Here`s a little question i came across on a totally unrelated subject but which may apply here...

Do Embassies want to see divorce decree or a certified copy of the divorce decree?

My case is already at the embassy having gone through uscis and nvc. Will a divorce decree notarized by a notary public, as a true semblance of the original, be accepted rather than the certified document usually issued from the court where divorce was granted.

You need the certified copy of the final divorce decree. Call the court where the divorce took place. They will tell you what to do. They may charge you a small fee, like $4.00-$6.00. They can mail it to you or you can pick it up from the court house.

I've read here that some people have received RFEs due to overlapping dates in their employment history on the G-325A Bio form. So what are you supposed to do if you had two part time jobs at the same time?

Also, if you've been promoted within a company, should you list the employer twice with a different occupation title, or should you just list the employer once?

Sorry if this seems like a non-issue, but it seems that RFEs can occur over non-issues, so I'd like to be sure.

Congratulations!


After 5 month delay of fingerprint clearance needed thru DHS, LEO Finally got visa last week. We are so happy. Leo has been in US since Friday night and we could not be happier. 2006 was such a stressful, emotional year but I have to say well worth the wait. Today it is snowing (a little) and Leo hasn't seen snow in such a long time. It is so cute to see the big smile on his face.

I resisted for about an hour and a half---but, I can't keep it up. And, I wanted to be in my own posting. We did not go for the checking every day for touches. We just waited it out.

My boyfriend emailed me some time today to tell me that the NoA2 arrived by snail today. The approval date, however, is January 16. I was so stressed about getting an RFE or, as was more likely, asked to try again because we forgot to cross a T somewhere.

But, no: approval instead.

We'll take it.

Last week at work, I was asked how things were going and I put my head down on my desk because the night before the average days between sent and interview had gone up to 215 days! And, it may still take that long, but I don't care about that today.

Yes, I agree. There is no reason to panic. All 4 pages of G-325A have to be filled out, signed, and dated.

It is possible the packet could be sent back, or you could be issued and RFE (Request For Evidence) to send them along. Either way, don't panic. Start now to gather the correct amount of each, they all need an original signature. 4 from you and 4 from your fiance.
Get them while you are waiting since you can't do much else. When /if USCIS contancts you hen you can just take the corrective action they suggest. You can do that for any other things you may have found are missing or not right in the packet you sent.

Good Answers. Just more comments.

1. I would verify whether the British law allows a British citizen to be a dual citizen.

2. Check others and write "I-129F Petition." Both the petitioner and beneficiary need to fill out one set of G-325A.

3. A born US citizen does not have any A number, but a naturalized US citizen does.

1. She can keep dual citizenship
2. Since you will be submitting it with I-129f you can Check "others" and write "I-129F"
3. If you are a born US citizen you can write "N/A" in the A number and if you are natulized then this is the number you had on you green card and the CIS registration number on your naturlization certificate.

You can file I-129F while your fiance is visiting you in USA. You need the final divorce decree singed by the judge whether it includes any financial information or not.


Dear all,
Here is my case and my interrogations.
Our intention with my boyfriend is to apply for a I-129F package. We have planned to send out the application while I’m in the US visiting my boyfriend as a visitor under visa waiver program.
I’ll stay only one month in the US and go back to my country after this period (some people have to work!).

I understand that many couples file the I-129F while the fiance(e) is in the US but does the process is slower than normal?
Do you know if the USCIS is waiting for the departure of the foreign fiance(e) to proceed?
We just want to start the process as soon as possible but if sending out the document bring us in more trouble, perhaps we should wait until I get back home to send everything out? (that means one month later!?!?)

I also have a question concerning the translation of my divorce decree. Do they require only the final judgement saying that I get divorced on XXX date or are they also requiring the paper showing what my ex husband get and what I also get from this previous marriage?

Credit history has no bearing with Immigration process. However, it is good to take care of the car and credit issue. It is not good to forget about parking ticket.

I doubt your license will be suspended or will you they put out a warrant on you over a parking ticket. But if you do park in the same jurisdiction again, don't be surprised if your car gets impounded.

$1100 dollars is alot for a ticket, you can try to negotiate it down, but considering how long you put it off, i doubt the county is going to be very helpful. I've gotten tickets here in Minneapolis that I didn't quite pay on time. I did manage to negotiate them down a bit.

Just inform the consular officer during the interview and he/she shoudl appreciate you to bring it to his/her attention.

Yesterday, I was checking the copies of I-129F packet my fiance sent to Homeland Security. As I was browsing, I noticed that MY place of birth written on the forms was Quezon City, but on my BC it is Manila.. And all the forms I have (eg., school docs, passport, NBI, SSS card, etc). Okay, it was plain typo-error. I was (maybe) abstracted when I was filling out the G-325A form. And my fiance just copied what was on my G-325A to I-129F. The QC on my BC was my mom's place of residence when she gave birth of me. Awww!! Our I-129F application is already approved and we already have case number.. On our I-129F packet, attached were the copy of my BC and passport. Didn't the USCIS browse it and should have put our petition under RFE because of that?

