IR-1 / CR-1 Spouse Visa Process & ProceduresFee for I-130/IR-1/CR-1
QUOTE (YOUTOO @ Feb 29 2008, 09:58 AM) <{POST_SNAPBACK}>
Fee question. I understand the original fee for the I-130 application is $ 355.00.
Then mine went into the K-3 route, fee waived. Now with all the I-129F problems
I want to change to the IR-1/CR-1 route, will I have to pay an additional fee?
Don't want to bore you stating how much the lawyer wants, just want info if
indeed there is a new fee and would like to know, how much. Thanks all.

You don't need to pay any fee to USCIS, since you paid $355.00. When your approved petition will go to NVC, you will need to pay them $70 (AOS Fee) and $400.00 (IV Fee).

QUOTE (YuAndDan @ Feb 29 2008, 10:30 AM) <{POST_SNAPBACK}>
NO no0pb.gif I-94 is only for NON-Immigrants like K-Visas. IR-1 visa is an IMMIGRANT visa Immigrants, Citizens, and LPRs do not need to do I-94.

You get in line with the citizens and residents ..... also, I think you need to fill out their white form from what I can remember, but definately not the green visa waiver
Again the I-94 is an arrival/departure record used by NON-Residents, Immigrants ARE residents, the do not fill out I-94, only form to do is the customs declaration form.

I agree with yuanddan.

IR-1 / CR-1 Spouse Visa Process & ProceduresAfter CR1 Question about travel, green card & SSN
QUOTE (VZQUEST @ Mar 1 2008, 04:23 PM) <{POST_SNAPBACK}>
My wife just had her CR1 interview and was approved. Because of personal family issues, she will not be able to move here permanently until June. We were thinking of having her fly here to the US for a few days next month so that she can at least enter the US at a POE and get the process started for Green Card and Social Security Number. She would only be here a few days and then would have to return back to her native country until June. Do you know if this would pose any problems that she would only have a round trip ticket for a few days? Also, she has already purchased her one way ticket for her June trip to the US. If this is likely to mess anything up, we will just have to wait until June. Any advice appreciated.

Congratulations for the Visa! I think, she will be fine, since she will be back in USA in June, about 3 months from now. The basic rule to keep the continus permanent residence is, one has to stay at least 50% of his/her time in USA and one trip out of USA should not last more than 6 months.

i want to appoint my husband(my petitioner) as the agent in the ds3032 form, but he will be moving to another state in abt 4 months...will a change of address create any delays/confusions/RFEs in the future? also, if an address change poses no hurdles, how can i inform the NVC of the change in address, when my hubby moves?

Thanks

Your hubby can inform NVC by email or phone call the change of address. Have hubby fill out USPS change of address so that his mails get forwarded to his new address.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Case Number
QUOTE (his_sunshine @ Feb 27 2008, 09:58 PM) <{POST_SNAPBACK}>
Hi All,

Our case was approved last January 17, 2008. It's now February 28 and we still do not have our NVC Case number. I have tried calling their hotline and follow the instructions (i.e. enter USCIS Receipt number) but I always get the message saying that they do not understand what I entered. I tried doing this several times to no avail. I also tried getting the operator but it's always busy and I always get reverted back to the machine.

1. Is it normal for the NVC number to take more than 1 month to be processed?
2. We have a lawyer representing us, will the notification from NVC be mailed to my husband? Or will it be mailed to our lawyer only? Or both of us?
3. What is the next process after receiving our NVC number? Keeping in mind we have a lawyer to represent us.

Thank you so much to whoever will reply.

Sunshine

Call NVC and talk with an operator live to find out, if they have your file from USCIS.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Question - So Simple!!
QUOTE (WantingMyHubby @ Mar 4 2008, 01:59 PM) <{POST_SNAPBACK}>
I'm sure this is a really stupid question, but I'm extremely paranoid!

On the I-130, question 15 - "Name and address of present employer" and then "Date this employment began", are they referring to the petitioner or beneficiary? I understand it to be directed towards the beneficiary, but am not sure.

Like I said, it's such an easy question, but I'm so nervous about everything...

Thanks blush.gif

It's about the beneficiary, the foreign alien spouse who will seek an immigrant visa to come to USA.

