 8 months when neither had an RFE. I definitely understand your anxiety. You should join the July VSC (Vermont Service Center) forum (see link below); you'll find a lot of people who feel the same way as you on that forum. Godspeed on your NOA2!!!

Here's the forum http://www.visajourn...s/page__st__330

Not sure if this interests you, but it is an option once you are past the 5-month mark. It might be worth a try.

K-1 Fiance(e) Visa Process & ProceduresInfo for those K-1s waiting on NOA2, esp from VSC

Hi. I call December 17, when it was 5 months from my NOA1 July 17, and they told me, i am going to hear from them in 2 days. Today i call again but they told me to call in 15-30 days, because my i didnt hit the 5 months. Today is my 158th day. I told them that is 5 months and 6 days, but the computer do not accept that[158 days is less than 5 months].I dont know if we can believe what the say to us. Good luck. Thank you.

Call them back; that's what happened to me, too. The rep said the computer wouldn't accept it based on the number of days, but she transferred me to an officer who put in a request to VSC.

Thank you for posting your conversation with the USCIS officer. It feels good to hear something very relevant and realistic rather than simply waiting and waiting and reading speculation and rumors from various posts on this site that turn out to be false.

I have just crossed the 4-month waiting mark, and I'm expecting my fiancee's visa will surpass the 5-month mark next month. But I would like to know one thing. How did you reach a USCIS officer on the phone? Which numbers did you dial in their automated system to reach an actual person? Your information is much appreciated.

Type 1, 2, 6. I think it's 1 for English, 2 for case status, and 6 for problem w/ the case. Wait time for me was only 1 or 2 mins.

K-1 Fiance(e) Visa Process & ProceduresInfo for those K-1s waiting on NOA2, esp from VSC

Hi Everyone,

We hit 5 months of waiting for our NOA2 yesterday so I called USCIS today. They were way nicer than I expected, gave me some info that I wanted to pass on to all of you. May or may not be the truth.

The first person I spoke to was very nice but yes, clearly reading off her script. She acknowledged that my case was outside the 5 month waiting period for a reply and said she couldn't access any more information on her computer so she was going to "escalate my call". The next guy I got was not reading off a script and was also very nice. He said that what I see on the USCIS website (check your case status, etc.) actually has some fine print on the bottom that has the "last updated" date and it was currently 10/31/10 so more than likely he had more current info in his system. (Who knew?) Then he told me that USCIS (perhaps he was just referring to VSC) is currently processing K-1s that were filed on 7/10 and that mine was filed on 7/16 (my NOA1 was actually 7/21, but maybe 7/16 is when they received it???) So he said they are scheduled to give me a decision in 6 days. I told him I would be calling back in 6 days if I had no new info and he told me to please go ahead and do that but that I should have a decision in 6 days. He said he was an immigration officer.

Then I asked him about the information that is floating around that USCIS (specifically VSC) is backed up processing Temp Status Protection visas for Haitian refugees and that K-1s have been put on hold for that. He was like "where on earth did you get a story like that?" I told him someone who called USCIS was told that. He said no way would USCIS ever say or do that because the first thing that would happen in response would be that everyone who had filed before the Haitians would start complaining that things were happening out of order.

What do you all think? Anyone hear a story like this when they called USCIS? Do you think there's any truth in it?

Mari

NOA1 - 7/21 (VSC)
NOA2 - hoping for something in 6 days :)

I actually had a similar experience today! I called USCIS 3 times, and the 3rd time was the charm. Today, I got to talk to someone higher up. The customer rep acknowledged that I am out of the processing time but said the system would not allow her to put in a request to check the status at the VSC, so she would have to transfer me higher up the chain. The next lady I talked to was very nice and asked for my email to give to the VSC. She put in a request to see why no action has been taken on my case since July 17 (my NOA1 date) and said I should hear something back on January 6th by email. She then gave me a reference # so that if I don't get a response by that date, I can call USCIS and give them that number. When I called yesterday, the lady did not offer to put in a request, but she did verify what the officer told you. She said that they are working on July 10 petitions and for me to call back in 7 days. Hope this means good news!

