K-1 Fiance(e) Visa Process & ProceduresI-129F question

We're getting ready to file our second I-129F.

Part B, question 9 asks for an A# (if any).

She had an A# for her previous K1, which we used last year. She returned to Russia without marrying me after visiting me.

Do they want me to give them that A# -- or in the context of this new petition does she in fact not yet have an A#, since I haven't yet filed this second petition? I'll need to fill in the G-325A's consistently with whatever I write here.

Thanks for help.

I think, yes, if she had an A number, that should be entered. However, you can use an additional sheet to explain how she got the A number.

K-1 Fiance(e) Visa Process & ProceduresProof of citizenship

According to VJ's K1 checklist it says that for proof of citizenship using a passport
to include

"a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years"

Is that really necessary? There are like almost 30 pages, most of which are blank, with several pages of just passport information.

Can someone clarify if I can just send in like the bio pages, and the pages actually stamped with visa arrival and deptarture date?

Thanks!

Yes, if a US citizen wants to use the passport as the proof of the US citizenship, then copies of all pages need to be sent. But, in order to avoid copying so many pages, one can simply submit a copy of his/her birth certificate (for a born US Citizen) or a copy of his naturalization certificate (for a naturalized US Citizen). Either of these 3 documents will be enough for a US citizenship proof.

I had submitted my naturalization certificate's photocopy for my US citizenship proof and it went perfectly fine.

K-1 Fiance(e) Visa Process & ProceduresNeeding help with the G-325a (biographical) form...

Thanks for all the help, everyone! What I ended up doing was putting "see attachment" in the City box and then affixing a sheet that said, "Attachment sheet for G-325a for section 'Applicant's residence last five years' due to lack of space in box: City: St-Jean-Sur-Richelieu". I had Réjean sign and date it. Now I'm wondering if I should highlight that part on the G-325a to make it more noticeable or if I should just leave it as it is.

Necrotica,

You covered everything.

K-1 Fiance(e) Visa Process & ProceduresNeeding help with the G-325a (biographical) form...

Réjean (Canadian fiancé) is here with me, and he leaves tonight at 8:30 pm. We're trying to get all our forms finalized to send in for the K1 visa, but we have a problem with one part of the G-325a form. Under the "Applicant's residents past five years" part, one of the cities will not fit in the space no matter if it is hand-written or typed. It's a city called "St-Jean-sur-Richelieu". He filled out and printed the forms while I was at work, and he put in the box the partial name of the city and thought it would be ok. Not quite, honey.

So, what should we do? Hand-write the whole name to the right side of that column? Attach an additional piece of paper to clarify? Will we have to reprint the forms and leave it blank with something like "See other page"? I have no idea what to do about this, and we really do not want this package sent back.

I know, we should have finalized this way earlier.

Also, his signature is more of a character than his name... is that going to pose an issue?

Thanks for your help!!! :)

Use an additional page to write any info that can not fit even with handwriting. Write down the items number on the additional sheet, then sign and date on the bottom of that sheet. I had to use an additional page of rmy I-130, but I did not sign it, yet it went through fine. However, I recommend you to sign and date on the additional page. Since a set of G-325A has total 4 pages, I would use microsoft word, type the info that does not fit, print 4 copies out, then sign and date it, attach each page with each G-325A page. He just needs to sign no matter what his signature is, as long as he uses the same signature.

What happens If you send the original to your fiance and it gets lost in the mail.... would they still accept the copy of it.

Thanks
Shalz

If you want to send it along with I-129F, then a photocopy is fine. Usually, they don't ask for the original approval during the interview. But, of course, it is better to have the original. Call USCIS customer service (misinformation line?) line to see, if they can help you get an original.
Well, the simple answer is, it depends on what the felony conviction was.

If it is an IMBRA related conviction, it will probably cause delays and potentially a denial. Again, it all depends on the conviction.

IMBRA = International Marriage Brokers Act

You can read about it on the site.

Hello!

My fiance has a felony (he is the U.S. citizen). Does anyone know, if that might be a problem?

Thank you!
Miriam
Yes, if it is an IMBRA related conviction, then it can cause delays. Again, it all depends on the convictions. BUT, it does not mean a denial. The law allows the consular officer to share the petitioner's convictions and criminal histories with the beneficiary, if the CO thinks it is necessary to share them. Of course, if someone has convictions after convictions, it will definitely be a concern and the petition can be denied, if it is a grave concern to USCIS and DOS. But if someone has only one conviction, I don't think they can deny the petition, although it can lead to extra checking and some delays. If someone has a conviction, then he/she should disclose it to the USCIS when filing the I-129F.

K-1 Fiance(e) Visa Process & ProceduresReligious wedding first?

