My husband is from WA State.. He wants to file I-I30 now. Where he can file it?

Does it need for him to submit PHOTOCOPY first of the needed documents?

Where is he going to pay for it?

If he is going to use a check payment, is he going to submit the check with the requirements? Please help!!!

Go on www.uscis.gov and click on Immigration forms option, choose I-130 and read ALL instructions. (Dont forget to file G-325 biographic forms with I-130).

Good luck!

Dani

I agree except it is G-325A biographic forms instead of G-325 forms.

in the instructions for the I130, it says to fill out the G325 for the petitioner and the beneficiary.

Correction: The instructions indicate filling out a G325a (quadruplicate form) for petitioner and for beneficiary. G325 is not the correct form.

Yes, you will probably get an RFE.

Further, the instructions indicate the need to send other supporting documentation as well. I'd be studying those instructions and getting anything else on the list ready for the RFE too.

Yes, I agree. You might get an RFE. So please start preparing two sets of G-325A, one for the petitioner and the 2nd one for the foreign alien spouse so that you can send them right away.

QUOTE (YuAndDan @ Mar 17 2008, 10:29 AM) <{POST_SNAPBACK}>

You are doing a good job policing who is posting similar posting multiple times. The answer to OP is, the Embassy will issue CR-1 visa, if your marriage is less than 2 years old during the visa issuance. You can enter into USA 2 years after your marriage and ask at the POE to change it to IR-1. But you can be be sure, if you will get the permanent green card or conditional one by mail. Or you can request the Embassy by email to schedule your interview immediately after your 2nd year's anniversary. Show the reasons of your request when you write the Embassy.

DS-230 is filled out by beneficiary, it is the immigrant visa application.

The petitioner can help fill it out, but the beneficiary has to sign part 1, and leave part 2 un-signed, they will sign it later at the visa interview.

Hi everybody,

We're sorta confused about the I-864 form. My husband (USC) is still a student, so he cannot sponsor me. But his mom and my brother (both USC) are willing to sponsor us/me. So which forms are they supposed to file? I read on internet that they are supposed to file I-864 A, but then on another website, it is the I-864... And since my husband cannot sponsor me, does he need to file I-864 or not??

Any advice would be really appreciated smile.gif

Thank you

Bob and Jessica

Each needs to file a separate I-864.

QUOTE (palilover @ Mar 17 2008, 11:41 PM) <{POST_SNAPBACK}>
Now I have noved and I want to update my address. but I am confused by this on USCIS website regarding the AR11.
It says I must put in the change of a ddress withing 10 days of moving? When did this change? It's been more like approaching 3 weeks as I checked it a while back and it said 30 days.
Is this going to be a huge issue or what could happen?

If you are a US citizen, you don't fill out an AR-11 form. When your approved petition goes to NVC, change your address with NVC which will take care of it right away unlike USCIS.

I think we answered this already in your prior thread: http://www.visajourn...howtopic=115893

And the VJ guides clearly state to include 2 original G-325(a) per person on the application.

My advice is to stop asking this question and start gathering the forms and other documentation you may have omitted and prepare for an RFE.

Yes, I remembered answering it. Why post the same question twice? Just prepare your G-325A sets. Please read the I-130 instructions carefully. It clearly says one needs to submit G-325A (one set for petitioner and another set for forein alien spouse) when applying for spouse.

You can send out the I-864 bill before it is generated, but NVC will send it back to you. The only reasonable choice is, you can send out as soon as NVC generates your I-864 bill.

You mention your husband's case is complicated but dont say why. The guides here on VJ are very good and he can complete them on his own. If he has any questions he can post them on this site and there are many people who are willing to help. I used an attorney for my K1 before I knew about VJ and he did nothing that I could not have done myself. In fact he hid behind his answering machine during the whole process (Attorney George Sabga from California) and was more of a hindrance than help. I did my adjustment of status (AOS) myself and we just completed our interview with no problems. Good luck to you.

Hi.. this might help to answer why their situation is complicated..

Oh, I did reply that thread. In this case, a lawyer can not do anything. The OP's husband has to take care of the child support debt issue first or his visa process may not go well.

Why is your husband's case complicated. Using a lawyer depends on if you are confident enough or not to do all paperwork by yourself.

Also, do i have to send the ds230 for her to sign it or just I just fill them out and sign under my name or not on the ds230. I read the jame's shortcut but i want to make sure. Thank you for your helping.

Yes, you have to wait for NVC confirmation email that you are the choice of agent before you mail out AOS Fee. Make sure, you make label for AOS Fee Bill. Your wife, as the visa applicant needs to sign DS 230 part I. You don't sign anywhere on DS 230 part I. Your wife can fill out the DS 230 part I using acrobat reader, print it out and sign it, and send it to you. You can prepare DS 230 part II, but your wife must not sign now, as your wife needs to sign it during the interview when she will be asked to do so. Don't send DS 230 packet now until NVC generates it later in your NVC process.

Thank you for your helping.IF I am her agent why she has to sign ds 230 part I . I know she has to sign part II at the us embassy. PLease clear my question. Thank again. Also, I do not know how to do the AOS label. IS it easy.