Is this enough reason to be under AR? Any suggestion what we/I can do as early as now so we/I can foreclose this?

Any advice would be highly appreciated.. Thank you!

It is a good idea to send all copies to your fiance so that he/she is aware of all information that were provided by the USC petitioner. Consular officer does ask questions based on the information provided by the petitioner to check whether the beneficiary is aware of those information or not.

Hi, I have a question. I just got back from the Philippines a few days from visiting my fiancee. I went to the US Embassy in Manila and received the I-129F form as well as the G325A forms. The G325A form was with carbon paper, so she could fill one out and the other 3 would copy. After she filled this out, you really can't make out the last copy. By this time we were in Davao, so we could not go back to embassy. What I did was this....I printed out 4 new forms from the site and had her sign and date each form while I was there. Can I fill out all the information for her and submit that, as she did sign each form as well as the letter of intent?? Or do I have to have her download these forms and have it all in her handwriting? Thank You so much!! Chuck

We were wondering if it was allowed for both the USC and the foreigner to be in USA at that time, or if it would be best for it to be sent of like the day after i leave the country or something like that?

Poor form design.

US births are recorded at the local level - county or perhaps even town - each having their own format, numbering system, etc. BC numbers would be next to meaningless. Naturalization certificates, however, come from only one entity - the entity that's going to want to be checking the naturalization file as they process a petition submitted by a naturalized citizen.

Yes, the box is for naturalization certificate number. You don't need to write your birth certificate number. I know, question 10 on I-129F is not very clear. However, if you take a look at question 13 on I-130 form which is clearer on this question, then it will be clear for you:

13. If you are a U.S. citizen, complete the following:
My citizenship was acquired through (check one):

Birth in the U.S.

Naturalization. Give certificate number and date and place of issuance.

and so on. So for your case, you just check "Birth in the U.S. box."

MN birth certificate is a typical one like other states. If James wants more copy(ies) of the birth certificate, he can contant the local county office (Vital Statistics Department). Yes, it is about 8.5"x11". As long as it is issued from the local county office, I would not worry about its size. The copy of the birth certificate is enough proof of US Citizenship.

We have been married for six months and she send me summon about annulment of marriage (based on fraud, which is not exit any where) divorce in alternative. 1. Beneficiary Birth Certificate is not a requirement. The USC is required to send either BC or copy of passport etc to prove citizenship.

2. If you downloaded the form from USCIS or from the link on VJ which is linked to the USCIS then this is the latest revised edition and will be usable for quite some time past that date.

3. Yes.

4. The FC-029 is an obsolete form and no longer required.

5. The embassy address is used for the letter of intent submitted by both of you again at interview stage.

6. The letter of intent on VJ is an example which has been used by many members. You insert/change the words to suit.


Aussiewench and desert fox answered them very well. I have one more ting to add. The petitioner, the US citizen in this case can submit a copy of birth certificate or copy of passport or a copy of naturalization certificate (if the USC was not born in USA). It is perhaps easier to submit either the copy of birth certificate or naturalization certificate (depends on which one is applicable to the USC) instead of copy of passport. One has to photocopy the whole passport which has many pages.

It is the Alien Number. Usually, a naturalized citizen has an A number, but a born US citizen does not have. So if the US Citizen petitioner is a naturalized US Citizen, then he/she needs to put his/her A number there while doing his/her G-325A. The foreign alien spouse does not have an A number. If you don't have an A number, simple write "NONE." Do not leave anything blank. If something does not apply to you, you can write "N/A."

So long as it has the official stamp from where the document was issued (ussually in a colour rather than black ink) you should be fine. most divorce papers look like photocopies except for the official mark so i wouldn't worry smile.gif

I learned somewhere that reason they need to see the three years of income tax return is to make sure that you don't owed any tax to the government. if that year you don't file an income tax return, you must write a letter such as that you don't make enough to qualify to file an income tax return. I guess what the CO want to see was the present income you make. if you don't make enough then you will need to have a co-sponsor.

By the way, I just to add that you don't to have 2 years old relationship to file a petition. You can start right away since you mention that you meet each other last month. At first, when i filed my paper I got confused too. I thought you have to meet in the last two year but actually meet within two years. Ex. I know my fiance for a year but I just met my him in person this past March and I filed a petition in June. So you don't have to wait until 2010 to file unless to you want to. But make sure you find about the legal age that you can petition and the legal age of your fiance. As far as co-sponsor, you can use your dad.

I have a question relate to co-sponsor. For the last few years I work part time, and I hold a full time job with enough income. But since my last fews year of income tax return not make enough, I think I will need co-sponsor to back up. I understand that I will need to file both I-134. I agree with the above. I see no harm. The more evidence the better. If you submit enough evidence along with I-129f now, the CO probably not going ask more at the interview. The important thing you want to show the CO about your true relationship.