Thanks again for your replies. We wanted to get church wedding right after i get K1 and before i enter the US for the civil one because we don't want to live together as a couple if we havent had religious wedding first, it's tradition for us, and my parents would disaprove it otherwise, but due to the circumstances, they would have to deal with it.... I understand we're under a special situation now.

I have a new question, if i enter the US and do civil wedding first, after around how long will i be able to come back to my country and perform the religious one?

Thanks so much for your help!

Yes, I understand your situation. For mycase, I married my wife, then applied for CR-1 and K-3. I agree with what Vamsi answered. As soon as you get the advance parole after your arrival in the US, you can go back to your country to perform the religious ceremony. You can review the K-1 guide in this website in order to have some understanding about how you can adjust your status, go for Advance Parole, etc, after arriving into the US. Good Luck!

K-1 Fiance(e) Visa Process & ProceduresReligious wedding first?

Hello. I just got off the phone with my fiance and have a couple of questions, maybe you guys can help me answer them:

1- We're thinking of having the religious ceremony in my country first and then the civil one when i enter the states. Now we're wondering if this slight change of order would affect any future immigration paperwork. Is anyone familiar with this?

2- Around how long in advance do they let you know when your interview will take place?

3- My fiance and i are going on vacation for one week next month, is it ok for the process if we meet in a 3rd country or he's supposed to come to mine always?

Thanks a lot for your help :help:

Marriage is marriage whether it is done with religious rituals or by the civil authority. You are husband and wife after marriage regardless of it is done along with religious ceremony or it is done by civil authority. You should get married after you arrive in the US, as it is a must for K-1. It is a clear violation of K-1, if you marry in your country and then hide it during the interview. You could be denied visa based on this fact. So why do you wanna mess it up? If you want to marry in your country in front of your families and with religious ceremony, CR-1 and K-3 options are available for you.

Should you decide to marry first in your country, then you can go for CR-1 and K-3.

I was just wondering how the process is carrying on for those of you that have sent in your I-129s to the Nebraska Service Center. Mine was sent in on the 21st of July and still havent heard anything. I guess cuz Im also in Ethiopia I feel kind of distant from the offices there.

When you send any documents to USCIS, NVC, it is better to send them with a delivery confirmation or any tracking method. That way, you can aleast know that they have received it.

K-1 Fiance(e) Visa Process & ProceduresG-325A Signatures

Just a note of advice.
When you sign your signature ensure you sign with your full name.
Do not use any abbreviation or else you can get an RFE for your signature.
Good luck

How do you know that if you don't sign with your full name, you will get an RFE? I know people whose signature is not their full names and they never got an RFE for their signatures.

Heck, my signature is so sloppy no one could tell if I signed my full name or not! I did just use my middle initial though. I doubt if it will be a problem.

After reading all replies about this post. I see some are worried because their signature is not their full names. You are worrying about something that you don't need to worry about. Your signature is your signature, so you don't have to use your full names when you sign. So you won't get any RFE.

G-325A has total 4 pages, they are identical except on the bottm left hand corner, each page is for one specific place, like consular. So all 4 pages have to be signed and dated, they have ot to be original. Signatures' photocopies are not accepted.
simple_maleMaleBangladesh2006-08-06 11:35:00
K-1 Fiance(e) Visa Process & Proceduresattachment g-325A

You have to do one set for you and one for her, each must be signed by the person that it is about.

Do not staple the G-325A. You attach each additional sheet with each page of G-325A. You may just type it on a computer and just print multiple copies. Make sure, you mention your Item # on the additional pages and then sign the additional pages that you are going to attach with G-325A.

Your USC fiance fills out one get of G325A for him, then sign and date it and you do the same for your
G-325A.

K-1 Fiance(e) Visa Process & ProceduresPassport Photo Size requirements

We sent our initial K-129F petition and materials in last month, and received the NOA receipt with a date of July 20, 2006.

However, looking again at all the information on this site (which I didn't find BEFORE sending all the stuff in, unfortuantely), I realize the passport photos we sent as required for the G-325A forms (bio data sheets) might be too small. the top of the head to the chin size requirement is met with what we sent, but the total dimensions of the photos are less than 2x2 inches. I guess we sent ID size rather than U.S. passport size. I didn't know there was a difference.

Quesitons, then:
1. If the photos were not acceptable would they have already sent the packet back to us to resubmit? Does reciept of a NOA mean that we are OK?

2. If not, has anyone received notice at the later stage (processing the K-129F) that they needed bigger photos?

3. Should I send in new photos with a cover letter and the reciept number I received?

Thanks for any advice. I feel doomed already!