DS 230 part I and part II are the applications for Immigrant Visa and Alien Registration. It is the foreign alien spouse who is applying for the immigrant visa, therefore, he/she must sign it. I have not made AOS label, so I can not tell how easy it is, but others made it and they can tell you about it.

No, actually it means your case number has been assigned. Check later this week again to find out what the automated system says and keep checking next week as well, if they have not generated DS 3032 by this week. Usually it takes about 1-3 weeks for them to generate those after the case number has been assigned.

It is good that you sent the choice of agent email right away. NVC will reply you with the choice of agent acceptance. It is hard to predict how many days it will take. But usually any day within 2 weeks you can expect email from NVC.

Your husband can send AOS Fee Bill, since it is already generated. Your husband does not need to use envelope provided by NVC (I used USPS Express Mail Envelopes) as long as he sends the mail to right address. Please read the shortcut more carefully. Ask your husband to prepare I-864 and start gathering relevants papers from now so that he can send them right away. Once NVC accepts AOS fee Bill, it will generate I-864. Once NVC accepts choice of agent, it will generate IV Fee Bill ($400.00) and once NVC accepts IV Fee Bill, it will generate DS 230 packet.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 question 22
QUOTE (guatetaliana @ Mar 30 2008, 11:57 PM) <{POST_SNAPBACK}>
I've searched the forum for answers to this and seem to get conflicting results, so hopefully somebody can help clear this up for me.

The NOA1 for our I-130 (being processed at CSC) arrived over a month ago. But just today, as I was looking at a copy of the form we submitted, I second-guessed myself.

On question 22, it says:
Complete the information below if your relative is in the United States and will apply for adjustment of status.

My husband is NOT in the US (we are living in his home city Monterrey, Mexico) and will not adjust status. Therefore I entered N/A and left the part about consulate abroad blank. I figured this was an all-in-one question as the instructions said "the information below", not "the information to the below, to the left".

Now I'm wondering if we made a mistake? Should I have written "Ciudad Juarez, Mexico" on the right side of that section? His permanent address on the form, and his address abroad are both written as our address here in Mexico. He clearly resides in Mexico. However, mine is listed as my permanent address in Chicago.

What would they intend to do with this when it's approved? Should I try to get this corrected? And if so, where do I call/write?

Thanks for your help!

Yes, question # 22 can be confusing. However, you should have written down the consulate in Mexico (Ciudad Juarez). Anyway, don't worry about it now. At worse case, USCIS will send an RFE for you to fill out that part. If that is the case, just follow USCIS instruction. Don't worry about it that much.

IR-1 / CR-1 Spouse Visa Process & ProceduresI 864 question
QUOTE (bgreed @ Mar 30 2008, 11:21 AM) <{POST_SNAPBACK}>
Sometimes I think there should be a separate area just for I 864 questions.

OK I've read the instructions several times , but still am not clear on a couple of things so anyone with better government form reading skills is welcome to reply,

Here goes;
First do I file a separate I-864 for each person I am sponsoring (1 for my wife and 1 for her son as they are two separate petitions)

Since I don't get to declare my kids from my previous marriage as deductions on my income tax (even though I pay child support) do I need to show them as dependents? To me the wording says if they aren't on my tax form then I don't have to show them.

So depending on how you read it my dependent count could be four (including me) (my wife and I also have a son together) or six if I include my two other kids.

Any thoughts?

By the way got our NOA1 on February 16th file was touched on 02/24/08 nothing since VSC.

Okay. You are doing immigrant visas, not K-3 nonimmigrant ones. So the answers are:

Yes, file one I-864 for your wife and another one for her son.

You don't show your kids from your previous marriage, since you don't declare them on your tax return. In a separate note, I think the most divorced couple usually claim their children on tax return every other year.

So total dependent count including you is four.

IR-1 / CR-1 Spouse Visa Process & Proceduresvisa fee

Hi everybody!
Is there anybody got his visa through Casablanca consulate? I just want to know how much money i have to pay for visa fee!?
Thank you.

For CR-1/IR-1, usually the choice of agent pays all fees at the NVC. The current fees are $70.00 for affidavit of support and $400.00 for Immigration Visa Fee. If these two are paid at the NVC, there is no more fee at the consulate during interview. Where are you in the process now?

IR-1 / CR-1 Spouse Visa Process & ProceduresAffidavit of Support - Household size

Hi...

I believe that the "spouse" that is referred to on the AOS is of the spouse who is NOT being sponsored on the affidavit. So assuming you only have 1 wife smile.gif you would put the figure from line 10 and leave the other "spouse" box blank.

Hope this helps

Yes, you can leave the other "spouse" box blank, you can write a small note "same as beneficiary" next to the blank box.

IR-1 / CR-1 Spouse Visa Process & ProceduresForm Ds-230 part 1
QUOTE (lucky_leester @ Mar 31 2008, 03:26 PM) <{POST_SNAPBACK}>
Could someone please help me with question 21a and 21b of Form DS-230 part 1?
I will be in Vietnam at the time of my wife interview and hopefully she passes.
My plan is for both of us to come to the U.S. together.
Therefore, do I put my name in question 21a?
And question 21b also confuses me, I'm not sure what to answer.
Thanks in advance!

What do question 21a and 21b ask for? It is better when you write down the questions so that people can answer easily.