Let me know what you guys think?? Any advice.

You need to say what are questions #s 20 and 22 about so that some of us (who don't remember what those questions are about) can try to answer.

20. It asks about all the places that you have lived since reaching the age 16.
22. List employement info for the last ten years

In the date section for both of the questions, when i sent that form to my wife i didnt write "present", i just have the "begining date" filled out.

I see. So you did write dates on "From" column, but you left "To" column blank. It is very likely that they will send your DS 230 back so that you can fill out the blank. Why don't you call NVC and ask if you can send another DS 230 in order to avoid an RFE.

But at this point I will take anything they give me. However, now I have a bunch of questions.

1) Does it really take 4-5 months at NVC?

2) Does it really take 8-12 months once NVC is done for Juarez to schedule an appointment?

3) Will the forms also be sent to me? I am so worried because the mail in Mex sucks and you can get it 1-2 months late or not at all.

Thanks for you help.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-3032 question regarding signatures/barcodes

Hello all-
I just got back today from being in Nicaragua with my husband for the past month. I had found a copy of the DS-3032 on the dept. of state website, and brought it with me to have my husband sign, as the nicaraguan mail service is slow and inefficient. Upon returning home today, I received a copy of the ds-3032 that the NVC sent me with a barcode and the case number on it. Does anyone have any experience/advice regarding this? Can I just attach the both forms and mail them together, or will this be insufficient? If not, I have to try to fax the form to my husband, and have it mail it back to the NVC, which will surely cause a great delay.

Look forward to hearing back!
Hope all your journeys are going well,
rachel

DS 3032 is the choice of agent form. Actually, your husband (the Beneficiary) can email NVC and ask NVC to appoint you (the US Citizen Petitioner) as his choice of agent so that NVC sends all future correspondence to you. It is very helpful because it will save time in postal mail. Plus taking care of the DS 3032 choice of agent by email will save you sometime in the process as well. Remember, your husband must email NVC (NVCINQUIRY@state.gov). You or your husband don't need to mail any DS 3032 form when your husband uses the email method. Usually, NVC accepts the choice of agent email within 2-10 business days. Below is a sample text that your husband can use (He should use it as an example):

To:nvcinquiry@state.gov
Subject :NVC Case Number ABC##########

(Text of e-mail below)
Case Number = ABC##########
Beneficiary Name and DOB = Your name and date of birth
Petitioners Name and DOB = Your wife's name and date of birth

Dear Sir/Madam:

I, (enter the beneficiary's name) is the beneficiary and my NVC assigned case number is ABC##########.

Unfortunately I cannot locate my Choice of Agent form DS-3032 and would like to appoint my wife (enter the petitioner's name) as my agent of choice to receive all correspondence from NVC.

My wife's (the petitioner) name and address are as follows:

(Wife's name and USA address)

All correspondence from the National Visa Center concerning my immigration visa process should be sent to the address referenced above.

Please kindly reply with a correspondence acknowledging the recepit of this e-mail in lieu of the DS-3032 Choice of Agent form. Thank you for your kind help.

Sincerely,

(Enter Beneficiary's name)
Managua, Nicaragua

So you are fine. Great and do not worry about this anymore.

She may not have to worry about visa issue but this issue will remain for some time because her green card will have a different name than her passport and any international travel or even domestic travel until she has ID in her married name will have to be done in her old name. It's a mess that will need taking care of at some time. Perhaps during a lull in your process you can get a new passport through the Bangladesh Embassy in DC after arrrival.

On a side note, two of my most thankful moments were when those jets left the Dhaka airport for London the first time and Singapore the second. If I'm never in Chittagong again, it will be too soon. The 500 taka notes are really beautiful though. I'm sad I lost my souvenir.

Pushbrk, I am not sure, if the OP is from Bangladesh, as her profile does not say anything. However, I am glad to hear that you were in Dhaka. My wife and I were born in Dhaka, but I moved to USA long time ago and my wife immigrated to USA recently. I have few 500 taka and other notes. Chittagong is a beautiful port city right by the Bay of Bengal. You will love it.