If you have received the NOA-1 already, then you are fine. Had they needed the correct size passport photo, they would not have sent you the NOA-1.

K-1 Fiance(e) Visa Process & ProceduresWhat do you put if you have no middle name?

I have no middle name (strange as it seems). I was thinking putting "None" for the middle name in the forms, but would they mistake you as (for ex.) "John None Doe?" as "None" in actually your middle name? Hmm....

Just leave it blank. They will also notice from your documents that you don't have a middle name. USCIS knows that some don't have any middle names. It is like when you write a foreign address, some foreign addresses don't have any state and you can just leave the state as blank.

K-1 Fiance(e) Visa Process & ProceduresApproval Inconsistentcieis

Are there many approval inconsistencies ? I heard different experiences between couples. Some people get Rfe for not signing all 4 G325A biography forms and others do only one and get through. What is the logic there????????????????????????

The logic is, one adjudicator is more easy going than another one. It order to avoid any RFE, it is better to sign and date all 4 pages and leave no space blank.

K-1 Fiance(e) Visa Process & Procedurescancelling a cancellation ...??

Ok, so here's a fun one ....
I submitted my I-129F in June, and I rcvd my NOA1 on July 29.
With both my fiance and I completely frustrated by the estimated two-year wait once our petition arrives at the Embassy, we decided to cancel the petition, and I was just going to move to his country.
I sent the official cancellation letter to CSC on Aug 3, and as of today, Aug 27, the petition is still active and pending NOA2.
My question, after having devised a different strategy to endure the extensive wait, is how do I cancel the cancellation letter, ...... that apparently hasn't even been received and/or processed yet?
Is there a direct email address or phone number for CSC that would allow me obtain a real live person who might be able to explain my options at this point?

CSC Does have an email address for K-1 which is: CSC-XII.129f@dhs.gov

Email them as soon as possbile and explain your situation. Good luck.

K-1 Fiance(e) Visa Process & ProceduresHelp Plz :(

All the pages of your passport should suffice alone; including a copy of the birth certificate is fine but unnecessary.

You and your dad should both fill out an I-134. Claim what you can, which isn't much since you have no income, and your dad will be a co-sponsor. You don't need that form till your application is approved and forwarded to the embassy, though.

Since you already have your passport's all pages copy ready, you can just send them for the citizenship proof. You don't need to send a copy of your birth certificate. USCIS needs either/or not both of them.

I am not sure, about I-134 issue regarding you, but someone can help you, for sure.

K-1 Fiance(e) Visa Process & ProceduresMy name has been removed from the IBIS

Hi everyone,

Yesterday my name was offically removed from the IBIS for a 12 year old arrest warrant. The charge was dropped. On the advice from my congressman's office I sent the release letter from the county and a letter explaining the whole affair to their office. The congressional office also sent a letter to expedite things and back up my case. (as they said). So the ball is the court of ICE and the Nebraska USCIS. They seem very confident that I should have swift action now. Considering I have been waiting since Nov of last year. Again thanks to everyone who has looked after me. I am eternally grateful. Maybe I will not be a Nebraska"Prisoner" anymore.

K-1 Fiance(e) Visa Process & Proceduresage difference?

Yodrak has hit the nail on the head. Large age difference could be a red flag depending on the cultural norms and immigration problems related to a particular country.

That said, age difference cannot be the sole reason for denial. As long as you have sufficient evidence and can prove your relationship, you should have no trouble.

I think that Jamaica does have some US immigration related issues, but Jamaica doesn't have a track record of abuse that some other countries have. Things like age difference won't raise many eyebrows there.

BTW...Jamaica is an amazing place with amazing people. I would love to go back and spend more time there. :joy: Cheers, and good luck to you!

I agree with Yodrak. I think, age difference won't be the only one issue, as Yodrak stated.

Did she enter the US legally?

If she is here and entered with inspection and you are a US citizen you can marry and then file a Petition for Alien relative and AOS. No visa would be necessary.

Yes, if she entered into the USA legally you can marry her and adjust her status in USA, as didromous mermaid said.

K-1 Fiance(e) Visa Process & ProceduresDivorce Decree vs Certificate

Here`s a little question i came across on a totally unrelated subject but which may apply here...

Do Embassies want to see divorce decree or a certified copy of the divorce decree?

My case is already at the embassy having gone through uscis and nvc. Will a divorce decree notarized by a notary public, as a true semblance of the original, be accepted rather than the certified document usually issued from the court where divorce was granted.

Comments are welcome..

You need the certified copy of the final divorce decree. Call the court where the divorce took place. They will tell you what to do. They may charge you a small fee, like $4.00-$6.00. They can mail it to you or you can pick it up from the court house.