K-1 Fiance(e) Visa Process & Procedurescan someone please give me some advice?...or at least calm me down :)
Agree completely with other posters. I had several problems scheduling my interview, and I know that sometimes the embassy system is not up-to-date. For instance, when they receive your case, they may have the case but not have it listed in their system. As long as you have proof on paper with a UID number and date, there is no reason for you to question the interview date. You never would have known it wasn't in the system if you haven't called, and most people wouldn't call since they already had the interview letter, so they would have no reason to turn you away either since you have proof.

Try not to worry too much. I think if you can print something showing you paid for the tickets, including the date of the flights, and if you give them those pictures, it should be enough. Do you have receipts showing where and when you stayed when you were in China? That would definitely be good evidence. Also, I'm not sure if this is possible, but maybe you could contact the airline you used to see if they can give you a copy of your old boarding pass.

My insincts tell me that you would have to answer "yes" to the first question and "no" to the second. But, I'd wait for an answer from someone who has had that experience. It sounds like she was innocent in her intentions, so I would not say that she was unlawfully present or violated her visa. After all, she had a visa, so she was there lawfully; the officers just determined that she was there as an immigrant, not a tourist, which is just a judgment call, not your fiancee's fault.

K-1 Fiance(e) Visa Process & ProceduresK1 OR K3 COULD EVERYONE PLEASE ADVICE !
If I understand you correctly, you're planning to come to the U.S. on a tourist visa and then get married? If so, I wouldn't advise it. If they know you're coming to see your fiancé, they probably won't give you a tourist visa anyway. You'd be better off applying for a K1 visa and getting married in the U.S. or you could get married first in your country and then apply for a K3 visa. There may be some people who come over on a tourist visa, fall in love, and get married, but they have to prove that it was a spontaneous decision, not planned before hand. If you already have a fiancé or boyfriend, and if USCIS knows that you came over here with the INTENTION of getting married on the tourist visa, then they would consider it immigration fraud. A K1 visa would be the safer route, and I think you can still visit the U.S. on a tourist visa while you wait for the K1 to be approved. Keep in mind that even if you already have your tourist visa, they can still deny you at the port of entry in the U.S. if they think you have intentions of staying in the U.S. This article has useful information.

My fiance`& I met December 2010 & we are already applying for I-I29F (K-FIANCEE`)
We been together for almost half a year & the reason i wanted to apply for fiance visa is because I reside in the U.S & Im pregnant with his baby.
With this scenario is it still possible for us to continue our said application, or should we think of other options ?
I would Love for him to be in the U.S by the time im due to give birth . , My due date is December 16 2011 .

K1 sounds like the best option for you. You're not married, so you can't do the K3 visa unless you want to go to his country to get married. I think K1 is faster than the K3 usually, although it varies. I wouldn't count on being together by December, though. I was hoping to see my fiancee (now wife) by Christmas after I filed in July, 2010, but our petition didn't get approved until January, so she finally arrived this March. Check out our timeline, and you'll see that it's not always as quick as 6 months, especially if you file in the summer (one of their busiest times).

K-1 Fiance(e) Visa Process & ProceduresK1-Visa Medical Vaccinations in Manila

Hi VJ members!..For those who already have taken their medical exam or for those who might know, I was wondering regarding the vaccination process at St. Lukes. Are we allowed to get all those shots within that time so that I dont have to take those other vaccinations in the States. Is it safe to receive all the injections in one time?. I remember reading 1 blog here and the lady said she only got 1 injection. However, on the paperwork they required multiple vaccinations. Any input would be appreciated. God bless us all! :)

See chart attached, but note that HPV is no longer required, even though the chart says it is. Depending on your age, you won't need every shot. My wife only got 2 shots at St. Luke's (MMR and Tdap). The only other one she would have needed would have been Varicella (chicken pox), but she told them she had chicken pox when she was young, so they took her word for it and wrote "Varicella history" on her paperwork. If you have records of your vaccines, I would bring them to be safe. The rest of them were not applicable for her age. You can check to see which ones you need by looking at the chart attached.Attached File  Vaccination Chart.pdf   114.46KB   36 downloads

Don,
If I was in your situation I would probably get a lawyer in the Philippines to make sure this isn't not going to be a show-stopper at interview time. But then again I'm just like that.
Gary

Gary,

I have had one too many experiences with the lawyers in the Manila area pertaining to other issues, the ones that came highly recommended before on these separate issues are worthless .. I have been told by people that I trust that the only lawyers in the Philippines worth their weight are female because they have to work so hard to get to where they are.