Oh, I've been to Chittagong twice, which is why I said "never again" will be too soon. FYI, that part of the Bay of Bengal is very shallow and the water is brown from silt for many miles from shore. I've stayed at the hotel Agrabad and at the Navy Base VIP housing. I was there delivering and training on a sonar system, so have seen the City, Port, River and have been miles out into the Bay. I was only at the Dhaka airport. Once inside the international terminal, things are pretty Western and comfortable but the treck to and wait in the domestic terminal was quite unpleasant. Upon arrival, I was quite impressed with the jetway and coucourse including the adequate air conditioning, until I stepped into the restroom without air conditioning and saw the trail of ants traversing the wall nearby.

I do have a fond memory of what seemed to be several family members who assisted with getting my baggage to the domestic terminal on the first trip. I had tipped those carrying the bags at the beginning of the walk but a girl of about 5, walked beside me and in perfect English said, "I would like an English coin." She was so cute, my heart was touched, so I gave her the only English coin I had, a full Pound.

My first trip was during the general strikes in March 1996, so not a good time. A local agent was to meet me but he had so much trouble getting from his home to the airport, he wasn't able to meet me until I'd been in the domestic terminal for a couple hours and the flight was about ready to leave. The Navy deemed it unsafe to transport me to and from the hotel downtown, so they put me up in the VIP officers quarters on the base. I could hear the molotof coctails going off outside the main gate a hundred meters away.

Actually, I found it quite a charming country overall but my visits could not be considered pleasant.

Oh I see. I had visited the Chittagong Navy area in Potenga many times. I like Potenga area in general.

It may not cause any problem at all. But it is better to keep everything same.

I just wanna know if there will be a problem if i'm still using my late husband name, even in my passport...what if my visa's come out under Mrs.Doe my current husband name... am I going to have problem with that in the immigration or in the future when i have to file for adjustment of my status....please help me helpsmilie.gif need some advise.....

You can use any name you want. However, when your husband petitioned for you, what name did he use? If he used your current married name, you should have changed your passport accordingly. If he used your name using your late husband, you don't have to worry about anything.

Well when he filed the I-130 he used Mrs. Doe not the current im using now..the problem is i've already had the medical using my passport with my late husband name on it..they accepted it..so meaning can i get another passport using his name? i can do that as long as there will be no problem to what i started...am I right? anyways, thank you for the response.. star_smile.gif

You can ask the passport office whether they can change the name into your current name. I don't think, you will need a new passport. But only the passport office can tell you for sure.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan we use a fax copy of marriage license to file I-130
QUOTE (ToddS @ Mar 12 2008, 08:26 AM) <{POST_SNAPBACK}>
My USC husband had spent the last two months gathering documents to file I-130. Yesterday, he said everything is ready except for the marriage license. He had misplaced the marriage license and had tried to look for it high and low for the last two weeks to no avail. He wants me to mail him my copy now.

My question is: can a faxed copy be used instead?

He has wasted so much time gathering documents and looking for missing papers. Can I fax the marriage license or scan a copy for him to print out instead of mailing the copy through the postal system and waste another week or so?

Leah

A faxed copy will be fine with I-130 to be sent to USCIS. Original will be needed during the last stages of NVC process or during the interview. The copy does not need to be notarized either. The instructions don't ask for notarization and it also clearly says a copy is fine.

It is not good to give wrong answers which can be unhelpful unless one is 100% sure.

I submitted one for each of the boys as they had individual petitions. However only had to submit one support fee for both.

That is a good point. WWW, find out, if you need to pay one fee only or two. I know, for parents only one fee is needed with separate I-864 (one for mother and 2nd one for father).

My wife's I-130 and child's I-130 has been approved and forwarded to NVC. I am little bit confused.
Should I complete two separate I-184 for wife and child or just only one for both?

I think, two separate I-864 will be needed. It is not I-184.

My husband is from WA State.. He wants to file I-I30 now. Where he can file it?

Does it need for him to submit PHOTOCOPY first of the needed documents?

Where is he going to pay for it?

If he is going to use a check payment, is he going to submit the check with the requirements? Please help!!!

Go on www.uscis.gov and click on Immigration forms option, choose I-130 and read ALL instructions. (Dont forget to file G-325 biographic forms with I-130).

Good luck!

Dani

I agree except it is G-325A biographic forms instead of G-325 forms.