IF ANYONE HAS DIRECT KNOWLEDGE / PERSONAL EXPERIENCE ABOUT THIS SUBJECT
OR
IF ANYONE CAN RECOMMEND A GOOD LAWYER IN MANILA OR MAKATI PLEASE LET ME KNOW

We had no issues getting any of the other paperwork for my fiancee's daughter to include the passport and other paperwork that I have listed on my website.

Is the decision for this issue made by the Philippine Government or U.S. Government? The reason I ask is that I have some fairly well connected friends in both countries with whom I have the option of calling in a favor, but I hate to use all of my options if I don't have to.

Thanks for your concern and advise.

Is the daughter the child of your fiance? Be advised that you may need the permission of the child's father to take the child out of the country, even if the parents were not married at the time of the child's birth. There may be some pending changes in family law WRT this.[/quote]

Yes, she is the daughter of my fiancee but the father remains UNKNOWN to either my fiancee or her illegitimate child as is stated on the birth certificate, affidavit of illegitimate, and statement of illegitimate.

Thank you so much for your reply, what exactly is the "Consulate Stage"?

Again, it would serve you well to read the guides here

Bill, thank you for pointing out the guides.

I have included everything that I have listed. In the tips page (I think that is correct) it stated that I should attach the passport style pics to the G-325A forms (I actually included my fiancee's daughters pictures with hers) and that some of the documents that I included should be original as opposed to copies so I changed them out.

As far as the current information issue goes, I don't mind getting additional statements from my employer, bank, tax returns, police clearances, etc. before the interview date. I actually have a government job and I know that it is better to have too much information than not to have enough.

Again, thank you so much for your assistance .. any further advise from you or anyone will be greatly appreciated.

My fiancee has been reading posts here for some time but this is our first post.

I believe that thru our investigating that we have completed all required documents and supporting evidence and we are planning on mailing them to the Nebraska Center tomorrow. If anyone is willing to look my list over and make any suggestions it will surely be of help to us both.

If there is anything else I should include, or a document is listed as a copy but it should be an original, or if anything isn't listed as notarized and it should be .. please let me know.

Your submission is more exhaustive than I believe is required at this stage. Not saying it is wrong, but many of these documents may need to be re-presented at the consulate stage...... Any document not in English needs to be accompanied by a translation.

I would only include originals of the I-129F, G-325a's and statements of intent. If submitting originals of any other documents with the petition I would replace with copies and save the originals for the consulate.

YMMV

K-1 Fiance(e) Visa Process & ProceduresSending Originals to My Fiancee
My I-129F package was recieved by "INS Express" on Wednesday and I was wondering some things.

1) if additional information is requested from me, will Nebraska, NVC, or either/both request it? After which NOA is it safe to send original documents to my fiancee?

2) which orginal documents should I send to my fiancee .. HERE is a link to the list of documents that I sent to NSC.

Thank You,

K-1 Fiance(e) Visa Process & ProceduresConfirming Money Order Deposit
Hello again,

I have a question concerning the payment of USCIS fees by postal money order.

I made payment for my petition for Fiancee Visa I-129F USCIS Fee by sending a USPS money order to the Nebraska Service Center last week using overnight shipping.

As the week progressed I was reading the timelines and several FAQ's and it came to my attention that in order to logon to the USCIS website and track the progress of my case that I needed the the case number. In one of the posts someone pointed out that the case number would be written on the back of the cashed Fee check, this brought me to the following questions ..

1) Does anyone know of a link where I can confirm the cashing/depositing of the money order?

2) Is there any way that I can see the case number from the back of the money order to enter it into my logon at the USCIS website so that I may track the progress of my case?

3) Would the advice of those with extensive knowledge on the subject be that others paying the fees do so using a personal check so that this information is readily available.

4) If paying by personal check, does a hold period apply for the check to clear the bank?

5) Other than from the back of the cashed check and directly from the applicant's NOA1, are there any other methods of receiving the case number from the USCIS?

Any help will be greatly appreciated.

Thank you,
Donnie Roach
